1 SKYVIEW GROVE ASSOCIATION, Inc. DOCK POLICY Approved: May 27, 2012 Amended: July 6, 2014 Amended: August 31, 2014 Purpose: In accordance with the Master Plan, installation of a limited number of boat docks will be allowed on Association property and in the Community Dock Areas. This policy has been established to provide installation, maintenance, use, and management standards for those docks, as well as to address dock area land use issues. This policy may be amended at any time. Administration: This policy will be administered by the Executive Committee with assistance from the Dock Committee. Specific responsibilities are described in following sections. Executive Committee: See Skyview Grove Association, Inc. Bylaws for information. Dock Committee: A Dock Committee, consisting of no more than 5 and no less than 3 association members in good standing, will be appointed by the Executive Committee. Dock Committee members will be appointed for a term of 2 years. The Executive Committee should make reasonable efforts to create a diverse Dock Committee that represents all groups within the overall association membership. The Dock Committee should include both year round and seasonal residents. It should also include waterfront and non waterfront members as well as both association dock users and non users. At no time should the Dock Committee include more than one member from any family. Dock Committee members can be appointed for an unlimited number of consecutive terms. A quorum will be a majority of Dock Committee members. Dock Use Permits: Dock Use Applications; copies of the Dock Policy, Dock Master Plan, and Docking and Storage Fee Schedule; and anticipated slip availability for the following season can be obtained at the Association s September meeting or from the Web Site 1. Any member in good standing can request a dock slip by completing a Dock Use Application and mailing it to the Executive Committee at PO Box 1221, Hinsdale, Ma Applications must be postmarked by October 31 st. Each year, new applications will be reviewed in order of association membership seniority. In addition, priority for new slip assignments will be given to applicants not 1 Amended July 6, 2014

2 having access to private docks or who have health related mobility limitations. 2 The Executive Committee with the assistance of the Dock Committee will review each application to insure that all requirements are met and that the applicant is a member in good standing. Written notification of the Executive Committee s decision will be sent to each applicant by January 31 st. Seasonal Dock Use Permits must be renewed annually. Present slip users must notify the Executive Committee of their intent to renew prior to the September meeting. All approved dock slip applicants must pay their membership dues and dock fee by April 15 th in order to receive their slip assignment. Slip assignments will be made by April 30 th. Past year dock users, who remain members in good standing, will be given priority for slip assignments. Slip assignment for new, approved applicants will be based on slip availability. If slip space is not available, the approved applicant will be added to a waiting list. Dock limit is one full slip or two half slips per membership. Slip assignments are not transferable other than to immediate family members. Seasonal dock use runs from May 15 th to October 15 th, water level permitting. Dock Standards: If a need for additional slip space arises, the Executive Committee can authorize the installation of new docks as well as expansion and replacement of existing docks. The Executive Committee can also authorize the replacement of old or unsafe docks. The entire cost of such work will be paid for by the Association, subject to the availability of dock funds. The following standards apply to all new docks as well as expansion and replacement of existing docks. A full size slip should measure at least 20 long by 8 wide with a minimum water depth of 24. Permanent wood framed dock sections will be allowed only in shallow areas where the potential for ice damage is minimal. 3 Wood framed dock sections will be 4 wide by 10 long and built using pressure treated 4 x 4 posts, 2 x 6 framing, and 5/4 x 6 decking. 4 All other 5 new dock sections will be pre-fabricated Shore Side Docks or equal. Dock sections will be 4 wide by 10 long with welded aluminum frames and adjustable legs. Deck panels will be pre-assembled using 5/4 by 6 cedar decking. Signage, slip numbers, and cleats will be provided at each dock. Floating docks are not allowed. Docks must be properly installed in the approved location and configuration and in accordance with the manufacturer s instructions. 3 In accordance with previous dock policy, all docks built or installed before May 27, 2012 are presently the property of the Association and will be managed by its Executive and Dock Committees. Dock Maintenance, Removal, and Re-installation: Maintenance of each dock as well as removal, storage, and re-installation of each prefabricated aluminum dock is the responsibility of volunteer dock users. Dock users who participate in these efforts will receive a dock use fee discount. See Docking and Storage Fees for details. Aluminum docks must be removed by October 31 st and properly stored for the winter. Docks can not be re-installed until May 1 st and must be ready for use by the May membership meeting. Docks must be properly re-installed in the approved location and configuration. All docks must be maintained in a safe, level, stable, and structurally sound condition. Prior to re-installation, cedar decking for aluminum docks will be treated with ecofriendly preservative. In an effort to insure safety, all docks will be inspected annually by the Dock Committee. The Dock Committee will report its findings to the Executive Committee and request funding, as needed, to complete necessary repairs. If adequate funding is not available, the Executive Committee can suspend use of any unsafe docks. Dock Use Regulations: Only members who have been approved by the Executive Committee are allowed to use seasonal dock slips. See Dock Use Permits above for the application and approval process. Only the boat approved by the Executive Committee may be docked at the assigned slip. The approved boat must be registered in the name of the applicant and must display both current Massachusetts Registration and Skyview Grove Association stickers. Docking of a limited number of kayaks, canoes, and 6 pedal boats is allowed in designated areas only. See below for further information. Use of an unauthorized seasonal slip is prohibited. A single slip space at the boat launch 7 will be available at no charge to members for daytime use. Members should limit docking time to 2 hours. Overnight use is prohibited. Non member guests are not allowed docking privileges. While docked, boats must be securely tied to dock cleats, with bumpers properly in place 8. Members must use care when operating in shallow water to minimize disturbance of the lake bottom. Safe boating and fueling practices must be followed at all times. 4 Access to the Frank Street and Skyline Drive dock areas is through right of ways on private property. Members can not store boats or other personal belongings in these areas. Members should also respect the rights and privacy of the property owners. Ongoing compliance will be monitored by all members of the Executive and Dock Committees. Pedal Boat Docking: Seasonal docking of a limited number of pedal boats will be allowed in designated areas. A docking 9 fee will be charged. Interested members should contact the Dock Committee for further details. Pedal boats must be removed from Association property by October 31 st. 10 Kayak and Canoe Docking and 11 Storage: Seasonal docking of a limited number of kayaks and canoes will be allowed in designated areas 12. In addition, 13 storage of a limited number of kayaks and canoes will be allowed in designated racks. A docking/ 14 storage fee will be charged. Interested members should contact the Dock Committee for further details. Kayaks and canoes, not stored in racks, 15 must be removed from Association property by October 31 st. Personal Belongings: 16 Storage of personal belongings is not allowed on Association property. Boat Launching: Trailered boats can only be launched at the Association boat ramp. Only boats belonging to members in good standing can be launched from the ramp. Non member guests are not allowed launching privileges. Sharing of boat ramp gate keys is prohibited. In order to prevent the transfer of invasive aquatic species, boats that have been used in other bodies of water must be thoroughly cleaned prior to launch. 17 Vehicles and trailers should be removed from the boat ramp and the gate should be closed and locked as soon as launching is complete. See below for vehicle and trailer parking regulations. Lightweight watercraft can be launched at the ramp or any Association dock. Vehicle and Boat Trailer Parking: Parking areas are provided at the Association boat ramp and Ashmere Road docks only. Parking is limited to designated areas. 5 the edge of the road at the boat ramp. Space for 2 vehicles is provided at the Ashmere Road docks. Since space is very limited, members are only allowed to park while boating. Parking is restricted to daylight hours with a 4 hour limit. Trailer storage on Association property is prohibited. Disclaimer: Association property is not policed. The Association is not responsible for damage to or theft of member s boats and other belongings docked or stored on Association property. Violations: All members are expected to comply with the regulations included in this policy. It is the responsibility of any dock use applicant to insure that all information provided in the application is accurate. Applications containing inaccurate information may be rejected by the Executive Committee. If rejected, a corrected application may be resubmitted for the following season. Failure to pay membership dues and dock fee on time will result in loss of slip assignment. Renewal of an assigned slip space that remains unused for the entire boating season will not be allowed. Loss of a slip assignment will be for an entire season. Members may then reapply as a first time applicant. Members are not allowed to install new docks or expand or replace existing docks. Any attempt to do so, will result in termination of Association membership. Use of Association property as part of a private business operation is prohibited and will result in termination of Association membership. Allowing any non member to launch a boat at the Association boat ramp will result in termination of Association membership. Vehicle and trailer parking violations will result in a warning for the first offense. Vehicles and trailers not removed within 48 hours will be towed at the owner s expense. Repeat violations will result in immediate towing. All Boats remaining on Association property after October 31 st will be removed at the owner s expense. Most other violations will result in a verbal or written warning for a first offense followed by loss of slip assignment for a repeat offense. Additional violations could result in termination of Association membership. Executive Committee can, at its discretion, offer waivers and time extensions to applicants who can provide evidence of extreme hardship.
