2 Details and Incident Description Task being performed was picking up damaged Filtrexx (erosion control silt sock) from around the Blue location which is under construction Crew makeup was 4 crew members and 1 supervisor Equipment being used was a Track Loader (Skid Steer w/tracks) WSRI has been working for COP since the field picked up in 2017 The supervisor was driving the track loader forward as the crew members were picking up the Filtrexx and coiling it into the track loader bucket. The IP had positioned himself beside the bucket while lifting the Filtrexx. The weight and awkwardness of the Filtrexx caused the IP to try and get his body closer to the load being lifted and he placed his foot in front of the track loader tracks. As the supervisor advanced the track loader he rolled up onto the IP s left foot. 2

4 Findings While interviewing the IP and supervisor it became obvious there was a language barrier. The IP only spoke Spanish and the supervisor only spoke English. When the supervisor was asked to speak with his crew he reached for his cell phone and pulled up Google Translator to initiate the discussion. When the supervisor was asked about the JSA and how it was conducted he stated he used the Google Translator to review the JSA??? The JSA (see next slide) did list the job step of operating the mini skid and the hazard of impact & crush on it. The actions listed to eliminate the hazard were eye contact and stay clear?? While operating the track loader the supervisor does not have line of site visibility of the space between the tracks and the bucket (RED/Strike Zone). Due to the weight, length and awkwardness of lifting the heavy Filtrexx the track loader needs to move forward while the crew members lift and place it into the bucket. The COP Construction Supervisor was not on location when the incident occurred. 4

6 Corrective Actions COP Construction Supervisor sent the crew to the yard with specific direction not come back to work unless they have a bilingual speaking person on the crew. Contacted the WSRI manager and informed them of the situation and provided the same direction and expectation of a bilingual crew member for any future work. WSER Supervisor will meet with WSRI management to discuss the issue regarding language barriers and what our expectations are path forward. The WSER assigned to the drilling rig will provide additional support to the construction supervisor starting Monday 8/6. One of their priorities will be to verify no similar language barriers are present in any of our construction operations. Clear direction was provided to the COP construction supervisor and WSER that any vendor showing up that has any potential language barriers without a bilingual speaking member The Job Will Be Shut Down. Need to evaluate other options for picking up Filtexx and not having personnel in close proximity of moving equipment (i.e. other implements, equipment, trailers). 6
