1 18 December 2012 Auckland Transport 6 Henderson Valley Road Private Bag Auckland 1142 Attention John Stokes, Chris Beasley REQUEST FOR FURTHER INFORMATION IN ACCORDANCE WITH SECTIONS 169 AND 92 OF THE RESOURCE MANAGEMENT ACT 1991 Notice of Requirement: NOR Proposal: Notice of requirement in respect of the construction and maintenance of a new road, being Northside Drive (East) Site Address: The Notice of Requirement applies to land located in an area stretching from the new State Highway 16 North Western motorway corridor and includes land owned by the New Zealand Transport Agency (NZTA) located to the west of the motorway corridor I am writing with respect to the Notice of Requirement (NOR) described above. After a preliminary assessment of the NOR the following further information is requested to enable an adequate analysis of the proposal, its effects on the environment and the way in which any adverse effects on the environment may be mitigated. The information requested below will enable Council to undertake a full and proper assessment of the NOR and provide a recommendation on it. Pursuant to S.92A of the Resource Management Act you must respond in writing to the following information request by 11 February 2012 by undertaking one (or more) of the following options: 1. Provide the information. 2. Request, in writing, an alternative date by when this information would be provided. The revised timeframe would need to be agreed to by Council. The application would remain on hold until this time. If you agree to provide the information but do not nominate a timeframe then Council will set a reasonable time within which you must comply, and will notify you of this. 3. Advise in writing that you are refusing to provide the information if you consider the information request to be unnecessary to enable the determination of the application. In accordance with the Resource Management Act, processing of your application will remain on hold until the indicated date, pending your response to this request. Please note that the processing clock will stop as this is the first request for additional information. NOR S

2 A copy of the NOR documentation has been provided to various resource management specialists involved in assessing the application. Their preliminary review of the NOR has identified requests for further information set out below. Transportation The Transport Assessment Report (TAR) has a number of gaps in the information which should be addressed, in particular, the form and intensity of adjacent development (including that introduced by Plan Change 15) should be demonstrated to be accounted for in the 2051 modelling. To address traffic generation from adjacent developments, please: 1. Explain the nature of the urban design requirements of PC15 referred to in 2.5 of Appendix E (Transport Assessment Report). 2. What are the potential developments in the land surrounding the proposed road and what form and intensity of future development has been taken into account in the 2051 modelling? 3. How has the preferred option been tweaked as stated in the memo from Hussam Abdul- Rassol on consideration of roading alternatives (Appendix L)? 4. There is no discussion about the implications of the projected traffic demands- these indicate that a 2 lane road should be sufficient but that is implied, not stated. The TAR does not identify the (potential) needs of future development of the surrounding area. Instead it refers to the needs of the existing development (horticultural and rural residential activities). What are the implications of the freight traffic function and what features of the NoR will accommodate freight traffic? 5. The report should identify the implications of the freight traffic function including what, if any, design features are incorporated to accommodate freight traffic. What role will the NoR play in the future public transport network and what criteria will be used to determine the location of future bus stops? 6. The NoR does not, however, indicate the role Northside Drive might play in the future public transport network. 7. In addition, the NoR does not state what criteria were used, or should be used, to determine the location of the future bus stops. Plans and road network function 8. The proposed road has been described as a District Arterial Route in section 4.4 and a Collector Route in the TAR. The application should be amended for consistency and the road network function allocated by Auckland Transport should be stated. 9. Figure 3 in the Form 18 shows a typical cross-section of the proposed road, although this cross section is not discussed in the text. The cross-section shows a carriageway with three traffic lanes of widths 3.50m, 3.50m and 3.70m plus 1.80m cycle lanes along both sides giving a pavement width of 14.3m. The 1.80m wide footpaths are separated from the carriageway by 2.70 wide berms containing swale drains, giving an overall width between fences/noise barriers/retaining walls of 23.3m. 10. Section 4 Potential Effects that the Public Work will have on the Environment... states that the width of the road is consistent with a District Arterial Road and refers to plans C14043 & C14045 at Appendix G. These plans indicate that Northside Drive east has a typical pavement width of 11.0m and a total width of 20.0m. The 11.0m pavement width consists of NOR S

3 two 3.70m traffic lanes and two 1.8m cycle lanes. From plan C14044 it can be seen that the cross-section included as Figure 3 (and the total road width of approximately 24m) applies only to the approach to the intersection with Trig Road. 11. Section 2 should include a cross-section and a description of that cross-section which is consistent with the plans referred to in Section 4. Figure 3 should be replaced with a crosssection from or based on plan C14043 not C Traffic Please confirm whether the motorway overbridge is part of this Notice of Requirement or whether a separate application will be made for this bridge. 12. If the bridge is in fact part of the proposal, please provide modelling for the bridge and please also provide modelling for the Trig Road intersection. 13. With regard to Trig Road intersection, which is outside the scope of work; as this is a motorway on-ramp please provide results of modelling of this junction as well as the off-ramp junction. This information is needed to ensure that traffic using the SH18 - Trig Road - Northside Drive - SH16 link has been considered in full in terms of the design of all four affected intersections, which will enable determination of whether the designation sought will be enough for future proofing. Earthworks 14. The Form 18 of the Notice of Requirement states on page 25 that earthworks will be a Controlled Activity, however in Appendix K (Stormwater and Erosion and Sediment Control) on page 37, earthworks including tracking/trenching over an area of approximately 22,000 m² on land are stated as requiring land use consent for a Restricted Discretionary Activity under Rule As the earthworks are within 50m of a watercourse (within the Sediment Control Protection Area) the latter is correct (Restricted-Discretionary Activity). Please amend the Form 18 and supporting documents to reflect the correct activity status for earthworks. 15. Please assess the effects of the proposed earthworks on the watercourse as this has not been adequately addressed in the proposal. 16. Please identify the stabilised construction entrances on the Erosion and Sediment Control Plans as they have been discussed in Appendix K and are shown in the key of Appendix F of Appendix K, but are not identified in the plans and also amend the Erosion Sediment Control Plans to include the location of watercourses within the vicinity of the site. Advice Notes: Earthworks 17. A ten year duration for earthworks has been applied for, however it may be appropriate to advise people of the Universal Soil Loss Equation of 3.6 months the likely timeframe for earthworks will be reasonably short. Please note that the Resource Management Act prescribes a detailed process for the issuing of requests for further information, and the options available to an applicant when responding to these requests. This letter is intended as a summary only of the legislative processes involved. Requests for information are issued by Council in order to facilitate the efficient processing of the NOR, and to ensure that all necessary information is before Council to ensure best practice decision-making takes place.
