1 CODE OPERATIONNEL DE RESEAU TRANSMISSION PART B3.1 CONDITIONS OF CAPACITY AVAILABILITY AT ENTRY/EXIT POINTS OF GRTGAZ TRANSMISSION SYSTEM EXCLUDING MAINTENANCE PERIODS Disclaimer The present translation is not binding and proposed by GRTgaz exclusively for information purposes. 2 Part constitution, amendments and changes The present part forms integral part of the Contract which is part of the appendices of Sections A B C D1 and D2 of the Contract since applicable to the title of the Contract. All the Contract stipulations apply mutatis mutandis to the present part. In accordance with article 2 of the Contract, the Shipper commits himself becoming acquainted with any evolution or update of this posterior part at the date of signature of the Contract, notified by GRTgaz. 1.1 Amendments following legislative and regulatory changes of the legal framework The stipulations of article Amendments following legislative and regulatory changes Section A of the Contract apply mutatis mutandis in the case of new legislative or regulatory provisions from any competent authority that may apply directly or indirectly to this part or a decision of the Energy Regulatory Commission under the article L of the energy Code or a final decision of the CoRDIS under the articles L to 24 of the energy Code, would come into effect after the Contract signature. 1.2 Other changes The stipulations of article Other changes Section A of the Contract apply mutatis mutandis in the case of GRTgaz should amend the Contract for reasons other than those referred to in sub-clause 1.1 above. Introduction This document sets out: The conditions of capacity availability on GRTgaz' main transmission system for each contractual point with interruptible capacity, for the North-South link, and for the Nord Atlantique and Sud Atlantique storage facilities. The conditions of capacity availability at the Fos, Montoir & Dunkerque LNG Terminal Interface Points. The terms used in this document are in accordance with the definitions presented in the Appendix A1 of the Transmission Contract. Reminder concerning Capacity 3.1 Firm Capacity: Definition In accordance with the general conditions of the transmission Contract, a Firm capacity is a capacity whose availability is contractually guaranteed by GRTgaz under normal operating conditions, in particular excluding maintenance works or case of force majeure. 3 3.2 Case of PITS In the specific case of Transport Storage Interface Points (PITS), allocated capacities are of «Transport Storage Interface Capacity» (CITS) type. Transport Storage Interface Capacity exists solely for the following periods: Entry Capacity is calculated for the period from 1 November to 31 March, Exit Capacity is calculated for the period from 1 May to 3 September. Global availability of capacity at PITS varies over the year. GRTgaz defines global availability conditions at PITS. GRTgaz makes its best efforts, as a prudent and reasonable operator, in order to accept nominations at PITS higher than subscribed capacity. 4.1 Definition Availability of Interruptible Capacity In accordance with the general terms and conditions of the Transmission Contract, an Interruptible Capacity is a capacity whose use is not guaranteed by GRTgaz. 4.2 Availability conditions The availability of Interruptible Capacity depends of several factors: The consumption level, seasonality and considered month, The network configuration, especially related to nomination 1 requests of all shippers on a given point, The maintenance works. Each interruptible capacity can be divided into a "climate-related" part and a "scheduled" part, respectively associated to the consumption or temperature parameter and to the nomination parameter of all shippers. This document sets out the relations between the capacity on the considered contractual point and these 2 parameters, excluding periods of maintenance works. 4.3 Curtailment Order of Interruptible Capacity In case of interruption, accordingly to Article 24 of Netword Code CAM, Interruptible Capacity of higher maturity prevails over Interruptible Capacity of lower maturity. Thus, interruption order is as follows: daily Interruptible Capacity are interrupted first, then monthly, then quarterly, then yearly. This order applies on Network Interconnection Points (Dunkerque, Oltingue, Obergailbach, Taisnières H & B, Alveringem) and on North-to-South link (North-to-South direction & South-to-North direction). 1 The nomination term here (and for the rest of this document) stands for nomination requests at 2pm D-1. 4 4.4 Description of information forms The main features of the contractual points listed below are provided in the attached appendices. PIR Entry points OBERGAILBACH : Forward & backhaul DUNKERQUE TAISNIERES B TAISNIERES H : Forward & backhaul PIR Exit points and PIRR OLTINGUE : Forward & backhaul ALVERINGEM : Backhaul SCHONENBUCH JURA : backhaul Other points Peak conversion H to B NORTH to PITS NORD ATLANTIQUE PITS NORD ATLANTIQUE to NORTH SOUTH to PITS SUD ATLANTIQUE Conversion B to H PITTM MONTOIR FOS DUNKERQUE GNL Links NORTH-to-SOUTH SOUTH-to-NORTH Each of the forms provided in the Appendix is divided into 3 sections with the following information: «Capacity» section This section summarizes the capacities available each month that includes the firm part, the climate-related interruptible part, and the interruptible part depending on nomination requests «Conditions of capacity availability» section This section provides indicative formulas concerning the availability in relation with the temperature or consummation parameter (for the "climate-related" part) and the nomination requests parameter for all shippers (for "the scheduled" part). The formulas are applied in accordance with the following rules: The available interruptible parts "climate-related" and "scheduled" can be aggregated, The interruptible capacities are always between and the maximum interruptible capacity specified in the table for each of the "climate-related" and "scheduled" parts. Climate: The capacity availability can be related to consumptions. Thus, gas consumption forecasts on GRTgaz network, in H gas or L gas, on North and South balancing zones are used to determine the climate-related parts. Total resultant nomination request. The total resultant nomination request on a contractual point correspond with the difference between: The Entry nomination requests sum of all shipper on this point, The Exit nomination requests sum on this same point. 5 A shipper can estimate the availability of Interruptible Capacity on a certain point or link with an hypothesis of total resultant nomination request on other points Section «History» section This section allows comparing the historical achievements of allocations (quantities allocated) over the period 1 January 31 December for monthly profiles of the available capacities. 4.5 Case of the North-to-South link capacity The Firm Capacity on the North-to-South link is 27 from 1 April to 31 October, and 29 from 1 November to 31 March. The Interruptible Capacity on the North-to-South link includes two components: A "climate-related" part up to 3. Its terms of availability are defined in the Appendix 1. A scheduled part up to 15. o For the period from 1 April to 31 October, these availability conditions are defined in the Appendix 16. o For the period from 1 November to 31 March, these availability conditions are defined in the Appendix Case of the capacity at PITS Nord Atlantique and Sud Atlantique The capacities marketed on PITS Nord Atlantique and Sud Atlantique are available in accordance with the following conditions: The provisions specified in paragraph 3.2 regarding the capacity seasonality at PITS, GRTgaz guarantees a minimum availability of the Exit Firm and Interruptible Capacity from the North zone to PITS Nord Atlantique and Entry Capacity into the South zone at PITS Sud Atlantique, according to the consumption, the total resultant nomination request on the concerned PITS and the total resultant nomination request on the North-To-South link In Summer PITS Nord Atlantique: A minimum level of Capacity is guaranteed from the northern zone to PITS Nord Atlantique depending on the level of the total consumption of gas H and L on the GRTgaz network for the considered day (Cons_H+L_D_forecast), in the limit of 17 and according to the formula: Available Technical Capacity(D) MAX ( ; -.19 * Cons_H+L_D_forcast + 274) Some Interruptible Exit Capacity from the northern zone to PITS Nord Atlantique can be released depending on the total resultant nomination request on this point and on total resultant nomination request on the link between North and South balancing zones, up to 185. The rule regarding the Interruptible Capacity release from the northern zone towards PITS Nord Atlantique is specified in Appendix 16. Version of 1 st April 217 Page 5 on 7

6 PITS Sud Atlantique: The Exit scheduled Capacity from southern zone to PITS Sud Atlantique are released in case of underutilization of the South to North link, and up to In winter PITS Nord Atlantique: A minimum level of Capacity is guaranteed from PITS Nord Atlantique to the northern zone depending on the level of the total consumption of gas H and L in the northern zone for the considered day (ConsNorth_H+L_D_forecast), in the limit of 43 and according to the formula: Available Technical Capacity(D) MAX (.33 * ConsNorth_H+L_D_forecast 32 ; ) In case of under-utilization of the interruptible part of link capacity between the South and North balancing zones, a transfer of capacity to the entry on the northern zone from PITS Nord Atlantique thanks to the nominations at 2 p.m on day D-1 may take place in the limit of 43 and according to the formula: Available Technical Capacity(D) MAX (.22 * ConsNorth_H+L_D_forecast 4; ) The Interruptible Capacity at PITS Nord Atlantique at the entry point at the Northern zone are released in the limit of 5 in case of LNG Montoir terminal emission lower than 15. The availability terms of Firm and Interruptible Capacity are defined in Appendix 13. PITS Sud Atlantique : A minimum level of Capacity is guaranteed from PITS Sud Atlantique to the southern zone from Sud Atlantique depending on the level of the total consumption in the southern zone for the considered day (ConsSouth _D_forecast), in the limit of and according to the formula: Available Technical Capacity(D) MAX (.52 * ConsSouth_D_forecast ; ) In case of under-utilization of the interruptible part of link capacity between the North and South balancing zones, a transfer of capacity to the entry on the southern zone from PITS Sud Atlantique thanks to the nominations at 2 p.m on day D-1 may take place in the limit of and according to the formula: Available Technical Capacity(D) MAX (.3 * ConsSouth_D_forecast + 4 ; ) Availability conditions of these capacities are defined in Appendix 14. Additional capacity from PITS Sud Atlantique to the southern zone are released accordingly to the resulting flow towards TIGF. Version of 1 st April 217 Page 6 on 7

7 5.1 PITTM Montoir Capacity at LNG Terminal Interface Points The available entry capacity at the Montoir Transmission - LNG Terminal Point depends on the local level consumptions as described in the form provided in Appendix 19. On the basis of these relations and taking into account the delivery history over the last two years as all as climatic data, it is also possible to conduct a statistical analysis to determine the minimum capacity available each day at a given level of probability. The curve provided in Appendix 2 thus represents the minimum capacity available each day using a 5% and 9% probability scenario. The probability level is determined using the consumption parameter. 5.2 PITTM Fos The entry capacity at the Transmission-LNG Terminal Interface Point depends on the following system parameters: Rhône pipeline transit capacity. Which depends on the performance of the pipeline's infrastructures. Currently, it is equal to 15. The consumption level in the South-East area. Which depends on the temperature and operations of certain major industrial customers (for example Combined-Cycle Gas Turbines power plants). We consider that this parameter may vary from 6 (August minimum with one or two CCG in works) to 29 (consumption at 2% risk, i.e. may occur once in fifty years). Deliveries towards TIGF via the Midi pipeline. These deliveries depend global balances of GRTgaz South and TIGF balancing zones. In normal operating conditions, this capacity is equal to 18, apart from maintenance periods. The level of injection and/or withdrawal into/from the Manosque storage facility. This level depends on shipper's nominations on PITS Sud Est. This parameter thus varies from -15 (withdrawal) to +2 (injection). For a given day, the following relation is established as: Capacity at FOS 33 + CONSUMPTION + PITS SUD EST The Firm Capacity at PITTM of Fos (41 ) is guaranteed in normal operating conditions of the network. An historical analysis shows that these conditions are defined by the existence of a minimal 8 difference between local exits (consumptions + potential injections at PITS Sud Est in summer) and withdrawal from PITS Sud Est in winter. The curve provided in Appendix 22 presents the entry capacity available each day using a 5% and a 9% probability scenario. The probability level is calculated on the basis of all consumption parameters taken together, including deliveries to Cruzy and Manosque (and not on the basis of each parameter separately). Capacity availability is given by the following condition: Ober(REC-DEL) > Max[4 ; Olt +,18 x ConsoNord(H+B, hors SFM) + Min(SFM_Nord ; 8) - 63] MARGIN FOR DETERMINATION OF REVERSE CAPACITY FROM 1/4/217 TO 31/3/218 The reverse capacity for D+1 is based on 2:pm nomination on D-day. The within-day renominations are likely to alter the level of reverse capacity.therefore, the reverse capacity is proposed with a margin to cover the main part of the noticed differences, without overly affecting its availibity. Based on 216 analysis, compared to the capacity determined on 2 pm nominations, the reverse capacity would have been reduced by : - 5 % of the days for a margin of 5 (the reduction would have been higher than 5 for 1% of the days) - 8 % of the days for a margin of 1 (the reduction would have been higher than 5 for 4% of the days) These reductions would have occured before 1/11/16 (corresponding to the commissioning of the "Arc de Dierrey" that removed the "Congestion Ouest-Est" bottleneck), when the availibility condition was more restrictive. GRTgaz reserves the right to to adapt the margin between 1 and 6 during the year according to market conditions.
