1 MINISTRY OF TRANSPORT SOCIALIST REPUBLIC OF VIETNAM Independence - Freedom - Happiness No. 337/QD-BGTVT Hanoi, August 9, 4 DECISION APPROVAL FOR DETAILED PLANNING FOR SEAPORTS IN THE SOUTHEAST (GROUP 5) BY AND THE ORIENTATION TOWARDS 3 MINISTER OF TRANSPORT Pursuant to Maritime Code Vietnam dated June 4, 5; Pursuant to the Law on Construction dated November, 3; Pursuant to the Government's Decree No. 7//ND-CP dated December,, defining the functions, tasks, entitlements and organizational structure the Ministry Transport; Pursuant to the Government's Decree No. 9//ND-CP dated September 7, on formulation, assessment, ratification, and management socio-economic development master plans and the Government's Decree No. 4//ND-CP dated January, on amendments to Decree No. 9//ND-CP; Pursuant to the Prime Minister s Decision No. 37/QD-TTg dated June 4, 4 on amendments to Planning for development Vietnam s seaport system by and orientation towards 3; Pursuant to document No. 7/TTg-KTN dated August, 3 the Prime Minister on improvement management Group 5 seaports and ports in Cai Mep Thi Vai area; In consideration report No. 434/TTr-CHHVN dated December 5, 3 Vietnam Maritime Administration; At the request Assessment Council and Director Planning and Investment Department, HEREBY DECIDES: Article. Grant approval for detailed planning for seaports in the Southeast (Group 5) by and the orientation towards 3 with the following contents:. Viewpoint - Make the best use natural and socio-economic conditions the region for port development; effectively use available land for port construction to improve the ability to receive large s and develop potential for international transment Group 5 seaports. - Make the best use available infrastructure s and ports; make in-depth investment to improve capacity and meet demands for movement goods carriage by sea in the Southeast and the South. - Develop Group 5 seaports in association with connection road, rail and inland waterway infrastructure to boost development coastal economic zones, urban areas and major industrial parks in Ho Chi Minh City, Dong Nai, Ba Ria Vung Tau, Binh Duong, Binh Phuoc and adjacent provinces. - Combine harmonious development dedicated ports for bulk cargo, liquid cargo, farm produce, etc. to serve movement goods in the entire area. - Provide land and water surface for development multipur s, container ports, or dedicated ports serving the entire area. - Enhance application advanced technologies in management and operation seaports, especially at major ports in Cai Mep Thi Vai area (Ba Ria Vung Tau), Cat Lai, Hiep Phuoc (Ho Chi Minh City). - Expedite and associate relocation ports in urban areas with traffic organization in seaport urban areas in a harmonious manner to avoid conflicting traffic connecting the port and urban areas. - Utilize every social resource, especially from the private sector and foreign direct investment for development seaports and public infrastructure seaports. - Port development must be sustainable; seaport development shall be in association with environmental protection, ecology protection, and avoidance negative impacts on social activities within the area. The development and operation seaports in the area shall be in association with protection the ecology Ganh Rai bay, mangrove forests in Can Gio and along Thi Vai River; ensure that there are not negative impacts on tourism potential Ho Chi Minh City and Vung Tau city.

Planning content a) Detailed planning for Group 5 ports: Group 5 has 4 seaports: Ho Chi Minh City Seaport, Dong Nai Seaport, Vung Tau Seaport (including Con Dao Port) and Binh Duong Seaport. - Ho Chi Minh City Seaport: a national central multipur (Class I) which comprises s along Sai Gon river, Cat Lai s along Dong Nai river, s along Nha Be river, and Hiep Phuoc s along Soai Rap river. Estimated capacity goods movement: 5,7 -,3 million tonnes per year by ; 7,4-3,7 million tonnes per year by 5; 44, - 5,3 million tonnes per year by 3. Estimated capacity container movement: 4,7-4, million TEU/year by 5; 5, million TEU/year by ;.-.47 million TEU/year by 5; million TEU/year by 3. Expected movement international passengers by sea: arrivals/year by ; 5 arrivals/year by 5; arrivals/year by 3. These s shall be relocated and repurd in accordance with the Prime Minister s Decision No. 79/QD-TTg dated August, 5; part the Khanh Hoi shall be converted into an inland passenger and maritime service center. Unrelocated wharves shall be upgraded, not expanded. + Cat Lai s (Dong Nai river): 9 s/docks for s with a deadweight tonnage up to tonnes. These are currently the primary container s Ho Chi Minh City Seaport. + Nha Be s (Nha Be river): s/docks for s with a deadweight tonnage. tonnes. s along Nha Be river shall be upgraded (not expanded) to serve s with a deadweight tonnage up to tonnes. 3 Rap sanctuary, satellite s central ports in Ho Chi Minh City area. - Dong Nai Seaport: National and central multipur (Class I ) which comprises: Long Binh Tan s (Dong Nai river); Phu Huu s (segments Dong Nai river and Long Tau Nha Be river), Ong Kep s (Long Tau and Dong Tranh rivers); Go Dau s and Phuoc An s (Thi Vai river). Estimated capacity goods movement: 9,7 -, million tonnes per year by ; 3,4-35, million tonnes per year by 5; 5,5-5,5 million tonnes per year by 3. Estimated capacity container movement:,9 -,77 million TEU/year by ;,3 -,57 million TEU/year by 5;,4 -,3 million TEU/year by 3. Detailed planning for primary s: + Phuoc An, Go Dau s (on Thi Vai river): primary s Dong Nai Seaport for general s and container s with a deadweight tonnage up to. tonnes (Phuoc An) and tonnes (Go Dau); some dedicated s for s with a deadweight tonnage.5. tonnes directly serving adjacent industrial facilities. + Phu Huu, Nhon Trach, Ong Keo s (Dong Nai, Nha Be, Long Tau rivers): dedicated s for s with a deadweight tonnage. tonnes and multipur s for s with a deadweight tonnage up to tonnes serving factories and industrial facilities in the area. + s along Dong Nai: s for general s and s carrying bulk cargo containers up to tonnes, dedicated s for s with a deadweight tonnage up to. tonnes in Long Binh Tan area (Dong Nai). - Binh Duong Seaport: a local multipur (Class II) along Dong Nai river which comprises for s with a deadweight tonnage up to tonnes and container handling. Estimated capacity goods movement:,99 -, million tonnes per year by and remains unchanged during Vung Tau Seaport: a national multipur, international gateway (Class IA) which plays a role as an international transment port, comprising: Go Dau, Tac Ca Trung s; Phu My, My Xuan s; Cai Mep, Sao Mai Ben Dinh s; Long Son s; Ding river s and Con Dao s. Estimated capacity goods movement:, - 9, million tonnes per year by ; 33, - 49,4 million tonnes per year by 5;,-95,5 million tonnes per year by 3. Estimated capacity container movement:,5 -,3 million TEU/year by 5; 3,5 4,7 million TEU/year by ; 5,4 -,3 million TEU/year by 5; 7,5 9,4 million TEU/year by 3. Expected movement international passengers by sea: arrivals/year by ; 574 arrivals/year by 5; 4 arrivals/year by 3. Detailed planning for primary s: + Go Dau, Tac Ca Trung s: for general s and container s, capable receiving s with a deadweight tonnage up to tonnes. + Phu My, My Xuan s (Thi Vai river): for general s with a deadweight tonnage 5.. tonnes; container s with a capacity up to 4. TEU. Shipping lanes shall be upgraded and expanded to receive s with a deadweight tonnage.. tonnes (4.. TEU) at Phu My and up to. tonnes at My Xuan; some s are dedicated to serving industrial and services facilities. + Cai Mep, Sao Mai Ben Dinh s are primary s the port which handle containers exported and imported long ping routes and international container transment. Cai Mep s are capable receiving s with a deadweight tonnage.. tonnes (.. TEU); ping lanes shall be upgraded to receive s with a deadweight tonnage over. tonnes at Cai Mep. Sao Mai Ben Dinh s area capable receiving container s with a deadweight tonnage from. tonnes (. TEU) to over. tonnes and international passenger s with a capacity up to. GRT. + Long Son s: dedicated to the oil refinery complex with s for receiving crude oil s with a deadweight tonnage 3. tonnes, s with a deadweight tonnage 5. tonnes carrying other materials and exports. The southeast coast is meant to build a multipur serving long-term development the area. + Vung Tau Song Dinh s: capable general s with a deadweight tonnage. tonnes (Dong Xuyen Industrial Park). + Con Dao s: general s and passenger s Con Dao, capable receiving s with a deadweight tonnage. tonnes. 4 and oil s for s with a deadweight tonnage up to. tonnes. b) Relocation plan: Other s along Sai Gon river which are connected to Cat Lai, Thu Duc, Long Thanh, Vung Tau and Dong Nai industrial parks by Phu My bridge shall keep operating and might be relocated after if necessary. (A list capacity and functions each port in the Group is provided in the Appendix enclosed with this Decision). c) Plan for buoy wharves: Buoy wharves on the ping lanes are only temporary in areas where permanent s yet to be feasible. The construction buoy wharves must be in association with development planning and appropriate for permanent s. When construction a permanent is completed, the investor in the buoy wharf shall relocate it to ensure safety and effective operation the permanent. d) Plan for upgrade ping lanes: - Sai Gon Vung Tau lane: upgrade some sharp turns, maintain depth and maritime signaling system for s with a deadweight tonnage tonnes; utilize tidal current both day and night. - Soai Rap lane: dredged to the depth -9,5 m, capable s with a deadweight tonnage up to tonnes fully loaded and 5. tonnes partially loaded. In the next period: monitor developments and assess the dredging result (-9.5 m) to consider dredging to serve s with a deadweight tonnage up to 5. tonnes fully loaded and over 5. tonnes partially loaded. - Dong Nai lane: Maintain operation the 3-km segment from Mui Den Do junction to Dong Nai Port. - Cai Mep Thi Vai channel: Determine the largest size s able to enter the s; estimate sizes s for each group: Cai Mep s for s with a deadweight tonnage. >. tonnes, container s with a deadweight tonnage.. TEU; Phu My (Thi Vai) s for s with a deadweight tonnage.. tonnes, container s with a deadweight tonnage 4.. TEU s; Phuoc An, My Xuan s for s with a deadweight tonnage up to. tonnes; Go Dau s for s with a deadweight tonnage up to tonnes. - Ding river lane: Maintain conditions for operation s with a deadweight tonnage. tonnes. dd) Projects given priority by - Cai Mep Thi Vai lane: complete comprehensive study into Cai Mep Thi Vai lane as the basis for preparing investment plans, etc. to attract pers to Cai Mep Thi Vai area. - Soai Rap lane: assess the stability -9.5m depth lane, consider dredging for s with a deadweight tonnage 5. tonnes and over 5. tonnes partially loaded (reduced load, utilizing tidal current) to enter Hiep Phuoc s. - Invest in s dedicated to oil refinery at Long Son: import crude oil, export oil products, import materials - Port-connecting roads: + Highway 5 (Dong Nai Ba Ria Vung Tau): complete upgrading Highway 5 connecting Cai Mep Thi Vai system and the local traffic network. + Inter-port Cai Mep - Thi Vai road (Ba Ria - Vung Tau): expedite construction the road after SP- PSA International Port, Thi Vai International Port and Ba Son Shipyard in Phu My. + Invest in construction Road 99B and Phuoc Hoa Cai Mep road to connect Cai Mep Thi Vai s and Cai Mep Ha Logistics Center. + Roads to Hiep Phuoc s: finish North South roads to Hiep Phuoc s and main roads to s the industrial park, especially Road D3 to Sai Gon Hiep Phuoc. 4. Policies, mechanism, and solutions a) Regarding general port development - Enhance private sector involvement in development seaport infrastructure. Enhance investment promotion, encourage and enable all domestic and foreign economic sectors to invest in seaport development; state budget shall focus on investment in public infrastructure works (ping lanes, common breakwaters) connected to important seaports. - Keep boosting administrative procedure reform in management investment and port operation towards simplification and international integration. Improve fice port authorities and regulatory

5 bodies at new s to ensure timely state management them. Improve state management planning for development seaports in the Group; ensure cooperation and harmony with planning for development local traffic network, construction planning, and socio-economic development master plans the areas where the ports are located. - Encourage construction common s at economic zones and industrial parks to improve effectiveness investment and use coastlines. Ensure at least 5 7 m in width land for port development along big rivers with potential for port development (Cai Mep - Thi Vai, Soai Rap, Long Tau, Nha Be, Dong Nai, etc.). Provide land area behind the ports to build goods distribution centers which plan the role as logistics centers. b) Policies on and organization port relocation - Policies on and organization relocation ports along Sai Gon river and Ba Son yard are specified in the Prime Minister s Decision No. 79/QD-TTg dated August, 5 and other directive documents. - Financial policies: specified in the Prime Minister s Decision No. 74/5/QD-TTg dated April, 5 on use revenues from transfer land use right, liquidation factories and other works upon relocation business organizations and factories under planning; the Prime Minister s Decision No. 4//QD-TTg dated April 4, the Prime Minister promulgating Financial policies on relocation ports along Sai Gon river and Ba Son yard and relevant legal documents. - Other policies on relocation may be reported to the Steering Committee for relocation ports along Sai Gon river and Ba Son yard; ultra vires issues may be reported to the Prime Minister. c) Mechanism for encouragement international transit goods - Enhance application policies encouraging development international transit goods and establishment basic infrastructure, organize the management, operation, provision financial and banking services and other services necessary for improvement competitiveness, attraction and movement internationally transited goods in the region. - Encourage and expedite construction logistics centers in Cai Mep Ha area. Article. Management and organization planning implementation. Vietnam Maritime Administration - Cooperate with People s Committees provinces and relevant agencies in publishing and managing implementation approved planning, especially for new construction wharves and s in their provinces, ensure that construction new wharves and s does not exceed the need for goods movement under approved planning; pro adjustments and updates to planning for ports and s to the Ministry Transport. - Annually cooperate with local governments and relevant organizations in assessing the implementation port development planning; pro actions against projects that fail to comply with the planning to the Ministry Transport. - Organize the implementation seaport development planning in association with implementation solutions for improve effectiveness seaports and s specified in Decision No. 334/QD- BGTVT dated October 5, 3 the Minister Transport.. Ministries, pressional regulatory bodies and the People s Committees provinces - Ministries, pressional regulatory bodies and the People s Committees provinces shall instruct investors to plan projects for construction, renovation and upgrade seaports and ping lanes in accordance with approved planning and regulations law on construction. - Ministries, pressional regulatory bodies and the People s Committees provinces shall instruct competent authorities to pro addition s to the planning to Vietnam Maritime Administration; Vietnam Maritime Administration shall submit reports to the Ministry Transport for consideration. - The People s Committees provinces, pursuant to approved planning, shall strictly manage and properly use land area dedicated to port construction; provide land area for harmonious development ports and infrastructure connected thereto, logistics centers and maritime service centers in order to ensure smooth operation seaports; cooperate with the Ministry Transport in organizing the transport system in a manner that avoids conflicting traffic between the ports and urban areas; reach an agreement the Ministry Transport in the scale and progress port construction projects before allocating land or issuing a certificate investment to a seaport construction project. Article 3. This Decision comes into force from the day on which it is signed and replaces Decision No. 745/QD-BGTVT dated August 3, the Minister Transport. Article 4.
