2 ISSUED FOR ADDENDUM No. 2 NOVEMBER 23, 2016 VOLUME I SC-2 FOREWORD: ATTACHMENTS Notice to Proceed. VTA will issue a Notice to Proceed promptly following execution of the Construction Agreement and Contractor s compliance with the requirements as set forth in this Section 2.3. Contractor shall commence performance of the Work after receipt of the Notice to Proceed, and shall continuously and diligently prosecute the Work to completion on or before the time or times set forth in the Special Conditions herein. Regardless of the date of the Notice to Proceed, the first day charged shall be the thirty fifth (35 th ) calendar day following the date of the NOA. Contractor shall neither enter upon nor occupy VTA property or commence any materials fabrication prior to receiving the Notice to Proceed. Any Work performed or expenses incurred by Contractor prior to Contractor's receipt of Notice to Proceed shall be entirely at Contractor's risk. VOLUME I SC-5 : Add the following paragraph to SC-5 Liquidated Damages. The work requiring single tracking or full track closure operations must be completed and in acceptable state in one (1) weekend as required in 10.9 & of these Special Conditions. The liquidated damages for failing to complete this work in each weekend shutdown as required will be $ per hour thereafter. The time of acceptance will include the ability of revenue service to resume. VOLUME 1 SC-10: Add the following paragraphs to SC-10 Work Sequence & Constraints Specific Construction Requirements Contractor will notify VTA and submit a work request as follows: 30 calendar days prior to commencement of any work. 60 calendar days prior to commencement of work that requires VTA support due to impacts to VTA operations. No work will be performed until after all material required for the work are readily available and located within 25 miles of the project sites. All work will be coordinated such that no work is performed on days with scheduled events that will impact roadway and LRT traffic. Contractor will pay special attention to the following events: Events at SAP Center Events at Levi s Stadium Silicon Valley Turkey Trot during Thanksgiving week Rock & Roll Half Marathon on First Sunday of October Independence Day celebration on 4 th of July San Jose Summer Jazz Fest in August San Jose Downtown construction moratorium during the winter holidays

3 10.9 Hours of Operation and Schedule Constraints Except for the work requiring single tracking or shutdown of LRT Operations, Contractor activity for work without impacts to VTA operations will be permitted between the hours of 9:00 AM (0900) and 4:00 PM (1600) daily Monday through Fridays. In areas not affected by Express Train Service, VTA may authorize contractor to work earlier and/or later than the 9:00 AM (0900) to 4:00 PM (1600) noted above. Weekend hours of work shall be between 8:00 AM (0800) and 6:00 PM (1800) with prior VTA approval. For definition, the weekend period starts at 12:00 AM (0000) Saturday morning and continues until 11:59 PM (2359) Sunday night. However, windows starting on the weekday night and ending on the weekend are also referred to as weekend windows. For example, a window starting late Friday night and ending Saturday morning is referred to as a weekend window. For work that is impacting LRT operations, contractor will assign multiple crews and work around the clock within the allowable windows provided by VTA. The schedule constraints have been established for this contract as follows: Rail Defect Repairs on 1 st and 2 nd Sts. (Milestone 1). The track repair work will be allowed under single tracking operations between the hours of 12:30 AM (0030) and 4:00 AM (0400) weekdays (Monday to Friday mornings). The work will be done within 5 weekday windows or 2 weekend windows. A 30 day notice to VTA is required for this work. Patrick Henry Power Switches (Milestone 2). The switch replacement work will be allowed under single tracking operations between the hours of 12:30 AM (0030) and 4:00 AM (0400) weekdays (Monday to Friday mornings). The work will be done within 5 weekday windows or 1 weekend window. A 30 day notice to VTA is required for this work. Capitol Station Track (Milestone 3). The track realignment work will be allowed under single tracking operations between the hours of 12:30 AM (0030) and 4:00 AM (0400) weekdays (Monday to Friday mornings). The work will be done within 5 weekday windows or 2 weekend windows. A 30 day notice to VTA is San Carlos Diamond (Milestone 4). The diamond curve replacement will be allowed AM (0400) Monday, or 4:00 AM Tuesday if done on a Memorial Day or Labor Day weekend. Up to 3 additional hours may be allowed on Friday night if approved at Track Karina Crossover (Milestone 5). The Karina crossover installation will be allowed AM (0400) Monday, or 4:00 AM Tuesday if done on a Memorial Day or Labor Day weekend. Up to 3 additional hours may be allowed on Friday night if approved at Track Santa Teresa Signal and Track. The signal cutover, testing and track work will be allowed under a single weekend period between the hours of 11:00 PM (2300) Friday and 4:00 AM (0400) Monday. Up to 3 additional hours may be allowed on Friday night if approved at Track Allocation. Major work with impacts to operations at this location must be completed during the weekend shutdown. Only minor work and site cleanup

4 without impacts to VTA operations is allowed after the weekend shutdown. A 60 day notice to VTA and a 45 day notification at Track Allocation is Woz Way Signal and Track. The signal cutover, testing and track work will be allowed AM (0400) Monday. Up to 3 additional hours may be allowed on Friday night if approved at Track Allocation. Major work with impacts to operations at this location must be completed during the weekend shutdown. Only minor work and site cleanup without impacts to VTA operations is allowed after the weekend shutdown. A 60 day notice to VTA and a 45 day notification at Track Allocation is Clayton Crossover. The Clayton/N. 1 st St. crossover installation will be allowed under a single weekend period between the hours of 11:00 PM (2300) Friday and 4:00 AM (0400) Monday, or 4:00 AM Tuesday if done on a Memorial Day or Labor Day weekend. Up to 3 additional hours may be allowed on Friday night if approved at Track Chynoweth Interlocking. The Chynoweth work will be allowed under single tracking operations between the hours of 12:30 AM (0030) and 4:00 AM (0400) weekdays (Monday to Friday mornings). The work will be done within 5 weekday windows or 2 weekend windows. A 30 day notice to VTA is Contractor will coordinate with VTA, the City of Santa Clara and the City of San Jose to submit and obtain approval of traffic control plans to allow for the safe loading and unloading of materials and equipment, the safety of workers, pedestrians and vehicular traffic. Traffic control permits will be approved and given to VTA prior to scheduling of the rail work through VTA Shutdown of Work LRT Operations Major track and signal work with impacts to VTA operations will be performed and completed within the weekend shutdown period. Only minor site preparation work without impacts to VTA operations is allowed before and after the allowed weekend shutdown. The completion milestone for each location with scheduled weekend shutdowns will be accomplished at the end of the weekend shutdown and no track and signal work with impacts to VTA operations will be allowed. After completion of work for LR tracks and upon verification by signal personnel that all track circuits and signals are operating correctly, contractor will notify VTA to commence train testing process for all train circuits. After VTA test train procedure has been performed and accepted by VTA, VTA will return the track back to regular service. Refer to SC-10.9 for specific hours for work windows. Prior to starting the work, contractor will demonstrate the ability to complete all work for track and signal including the durations for cutover, testing and run the test train on each track. Contractor s request for LRT Operations shutdown is subject to VTA s approval and Contractor satisfying all applicable requirements specified in SC-13.7, Contractor Safety & Light Rail Transit Operations. In addition to attending the scheduled progress meetings, and prior to the weekend shutdown or work within 10 of the trackway, the Contractor will attend a mandatory Track Allocation meeting. For work requiring shutdowns, contractor will attend meeting 45 days prior to the shutdown. At the meeting, the Contractor will present his anticipated work plan in writing Site Specific Work Plan (SSWP) as required in SC , Site Specific Work Plan. VTA s

5 Way, power & Signal (WPS) department will approve Contractor s SSWP prior to mobilization of the contractor to do any work. The standing time of these meetings are Wednesday at 1:00 PM at 101 W. Younger, at the Guadalupe Light Rail Yard. Contractor will coordinate with VTA and attend Track Allocation Meeting the week prior to the scheduled weekend shutdown Clearing the Trackway. Personnel, equipment, tools and unsecured materials will be clear of trackway. If it is necessary to work within 48 inches from the nearest rail, personnel, equipment, tools and unsecured materials will be greater than 48 inches from the nearest rail of an active track a minimum of 30 seconds prior to any rail mounted vehicle, including revenue vehicles (trains) and high rail maintenance vehicles, entering the work limits. Upon notification by LRT flagger, all personnel, equipment and materials will immediately clear the trackway. If Contractor is unable to clear the trackway prior to a rail-mounted vehicle entering the work limits which results in an unscheduled slowing or stopping of the rail mounted vehicle, Contractor will modify construction methods and/or LRT flagger will adjust the time that the LRT flagger provides notification of approaching rail mounted vehicle to workers Track Closures. Contractor shall develop construction methods and procedures so that all work is performed in accordance with minimal impact to rail operations. When the weekend track closures are granted by VTA, there will be no existing on-track vehicles operating within the track limits during the allowed closure window. No additional track closures will be permitted. Contractor will develop and implement construction methods and procedures compatible with SC-10.11, Clearing the Trackway Power Shutdowns. Power shutdowns are required when personnel, materials and equipment have the potential of encroaching within the 10 feet of an overhead contact wire, including whenever lifting equipment; such as cranes, forklifts, boom trucks, etc., is used to move or remove materials to and from the worksite. The overhead wires convey approximately 800Vdc power to the LR train and are located approximately 17 feet above the top of rail, in the center of the tracks. VTA will provide power shutdowns during non-revenue hours. The lockout and tagout procedure to shutdown power will be implemented after the last train exits the work limits and the lockout and tagout procedure to return power to the system will be completed 30 minutes prior to the first train entering the work limits. The procedure to shutdown power and to return power will each take approximately 45 minutes. It will be necessary for the Contractor to provide two workers to participate in the lockout and tagout procedures Construction Staging. Contractor will determine construction staging of the work. When developing the construction staging, Contractor will adhere to the requirements for track closures and lane closures to ensure the track is completed and returned to service by the end of the track closure period. LR trains must be able to operate on the track. Vehicle driving surface repairs will be completed prior to the end of the lane closure/detour period. Vehicles must be able to operate over the public travel ways. Contractor will limit the scope of work on any given weekend so that the work can be completed in adequate time to complete the trackwork and restore the vehicle travel ways. Contractor will develop construction methods and procedures to avoid any potential encroachment of personnel, materials and equipment within 10 feet of the overhead contact wire.
