1 Statement of Work Off-Site Incinerator Services for Narcotic Material 1. BACKGROUND: This requirement is for Narcotic Incineration services for the U.S. Customs and Border Protection ( CBP ), El Paso Field Office. CBP Officers in the course of their work, seize several hundred thousand pounds of narcotics every year. These narcotics are primarily Marijuana, Methamphetamines, Cocaine, Heroin, Hashish, Opiates, Khat and Steroids. These seizures take place at controlled ports of entry as well as uncontrolled areas along the border and are aimed at stopping the flow of prohibited narcotics/drugs from import into the United States. 2. SCOPE: CBP seeks an incineration facility capable of completely incinerating narcotics and personal effects (items of personal property that one carries on one's person, including identification/papers, jewelry, cell phones, clothing, etc.). CBP anticipates incinerating approximately 155,000 lbs. of Hard and Soft Narcotics in the base year, 160,000 in option year one, 165,500 lbs. in option year two, 172,550 lbs. in option year three and 184,000 lbs. in option year four. The Incineration Facility shall have the capacity to incinerate soft and hard narcotics at a minimum rate of 1,000 lbs. per hour. Definition of Terms: Hard Narcotics are Cocaine, Heroin, and Methamphetamine whether dry or wet; and must reach between 1,800 degrees Fahrenheit or greater to be considered completely incinerated. Soft Narcotics are Marijuana, Hashish, Steroids, Opiates, and Khat that do not fall under Hard Narcotics whether dry or wet and can be completely incinerated at temperatures greater than 1,000 degrees Fahrenheit. High British Thermal Unit (BTU) is temperatures between 1,800 to 2,000 degrees Fahrenheit or higher. Low British Thermal Unit (BTU) is temperatures between 1,000 to 1,750 degrees Fahrenheit. The term environment is inclusive of all interior spaces, air, ground, subsurface, and water. Completely Incinerated Narcotics is considered to be narcotics incinerated to a point that the ash generated from the narcotics incineration process no longer holds any composite of drugs. Personal effects are considered completely incinerated to the point where they are rendered useless.

APPLICABLE DOCUMENTS: The contractor shall be responsible for researching all legal and regulatory requirements for specific state, county, and local laws, and providing a list of applicable licenses, certificates, and waivers to the Government along with documents that illustrate the contractor s compliance. 4. SPECIFIC TASKS: 4.1 Contractor shall be responsible for incinerating the narcotics. The narcotics contraband and personal effects list in Table 1 is grouped into 3 categories. Category 1: Soft narcotics which include Marijuana, Hashish, Steroids, Opiates and Khat; Category 2: Hard Narcotics which include Cocaine, Heroin, and Methamphetamine (wet or dry); Category 3: Personal Effects which include items of personal property that one carries on one's person, including identification/papers, jewelry, cell phones, clothing, etc The following are examples of the type of narcotics, personal effects and the type of package they come in at the time of seizure. Fiberglass Liquid Cocaine PVC Materials 4.2 The Contractor s Incinerator shall have the capacity to incinerate narcotics in its physical condition/state to include packaging material, which at times may be soaked in gasoline, other combustible and/or hazardous materials. 4.3 The Contractor s Incineration Facility shall stay operational until the completion of the order. 4.4 Contractor shall prohibit public access to its facility while CBP is conducting narcotics incineration. The Contractor s employee s access to the CBP incineration work area shall be limited to Incineration Facility employees

3 assigned to assist CBP with incineration. The Incineration Facility must meet all state and federal EPA standards. 4.5 The COTR shall contact the contractor when a burn is needed. CBP shall schedule incinerations no less than one week in advance of the order date. 4.6 CBP will provide the contractor a total weight of all seizures being destroyed upon completion of the destruction. Because of the highly sensitive nature of this information, the contractor shall only reveal the information to employees with an absolute need to know. At all times, the contractor shall keep the total weight documentation in a locked container in a secured location with limited access. 4.7 The Hard Narcotics must burn at a High BTU (temperatures greater than 1,800 degrees Fahrenheit) and Soft Narcotics must burn at a Low BTU (temperatures greater than 1,000 degrees Fahrenheit). 4.8 On the day of the burn, the contractor shall provide adequate parking space for 6-10 government vehicles and two ft. trucks and/or one tractor-trailer. 4.9 The Contractor shall maintain the Narcotics Destruction Site near or within a drive time from the respective vault which will allow CBP to travel, unload and destroy at least 10,000 pounds of contraband at a burn rate of up to 2,000 lbs. per hour The contractor shall have staff on site during incineration of CBP narcotics to address any mechanical or operational problem with the incinerator immediately. 5. GOVERNMENT-FURNISHED EQUIPMENT AND INFORMATION: 5.1 CBP will transport the narcotics requiring incineration to the facility. 5.2 CBP personnel shall perform all labor required to move narcotics to enter the incineration equipment, visually and manually inspect ashes through out the incineration process to verify complete incineration of the narcotics. 5.3 CBP personnel, including armed officers, shall have unrestricted access to the entire Incineration Facility, including the grounds outside the Facility, during the performance of an order. 5.4 At no time may CBP s narcotics be commingled with narcotics from any other source. 5.5 After incineration, CBP shall inspect the remains of the narcotics to ensure it is completely incinerated. In the event CBP discovers partially incinerated narcotics the contractor will recycle the partially incinerated narcotics through the incineration process to ensure the complete incineration.

4 5.6 Contractor shall be responsible for disposing of all residual and/or ashes after incineration in accordance with state and federal law and best industry practices. Contractor shall secure and maintain all necessary permits and/or licenses for such disposal. 6. PLACE OF PERFORMANCE: The place of performance shall be at the Contractor s Incineration Facility. The Incineration Facility shall be located within a maximum of 400 miles from the CBP El Paso Field Office. The CBP El Paso Field Office address is: 9400 Viscount Blvd. El Paso, Texas PERIOD OF PERFORMANCE: The Period of Performance shall be one base year, with four one-year option periods. 8. SECURITY: CBP shall provide the security personnel which will be comprised of status CBP employees who will be present throughout the entire Incineration process. A background investigation including drug screenings shall be conducted on all contractor personnel assisting CBP with the incineration of narcotics. Contractor shall be responsible for coordinating employee background investigations with the CBP Contracting Officer s Technical Representative. 9. TECHNICAL REQUIREMENTS: 9.1 The Incineration Facility shall meet all applicable Federal (OSHA, EPA, and FDA) and State and Local health requirements. The smoke discharged from the incineration process shall not contain gaseous hazards. The facility itself and the incinerator should not pose any specific hazards to government personnel. Contractor shall conduct a walkthrough and advise all personnel of any areas of safety concern and all areas where safety equipment is required should be clearly marked in accordance with OSHA standards. 9.2 Contractor shall provide any state and/or federal licenses and/or permits upon request. 9.3 The contractor shall conduct a walkthrough and advise all personnel of any areas of safety concern and all areas where safety equipment is required should be clearly marked in accordance with OSHA standards. 9.4 The contractor shall make available for CBP personnel adequate, clean restroom facilities, designated smoking area, and designated area for eating. 9.5 The Contractor s Incineration Facility must be located in a geographical area where emergency responders can reach the location within 10 to 15 minutes in case of an emergency. The contractor shall provide CBP with an emergency

5 response plan that specifies response actions and notifications given in the case of an emergency at the facility. 9.6 Contractor shall provide all necessary safety equipment such as hard hats, eye shields, ear protection and other required personal protective equipment (PPE) to CBP personnel to be used during the incineration process. These items will be returned before CBP personnel depart the Incineration Facility. 9.7 The contractor shall notify the CBP Contracting Officer s Technical Representative via phone or fax or electronic at least one month prior to scheduled maintenance or downtime of the Incineration Facility. SPECIAL CONSIDERATIONS: 10.1 Internal Affairs Certification Process CBP s Internal Affairs (I.A.) shall schedule a site visit to inspect the contractor s incineration facility. During the visit, CBP representatives will be using the Laboratory Scientific Services (LSS) Supplemental Manual Vol. 2 Section III Standard Operating Procedure for Narcotic Destruction Site Inspections to verify the contractor s facility complies with CBP standards. The site visit is a certification process provided by CBP s I.A. Office. If the contractor fails certification then a determination will be made by the Contracting Officer as to whether the contractor will receive an extension to remedy the discrepancies found.
