6 PAGE: 6/35 PART I Introduction, Definitions, Contact details & General Information 1 Scope and Purpose The guidelines given in this book is intended for Masters of seagoing vessels and other port users who require information regarding principles for admission of vessels into Kwanda Port and use of port facilities which includes the Pululu Channel, the buoyage of which is maintained by Kwanda Lda. It is the responsibility of the Agents and operators of the respective vessels to ensure that these guidelines are available to Masters of the vessels under their purview, before their arrival off port waters. Not having this publication on board a vessel will not be acceptable as an excuse for non compliance with port procedures. Kwanda Lda has made every effort to make the contents of this guideline as error-free as possible, deemed correct at the time of issue, but deny any liabilities for inaccuracies if any. In case of any discrepancies or inconsistencies between these guidelines and applicable Angolan Government legislation, the latter will prevail. 2 Reference Documents These guidelines are based upon the requirements of, or information contained in the following documents; Republic Of Angola Ministry of Transport Information on Shipping Demanding Entrance in Angolan Waters. Kwanda port Procedures Guide Book (Issued by the Harbour Master) April International Maritime Organization (IMO) Regulations including IMDG Code and SOLAS. Regulations of International Ship and Port Facility Security Code (ISPS) 3 Definitions Agent Any shipping, custom, clearance or other agent appointed, or acting on behalf of the Vessel, Owner, Operator, Shipper, Consignee, Charterer or the Shipping Company. Harbour Master (O capitao do Porto do Soyo) The person authorised by and excising the authority of the Ministry of Transport, other Representatives and Departments of the Government of the Republic of Angola. Kwanda Port (the Port) The Port Located in the Republic of Angola, Zaire province, Soyo Municipality, (Southern part of the entrance to the River Congo), at the head of Baia de Diego Cão S, E (The port is referred to as Port of Soyo in general, but the actual port of Soyo lies further up the Congo River in the vicinity of Soyo township. See below) Kwanda Supporte Logistco Limitada (Kwanda Lda) The private Stevedoring company approved and appointed by the authorities to operate the land based area of Kwanda Port, referred to hereunder as Kwanda, Kwanda Port or the Port Operator. Kwanda Lda is not the Port Authority. Kwanda Base The offshore supply and logistic base of which Kwanda Port is a division and is operated by Kwanda Lda. Kwanda Port Radio Control (KPC) The Control Room or Person who from time to time acts for and exercises the control of Kwanda Port. Maritime Police (MP Control) Officials of the Government of the Republic of Angola, operate under the authority of the Harbour Master

7 PAGE: 7/35 Port of Soyo The port located east of Kwanda Port, further up the Congo River in the vicinity of Soyo township. Soyo Port Authorities The relevant bodies appointed and authorized to control and administer the ports within Soyo Municipality, one of which is Kwanda Port, including but not limited to, The Harbour Master, Ministry of Transport, other Representatives and Departments of the Government of the Republic of Angola. Angolan Waters (which includes the Pululu Channel and the waters adjacent to the port), are under the control of the Harbour Master who acts with the authority of the Ministry of Transport, and has the authority to grant or deny entry into such Angolan Waters and / or Pululu Channel. Port Waters including Anchorages are also under the control of the Harbour Master. 4 Background The Port was originally intended as a logistics base for the Oil and Gas Industry, to accommodate Supply Vessels. It has now expanded to accommodate Freighters. Additional development is being executed, or are planned that will further expand the facilities to accommodate the volume of traffic entering the Port. During August 2008 to July 2009 (1 year), a total of 574,342 tonnes of General Cargo and 6634 TEU Laden containers were handled by the port. During the 6 month period August 2008 to July 2009 a total of 1357 vessels (about 226 / Month) of which 129 were Freighters (Average about 22 /Month) were handled, the other main type of vessels being Off-Shore Supply Boats (35 to 85 meter in length. 5 Contact Details Kwanda Port General Contact Kwanda.Port@Saipem-sa.com Kwanda Port Radio Control : VHF Channel : Ch 77 Included in Kwanda Port Kwanda Base Office Radio Operator: , Port Manager Extension 123 Transport Coordinator Extension 120 Administrative Coordinator(Invoicing) Extension 124 Operations Coordinator (ALNG) Extension 125 Nautical Coordinator Extension 128 Technical & Opearations Coordinator Extension General Information 6.1 Water Density Varies between Fresh Water and 1.013, due to the influence of the Tides and the flow of the River Congo. It is recommended that be taken for Draft estimation purposes. 6.2 Port Time = GMT + 1 Administration Office Working Hours : Monday to Friday 0800 to 1700 Hrs. Saturday 0800 to 1200 Hrs. Sundays and Angolan Govt. Public Holidays : Administration Office Closed 6.3 Base Law As per Harbour Master s Directive: All crafts navigating within the boundaries of the Port of Soyo are bound to comply with Angolan Maritime Law and to navigate in compliance with the International Rules for the Prevention of Collision at Sea. 6.4 Tide Levels Mean spring range about 1.4 meter and mean neap range about 0.6 meter. Chart Datum is considered as LAT -0.1m. Quay Height is 2.6meter above Chart Datum.

Notices Requirements: Notices are a requirement even in the case that the vessel is not expected to berth at Kwanda (e.g. arriving for repair and/or clearance purposes). Channel fee is levied from all vessels passing the Pululu Channel irrespective whether berthing at Kwanda Port or not. 7.1 Notice Timing Advance notice of arrival shall be given to Kwanda by the Agent, 30, 15, 10, 7, 5, 3, 2 day, and 24Hr. (Firm) prior to ETA. Vessels are requested to copy any notices passed to the Agent by directly to Kwanda.Port@Saipem-sa.com with further copies to Kwanda.HSE@saipem-sa.com and Kwandaport.PFSO@Saipem-sa.com 7.2 Notice Contents The 1 st notice shall contain the following information (Irrespective of the type of vessel / Trade): 1. Name of vessel, 2. Vessel Particulars and General profile (if 1 st time caller, preferably including a photograph). In case of Tug + Barge Convoys, particulars of the Tug & the barge should be provided. 3. Maximum arrival Draft in Fresh Water 4. ETA at the Outer Anchorage or in case of supply boats and similar small craft, ETA at Pululu Channel Entrance Buoys 6. Full Style of (Local) Shipping Agent of the vessel 7. Purpose of call 8. Availability of Thrusters (Bow/Stern)

9 PAGE: 9/ The 7 day notice shall contain the following information (Irrespective of the type of vessel / Trade): 1. Name of vessel 2. ETA 3. Cargo Manifest (Standard IMO Format) including for Liquid Bulk. Cargo lists are not acceptable for cargo to be discharged. 4. IMDG Cargo Manifest (Standard IMO Format) (See Annex). 5. Detailed and accurate stowage plan of cargo to be discharged and / or Loaded. 6. Special discharging instructions if any (preferably with photographs) including availability of special discharging gear on board. 7. List of cargo of Gross weight over 42 tonnes, List of over sized cargo and/or Special cargo. 8. If applicable List of containers to be re-stowed (see note below). 9. ISPS Declaration Angolan Government Format (See Paragraph 27 and annex 6). 10. If applicable - Designated lay-down area of the cargo (in the consignee s reception area including plan) Any vessel arriving at the Pilot station without notice, may incur up-to a 48 hr delay, to be included in the berthing programme. (See further details reference Port Documentation Requirements ) The Port requires knowing the Gross Weight and dimensions of each individual package. This includes Gross Weights of individual (ISO) Containers. Unless the Manifest indicates such, a separate list indicating above, (giving the reference to the B/L or item No. in the Manifest) should accompany the manifest. View the demand for available port facilities, Re-stow of containers is severely discouraged and may be refused unless prior approval has been obtained from the Management. To consider acceptance, for Safety reasons, a detailed list to be sent (with ID Numbers, GW, Contents) and whether they are to be re-stowed via Quay or Via Shore. Agents are solely responsible for declaration of such cargo to Government Authorities before landing ashore. Landing of any material onto the quay (including Hatch Pontoons) from the vessel is severely discouraged and if essential to reach the cargo to be discharged, prior approval should be obtained from Kwanda. Charges may apply for utilisation of quay space. As per Customs requirements, the Manifest should be stamped by the Customs and a copy of the stamped Manifest to be presented to Kwanda Port (Documentation Supervisor), 24 Hrs. before vessel s ETA. 7.3 Form of Notices All Notices shall be by . It will not be sufficient to give notice only by VHF. These notices are not a substitute for, and is in addition to the Information of Ship Demanding Entrance in Angolan Waters, as required by the Ministry of Transport. Freighters : Documentation should be received within Administration Office working Hours (see 6.2) Supply Boats : Delays may occur if Documentation is not received within Administration Office working Hours. 8 Port Documentation Requirement For cargo to be discharged Un-manifested cargo may not be accepted for discharge unless a letter of guarantee accepting responsibility is provided by the Agents. Descriptions of cargo in documentation should be given in Metric Units. Vessel may not be allowed to berth at Kwanda Port, if Port documentation requirements are not complied with. If receipt of these documents is delayed, subject vessel may have to remain at anchor while documentation procedure is completed and the vessel can be included in the berthing program. All stated conditions are applicable to discharge of Liquid Bulk to reception facilities or Trucks as well. 8.1 Pre Arrival Documentation Freighters In order to be included in the berthing program, for vessels with short sea voyages, the Agent shall at least 72 hours before vessel arrival, submit by , the information as detailed in paragraph to with further copies to and Kwanda.Port@Saipem-sa.com Kwanda.HSE@saipem-sa.com Kwandaport.PFSO@Saipem-sa.com

10 PAGE: 10/35 Supply boats with exclusive berths Manifests to be delivered preferably at least 24 Hrs. prior vessel s arrival to Kwanda.Port@Saipem-sa.com with further copies to Kwanda.HSE@saipem-sa.com and Kwandaport.PFSO@Saipem-sa.com While KPC may permit a vessel to berth at exclusive berth, no Cargo work will commence, until manifests are received by Kwanda and processed. If a vessel of an operator with an exclusive berth needs to berth at another berth due to operational requirements, normal tariffs will apply. Other Supply boats Manifests to be delivered preferably at least 24 Hrs. prior vessel s arrival. to Kwanda.Port@Saipem-sa.com with further copies to Kwanda.HSE@saipem-sa.com and Kwandaport.PFSO@Saipem-sa.com 8.2 Exceptions In case of Freighters on Feeder Services or Supply boats coming from off-shore projects, with voyage time of less than 24 Hours and where the manifests for cargo on board are hand carried by the Master/Captain/Skipper of the subject vessel, the manifest and the arrival notice may be ed by the vessel, directly to Kwanda Port. For vessels not equipped with , an application may be made by the vessel's agent with notice of arrival (sent by as stated above), stating that the manifests will be sent by to Kwanda as soon as vessel is berthed and requesting to arrange berthing. The hand carried documents shall be scanned and ed upon arrival. Address and copies, as above. In case above is not possible, five sets of copies of the documents to be delivered to Administration Department and acknowledgement received on a copy (Stamped, Name indicated and signed). Hand carried documents will be accepted only during Office hours ( see paragraph 6.2 ) 9 IMO Cargo (Dangerous Goods) All vessels shall Comply with all IMO requirements, and the latest revision of such other requirements of Kwanda and the Kwanda Port Authority as are from time to time in place. The IMDG Declaration (as stated in paragraph and as per Annex 7) should be sent by to: Kwanda.Port@Saipem-sa.com with further copies to Kwanda.HSE@saipem-sa.com and Kwandaport.PFSO@Saipem-sa.com The list should include any cargo to be re-stowed on board and via quay. In case there is no IMDG cargo on board, a message should be sent indicating IMDG Cargo : Nil See Paragraph 27 regarding ISPS Declaration. 10 Documentation for Cargo to be Loaded 10.1 General Conditions for all Vessels Similar to the requirements for cargo to be discharged, including declaration of IMDG Cargo. As per Customs requirement, the Load List / Manifest should be stamped by the Customs and a stamped copy to be presented to Kwanda Port (Documentation Supervisor), before commencement of loading. This is applicable to loading of Liquid Bulk from reception facilities or Trucks as well. Descriptions of cargo in documentation should be given in Metric Units.

11 PAGE: 11/35 Freighters at least 48 Hrs. before the vessel s ETA, all relevant cargo documents including the Provisional Cargo Manifests shall be submitted to Kwanda by . This is applicable to Empty containers as well. to Kwanda.Port@Saipem-sa.com and Kwanda.HSE@saipem-sa.com For Containerized Cargo, the Agents should ensure that the containers to be loaded are physically in the port Container Yard, before submitting the loading list. For Empty containers listed for loading - It is the responsibility of the Agent of the vessel to ensure that they are cleaned (and sealed if so required) prior delivery to the loading quay side. Freighters whose consignees of cargo are not registered with Kwanda Lda. A Service Order Client (see paragraph 10.2) is required to operate vessels whose consignees of cargo are not registered with Kwanda Lda. (As is common in Coastal Trade Vessels). The service order will be executed, only on receipt of pre-payment, based on the manifested cargo and Kwanda Lda Price List. Supply Boats (including those of clients with exclusive berths) Documents should be submitted at least 24 Hrs. before intended loading. In case of last minute shipments, the shipper/agent/operator shall inform Kwanda as soon as possible and in any case before the entrance of the cargo in the ISPS port area. This should be carried out by transmitting an addendum to the Provisional Cargo Manifests. to and Kwanda.Port@Saipem-sa.com Kwanda.HSE@saipem-sa.com For Containerized Cargo, the Agents should ensure that the subject containers are physically in the port Container Yard, before submitting the loading list. Cargo work will not commence, until such time that Manifests are received by the Kwanda and processed. This is applicable to loading of Liquid Bulk from reception facilities or Trucks as well Documentation Requirement for Yard Operations and Port Tug assistance For operations in Clients yards, unless the cargo is handled for loading / discharging operation of a vessel (including supply boats), a Kwanda ltd Service Order Client shall be completed and delivered by hand to the Documentation Section, Kwanda Port. This is applicable to vessels whose consignees of cargo are not registered with Kwanda Lda. (As is common in Coastal Trade Vessels) as well. In this case, the service order will be executed, only on receipt of pre-payment, based on the manifested cargo and Kwanda Lda Price List. In case the requirement is for assistance of the Port Tug, it shall be handed over to the Nautical Department. The Service Order shall detail: Description of the Work Schedule Remarks Details of the Work, Location of the cargo and list of required machinery (Or the Port Tug, in case of a tow) Date and time the machinery (or the Tug, if applicable) is required and the estimated duration Name and Contact of yard s responsible Personnel. To include Phone and Kwanda Radio Trunking Number if applicable In normal course of business Kwanda Lda will invoice the party requesting the Work. If the invoice is to be to some other party then this party must be clearly identified in the remarks, which shall detail the full name and trading address of the party to be invoiced. When the Service Order is received by the Nautical Dept., it will be signed and the client s copy returned. 11 Post Arrival Procedure 11.1 Requirement for Vessel

12 PAGE: 12/35 Tally documents shall be presented for signature by port tally to vessel s cargo officer. It is a requirement that these documents be signed and stamped by the ship s officer (with remarks if any). (Tally documents include: Record of Operations, Tally reports shift basis, Cargo damage reports, Short / Over-lading report and Final tally, time - S.O.F etc.) Special notes to Agents It is the responsibility of the agents to 1. Provide a Statement of Facts (S.O.F.) signed by the Master of the Vessel and the Agent, for all Freighter operations. This S.O.F. shall be handed over to the Documentation section, prior vessel s departure. 2. Confirm with Kwanda Port Documentation Department, whether documentation requirements of the port have been complied with prior to delivery of clearance documents and arranging of Pilot to the relevant vessel. Vessel may not be permitted to sail, if port documentation procedures are not complied with. 12 Communication and reporting 12.1 Overview of communications 1. Angolan waters (which includes the Pululu Channel and the waters adjacent to the port), are under the control of the Harbour Master.The Harbour Master has the authority to grant or deny entry into Angolan Waters and/or Pululu Channel. The Maritime Police (MP Control) operate under the authority of the Harbour Master and controls the maritime traffic in port access channel and port waters. Kwanda Lda. manages port operations. Therefore authorization from both these parties is required before any movement inwards or outwards. 2. Communication with Kwanda Port Control and MP Control should be either in Portuguese or English Language. 3. From the time of arrival off Kwanda Roads, including the time the vessel is at anchor or alongside, a continuous watch on VHF Channels 77 and 16 shall be maintained. 4. All movements of vessels within port waters have to be carried out only after permission has been granted by MP Control. The Vessel shall report such movement to Kwanda Port Control (on VHF Ch.77) 5. Kwanda as the operators of the Port shall decide on the Berthing allocation. All land areas within the port, including berths / Quays /storage areas, fall within their jurisdiction. 6. Kwanda coordinates with MP control regarding allocation of berths and berthing of vessels. 7. Pilotage is operated under the authority of the Harbour Master. (Pilot Boat also operated under the authority of the Harbour Master). 8. Port Tugs operate under the management of Kwanda Lda. 9. 13 PAGE: 13/35 13 Registration for Berthing and Reporting requirements All vessels are required to register with Kwanda Port Control, Irrespective of Trade (International or Coastal / Cabotage), the size of vessel, or type of vessel in order to be included in the arrival schedule and berthing schedule. Reporting is a requirement even in the case that the vessel is not expected to berth at Kwanda (e.g. arriving for repair and/or clearance purposes). Channel fee is levied from all vessels passing the Pululu Channel Registration Procedure 13.2 Freighters & Tankers (Including Chemical/Product Tankers) 1. When within VHF range, vessel shall report to Kwanda on Ch. 77, and advice ETA off Ponta Padrao. 2. On approaching Outer anchorage (Off Ponta da Moita Seca or Ponta Padrao), vessel shall contact Maritime Police, (Call MP Control'), on VHF Ch. 16, and obtain permission to anchor. 3. On anchoring, vessel shall report to 'MP Control' on VHF Ch. 16 and Kwanda on Ch. 77, to register. (Calling Kwanda Port is important as all vessels for Commercial Operations will be berthed on a First Come ~ First Served basis, unless there is a berthing priority decided by the Kwanda Port Management). 4. If the arriving vessel has completed pre-berthing documentation procedure and Kwanda has confirmed to the vessel on VHF Ch. 77 that the berth allocated for the subject vessel is free, the vessel shall request MP control for clearance to enter the Pululu channel and berth, even-though the vessel has not dropped anchor at outer anchorage. Vessels are deemed have arrived and the time is considered to be arrival time when the vessel reports either: Anchored off Ponta da Moita Seca ( S, E) or off Ponta Padrão or If permission has been granted by MPcontrol to enter the Pululu channel without anchoring: when passing the 1 st set of Buoys (E2, E3) inwards. Vessels requesting a berth other than for Commercial activities (e.g. Crew change, Passengers, Port Clearance etc.) will have least berthing priority and will not be included in the 1 st come 1 st Served scheme. For such vessels, a Berth will be provided only if there are no vessels awaiting berth for Commercial Activities. Any lay-time related to Kwanda shall exclude the following: 1. from the time of arrival to the time of 1 st Daylight High-water. 2. from the time of commencement of heaving up of anchor to approach for Pilot, to the time of Clearance by authorities, once at berth. (This includes time of transit in the Pululu Channel) 13.3 Registering and Reporting requirement to Kwanda by All other Vessels Supply Boats (Including vessels with exclusive berths), Crew Boats, Passenger Boats, Tugs (with or without tows), Tankers and Coastal craft berthing at Commercial Quay etc. shall inform Kwanda on VHF Ch. 77 and MP Control on VHF Ch. 16 as follows 1. At least 1 Hour Before entering the Pululu Channel or when within VHF range at the earliest. 2. On Entering Pululu Channel and leaving it 3. On anchoring at inner/outer anchorage and/or on berthing (all fast). Time of arrival (for registration for berthing) is taken as when the vessel reports on VHF Ch. 77 of either anchoring at Outer Anchorage or when passing the 1 st set of Buoys (E2, E3) inwards General Unless a berth has been allocated by Kwanda, the vessel has to either anchor at outer anchorage or proceed to inner anchorage once permission has been granted by MP Control. Due to the limited availability of berthing space, Agents are strongly advised not to request for a berth, unless the cargo is ready for loading and/or Discharging (or Embarkation / Disembarkation of personnel, if this is the case). All vessels calling at Kwanda (irrespective of Type / Size of vessel) should be equipped with a suitable anchor(s) to enable them to remain at anchor to await berth. In addition, for Barges, it is recommended that they be equipped with winches capable of handling the anchors and to aid safe mooring alongside.

14 PAGE: 14/35 In principle, vessels are not allowed to stay alongside without any cargo work / Passenger embarking ~ disembarking being effectively carried out. This is optimise usage of quays and to minimise losses caused to all parties concerned, due to a vessel having to wait at anchor, awaiting a berth. Thus, Penalties may be applicable for vessel(s) idling at a berth. Unless Port clearance is arranged by the Agent within 1 Hour of completing cargo work and port documentation, the vessel will have to arrange to proceed to anchorage (In case of a freighter or a Barge, she may wait till 1 st Daylight High-water and availability of Pilot to proceed to Outer Anchorage) and the respective agent shall arrange deliver the clearance to the vessel. Penalties may be applicable for such delays. 14 Information required by MP Control Intended movement of any vessel within Kwanda waters shall be notified by VHF to MP Control Arrival Information: 1. Name of vessel, Port of Registry, IMO number 2. Name of Shipping Agent of the vessel 3. ETA at the Pululu Channel Entry Buoys or Outer Anchorage 4. Maximum Arrival Draft in FW 5. Last Port of Call 6. IMDG Declaration (amount in Kg, by IMO class) to Discharge and in Transit 7. Any Manoeuvring Restrictions or Apparent Damages to the Vessel, its Equipment and / or Cargo, which may affect safe navigation or safe operation of the vessel. 8. Any Irregularities 14.2 Departure Three hours before departure from Kwanda Port and with confirmation one hour prior to departure, the following information shall be communicated to MP Control, 1. Name of the Vessel 2. Estimated Time of Departure (ETD) 3. Maximum Draft FW and SW 4. Next Port of Call 5. Any other Relevant Information 15 Information Required by Kwanda Intended movement of any vessel within Kwanda waters shall be notified by VHF to Kwanda Port Control Arrival Information: 1. Name of vessel, 2. LOA 3. Maximum arrival Draft in Fresh Water 4. Type of vessel 5. ETA at the Outer Anchorage or in case of supply boats and similar small craft, ETA at Pululu Channel Entrance Buoys 6. Name of Shipping Agent of the vessel 7. Purpose of call 8. Availability of Thrusters (Bow/Stern) 9. Any Manoeuvring Restrictions or Apparent Damages to the Vessel, its Equipment and / or Cargo, that may affect safe navigation or safe operation of the vessel. 10. Any Irregularities 15.2 On entering the Pululu Channel: Report that vessel has entered the channel. Freighters to Inform Port Tug on VHF Ch.16 or 71 to confirm attendance and to establish working VHF channel On Berthing ~ Un-berthing / Anchoring ~ heaving up Anchor: Report to Kwanda the time that vessel has Berthed ~ un-berthed or Anchored ~ departed anchorage. All movements within Kwanda Port waters to be reported to Kwanda Port Control on VHF Ch.77, and MP Control.

(POB time is arranged by the vessel s agent). 1. Name of the Vessel 2. The time the Pilot is expected to board and Estimated Time of Departure (ETD) 3. Maximum sailing Draft in FW 4. Confirmation that Port Tug has been informed. Part III Port Description, Navigational & Other Information 16 Anchorages 16.1 Outer Anchorage. Deep water anchorage with good holding ground and sheltered from the Congo River flow, can be obtained West of Ponta da Moita Seca ( S, E) (Point A below). Mariners should take note of drilling rigs which may operate off this area, and the existence of under water pipe lines. Anchorage can be obtained West of Ponta Padrão ( S, E) (Point B below). However the effect of the Congo River is stronger at this location Inner Anchorage. It is prohibited to anchor any vessel within the dredged area of the Kwanda Turning basin. Extremities of this area is marked with buoys. Space is available beyond the outer limits of the Kwanda turning basin dredged area for vessels drawing less than 4.0 meter (in FW). Vessels drawing over 4.0 meter should not enter the Pululu channel, unless it has been confirmed by Kwanda that the allocated berth for the vessel is free. (This is especially applicable to vessels of over 90 meter in length, due to limited space for manoeuvring within the turning basin, unassisted by a tug). Permission by MP Control is required to enter the 'Pululu Channel' and anchor at the Inner Anchorage Overview of Outer Anchorage Above is for information only with acknowledgement to the copyright holder

16 PAGE: 16/ Berths 17.1 Details of Berths Kwanda Port has the following berths (All recommended drafts referred to, in Fresh Water) Main Quay (Mainly for Freighters) Length 220 meters, Draft Up-to 7.3 meters (Also referred to at times, by its previous name DLH Quay ) : : it is recommended that 75 Meter from the Northern End of the Quay (Marked by a white line on the quay near bollard No. 7) is kept free, for Supply boats to berth. Last bollard for the Stern lines is the bollard next to this white line (bollard No.7). Bollards in Slots 1,2 & 3 are rated as 20t and designed for supply boats. If a freighter of over 140 mtrs requires to berth at Main Quay with Slot 1 closed, only 1 mooring line each will be allowed in bollards of slots. Vessel has to make arrangements to lead a line from mid part of vessel to a bollard on the main quay, if a 3 rd mooring line is required. (See recommended mooring diagram given in Annex 8) Texaco(W) Quay Length 91.5 meter, Draft Up-to 7.3 meter : ENI Quay It is recommended that vessels are equipped with additional fenders. Length 120 meter, Draft Up-to 7.3 meter ALNG Quay North ALNG Quay South For Ro-Ro Vessels. Length 50 meter, Draft Up-to 7.3 meter Length 200 meter, Draft Up-to 7.3 meter Commercial Quay Length 200 meter, Draft Up-to 7.3 meter North 110 meter of quay (CQ North) Priority for Sonangol Tankers. When a tanker approaches the berth, MP control may require that the whole of Commercial quay is vacated of any craft. Vessels are berthed on condition that they vacate berth if the berth is required for a Sonangol Tanker. All costs involved due to such movements will be to vessel s account. South 90 meter of quay (CQ South) Priority for Petromar vessels. It is recommended that vessels are equipped with additional fenders. Slot 1 Slot 2 Slot 3 Texaco(E) Quay Length 44.5 Meter, Draft 6.0 meter (Exclusive for Schlumburger) Length 56.5 Meter, Draft 7.0 meter (Exclusive for Esso) Length 55.3 Meter, Draft 6.0 meter (Exclusive for Halliburton) Length 73.0 meter, Draft Up-to 7.3 meter 17.2 Pictorial Overview of Births

17 PAGE: 17/ Allocation of Births The following operators have exclusivity for supply boats at following berths: Schlumberger : Slot No.1 ESSO : Slot No.2 Halliburton : Slot No.3 These vessels/operators are not exempt from giving Notice of arrival at Kwanda Port and are required to give as much advance notice as possible and the specific arrival notices applicable to these vessels as detailed above. While Kwanda reserves the right to allocate berthing priorities, efforts will be made to allocate births on a 1 st come 1 st served basis. the above mentioned operators have exclusivity only for the given berths. If a 2 nd vessel for the same operator arrives, a berth will be allocated for the 2 nd vessel on a 1 st come 1 st served basis and normal tariffs will apply. 18 Approaches The wreck which was existing off the Commercial Quay was removed and dredging of the area of the Kwanda basin (Marked by buoys) to 7.5m in depth was completed in May Access Channel 18.2 Currents Entry to Port is through Pululu Channel - Marked by buoys. (Buoy numbers are not marked on the buoys) Dredging to 200 meter width and to 7.5m depth at LAT has been completed in August Liable to silting caused by strong flow of Congo River. Extracts from few Safety Notices as of the date of issue of this Criterion, is annexed herewith. Up-to date copies of the Safety Notices are issued to known Agents as appropriate. There is a strong West to WNW stream that is prevalent at the Northern entrance resulting in strong set towards the Ponta Padrão ( S, E). These steams are said to be influenced heavily by the rain fall in the upper reaches of the river. It has been reported by ship Masters that Westerly Cross currents estimated to be up-to 8 knots or more and resulting in a set of up-to 40 when entering the channel has been encountered at times, in this area. These effects are more pronounced for Tug-Barge convoys at the entrance to the channel. Mariners are advised to navigate with caution and maintain a safe navigating speed that provides adequate steerage, taking into account the draft of the vessel and its length. When transiting the Channel, allowance for Squat should also be taken into consideration. As per reports received from Masters of vessels, the strong Westerly set between1st set of buoys(e2, E3) and 3 rd set of buoys (SC3,SC4); is strongest at 1 st set of buoys and begins to reduce from 3 rd set of buoys; and by last set of buoys (KB1,KB2), is almost nil. Flood and Ebb tidal flows within the Kwanda Basin are quite strong (Est. 5 kts or more at times at some locations) but it has been reported that there is very little movement in tidal flow between ± 1 Hr. from HW and LW. Direction of tidal flow is approximately in the direction of the channel at the Southern end of the Channel Currents and Lengths of vessels intending to berth at Kwanda Port Attention is drawn to the fact that currents (estimated at 5 knots or more at times, the effects of which may be enhanced by prevailing winds) within the Kwanda Basin and the limitations caused by the area available for manoeuvring to and from the berth including for turning a vessel are among the main determining factors when deciding on the length of a vessel at a particular berth, in addition to the length of a quay and proximity to other dangers. The widths available for turning off the quays are about:

18 PAGE: 18/35 Main Quay : 450 meters Texaco Quay : 275 Meters ALNG Quay : 350 Meters 18.4 Time of entering the Pululu Channel Vessels drawing over 7.0 meter draft (FW) are recommended entry / departure only at High Water and Only in Daylight Hours. Tugs with tows are recommended transit in Pululu Channel only in Daylight hours Transiting the Pululu Channel As per the directive of the Harbour Master, Port of Soyo, Govt. of Angola, Vessels should maintain a safe speed at all times when transiting the Pululu Channel and within the Port waters. Vessels should take all action to ensure that they do not threaten or endanger small fishing craft that are transiting or fishing close to the Pululu Channel. It is forbidden for two vessels to be in the Pululu Channel at the same time. 19 Pilots As detailed herein, Pilotage (Including the Pilot Boat) operates under the authority of the Harbour Master. Pilotage is compulsory for all vessels, unless exempted by the Harbour Master. Pilots are available during Day Light hours. Pilots shall be arranged by the vessel s agent. (Pilots shall be paid for, whether used or not.) Pilot usually boards from a small boat off the 1 st set of buoys, about 1nm to 1.5nm NE off the 1 st Red buoy and usually about 1 to 2 Hrs. before HW. (Approximate boarding position S, E). However, the specific boarding position and time to be obtained from MP control, for each vessel. The Master of the vessel is responsible for safe Navigation of the vessel at all times, whether under the guidance of a Pilot or Not. The vessel will be liable for any damage caused by the vessel to port structures including Buoyage. 20 Tugs (This section to be read in conjunction with the relevant annex) General Information Two tugs with a bollard pull of 28 tons each are available for assistance. Tug shall be given 1 hrs. notice prior to vessel movement. Notice can be arranged through Agents or Directly by vessel. The Tugs Maintain watch on Ch.16 and 71. A 52 ton Bollard pull tug is available to assist vessels with cargo for the ALNG Project. In case this tug is used by vessel(s) not carrying ALNG Cargo, an hourly rate is chargable, as per the Port tariff. (See 20.2 below) For Freighters Tug attends from the last pair of buoys on arrival (SC5/SC6) or at the berth on departure. Tug usage is compulsory (for safety reasons) and payment will be levied whether used or not (see 20.2 below). Even if the vessel has thrusters, it is recommended that the tug be kept on stand-by for safety. Port Tugs are not permitted to carry Passengers due to Legal implications Payment for tug use Freighters and Supply Boats Tows and other special operations paid for by the Consignees of Cargo, through a Tug Surcharge based on the monthly tonnage of cargo loaded / discharged in the port. As per the Kwanda port tariff, depending on the type of operation.

19 PAGE: 19/35 Freighters without ALNG Project cargo 21 Vessels Engaged in Towing Operations. If the 52t bollard pull tug is used, charge applicable as per tariff for special operations As per Harbour Master s directive, towing operations within the confines of the Port of Soyo are only permitted to be executed by experienced tug masters. Tug Masters shall remain responsible and accountable for the tug and the towed object and shall ensure that they do not threaten or endanger any vessels anchored or moored in the Port. Further, the tug shall manoeuvre the tow in such a manner that it is kept well clear of the channel buoyage. It is recommended that for vessels with the tow astern, the length of tow wire to be reduced to the minimum safe length, when entering the Pululu channel (so that there is lower probability that the tow will drift in the cross currents). Inexperienced Shipmasters who wish to enter the port with objects in tow shall call on the services of the Port of Soyo Pilotage. For all tows, use of the Port Tug for assistance is Compulsory for safety reasons (due to the strong cross currents at times making the towing object uncontrollable in the channel). It is imperative that Kwanda is advised of the tow, by the towing vessel, at least 1 hour before entering the channel, so that the Tug can be kept on standby, ready to assist. Tug attends from the 1 st pair of buoys on arrival (E2/E3) to berth (or Anchorage as applicable) and from the berth (or Anchorage as applicable) to 1 st pair of buoys on departure. For large barges and those with heavy cargo, it is recommended that services of a 2 nd Port Tug be requested. (See 18.2) The requirement for Port Tug assistance is compulsory for safety reasons, even if the tow is assisted by a second (Private) tug and will be invoiced accordingly. The Vessel's Agent should request for tug assistance from Kwanda Port, by submission of a Service Order to the Kwanda Nautical Department at least 1 Day in advance of the intended operation. (See item 10.2 for details of completion of the Service Order). Tugs with tows are recommended transit of Pululu Channel only in Daylight hours. The Master of the Tug (of the tow) is responsible for safe Navigation of the vessels at all times, whether under the guidance of a Pilot /assisted by the port tug, or Not. The vessel will be liable for any damage caused by the vessel(s) to port structures including Buoyage. When in Kwanda waters, view the strong currents (the effects of which may be enhanced due to prevailing wind conditions), for safety reasons, the Tug which is accompanying the Barge should remain attached to the barge and ready to manoeuvre at short notice at All times, even if the barge is moored alongside a quay/vessel or is at inner anchorage. 22 Navigation in restricted visibility The Harbour Master considers Restricted visibility to be when the horizontal visible distance is less than 200 meters. In restricted visibility, traffic is not permitted to navigate within the Pululu Channel; except in cases of absolute necessity and where permission has been granted by the Port of Soyo Control (MP Control). This restriction applies to all vessels. 23. Size of Vessels Draft : Maximum Recommended Draft = 7.3 Meters in Fresh Water in the Pululu Channel and dredged area of the port waters. Length (LOA) : The Port Authority / Harbour Master has no objections for the entry of vessels up to 170m LOA at the port of Soyo. In order to ensure a safe maneuver to and from berth, the maximum size / length of vessels accessing the Kwanda Port at any time needs to take into account and suit to the following constraints among which some can and do vary from day to day, and season to season: - tidal currents, - turning basins dimensions respectively 450/275/350m in front of Main/Texaco/ALNG & Commercial quay, - bollard pull of the port tugs, - season and corresponding winds and rain fall, - vessel's particulars and capabilities considering among others the power of the main engines, bow-thruster(s), draft, air-draft, manoeuvring characteristics etc. - characteristics of the quays.

20 PAGE: 20/35 To allow optimum use of available berths and to minimise constraints to berthing, it is recommended that the LOA of vessels to be operated at non-fully dedicated quays should not exceed: Main Quay : 150 Meters Commercial Quay : 140 Meters Texaco Quay : 100 Meters. The ALNG Quay is for the exclusive use of ALNG project vessels, and vessels up to the Port maximum of 170m are allowed, provided that there is full compliance with the recommended criteria as stated in the guidelines. The ENI Quay is for the exclusive use of ENI project vessels. 24 Berthing Mooring Gang and Supervisor is supplied by Kwanda. At least 1 Hours notice shall be given to Kwanda on VHF Ch. 77, to arrange for the mooring gang. Notice should be arranged through the agents / Operator. When Cargo vessels Berth / Un-berth from Kwanda Main Quay and if vessels are berthed in slots 1, 2 and 3 with bows out and at Main Quay North, for safety reasons, the Pilot may require these vessels to vacate berth until the manoeuvre is completed. If vacating of slots are required in Pilot s opinion, agent, shall ensure through MP control, that these slots and any crafts (Supply boats) moored in the Main Quay North area, are vacated in advance. At least 1 Hours notice of expected POB time shall be given by the Agent to Kwanda Port (on VHF 77) and to the vessels concerned (through MP Control), so that cargo operations at the subject vessels can be stopped and the vessels readied to clear the manoeuvring area, in time. 25 Port Equipment (to be read in conjunction with paragraph 26.3): Various mobile cranes of up-to 100t capacity are available to aid discharge of Special / Heavy Lift cargo (see 26.1). However, it is required that all freighters are equipped with own gear with sufficient load /rate capacity, capable of handling cargo to be discharged / Loaded at Kwanda. Payment is applicable as per port tariff, if shore cranes are used. Various ancillary equipment such as Fork Lifts (Various capacities), Trucks/ Trailers etc. is also available. Port has no equipment to discharge/handle Dry Bulk cargo. 26 Cargo Recommendations: Cargo should be stowed in such a manner that the Port Stevedores have safe access at all times for handling the cargo. This includes safe footing and adequate lighting. In case of Bagged Cargo, it is the responsibility of the Consignee to ensure supply of empty bags, to enable collection of spillage if any Special / Heavy lift Cargo : Any single package of over 20 tonnes gross weight is deemed to be Heavy Lift Cargo. For cargoes of 42 metric tonnes and over, Confirmation of facilities available for discharge and prior approval is to be obtained from the Port Management (By shipper / Operator of vessel), prior to accepting of such cargo for shipment to Kwanda Port General Cargo (to be read in conjunction with paragraph 26.3): Unless the following recommendations are adhered to, excessive delays can be expected for cargo discharge. All practicable cargo (e.g. Pipes / Bundles of pipes, Boxes of 1 M 3 or more) should be pre-slung. If so required, crew will be allowed to collect the slings to be returned to the vessel after cargo is discharged on to the quay. As an alternative, cargo should be palletised and stowed in such a manner that they are reachable by (small) fork lift or can be easily slung. Any cargo in small packages (e.g. In 50kg bags or small boxes) should be palletized or packaged and pre- Slung. If there is no direct access by crane / derrick hook to cargo, they should be movable to such location by fork lift.

21 PAGE: 21/35 For cargo in Super bags/big Bags (usually of 1 to 1.5t each), vessels should be equipped with cargo gear of at least SWL of 10 tonne each, so that a spreader beam can be used to aid discharge. Cutting/Removing and/or welding/securing of Sea Fastenings Kwanda Port does no provide this facility. It is recommended that this be carried out by ship s crew, as facilities for such operations are very limited and usually results in excessive delays, if carried out by external contractors. The following should be taken into account for cargo to be discharged and loaded: Kwanda Port Area should not be considered a storage area for Cargo. For Cargo to be Discharged : Client s yard should be available for direct delivery from Port, specially for large parcels. Berthing may be delayed until such time the Port Management evaluates and decides that the receiver s yard is ready and suitable to accept the cargo. Any adverse consequences and costs involved due to the client s yard not being ready to accept the cargo, will be to client s account. For Cargo to be Loaded : Preferable if storage time within the port be limited to a maximum of 24 Hrs. before intended time of loading. Storing of discharged cargo in the port is at the discretion of the Port Management and is severely discouraged. However, if the management decides to accept such cargo, if storage time exceeds 72 hours due to non readiness of yard space of receiver, charges would be levied as per tariff. Special for Supply Boats : Once the location of berthing has been decided, cargos to be loaded to be made ready in a staging area near the quay, in consultation with the Operations Dept. Quay Coordinator. This should be done within 24 Hrs. of vessel s expected time of berthing (ETB) obtained from the port General Cargo Freighters - Special clause: The notice given in Annex 3 is applicable unless a special agreement has been reached with the Port Management. Attention is drawn to the fact that All Cargo Vessels calling at Kwanda are expected to be equipped with their own gear capable of discharging the cargo which is being carried on board, at the rates of discharge given in Annex 3. If the standard rates of discharge are not achievable due to reasons attributed to vessel s cargo gear, Shore cranes may be used,chargable as per port tariff. If a vessel has to be shifted due to operational reasons, all charges involved will be to vessel s account Cargo in Barges and Landing craft: Unless agreement has been reached with the management to discharge cargo by shore cranes, Barges and landing craft should be geared. If carrying Dry Bulk cargo, cargo should be able to be discharged via a ramp / Conveyor belt. In such a case, it is the responsibility of the consignee, to arrange discharge and delivery. Crafts with such bulk cargo will be berthed on condition that any cargo spillage and residue on the quay and the roads within the Kwanda Base through which the cargo is transported is cleared immediately. : Kwanda Port has no facilities to provide gangways Refrigerated Containers Kwanda Port does not provide facilities for plugging in or maintenance of Refrigerated containers discharged from Vessels (or to be loaded to vessels) and will not accept liability for damage to cargo if any, due to none plugging in of Reefer containers. It is the responsibility of the Receiver to maintain temperatures of Refrigerated Cargo from the time of discharge from a vessel. Refrigerated containers will be accepted for discharged from a vessel on condition that the Receiver shall be ready to accept direct delivery of such Containers. 27. Security / ISPS Requirements (This section to be read in conjunction with the annexes hereto). Kwanda Port is ISPS Compliant. Vessels shall send the Angolan Govt. Form given in Annex 6 duly filled. (In case the vessel is unable to send attachments by , the details as stated in the document should be sent as text). Ship Master shall declare dangerous goods to be discharged and in Transit as per IMDG Code. (see Paragraph 9)

22 PAGE: 22/35 Documents to be ed to: with further copy to All crew are required to wear Identity cards (Containing his/her photograph and rank) when out of the vessel s accommodation. It is required that a gangway watch be kept by ship s crew at all times. (Watchmen are not provided by the port). 28 Loading, discharging and transit of dangerous goods (See paragraph 9.0) Loading, Discharging and Transit of dangerous goods is subject to specific procedures which are available from Kwanda upon request. The Receiver shall make arrangements for immediate reception of IMDG Cargo, on discharge from a vessel. 29 Shore Leave, Crew Change / Passengers: 29.1 Shore Leave Within the Base Permitted. To be arranged through the Agents / Immigration. A Crew List Signed/Stamped by the Master should be given to Port Security at the gate. The Crew must carry an Identity document containing the concerned crew member s photograph. Any goods purchased by the crew (out side the port ISPS Area) shall be deposited at the Main gate (Port North Gate) security cabin. A responsible officer from the vessel shall collect it from the gate Shore Leave Out of the Base Permitted. To be arranged through the Agents / Immigration Crew Change / Passengers : Possible through the agents. However vessels are not permitted to delay departure and lie idle at a berth, to await crew change / Arrival Departure of Passengers. Penalties may apply at port standard rate for idling (once cargo operations have been completed) at a berth. : List of Passengers and/or Sign-On/Off Crew, certified and Ink stamped by the Agent must be presented to Kwanda Port Security Officer at the gate. Charges applicable as per Port Tariff. 30 Repairs 30.1 Facilities for repairs Not Available. Kwanda will not provide berths for repairs of any craft. Penalties may apply at port standard rate for idling without cargo work, once cargo operations have been completed) at a berth Carrying out work on board Washing of Vessel (where wash water is discharged into Kwanda Waters), Painting, Welding, Immobilisation of Main Engine : Authorisation from Kwanda shall be obtained (for safety reasons) through the agents, before applying for authorisation from the Harbour Master. A fee (by Harbour Master) may be applicable for the permit. (It is prohibited to commence work / immobilise Main Engine(s) without authorisation). Penalties may apply at port standard rate for idling (once cargo operations have been completed) at a berth Cargo / Bunkering operations between vessels, within Port Waters : It is prohibited to carry out transfer of Cargo and / or Bunkers / oil products between vessels whilst at anchorage in port waters. If any transfer of fuel or oil products between vessels is to be carried out, the following must be adhered to. a. One of the vessels must be alongside a quay or permanently moored (e.g. repair facility barge) b. Permission must be obtained from MP Control.

23 PAGE: 23/35 c. Permission must be requested in writing / and obtained from Kwanda Port HSE Dept. Copy of such correspondence should be addressed to Kwanda Port d. It is the responsibility of the vessels concerned to ensure that all precautions against polluting of the Port and Port waters are taken and if any spillage, it is contained in the vessel. e. When requested by Kwanda Safety Department., it is the responsibility of the vessels concerned to ensure that bunker transfer operations are not commenced until an oil boom is placed by Kwanda Safety Dept around the vessels, to contain accidental spillage if any. f. Once authorised, such operation will be reported by the pumping vessel on VHF Ch.77 to Kwanda Port Control : connection, commencement / completion of pumping, disconnection and any incident, leakage, spillage, without delay. 31 Port Safety Rules Kwanda considers HSE (Health Safety & Environment) issues very seriously. The goal is to have zero LTI (Lost Time Incidents). 1- All vessels, irrespective of Size or Type (including Crew Boats ) are required to be manned and ready to manoeuvre at short notice at all times when at anchor or at berth alongside 2- The port requires that the following safety equipment be worn by all personnel (Including ships crew, visitors & Agents) when within the port area: a) Safety Helmet b) Safety Shoes d) Coverall / Overall c) Eye Protection glasses (where applicable) 3- A Red line has been drawn on the quay, 2 meter from the edge of the quay (Water side). A Life jacket must be worn by any person, when walking within the red line and the edge of the quay (water side) in the Port area, unless the area is protected by a guard rail. 4- A Safety Belt must be worn when working aloft, above 1.5 m from the deck. 32 Stevedores: 5- It is the responsibility of the Vessel s Captain to advice Port Stevedore Supervisor and Safety Supervisor of non Smoking and smoking areas onboard. 6- Vessel s accommodation ladder must be protected by a properly rigged safety net. (The net should extend from the top of the gangway to the end of the accommodation ladder). 7- The gangway and the nearby embarkation area should be well illuminated. 8- It is strictly forbidden throw garbage in port waters. This includes the Pululu Channel. 9- In case of any Oil, or chemical spill, the Port HSE department shall be advised immediately. 10- Keeping in mind that Kwanda is a tidal port with strong flows, mooring ropes must be tended to and the vessel kept safely alongside the quay at all times. It is prohibited to carry out cargo operations, unless the vessel is moored properly. 11- It is prohibited to discharge any liquid (including Cooling water) from the vessel on to the quay. Will be arranged by the Port Operations Coordinator. Port works all days of the year (There are no port holidays). As of August Two shifts - Day ; Night Hatch opening / closing / Cleaning, Un-lashing / Lashing of General Cargo and Containers - to be carried out by the ship s crew. Ship s Crew should ensure Cleanliness of holds/decks and adequate lighting for Safe access to cargo by stevedores at all times.

24 PAGE: 24/35 33 Fresh Water Available for Supply boats in limited quantities (as per 2008 tariff $ 30/tonne) and supply cannot be assured for vessels which do not have special agreements with Kwanda, for such supply. As such other vessels should not rely on replenishment of Fresh water from Kwanda. Not able to supply to Freighters due to other limitations. If sufficient stocks are available, delivery to supply boats may be arranged through pipe line at Main Quay (North). Agents to request supply by a Service Order Client, approved by the Kwanda Management and a copy each to be given to the Kwanda HSE Dept. and Nautical Department. Signature of approval by the Kwanda Management does not guarantee supply, since supply will depend on the availability of water in Kwanda Port Storage tanks and demand by vessels operated by clients who have signed special agreements with the Management. The quantity received by the vessel will be determined by the shore based a water meter. (applicable to vessels / operators that do not have special agreements with Kwanda, for FW supply): It is the responsibility of the Agent to arrange for Fresh water Supply to be carried out concurrently with Cargo operations. Vessels sailing will not be permitted to be delayed on account of receiving of Fresh water. Penalties may apply at port standard rate for idling (once cargo operations have been completed) at a berth. 34 Bunkers 34.1 Freighters : Bunkering of Freighters is not recommended since delivery time cannot be guaranteed. Therefore all freighters arriving at Kwanda are expected to have adequate bunkers on board. Agents are advised that unless bunkering can be arranged concurrently with cargo operations, not to agree for supplies. Penalties may apply for any delays due to bunkering at quay Supply Boats : For small craft, Gas Oil supply may be arranged by Road Tankers. Agents to request at least 3 days in advance of ETA of vessel directly from Kwanda Transit Department with copies to Nautical Department, Port Operations Manager and Port HSE Department. Arrangements can be made directly by Agents or through Kwanda Transit Department for Supply Boats to receive bunkers from Sonangol, at Commercial Quay. Bunkering of Supply Boats at Commercial Quay Additional requirements: Once arrangements for supply has been finalised, a request to arrange berthing shall be sent by to Kwanda Port, with the following information: a) Name of Vessel, LOA and Maximum draft in Fresh Water b) Intended quantity to bunker c) Time of intended supply (as per the supplier) Once the bunkering has been completed, the following should be notified to Kwanda Port: a) Actual time of Berthing b) Vessel Bunker report (Supplier s receipt), indicating the actual quantity of bunkers received c) Actual time of departure from berth. By-mail to: with copies to Kwanda.Port@Saipem-sa.com Kwanda.HSE@saipem-sa.com 35 Medical Kwanda Base Clinic Hospital is equipped to deal with Emergencies. Crew Medical Treatment - Arrangements to be made through the Agents. No Dental treatment facilities are available. (See Paragraph 40.1) 36 Pollution / Garbage The Angolan Government is a signatory to the MARPOL convention. All vessels calling at Kwanda Port shall comply with the International Regulations for the Prevention of Pollution At Sea. Ships waste may be collected on request to Kwanda. Request should be made by Agents to directly to Kwanda, through a Service Order, with a copy to Port Operations Manager. There are no facilities to discharge waste oil.

25 PAGE: 25/35 37 Supplies Provisions and other services Ship Chandler services are not available. However, suppliers Novagest, and Sodexho maintain warehouses for cold storage and dry provisions. Fresh vegetables, fruits, yams etc. are available at the local market in limited quantities. Arrangements for purchase should be made through the agents. (Exchange rate: Approximately 1 US$ = 75 Kwanza August 2009). US Dollars are generally accepted as payment. Life Rafts, Fire Extinguishers etc: Service Provider Stapem located in Kwanda base has informed that they are an approved service station for RFD, Viking, DSB, Zodiac and Dräger. They provide diving services as well and can be contacted on sosa@stapem-offshore.fr or through Kwanda Port. 38 Future Developments - Port A dedicated berth for small passenger craft is under consideration. 39 Safety Notices - Navigation: Safety Notices are issued by the port, distributed by to all known operators and agents and it is the responsibility of the Agents of respective vessels to promulgate the information to all parties concerned. 40 Emergency Contacts 40.1 Medical Call Kwanda Port on VHF Ch. 77 with information. They will contact Kwanda Base Radio, who will make necessary arrangements for the Doctor. The Agent of the vessel should present a Service Order Client to the clinic. Clearance Requirements As far as Kwanda Port is concerned, Kwanda Lda is a Stevedoring Company and the operator of the land based area of the port. Kwanda Lda is not the Port Authority. Agent has to obtain clearances from relevant authorities (Port Health, Customs, and Immigration etc.) and advise the vessel. 29 PAGE: 29/35 Annex 3 - Conditions applicable if a special agreement is not reached with the Port Management Notice to All Agents and Port Operators Requirements for Freighters intending to discharge cargo at Kwanda Due to excessive delays caused by improper loading of cargo including unsafe conditions on Freighters and to minimise delays at berth, the Port Management has decided to implement the following conditions for all Freighters arriving at Soyo / Kwanda with effect from 1st of September All freighters are required to be equipped with their own gear capable of discharging the cargo which is being carried on board, at the discharge rates given below. a. Containers : 2000t / 24 Hrs. (: Rate is in Tonnes) b. Super Bags (Big Bags of 1 to 1.5t each) : 1500t / 24 Hrs. c. Other Break bulk cargo : 1000t / 24 Hrs. 2. Any cargo not being capable of being discharged by their own gear shall be termed as Heavy Lift cargo in this context and approval from Kwanda Port Management is to be obtained prior accepting such cargo for shipment to Kwanda Port. 3. Discharging may be refused and vessel may have to vacate berth if the following conditions are not met. 1. All Freighters calling at Soyo / Kwanda with Super bags/big Bags (usually of 1 to 1.5t each), should be equipped with cargo gear at least of SWL 10 tonne each, so that a spreader beam can be used to aid discharge. (Vessel should demonstrate its ability) 2. All cargo including bagged cargo in small packages (e.g. in 50kg bags) should be palletized (in approximately 1 to 1.5 m 3 units) OR packaged (in approximately 1 to 1.5 m 3 units) 4. With effect from 1 st of January 2009, a 50% surcharge on Stevedoring Tariff and mooring fees will be levied if the following conditions are not met: All cargo (Specially Pipes / Bundles of pipes, Beams, Pallets, Crates and similar cargo) should be pre-slung and stowed in such a manner that they either have direct access by hook or are reachable by fork lift. If so required, crew will be allowed to collect the slings to be returned to the vessel after cargo is discharged on to the quay. Loading of such cargo on surfaces on which a fork lift cannot move (e.g.. Pallets/Packages stowed on pipes) will not be acceptable. Please ensure that the above is promulgated to all persons concerned to avoid disputes at a latter stage.

31 PAGE: 31/35 Annex 5 Port Tug GENERAL CONDITIONS OF PORT TOWAGE IN SOYO PORT SONATIDE, the towage company, undertakes their operations on the following standard terms and conditions, in which the words the Company and the Contracting Party refer respectively to the towage company and to the operator of the ship or other vessel towed. 1. It is expressly agreed that towage operations undertaken by the Company inside or on entering or leaving harbour, and in roads and anchoring zones, shall be subject to the following contractual conditions, whether or not any document is signed prior to the operation. 2. The towage contract is a hire-of-service contract, in the performance of which the Company puts traction at the disposal of the Contracting Party, in other words the moving power of its tugboats in seaworthy condition and the services of its crews, whether or not the towed vessel has a crew of its own. 3. The contractual period begins as of the moment when the tug(s), approaching the contracting vessel to cast or receive the towline, to push the vessel or to undertake any operation in connection with towage, is/are liable to receive orders from it, whether or not these be given, or is/are sufficiently close to the vessel to be subjected to its action or liable to collide with it or be hit by it. This period ends, once the operation is completed, as soon as tug(s) have moved sufficiently away from the vessel so as to be no longer subjected to its action or liable to collide with it or be hit by it. 4. Throughout the course of the contractual period as defined above, it is expressly agreed that the captain and crew of the tugs are at the disposal of the Contracting Party and are thereby the latter s agents, exclusively under his control and direction, employed to perform a task. The tugs are thus in the care of the Contracting Party. This being so, any average, damage or other such cost of any nature whatsoever, incurred either by the vessel towed or by the tug(s) in the course of the towage operations, shall be borne exclusively by the Contracting Party. The latter shall also be liable for any claims brought any third parties against the vessel towed or against the tugs arising from any incident during these operations. The Company shall remain liable, however, for gross personal negligence in the performance of its commitment to supply means, tugs and crews. 5. Towlines appropriate for the towage operations shall be supplied by the tugboat this in any way affecting the principle of responsibility laid down in clause 4 above. No additional charge will be made for this use of the tugboat s towline. The vessel towed may, at its own request, use its own towline, but this preference shall in no way entitle it to any corresponding reduction in the towage price. 6. The company reserves the right to replace, even in the course of manoeuvres, one or more tugs with others belonging to it or to other owners. 7. Under no circumstances may any claim be made against the company for delay or for the consequences thereof. 8. Port charges, pilotage dues and boatage charges concerning the tug(s) or the vessel towed shall be borne by the contracting party, whether during the towage or for the tugs outward or inward passage before and afterwards. 9. Any operation begun is considered owing in full even in the event of loss of the vessel towed for any reason other than the company s gross personal negligence. The company is entitled to payment of the price of any operation ordered. 10. The company is entitled to payment in those cases where exceptional circumstances modify the nature of the services stipulated in the contract. 11. Towage fees (or other fees as defined above) are included in Kwanda operational fees to be paid by Clients to Kwanda Lda. 12. Exclusive jurisdiction is expressly attributed to the court of London, to which all disputes must be submitted, even action to enforce a warranty, cases where a relationship with another case may justify their being tried together or those with more than one defendant, it being agreed that this clause shall stand as an express exception to any provision to the contrary

The operation is expected to be carried out on or about 25/08/09. The anchor positions are expected to be marked by marker buoys. Planned Mooring Anchor Coordinates: North Buoy: S, E South Buoy: S, E These locations are in the ALNG area and well clear of the Pululu channel approach to Kwanda. The intention of these anchor moorings are to moor a vessel for cargo operations, which is expected to be carried out in the near future (See diagram below)

35 PAGE: 35/35 Safety Notice Navigation No. 03/07 Reported Obstruction in Kwanda Small Craft / Supply Boat Anchorage Area It has been reported that an obstruction of about 2m x 3m exists at approximate position by GPS: 06 06'.988 S, '.183 E, Depth - about 4.5meter below Chart Datum. This location is slightly Westward of the Designated Kwanda Port turning basin and apparently about 150 meter in SW'ly direction from the last green buoy. As such it is clear of the designated Channel and turning area for Freighters. A small (white) plastic marker (attached to a rope) is said to have been placed at this location, by the party which reported. It is requested that all mariners be advised regarding above, to exercise caution when Navigating near this area and not to anchor near this location.
