CRTERA TO BE CONSDERED: HOW TO PROVDE TESTMONY: HEARNG PROCEDURE: Pursuant to SRC d), an applcaton for a CONDTONAL USE PERMT shall be granted f the followng crtera are met: 1. The proposed use s allowed as a condtonal use n the zone; 2. The reasonably lkely adverse mpacts of the use on the mmedate neghborhood can be mnmzed through the mposton of condtons; and 3. The hearng wll be conducted wth the staff presentaton frst, followed by the applcant's case, neghborhood organzaton comments, testmony of persons n favor or opposton, and rebuttal by the applcant, f necessary. The applcant has the burden of proof to show that the approval crtera can be satsfed by the facts. Opponents may rebut the applcant's testmony by showng alternatve facts or by showng that the evdence submtted does not satsfy the approval crtera.
