1 CORPORATON OF THE TOWN OF BRACEBRDGE BY-LAW NO BENG A BY-LAW TO AMEND ZONNG BY-LAW #73-60 WHEREAS By-law No was enacted to regulate land use in Muskoka North Ward, of the Town ofbracebridge, in the District Municipality ofmuskoka; AND WHEREAS it is deemed necessary to amend the said by-law by rezoning certain lands shown in Plate "A", by amending certain provisions of Plate "B" attached thereto, and by the addition of certain provisions under Section 2: Exceptions; NOW THEREFORE THE CORPORATON OF THE TOWN OF BRACEBRDGE ENACTS AS FOLLOWS:. THAT Plate "A" to By-law No is hereby amended by changing the zoning of Part of Lots and 2, Concession 12, Muskoka North Ward of the Town ofbracebridge, as shown outlined in red on Schedule "A" attached hereto, from the present zone of General ndustrial (M2), in part, General ndustrial Special-26 (M2-26) in part, and General ndustrial Special- 27 (M2-27) to General ndustrial Special-28 (M2-28); 2. THAT Plate "B", Permitted Uses in Zones, Text, Paragraph 6(q), is hereby amended by the addition of the following: Permitted Uses M2-28 The permitted uses in a M2-28 Zone are limited to: Business Commercial Establishment, as defined in paragraph (i), Business or Professional Office, Cold Storage Locker Plant, Commercial Training Facility, as defined in paragraph (i), Contractors Yard, Dry Cleaners Establishment, Dry Cleaners Plant, Eating Establishment, Equipment Sales and Rental, Laundry Establishment, Laundry Plant, Light Manufacturing, as defined in paragraph (i), Miscellaneous Exceptions ( q), Motor Vehicle Body Shop, Motor Vehicle Dealership, Motor Vehicle Gas Bar, Motor Vehicle Repair Garage, Motor Vehicle Sales, Used, Motor Vehicle Supply Establishment, Motor Vehicle, Wash, Open Storage, as defined in paragraph (iii), Outside Display and Sale, (restricted), Printing and Publishing Establishment, Public Use, Recreational Establishment, as defined in paragraph (i), Rental Agency, Seasonal Farm Produce Stand, as defined in paragraph (i), Service Shop, Storage Warehouse, as defined in paragraph (i), Workshop, and a high school as a temporary use.

2 Commercial Training Facility: Shall mean a service commercial establishment which provides instruction in any subject for profit or gain, and without limiting the generality of the foregoing, includes a secretarial school, business school, trade school, a dance school or studio, a school of music, a modeling school, a ceramics school or studio or any other specialized school but does not include a public school, separate school or private school. Light Manufacturing: The use of land, buildings or structures for the purpose of manufacturing, assembly, making, preparing, inspecting, finishing, treating, altering, repairing, warehousing or storing or adapting for sale any goods, substance, miicle, thing or service but does not include the manufacturing or production of chemicals or chemical processing; meat, poultry or fish processing; or stamping, punch pressing, or forging of metals. Recreational Establishment: Shall mean a motion picture or other theatre, billiard or pool room, bowling alley, ice or roller skating rink, dance hall or music hall; miniature golf or indoor golf facility, or place designed and equipped for the conduct of sp01is, leisure time activities and other customary and usual recreational activities. Seasonal Farm Produce Stand: A building or structure where farm produce and goods are offered or kept for sale on a seasonal basis and where the majority of the produce and goods are grown locally. Storage Warehouse: Shall mean a building or portion thereof used for the storage of goods, but shall not include a retail use, a fuel storage depot and supply yard or a truck transport terminal, as defined herein. ii) The parking standard for the total site shall be three (3) spaces per 000 square feet of total floor area. iii)open Storage No portion of a lot shall be used for the storage of goods or materials unless such storage is within a building, or unless the following provisions are complied with, in the event that the storage is in the open. a) Such open storage is accessory to the use of the main building on the lot; b) Such open storage complies with the yard and setback requirements for the M2 Zone, as set out on Plate "D", and, in addition, no open storage is located closer than 60 feet to any street line; c) Such open storage does not cover more than 30% of the lot area, or cover an area which is in excess of twice the ground floor area of the main building on the lot; d) Any portion of a lot used for such open storage is screened from adjacent uses and streets adjoining the lot, by buildings or enclosed by shrub planting, a planting strip or within a closed wooden, plastic andor metal fence extending at least 6 feet in height from the ground. All fences, except those constructed of aluminum, shall be painted and kept painted, from time to time, so as to maintain the wood or metal in good condition. 4. THAT Schedule "A" attached hereto forms pati of this by-law. 3

3 With certain special provisions regarding parking, restricted uses, definitions of pennitted uses and outdoor display, as set out in Section 12:553; 3. THAT Section 12: Exceptions, be hereby amended by the addition of Paragraph 12:553 as follows: 12:553 n a M2-28 Zone the permitted uses shall be limited to the following: Business Commercial Establishment, as defined in paragraph (i), Business or Professional Office, Cold Storage Locker Plant, Commercial Training Facility, as defined in paragraph (i), Contractors Yard, Dry Cleaners Establishment, Dry Cleaners Plant, Eating Establishment, Equipment Sales and Rental, Laundry Establishment, Laundry Plant, Light Manufacturing, as defined in paragraph (i), Miscellaneous Exceptions ( q), Motor Vehicle Body Shop, Motor Vehicle Dealership, Motor Vehicle Gas Bar, Motor Vehicle Repair Garage, Motor Vehicle Sales, Used, Motor Vehicle Supply Establishment, Motor Vehicle, Wash, Open Storage, as defined in paragraph (iii), Outside Display and Sale, (restricted), Printing and Publishing Establishment, Public Use, Recreational Establishment, as defined in paragraph (i), Rental Agency, Seasonal Fann Produce Stand, as defined in paragraph (i), Service Shop, Storage Warehouse, as defined in paragraph (i), Workshop, and including a high school as a temporary use for a period of three (3) years until February 11, Any of the permitted uses may be incorporated in a building or buildings designed, developed and managed as a unit by a single owner or tenant, or group of owners or tenants, having an off-street parking area provided on the site. Outside display and sale may only be pennitted unenclosed adjacent and accessory to the storefront, on a temporary basis, during regular business hours. i) For the purposes of an M2-28 Zone, the following definitions shall apply: Business Commercial Establishment: Shall mean a building or part of a building used for the storage and distribution of goods, wares, merchandise, substances, or articles or for accessory retail sales of goods, wares, merchandise, substances or articles otherwise stored or manufactured within the building and provided that such accessory retail sales component does not exceed a maximum gross floor area of 200 square metres. 2
