3 A 16/Res.648 REQUREMENTS, NCLUDNG GUDELNES FOR REPORTNG NCDENTS RECALLNG the Gudelnes for Reportng ncdents nvolvng Dangerous Goods n Packaged Form developed by the Martme Safety Commttee (MSC/Crc.360/Rev.l), RECALLNG ALSO artcle 8 and Protocol of the nternatonal Conventon for the Preventon of Polluton from Shps, 1973, as modfed by the Protocol of 1978 relatng thereto (MARPOL 73/78), as amended, and also the Gudelnes for Reportng ncdents nvolvng Harmful Substances (resoluton MEPC.30(25)), RECOGNZNG that States Partes to the nternatonal Conventon relatng to nterventon on the Hgh Seas n Cases of Ol Polluton Casualtes (1969) and the Protocol Relatng to nterventon on the Hgh Seas n Cases of Marne Polluton by Substances other than Ol (1973) may take such measures on the hgh seas as may be necessary to prevent, mtgate or elmnate grave and mmnent danger to ther coastlne or related nterests from polluton or threat of polluton of the sea by ol and substances other than ol followng upon a martme casualty or acts related to such a casualty, whch may reasonably be expected to result n major harmful consequences, RECOGNZNG ALSO the need for coastal States to be nformed by the master of an assstng shp, or of a shp undertakng salvage, of partculars of the ncdent and of acton taken, RECOGNZNG FURTHER that an ncdent nvolvng damage, falure or breakdown of the shp, ts machnery or equpment could gve rse to a sgnfcant threat of polluton to coastlnes or related nterests, HAVNG CONSDERED the recommendaton made by the Martme Safety Commttee at ts ffty-seventh sesson and by the Marne Envronment Protecton Commttee at ts twenty-sxth sesson, 1. ADOPTS the General Prncples for Shp Reportng Systems and Shp Reportng Requrements, ncludng Gudelnes for Reportng ncdents nvolvng Dangerous Goods, Harmful Substances and/or Marne Pollutants set out n the Annex to the present resoluton;

URGES Member Governments to brng the reportng format and procedures to the notce of shpowners and seafarers as well as of the desgnated authortes concerned; 4. ~ECOMMENDS Member Governments and States Partes to MARPOL 73/78 to mpl~ment the Gudelnes, n accordance wth paragraph (2) of artcle V of Protocol thereof; 5. 5 A 16/Res ANNEX GENERAL PRNCPLES FOR SHP REPORTNG SYSTEMS AND SHP REPORTNG REQUREMENTS, NCLUDNG GUDELNES FOR REPORTNG NCDENTS NVOLVNG DANGEROUS GOODS, HARMFUL SUBSTANCES AND/OR MARNE POLLUTANTS 1 General prncples 1.1 Shp reportng systems and reportng requrements are used to provde, gather or exchange nformaton through rado reports. The nformaton s used to provde data for many purposes ngludng search and rescue, vessel traffc servces, weather forecastng and preventon of marne polluton. Shp reportng systems and reportng requrements should, as far as practcable, comply wth the followng prncples:.1 reports should contan only nformaton essental to acheve the objectves of the system;.2 reports should be smple and use the standard nternatonal shp reportng format and procedures; where language dffcultes may exst, the languages used should nclude Englsh, usng where possble the Standard Marne Navgatonal Vocabulary, or alternatvely the nternatonal Code of Sgnals. The standard reportng format and procedures to be used are gven n the appendx to ths Annex;.3 the number of reports should be kept to a mnmum;.4 no charge should be made for communcaton of reports;.5 safety or polluton related reports should be made wthout delay; however, the tme and place of makng non-urgent reports should be suffcently flexble to avod nterference wth essental navgatonal dutes;

6 - 5 - A 16/Res nformaton obtaned from the system should be made avalable to other systems when requred for dstress, safety and polluton purposes;.7 basc nformaton (shp's partculars, on-board facltes and equpment, etc.) should be reported once, be retaned n the system and be updated by the shp when changes occur n the basc nformaton reported;.8 the purpose of the system should be clearly defned;.9 Governments establshng a shp reportng system should notfy marners of full detals of the requrements to be met and procedures to be followed. Detals of types of shps and areas of applcablty, of tmes and geographcal postons for submttng reports, of shor~ establshments responsble for operaton of the system and of the servces provded should be clearly specfed. Chartlets depctng boundares of the system and provdng other necessary nformaton should be made avalable to marners;.10 the establshment and operaton of a shp reportng system should take nto account:.10.1 nternatonal as well as natonal responsbltes and requrements;.10.2 the cost to shp operators and responsble authortes;.10.3 navgatonal hazards;.10.4 exstng and proposed ads to safety; and.10.5 the need for early and contnung consultaton wth nterested partes ncludng a suffcent perod to allow for tral, famlarzaton and assessment to ensure satsfactory operaton and to allow necessary changes to be made to the system;

7 A 16/Res Governments should ensure that shore establshments responsble for operaton of the system are manned by properly traned persons;.12 Governments should consder the nterrelatonshp between shp reportng systems and other systems;.13 shp reportng systems should preferably use a sngle operatng rado frequency; where addtonal frequences are necessary, the number of frequences should be restrcted to the mnmum requred for the effectve operaton of the system;.14 nformaton provded by the system to shps should be restrcted to that necessary for the proper operaton of the system and for safety;.15 shp reportng systems and requrements should provde for specal reports from shps concernng defects or defcences wth respect to ther hull, machnery, equpment or mannng, or concernng other lmtatons whch could adversely affect navgaton and for specal reports concernng ncdents of actual or probable marne polluton;.16 Governments should ssue nstructons to ther shore establshments responsble for the operaton of shp reportng systems to ensure that any reports nvolvng polluton, actual or probable, are relayed wthout delay to the offcer or agency nomnated to receve and process such reports, and to ensure that such an offcer or agency relays these reports wthout delay to the flag State of the shp nvolved and to any other State whch may be affected;.17 States whch are affected or lkely to be affected by polluton ncdents and may requre nformaton relevant to the ncdent should take nto account the crcumstances n whch the master 1s placed, and should endeavour to lmt ther requests for addtonal nformaton; and.18 the appendx to ths Annex does not apply to danger messages referred to under regulaton V/2 of the 1974 SOLAS Conventon, as amended. The present practce of transmttng such messages should reman unchanged.

8 - 7 - A 16/Res Gudelnes for reportng ncdents nvolvng dangerous goods 2.1 The ntent of these Gudelnes and those contaned n the appendx s to enable coastal States and other nterested partes to be nformed wthout delay when any ncdent occurs nvolvng the loss, or lkely loss, overboard of packaged dangerous goods nto the sea. 2.2 Reports should be transmtted to the nearest coastal State. When the shp s wthn or near an area for whch a shp reportng system has been establshed, reports should be transmtted to the desgnated shore staton of that system. 3 Gudelnes for reportng ncdents nvolvng harmful substances and/or marne pollutants 3.1 The ntent of these Gudelnes and those contaned n the appendx s to enable coastal States and other nterested partes to be nformed wthout delay of any ncdent gvng rse to polluton, or threat of polluton, of the marne envronment, as well as of assstance and salvage measures, so that approprate acton may be taken. 3.2 n accordance wth artcle V(l) of Protocol of MARPOL 73/78, a report shall be made to the nearest coastal State. 3.3 Whenever a shp s engaged n or requested to engage n an operaton to render assstance to or undertake salvage of a shp nvolved n an ncdent referred to n subparagraph l(a) or (b) of artcle of Protocol of MARPOL 73/78, as amended, the master of the former shp should report, wthout delay, the partculars of the acton undertaken or planned. The coastal States should also be kept nformed of developments. 3.4 The probablty of a dscharge resultng from damage to the shp or ts equpment s a reason for makng a report.

9 A 16/Res.648 REQUREMENTS, NCLUDNG GUDELNES FOR REPORTNG NCDENTS 1 PROCEDURES Reports should be sent as follows: APPENDX Salng plan (SP) Before or as near as possble to the tme of departure from a port wthn a system or when enterng the area covered by a system. Poston report (PR) When necessary to ensure effectve operaton of the system. Devaton report (DR) When the shp's poston vares sgnfcantly from the poston that would have been predcted from prevous reports, when changng the reported route, or as decded by the master. Fnal report (FR) On arrval at destnaton and when leavng the area covered by a system. Dangerous goods report (DG) When an ncdent takes place nvolvng the loss, or lkely loss overboard of packaged dangerous goods, ncludng those n freght contaners, portable tanks, road and ral vehcles and shpborne barges, nto the sea. Harmful substances report (HS) When an ncdent takes place nvolvng the dscharge or probable dscharge of ol (Annex of MARPOL 73/78) or noxous lqud substances 1.n bulk (Annex of MARPOL 73/78). Marne pollutants report (MP) n the case of loss or lkely loss overboard of harmful substances n packaged form ncludng those n freght contaners, portable tanks, road and ral vehcles and shpborne barges, dentfed n the nternatonal Martme Dangerous Goods Code as marne pollutants (Annex of MARPOL 73/78). Any other report Any other report should be made n accordance wth the system procedures as notfed n accordance wth paragraph 9 of the General Prncples.

10 - 9 - A 16/Res STANDARD REPORTNG FORMAT AND PROCEDURES 2.1 Sectons of the shp reportng format whch are napproprate should be omtted from the report. 2.2 Where language dffcultes may exst, the languages used should nclude Englsh, usng where possble the Standard Marne Navgatonal Vocabulary. Alternatvely, the nternatonal Code of Sgnals may be used to send detaled nformaton. When the nternatonal Code s used, the approprate ndcator should be nserted n the text, after the alphabetcal ndex. 2.3 For route nformaton, lattude and longtude should be gven for each turn pont, expressed as 1n C below, together wth type of ntended track between these ponts, for example "RL" (rhumb lne), "GC" (great crcle) or "coastal", or, n the case of coastal salng, the estmated date and tme of passng sgnfcant ponts expressed by a 6 dgt group as n B below. The master should also keep the coastal State nformed of developments. 3.4 Probablty of dscharge 3,4.1 The probablty of a dscharge resultng from damage to the shp or ts equpment s a reason for makng a report. n judgng whether there s such a probablty and whether the report should be made, the followng factors, among others, should be taken nto account:.1 the nature of the damage, falure or breakdown of the shp, machnery or equpment; and.2 sea and wnd state and also traffc densty n the area at the tme and place of the ncdent t s recognzed that t would be mpractcable to lay down precse defntons of all types of ncdents nvolvng probable dscharge whch would warrant an oblgaton to report. Nevertheless, as a general gudelne the m,ster of the shp should make reports n cases of:.1 damage, falure or breakdown whch affects the safety of shps; examples of such ncdents are collson, groundng, fre, exploson, structural falure, floodng, cargo shftng; and.2 falure or breakdown of machnery or equpment whch results n mparment of the safety of navgaton; examples of such ncdents are falure or breakdown of steerng gear, propulson plant, electrcal generatng system, essental shpborne navgatonal ads.
