10 1. Implement an Integrated Pest Management (IPM) program targeting EGVM as outlined by the United States Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS) ( st_info/eg_moth/index.shtml), the Project, and/or the University of California Cooperative Extension. All IPM treatment records must be retained for a period of three years. Such records shall be made available to the Project upon request.

11 2. Each orchard/grove must be inspected and found free of EGVM prior to first harvest and every 30 days thereafter for as long as harvesting continues. 3. Request for inspection must be submitted to the Project at least 48 hours prior to harvest. 4. Grower will provide the services for removal of fruit to be inspected. Fruit within each orchard/grove will be randomly selected for inspection as directed by the Project.

12 5. Ensure shipments of fruit destined for packing or processing at a location other than the field are: a. accompanied by a copy of the Certificate of Quarantine Compliance (CQC), issued at the time of inspection, and b. received by an approved receiver*.

13 6. Establishment must make a copy of the CQC available upon request by the Project.

14 7. Ensure each final container of field packed fruit grown inside the quarantine area qualifying for intrastate shipment has a diamond stamp. The diamond stamp must accompany the container until received at final destination. 8. Each shipment of field packed fruit qualifying for interstate shipment must be accompanied by a Certificate (Federal Shield).

15 9. Fruit grown in orchards/groves where EGVM has been detected by inspection must receive a post-harvest treatment* approved by the Project. Each shipment of fruit subject to treatment must be transported under Limited Permit to an approved treatment facility*. Project will notify grower of EGVM detections.

16 10. Each pallet of fruit requiring treatment will have a treatment lot number identifying the treatment and a pallet card or tag that identifies the source grower lot/orchard/grove, variety and date for purposes of trace back activities. This pallet card must accompany the pallet for the duration of transit/shipment until received at final destination.

17 11. If the commodity is grown within 200 meters of a EGVM detection Establishment must notify the receiving County Agricultural Commissioner at least 24 hours prior to transport of each shipment. Notification must include: a. Receiver (name and complete physical address) b. Date of shipment and estimated date of arrival c. Weight or amount of shipment (number of trucks, bins, etc.) d. Other as noted in special instructions below

18 12. Ensure all equipment (bins, barrels, machinery, gondolas, etc.) used for orchard/grove maintenance and harvesting is thoroughly cleaned of all host material and debris year-round and prior to leaving the growing premises. 13. No growing equipment (such as stakes and poles) may be removed from the growing premise unless the equipment: a. has been stored on the property no less then 60 feet away from any EGVM host material for a minimum of nine months prior to relocation, or b. is going directly to a landfill located within the quarantine area, or c. is handled in a method approved by the Project

19 14. Ensure all orchard/grove planting and removal* is conducted by an establishment under compliance with the Project.

20 15. Green waste includes culled or discarded fruit, fruit skins, leaves/branches, stems, vines, foliage, grape spurs and canes, pomace, must, winery and harvesting waste, home garden waste, grass clippings, space trimmings, weeds or other vegetative material, etc. In orchards/groves where: a. EGVM has been detected, all green waste shall be handled as prescribed in Appendix 1 or as specified below (see special instructions ). b. fruit has been inspected and a CQC has been issued, green waste associated with the inspected fruit may move intrastate (within California) without further restriction and can not be moved interstate.

21 16. Samples of regulated plants or plant parts requiring destructive lab analysis (such as pesticide residue, nutrient or mineral analysis) must be submitted to an Approved Lab (66-105) located inside or outside the EGVM quarantine area. 17. Samples of regulated plants or plant parts requiring disease/pest research or diagnostics must be submitted to a lab with a valid State plant pest permit (66-026) and samples may be: a. collected and moved by a lab employee with a copy of the permit in their possession if authorized by the permit, or b. collected and shipped in accordance with Master Permit QC 1308.

22 18. Maintain records of each shipment from and within the EGVM state interior quarantine for a period of three years and make those records available to the Project upon request. 19. Ensure all employees receive training to be compliant with all specifications of this compliance agreement exhibit.

23 *Project approved receivers, post-harvest treatments, planting and removal establishments and establishments under compliance with Master Permit QC 1308 can be verified online at: Shipments found to be in violation of the above stipulations are subject to being held, rejected, destroyed, or subject to other prescribed actions at the discretion of the Project.

24 COOPERATIVE EUROPEAN GRAPEVINE MOTH (EGVM) QUARANTINE PROJECT COMPLIANCE AGREEMENT EXHIBIT K1- Shipping/Storing/Packing/Receiving Establishments Located Within or Outside the EGVM State Interior Quarantine Area Provisions for Regulated Fruit Other than Grapes Produced Inside the EGVM State Interior Quarantine Area Establishment agrees to the following: 1. All shipments of host fruit grown inside the quarantine area will be designated with a Certificate of Quarantine Compliance (CQC) upon arrival at the receiving facility. Establishment must make a copy of the CQC available upon request by the Project.

25 2. All shipments of host fruit grown inside the quarantine area must be segregated from host fruit grown outside the quarantine area.

26 3. Ensure each pallet containing host fruit grown outside the quarantine area and shipped from, packed, or stored inside the quarantine area qualifying for intrastate movement has a pallet card/tag with the diamond stamp (see specifications below). This pallet card or tag must accompany the pallet for the duration of transit/shipment until received at final destination.

27 4. Ensure each final container of host fruit grown inside the quarantine area qualifying for intrastate movement has a diamond stamp (see specifications below). The diamond stamp must accompany the container until received at final destination.

29 5. Each shipment of host fruit grown inside the quarantine area qualifying for interstate shipment must be accompanied by a Certificate (Federal Shield).

31 6. Shipments of treated host fruit must be accompanied by a certificate of treatment from a Project approved treatment facility. Project approved treatment facilities can be verified online at: n/egvm_quarantine.html

Once treated, host fruit must have a treatment lot number identifying the treatment and a pallet card/tag identifying the source grower lot/vineyard, variety of fruit and date for purposes of trace back activities. The pallet card or tag must accompany the pallet until received at final destination.

33 8. In orchards/groves where stonefruit has been inspected and a CQC has been issued, green waste associated with the inspected stonefruit may move within California without further restriction. Green waste cannot move outside of California.

34 9. Maintain all records of intrastate and interstate shipments of all host fruit for a period of three years. Establishment shall provide such records to the Project upon request.

35 10. Ensure all employees receive training to be compliant with all specifications of this compliance agreement exhibit.
