2 TENDER ENQUIRY FOR LOADING I UNLOADING WITH FORKLIFT & CRANE AT OUR AIRPORT OFFICE Section - I Introduction - The The Cargo Department of Balmer Lawrie & Co. Ltd. Is carrying out jobs involving transportation. The department in the course of its working requires execution of such transportation job as per its requirement in a safe and proper manner. department has in hand different types of consignments in the nature of Aircraft parts, machinery parts, machineries, steel pipes, consumables, food grains, leather goods, oils and petroleum products and so on. The exact volume of work can not be anticipated, The destinations and approx. no. of vehicles for which rate are required are listed at Annexure JA'. Section - 11 Definitions The following expressions hereunder and elsewhere in the tender / contract documents used shall have the following meaning hereunder respectively assigned to them except where the context otherwise requires. ( 1) "BL" shall mean Balmer Lawrie & Co. Ltd., a Company incorporated in India having its office at 32,33, Kushal Bazar, Flat No. 1 & 2, Ground Floor, Nehru Place, New Delhi ) "Tenderer- shall mean such parties who have been issued tender documents by BL and those parties who have submitted their offers to BL in response to the tender documents issued to them. 3) "Contractor" shall mean the tenderer selected by BL for the performance of the work. Section - III Eligibility Criteria For The Tenderer 1. Only registered transporters are eligible to apply. In case an unregistered tender er want to participate, he should first seek registration and only thereafter his bid would be accepted. Cont.....P/2

3 \ \ \ Section IV INSTRUCTIONS FOR FILLING UP THE TENDER FORM AND GENERAL TERMS AND CONDITIONS. The tender can be submitted only in the name of the Tenderer in whose name the tender documents are issued. The tender documents so filled in should be completed in all respects. The Tenderer shall submit their offers without any qualifications. e. Tender documents shall be stamped and signed by duly authorized person of the Tenderer on each page and the space meant for signature of the tenderer. The Tender shall clearly indicate their legal constitution and the person signing the tender shall mention his capacity. The Company reserves the right to reject. any tender not supported by adequate proof of the signatories authority. The rates for various destinations are required to be quoted in the schedule of rates as per Annexure 'A'. (Tender document). Any deviation, may lead to non acceptance of such tender. All over-writing is to be initialed. All entries in the tender documents should be in ink. INSTRUCTIONS FOR SUBMISSION OF TENDER \ \\\ The following documents shall be placed in a sealed envelope subscribing the words "TENDER NO.O>6;/lS,-!6TENDER FOR CRANE1FOI<..KLTf'r ' ~,.. j 1) The envelope should contain complete set of tender documents including terms and conditions duly signed and stamped as token of acceptance of the terms and conditions. 2) Earnest Money of Rs to be submitted along with tender documents. 3) Documents and copies of certificates in support of experience capability should accompany the tender documents. 4) The envelope shall be properly sealed and submitted to reach on or before 1'51!oj2015before 4.00 PM to Balmer Lawrie & Co. 4 -3- Section-V Terms And Conditions 1. The offer shall remain valid upto 90 days from the date of submission. 2. Scope of Work Balmer Lawrie will determine points / destinations of loading and unloading. The contractor will be expected to provide suitable vehicles within Time period for each individual point of loading. - The contractor shall be responsible of the condition of the vehicle; if not fit for loading, all costs involved in such case shall be to the contractor's account. 3. The detention charges, if any shall be payable only on the certificate / confirmation of such detention by the consignor/consignee in writing detailing time of arrival/ departure. (No detention is payable). The detention charges shall not be payable if the vehicles detained at road or due to any defect in vehicles and / or non-availability of crew on vehicles or due to any force major conditions. 4. Responsibility / Liability e i) The contractor will be responsible for any loss and/ or damage caused to the consignment directly/indirectly while the same is under the charge of the contractor. In such case entire loss may be deducted/ recovers from contactor's bill or security deposit, the contractor will be required to deposit the differential amount on demand raised by BL. ii) The contractor shall be fully responsible and liable for payment of all demurrage wharf age, and any kind whatsoever or other extra charges levied by the Airport authority, State Government or Municipal Authority due to lapse on the part of contractor for non-placement / delayed placement of vehicles despite receiving requisition in advance except any force major situation. Hi) Goods must be load ding/ unloading in same conditions as received and any damages/losses will be recovered in full from the transporter. Cont... P/4 ~~~

5 -4- iv) Lead Time: As required by Balmer Lawrie & eo Ltd. representative. v) Liquidated Damages for Delay : In the event of damage, M/ s Balmer Lawrie and Co Ltd., reserves the right to claim for late delivery shipment as well as for delays in starting the work as per schedule after intimation/ contract. 5. BL's Supervision On The Job Where BL considers it necessary, the Contractor will be required to carry out his operations under- the guidance / control and supervision of BL's representatives. However, the Contractor's responsibilities in no way be reduced or diluted on account of BL's supervision over his operations. Payment Of Bills After completing the job for individual shipment, the contractor shall submit his bill in quadruplicate along with receipted challan (POD) in BL's office at Godown no 14 ACCAI Terminal Nanagal Diary New Delhi The bills should indicate date of commencement of place of loading and type of vehicle, gross weight of materials carried by each vehicle. Bills complete in all respects will mature for payment on expiry of 30 days after date of submission. BL, however, reserves the right of returning bills submitted with incomplete information or documents and in such cases, date of resubmission, with be treated as date of submission. 7. Duration Of Contract The. contract will be effective for a period of One Year from the date of letter indent unless terminated earlier by BL. However, BL reserves the right to extend the period of contract for a further period.of 12 months if found necessary at the same rates, terms and conditions. 8. Termination Of The Contract BL reserves the right to terminate the "contract at any time and without assigning any reason thereof, and in such event the contractor shall not be entitled to any compensation by reason of termination. 6 -5-9. Security Deposit Along with the letter of acceptance, the contractor will be required to submit Security Deposit of 5, by Demand Draft or pay order. Security deposit so paid will be interest free. Any loss or damage caused to BL due to contractor's fault will be recovered from the Security Deposit. 10. Earnest Money Deposit EMD will be 5, which is refunded to the unsuccessful tenderers only after the tender is finalized. EMD received from successful tenderers will be refunded only after the tender is finalized and after receipt of Security Deposit above EMD will be interest free. 11. Award Of Contract (a). BL. reserves the right to appoint one or more contractor at its discretion. (b) Method to be adopted for splitting of orders will be as under: [i) All other things being equal, order will be placed on Ll Tenderer in each case. However in case of 2 or more tenderers offering Ll rates for any sector and any type of vehicle, revised offers will be invited from such tenderers, only for those sectors/type of vehicle to decide on L1 tenderers. ~ 12. Arbitration : If disputes & differences arise between the parties concerning any aspect of the contract same shall be referred to arbitration of a sole arbitrator to be appointed by the Executive Director of Balmer Lawrie & Co. Ltd., and the Service Provider shall have no objection to the appointment of any officer of Balmer Lawrie itself as sole arbitrator. The decision of sole arbitrator shall be final and binding upon the parties and the arbitration shall be in accordance with the provisions of the Arbitration and Conciliation Act, 1996 & Modifications Thereof. The venue of the arbitration shall be Delhi. 13. Whether registered under the MSMED Act. (If yes,please provide certification of such registration) 14. If the successful tenderer is unable to accept or execute orders when placed upon him or fails to deposit the security deposit or withdraws his offer, his earnest money deposit shall be forfeited and he will be barred from all future contracts of this company.
