2 REGULATORY DVSON January 4, 2019 SAC Pursuant to Secton 10 of the Rvers and Harbors Act of 1899 (33 U.S.C. 403) and Sectons 401 and 404 of the Clean Water Act (33 U.S.C. 1344), Department of the Army (DA) permt number SAC authorzes the South Carolna Ports Authorty (SCPA) to conduct approxmately 2.34 mllon cubc yards of new work dredgng and 328,000 cubc yards of annual mantenance dredgng assocated wth the berth and access channel at the Hugh K. Leatherman, Sr. Termnal (HLT). The authorzed depth of the berth s -45 feet Mean Lower Low Water + 2 feet of advanced mantenance + 2 feet of extreme low tdal varaton + 2 feet of allowable overdepth. The total depth of the berth s 2 feet deeper than the access channel (and the adjacent Federal navgaton channel) so contaner shps can rse and fall wth the tde whle they are beng loaded and unloaded at HLT. The exstng DA permt authorzes the SCPA to hydraulcally pump dredged materal from HLT to an exstng dredged materal contanment area (DMCA), or to place the dredged materal n scows before hydraulcally pumpng t nto one of the DMCAs on Clouter sland, Danel sland, or Drum sland. Ths 10-year new work and mantenance dredgng permt s scheduled to expre on September 30, n accordance wth Secton 103 of the Marne Protecton, Research, and Sanctuares Act (MPRSA), the SCPA has requested to modfy ths permt so the dredged materal can also be transported to the Charleston Ocean Dredged Materal Dsposal Ste (ODMDS) for the purpose of ocean dsposal. The proposed modfcaton would not alter the footprnt of the prevously authorzed berth or access channel at HLT (approxmately 77.8 acres). The SCPA would use the same dredgng methods, a hydraulc cutterhead or a mechancal dredge, to dredge the berth and access channel and to place the dredged materal nto scows. The only dfference s that the SCPA would transport the dredged materal from HLT to the Charleston ODMDS (rather than hydraulcally pumpng the dredged materal nto an exstng DMCA). Drawng sheet 7 of 7 dentfes the state plane coordnates for the 9.8-square mle boundary of the ODMDS and the 5.1-square mle dsposal zone that s located nsde the ODMDS. The Charleston ODMDS was desgnated by the U.S. Envronmental Protecton Agency (EPA) for the long-term placement of dredged materal assocated wth the Charleston Harbor Federal navgaton channel and other dredgng projects near Charleston, South Carolna. Over the past 20 years approxmately 22 mllon cubc yards of new work materal and 1 mllon cubc yards per year of mantenance materal has been placed n the ODMDS (a total of more than 42 mllon cubc yards). Snce the berth and access channel at HLT are located adjacent to the Federal navgaton channel, the SCPA beleves there may be opportuntes for contractors to use the same dredgng equpment to conduct work assocated wth both projects. The SCPA recently conducted sedment testng to determne whether new work and mantenance materal from HLT s consdered sutable for placement n the Charleston ODMDS. Ths data s currently beng evaluated by the Corps, EPA, and the other regulatory and resource agences. Please note the SCPA has also conducted sedment testng for the Wando Welch Termnal (WWT), Columbus Street Termnal (CST), and Unon Per Termnal (UPT). Snce each port faclty has ts own DA permt, the SCPA has submtted separate requests to modfy the exstng dredgng permts or to obtan new DA permts for the berths at WWT, CST, and UPT. The proposed work s lmted to modfyng the exstng DA permt so new work and mantenance materal from the berth and access channel can be transported to the Charleston ODMDS. f authorzed, dredged materal that s determned to be sutable for ocean dsposal may be transported to the Charleston ODMDS n accordance wth the approved Ste Management and Montorng Plan dated June The SCPA has not proposed compensatory mtgaton to offset 2

Accordng to the applcant, the purpose of the proposed project s to mprove dredgng effcency and cost-effectveness and to mprove management of the long-term capacty at exstng, upland DMCAs. NOTE: Ths publc notce and assocated plans are avalable on the Corps webste at: The Dstrct Engneer has concluded that the dscharges assocated wth ths project, both drect and ndrect, should be revewed by the South Carolna Department of Health and Envronmental Control n accordance wth provsons of Secton 401 of the Clean Water Act. As such, ths notce consttutes a request, on behalf of the applcant, for certfcaton that ths project wll comply wth applcable effluent lmtatons and water qualty standards. The work shown on ths applcaton must also be certfed as consstent wth applcable provsons of the Coastal Zone Management Program (15 CFR 930). State revew, permttng and certfcaton s conducted by the S. C. Department of Health and Envronmental Control. The Dstrct Engneer wll not process ths applcaton to a concluson untl such certfcatons are receved. The applcant s hereby advsed that supplemental nformaton may be requred by the State to facltate the revew. Ths notce ntates the Essental Fsh Habtat (EFH) consultaton requrements of the Magnuson-Stevens Fshery Conservaton and Management Act. mplementaton of the proposed modfcaton would result n no addtonal mpacts to estuarne substrates and emergent wetlands utlzed by varous lfe stages of speces comprsng the shrmp, and snapper-grouper management complexes. The Dstrct Engneer s ntal determnaton s that the proposed acton (.e., the transportaton of dredged materal to an EPA desgnated ODMDS) would not have a substantal ndvdual or cumulatve adverse mpact on EFH or fsheres managed by the South Atlantc Fshery Management Councl and the Natonal Marne Fsheres Servce (NMFS). The Dstrct Engneer s fnal determnaton relatve to project mpacts and the need for mtgaton measures s subject to revew by and coordnaton wth the NMFS. Pursuant to Secton 7 of the Endangered Speces Act of 1973 (as amended), the Corps has revewed the project area, examned all nformaton provded by the applcant, and the Dstrct Engneer has determned, based on the most recently avalable nformaton that the transportaton of dredged materal from HLT to the Charleston ODMDS would have no effect on the Federally endangered shortnose sturgeon (Acpenser brevrostrum), Atlantc sturgeon (Acpenser oxyrnchus), North Atlantc rght whale (Eubalaena glacals), desgnated crtcal habtat for the Atlantc sturgeon, or desgnated crtcal habtat for the North Atlantc rght whale, and may affect, but s not lkely to adversely affect the Federally endangered West ndan manatee (Trchechus manatus), whch s present n the vcnty of the project area. Ths publc notce serves as a request for wrtten concurrence from the U.S. Fsh and Wldlfe Servce and/or the Natonal Marne Fsheres Servce on ths determnaton. Pursuant to Secton 106 of the Natonal Hstorc Preservaton Act (NHPA), ths publc notce also consttutes a request to ndan Trbes to notfy the Dstrct Engneer of any hstorc propertes of relgous and cultural sgnfcance to them that may be affected by the proposed undertakng. n accordance wth Secton 106 of the NHPA, the Dstrct Engneer has consulted South Carolna ArchSte (GS), for the presence or absence of hstorc propertes (as defned n 36 C.F.R )(l)(1)), and has ntally determned that no hstorc propertes are present; 3

To ensure that other hstorc propertes that the Dstrct Engneer s not aware of are not overlooked, ths publc notce also serves as a request to the State Hstorc Preservaton Offce and any other nterested partes to provde any nformaton they may have wth regard to hstorc propertes. Ths publc notce serves as a request for concurrence wthn 30 days from the SHPO (and/or Trbal Hstorc Preservaton Offcer). The Dstrct Engneer s fnal elgblty and effect determnaton wll be based upon coordnaton wth the SHPO and/or THPO, as approprate and requred and wth full consderaton gven to the proposed undertakng s potental drect and ndrect effects on hstorc propertes wthn the Corps-dentfed permt area. Any person may request, n wrtng, wthn the comment perod specfed n ths notce, that a publc hearng be held to consder ths applcaton. Requests for a publc hearng shall state, wth partcularty, the reasons for holdng a publc hearng. The decson whether to ssue a permt wll be based on an evaluaton of the probable mpact ncludng cumulatve mpacts of the actvty on the publc nterest and wll nclude applcaton of the gudelnes promulgated by the Admnstrator, Envronmental Protecton Agency (EPA), under authorty of Secton 404(b) of the Clean Water Act. That decson wll reflect the natonal concern for both protecton and utlzaton of mportant resources. The beneft whch reasonably may be expected to accrue from the project must be balanced aganst ts reasonably foreseeable detrments. All factors whch may be relevant to the project wll be consdered ncludng the cumulatve effects thereof; among those are conservaton, economcs, aesthetcs, general envronmental concerns, wetlands, hstorc propertes, fsh and wldlfe values, flood hazards, flood plan values, land use, navgaton, shorelne eroson and accreton, recreaton, water supply and conservaton, water qualty, energy needs, safety, food and fber producton and, n general, the needs and welfare of the people. A permt wll be granted unless the Dstrct Engneer determnes that t would be contrary to the publc nterest. n cases of conflctng property rghts, the Corps cannot undertake to adjudcate rval clams. The Corps s solctng comments from the publc; Federal, state, and local agences and offcals; ndan Trbes; and other nterested partes n order to consder and evaluate the mpacts of ths actvty. Any comments receved wll be consdered by the Corps to determne whether to ssue, modfy, condton or deny a permt for ths project. To make ths decson, comments are used to assess mpacts on endangered speces, hstorc propertes, water qualty, general envronmental effects, and the other publc nterest factors lsted above. Comments are used n the preparaton of an Envronmental Assessment pursuant to the Natonal Envronmental Polcy Act. Comments are also used to determne the need for a publc hearng and to determne the overall publc nterest of the actvty.
