1 SPRING 2010 Significant Changes and Amendments to the 51st. Edition (2010) of the IATA Dangerous Goods Regulations The changes outlined below are taken directly from the introduction to the 51st edition of the IATA Dangerous Goods Regulations. The IATA Dangerous Goods Regulations are produced in consultation with ICAO and are recognized by the world's airlines. Each year, the major changes are printed in the introduction of the current edition. Please contact INFO- TRAC for clarification on any of the listed changes or for interpretations of any of the IATA Dangerous Goods Regulations. The 51st edition of the IATA Dangerous Goods Regulations incorporates all amendments made by the Dangerous Goods Board and includes changes advised, at time of printing, by ICAO to the Edition of the ICAO Technical Instructions. The following list is intended to assist the user with identifying the main changes introduced in this edition and must not be considered an exhaustive listing. The changes have been prefaced by the section or subsection in which the change occurs. 2 Limitations 2.3 Dangerous Goods Carried by Passengers or Crew. The provisions for carbon dioxide, solid have been clarified to identify that marking and the design of packages to permit the release of carbon dioxide gas applies to both checked and carry-on baggage. Belgium, Denmark and Russia have advised of amendments to their State variations Operator Variations. Appendix H Appendix H in this edition includes all of the reformatted packing instructions that will come into effect 1 January 2011 for Classes 3, 4, 5, Division 6.1, Classes 8 and 9 as well as an indication of the other regulatory changes that will come into effect from 1 January The regulatory changes indicated are based on the changes that have been agreed by the United Nations Subcommittee of Experts and that have been adopted into the 16th revised edition of the Recommendations on the transport of dangerous goods (Model Regulations) as well as those that have been agreed for adoption by the ICAO Dangerous Goods Panel into the edition of the Technical Instructions. PAGE 3 IMO ERRATUM TO AMENDMENT OF THE 2008 IMDG CODE The changes outlined below are taken directly from the IMO issued erratum to amendment of the 2008 IMDG Code. The IMDG Code is used for international vessel transportation. For additional information regarding these changes or any issue regarding the IMDG Code, please contact INFOTRAC. 6 PAGE 6 DOT Increases Civil Penalties SUMMARY: PHMSA is adjusting the maximum and minimum civil penalties for a knowing violation of the Federal hazardous material transportation law or a regulation, order, special permit, or approval issued under that law. The maximum civil penalty is increased to $55,000, and to $110,000 for a violation that results in death, serious illness, or severe injury to any person or substantial destruction of property. The minimum civil penalty is increased to $275, and to $495 for a violation related to training. These adjustments are required by the Federal Civil Penalties amended by the Debt Collection Improvement Act of DATES: Effective Date: This final rule is effective on December 31, Federal Register / Vol. 74, No. 248 / Tuesday, December 29, 2009 / Rules and Regulations Hazardous Materials: Revision to Requirements for the Transportation of Batteries and Battery-Powered Devices; and Harmonization With the United Nations Recommendations, International Maritime Dangerous Goods Code, and International Civil Aviation Organization s Technical Instructions; Correction SUMMARY: On January 14, 2009, the Pipeline and Hazardous Materials Safety Administration (PHMSA) published a final rule amending the Hazardous Materials Regulations (HMR) to maintain alignment with international standards by incorporating various amendments, including changes to proper shipping names, hazard classes, packing groups, special provisions, packaging authorizations, air transport quantity limitations, and vessel stowage requirements. The revisions were necessary to harmonize the HMR with recent changes to the International Civil Aviation Organization s Technical Instructions for the Safe Transport of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, Transport Canada s Transportation of Dangerous Goods Regulations, and the United Nations Recommendations on the Transport of Dangerous Goods. These revisions also included amendments and clarifications addressing the safe transportation of batteries and battery-powered devices. This final rule corrects several errors in the January 14, 2009 final rule. DATES: Effective date: The effective date of these amendments is January 4, Applicability date: These amendments are applicable beginning January 1, Federal Register / Vol. 75, No. 1 / Monday, January 4, 2010 / Rules and Regulations Significant New Use Rules on Certain Chemical Substances - EPA SUMMARY: EPA is promulgating significant new use rules (SNURs) under section 5(a)(2) of the Toxic Substances Control Act (TSCA) for 15 chemical substances which were the subject of pre-manufacture notices (PMNs). Three of these chemical substances are subject to TSCA section 5(e) consent orders issued by EPA. This action requires persons who intend to manufacture, import, or process any of these 15 chemical substances for an activity that is designated as a significant new use by this rule to notify EPA at least 90 days before commencing that activity. The required notification will provide EPA with the opportunity to evaluate the intended use and, if necessary, to prohibit or limit that activity before it occurs. DATES: The effective date of this rule is April 2, 2010 without further notice, unless EPA receives written adverse or critical comments, or notice of intent to submit adverse or critical comments before March 3, This rule shall be promulgated for purposes of judicial review at 1 p.m. (EST) on February 16, Federal Register / Vol. 75, No. 20 /Monday, February 1, 2010 / Rules and Regulations

7 PAGE 7 Occupational Injury & Illness Recording & Reporting Requirements SUMMARY: OSHA is proposing to revise its Occupational Injury and Illness Recording and Reporting (Recordkeeping) regulation to restore a column to the OSHA 300 Log that employers would use to record work related musculoskeletal disorders (MSD). The 2001 Recordkeeping final regulation included an MSD column, but the requirement was deleted before the regulation became effective. This proposed rule would require employers to place a check mark in the MSD column, instead of the column they currently mark, if a case is an MSD that meets the Recordkeeping regulation s general recording requirements. Federal Register / Vol. 75, No. 19 / Friday, January 29, 2010 / Proposed Rules Hazardous Material: Miscellaneous Packaging Amendments SUMMARY: In this final rule, PHMSA is amending packaging requirements in the Hazardous Materials Regulations to enhance compliance flexibility, improve clarity, and reduce regulatory burdens. Specifically, we are revising several packaging related definitions; adding provisions to allow more flexibility when preparing and transmitting closure instructions, including conditions under which closure instructions may be transmitted electronically; adding a requirement for shippers to retain packaging closure instructions; incorporating new language that will allow for a practicable means of stenciling the UN symbol on packagings; and clarifying a requirement to document the methodology used when determining whether a change in packaging configuration requires retesting as a new design or may be considered a variation of a previously tested design. This final rule also incorporates requirements for construction, maintenance, and use of Large Packagings. DATES: Effective Date: October 1, Voluntary Compliance Date: Compliance with the requirements adopted herein is authorized as of March 4, Federal Register / Vol. 75, No. 21 / Tuesday, February 2, 2010 / Rules and Regulations Hazardous Materials: Risk-Based Adjustment of Transportation Security Plan Requirements; Final Rule SUMMARY: PHMSA, in consultation with the Transportation Security Administration (TSA) of the Department of Homeland Security (DHS), is modifying current security plan requirements applicable to the commercial transportation of hazardous materials by air, rail, vessel, and highway. Based on an evaluation of the security threats associated with specific types and quantities of hazardous materials, the final rule narrows the list of materials subject to security plan requirements and reduces associated regulatory costs and paperwork burden. The final rule also clarifies certain requirements related to security planning, training, and documentation. For example, security plans now apply to each person who offers for transportation in commerce or transports in commerce one or more of the following hazardous materials must develop and adhere to a transportation security plan for hazardous materials that conforms to the requirements of this subpart. As used in this section, ``large bulk quantity'' refers to a quantity greater than 3,000 kg (6,614 pounds) for solids or 3,000 liters (792 gallons) for liquids and gases in a single packaging such as a cargo tank motor vehicle, portable tank, tank car, or other bulk container. (1) Any quantity of a Division 1.1, 1.2, or 1.3 material; (2) A quantity of a Division 1.4, 1.5, or 1.6 material requiring placarding in accordance with Sec (c); (3) A large bulk quantity of Division 2.1 material; (4) A large bulk quantity of Division 2.2 material with a subsidiary hazard of 5.1; continued on Page 8

8 PAGE 8 Hazardous Materials: Risk-Based Adjustment of Transportation Security Plan Requirements; Final Rule SUMMARY: (continued from page 7) (5) Any quantity of a material poisonous by inhalation, as defined in Sec of this subchapter; (6) A large bulk quantity of a Class 3 material meeting the criteria for Packing Group I or II; (7) A quantity of a desensitized explosives meeting the definition of a Division 4.1 or Class 3 material requiring placarding in accordance with Sec (c); (8) A large bulk quantity of a Division 4.2 material meeting the criteria for Packing Group I or II; (9) Any quantity of a Division 4.3 material; (10) A large bulk quantity of a Division 5.1 material in Packing Groups I and II; perchlorates; or ammonium nitrate, ammonium nitrate fertilizers, or ammonium nitrate emulsions, suspensions, or gels; (11) Any quantity of organic peroxide, Type B, liquid or solid, temperature controlled; (12) A large bulk quantity of Division 6.1 material (for a material poisonous by inhalation see paragraph 5 above); (13) A select agent or toxin regulated by the Centers for Disease Control and Prevention under 42 CFR part 73 or the United States Department of Agriculture under 9 CFR part 121; (14) A quantity of uranium hexafluoride requiring placarding under Sec (b); (15) International Atomic Energy Agency (IAEA) Code of Conduct Category 1 and 2 materials including Highway Route Controlled quantities as defined in 49 CFR or known as radionuclides in forms listed as RAM-QC by the Nuclear Regulatory Commission; (16) A large bulk quantity of Class 8 material meeting the criteria for Packing Group I.
