3 Notice 1 Title This notice is the Animal Products (Transport of Export Animal Products and Handling at Point of Export) Notice Commencement This notice comes into force on the 1 November Part 1 Preliminary Provisions 3 Application (1) Subject to clause (2), this notice applies to (a) operators transporting within New Zealand animal products and animal material intended for export with official assurances; and (b) wharf operators handling animal material and products intended for export with official assurances. (2) This notice does not apply to (a) operators handling live animals (that have not been the subject of primary processing) and germplasms that are subject to the official assurance system administered by MAF Biosecurity New Zealand; or (b) operators handling animal products destined for the New Zealand market only, or for export without official assurances; or (c) transport of animal material (including live animals) from the primary producer to the first processing operation, unless an overseas market access requirement issued under section 60 requires such transport to occur under a risk management programme or regulated control scheme; or (d) transportation on the ship or aircraft on which a consignment will be exported from New Zealand. 4 Interpretation (1) In this notice, unless the context otherwise requires Act means the Animal Products Act 1999 dairy transporter means a transport operators who transports dairy product or dairy material under a risk management programme NZFSA means the New Zealand Food Safety Authority wharf means port facilities used for the loading and unloading of sea freight vessels, the temporary portside storage of products while awaiting loading onto a vessel, and sites operated by the port company for the temporary holding of sea freight consignments prior to movement directly to the port. (2) Any term or expression that is defined in the Animal Products Act 1999, or regulations made under the Act, and is used but not defined in this notice, has the same meaning as in that Act or those regulations.
4 Part 2 Requirements for Animal Products and Animal Materials 5 Requirements (1) When transporting animal products and animal material intended for export with official assurances, transport operators must register and operate under a relevant transport regulated control scheme or registered risk management programme. (2) When handling animal products and animal material intended for export with official assurances, wharf operators must register and operate under a relevant regulated control scheme or registered risk management programme. 6 Documented systems (1) Operators must have documented systems to ensure compliance with the requirements of the relevant regulated control scheme or registered risk management programme. 7 Documentation for transport service operators (1) Each consignment must be accompanied by operator documents showing the conveyance reference number, (for example a fleet number, licence plate or flight number). (2) Documentation must include annotations for any changes of vehicle or vehicle reference number during the journey, and any vehicle docking facilities which handled the consignment. (3) Consignments are not required to be accompanied by the documentation in subclauses (1) and (2) if transfer documentation is required under the Act to accompany the animal material or animal product and (a) the operator prevents access to consignments during transport using uniquely numbered seals, approved by the consignor s verifier; (b) the consignor enters the seal number on accompanying transfer documents; and (c) the seals are not removed or changed during the journey. 8 Transfer certification Consignors must identify the transporter and departure date of any consignment on any transfer documents. 9 Revocation of export requirements (1) The Animal Products (Animal Product Transportation and Handling at Point of Export) Notice 2009 is revoked on 1 November (2) The following requirements are revoked on 1 April 2010 (a) 08/004 Road and Rail Transport of Export Meat, Game and Game Meat Products (b) 02/107 Road and Rail Transport of Fish Products Intended for Human Consumption and for which Official Assurances are required (c) 02/094 Verification Activities for Fish Products at Wharves (d) 00/094 Road and Rail Transport of Export Meat, Game and Game Meat Products to and from Licensed or Approved Premises (e) 00/092 Verification Activities for Animal Products at Wharves.
