3 Introduction When HM Customs & Excise (Customs) complete the implementation of the New Export System (NES) it will apply to all exports to non-eu countries. NES will replace the existing export procedures, period entry, local export control and simplified procedures. Implementation is in three stages; Dover went live in March 2002, all other maritime ports go live in October 2002 and the airports follow in Spring Changes to Procedures NES will affect export procedures in a number of ways: All shipments will require positive clearance from Customs before they can be exported. Shipment details must be sent to the Customs computer and permission to progress received before the goods can be loaded onto an aeroplane or ship. Export details can be submitted while the goods are at an inland warehouse or at the port / airport of exit. Every shipment needs to have a Unique Consignment Reference (UCR). This is used to identify the shipment at each stage of the export process and is key in being able to provide the necessary audit trail. The biggest change is that all NES entries are processed by the Customs computer CHIEF (Customs Handling of Import and Export Freight) using electronic messages. This replaces the existing systems using C88 s and commercial documentation e.g. Standard Shipping Notes SSNs. Customs are very keen for exporters or their agents to submit declarations electronically to minimise processing time. There is a NES procedure that allows paper declarations to be manually input into CHIEF by Customs staff, but this could lead to delays in loading goods due to EPU opening times and paper backlogs. For short turnaround exports delays could result in consignments missing a vessel or aeroplane. 3

4 Benefits Electronically submitting export declarations will provide the following benefits to companies involved in exporting: 1. Immediate Positive Clearance Most goods will be immediately cleared by Customs. This service will be provided 24 hours a day, 365 days a year 2. Greater efficiency at ports and airports Delays to shipments through missing or incorrect Customs documentation will be removed, as the presentation of paper declarations will not be required. 3. Evidence of export for VAT purposes Exporters will have, for the first time, electronic evidence of export, for VAT zero-rating. 4. Clearance at own premises Customs authorisation is required Companies can clear goods for export at their own Customs approved premises. This enables a company to retain complete control of movements and avoids the need to remotely clear goods at the port or airport. Any physical searches can also be carried out at the company s premises reducing costs. 5. Simplified Procedures Customs authorisation is required Companies can use Simplified Declaration Procedures enabling the majority of the data required for the export declaration to be electronically submitted to Customs up to 14 days after the vessel / aircraft has departed. A simple electronic Pre-Shipment Advice (PSAs) will need to be submitted prior to export. 6. Electronic links to DoTI and RPA For companies involved in the export of CAP refund and licensable goods, the DoTI and RPA will issue electronic documents. This will remove the need for paper licences, streamlining the export process and speeding up CAP refund payments. 7. Equal treatment Processing times will be consistent providing equal treatment of export declarations at all ports and airports. 4

5 Export Declarations Under NES there are four types of procedures available to cater for different business requirements. Export declarations can be input to CHIEF from any location within the UK. There is no compulsory association with EPUs as there is with imports. Standard Export Procedure (Full Pre-Entry) A full pre-shipment declaration is electronically transmitted to CHIEF. Simplified Declaration Procedure (SDP) A new procedure that enables approved traders (exporters and agents) to make an initial simplified declaration to CHIEF, prior to shipment by, using PSAs. Once the goods have left the UK a supplementary declaration, containing all the data required by Customs, must be sent to CHIEF within 14 days. Both the PSA and the supplementary declaration must be submitted electronically. Local Clearance Procedure (LCP) Allows exporters to have goods cleared at their approved premises, prior to despatch to the port or airport of export. Traders can use either SDP or Full Pre-Entry methods to submit declarations. Designated Export Place (DEP) At an approved DEP export consignments are consolidated for loading and items are declared individually using either SDP or Full Pre-Entry methods. The DEP operator then informs CHIEF which consignments are in the consolidation and creates a master UCR to cover the whole consolidation. After CHIEF accepts and clears the consolidation, it can be moved to the port or airport, where the master UCR is used when dealing with Customs. Note: For all the above procedures Customs will carry out any anti-smuggling checks they feel are required at the port or airport. 5

6 Frontier Processing When the goods for export are at the port or airport, Customs will require two messages to be sent electronically to CHIEF, a Goods Arrival Message and a Goods Departure Message. These two messages are needed to complete frontier processing. Customs believe the submission of these messages is the responsibility of the Loader, as they currently provide the Load List (maritime) or Export Reception List (air). The Loader may be the port operator/cargo handler, the shipping line, the airline or any other authorised organisation. They will require an electronic link to CHIEF. The Goods Arrival Message needs to be sent electronically to CHIEF when the goods physically arrive at the port/airport or inland location. Following receipt of a Goods Arrival Message, CHIEF will make a route known to the sender. The route will state whether the goods have permission to progress or whether they are to be held for further Customs action, e.g. a physical check of the goods. The goods can not be loaded onto a vessel or aircraft until permission to progress has been received. The Goods Departure Message needs to be sent electronically to CHIEF when the goods leave the UK. The Goods Departure Message will provide exporters with the evidence that the goods have been exported. This proof will aid companies in gaining VAT zero-rating for exported goods. This will be available electronically for the first time. 6

8 NES Declaration Procedures The following three pages contain flowcharts showing the three declaration procedures available under NES. The first procedure is for making a declaration prior to the goods arriving at the port or airport; Declaration at the Frontier (Pre-Lodgment). The second shows a declaration for goods that have already arrived at the port or airport; Declaration at the Frontier (Lodgment). The final flowchart shows the procedure for goods that are present or have arrived at inland premises; Declaration Inland (LCP, DEP and ICD). 8

12 Glossary of Terms The following glossary provides a brief description of terms used in this document: Term agent anti smuggling checks CAP CHIEF consignment consolidation Customs declarant DEP DoTI EPU Description In the context of this document a person who either completes a Customs declaration / PSA or deals with the consignment at a later location. An agent can act on behalf of an exporter but may also act on behalf of a freight forwarder, cargo handler, shipping line etc. Customs checks which can only be carried out at the UK frontier e.g. goods substitution checks. Common Agricultural Policy. The agricultural policy used by Member States of the EU. Customs Handling of Import and Export Freight. The name given to the Customs computer that handles import & export declarations. All the goods referred to on a Customs export declaration. The grouping of a number of consignments into usually a single unit (such as a container or trailer) for movement purposes. H M Customs & Excise. The legal body in the UK for controlling, amongst other things, the importing & exporting of goods into and out of the UK. The person/company making the Customs export declaration. Designated Export Place. A Customs approved inland location where goods can be placed under Customs control for export purposes. Department of Trade & Industry. The UK government department in charge of UK trade and industry. Entry Processing Unit. Customs office, generally at a port or airport, for receiving and handling paper import and export documentation. EU European Union A social and economic group consisting of 15 Member States. Export Reception List exporter The traditional paper list at airports used by interested parties, including Customs, to identify what goods are to be loaded onto a aeroplane. Export Reception Lists will be abolished under NES. The Customs description of an exporter as defined in Article 788 of the Customs Code is the person on whose behalf the export declaration is made and who is the owner of the goods or has a similar right of disposal over them at the time when the declaration is accepted. 12

The person/company responsible for arranging the physical movement of the goods. The procedure for sending Customs a complete export declaration prior to the goods being shipped. Inland Clearance Depot. An approved inland location where goods can be declared to Customs and brought under Customs control using Full Pre-Entry and SDP procedures. Local Clearance Procedures. The procedure used to make export declarations while the goods are at a company s premises, prior to being sent to the port or airport of exit. The company responsible for the loading of the goods to be exported onto a ship or aircraft. The traditional paper lists at ports used by interested parties, including Customs, to identify what goods are to be loaded onto a ship. Loading Lists will be abolished under NES. New Export System. New legal procedures for all trade goods being exported outside of the EU. The last Customs office at the EU frontier. For the purposes of this document the Office of Exit is the last Customs office at the UK frontier. An Office of Exit can also be an Office of Export. The first Customs office where the goods can be taken under Customs control for documentary and/or physical checks. An Office of Export can also be an Office of Exit. Under NES this is the term used to indicate that a consignment can move from one export stage to another. Pre Shipment Advice. The initial simple declaration when using PSA, which is sent electronically to CHIEF. The code allocated by CHIEF to a declaration detailing the status of the consignment. 13

14 Term RPA SD SDP UCR Description Rural Payments Agency. An Executive Agency of the Department for Environment, Food and Rural Affairs (DEFRA). The RPA is the paying agency for CAP schemes in England and certain schemes throughout the UK. Supplementary Declaration. The 2 nd stage when using PSA providing a detailed, electronic declaration to CHIEF. Simplified Declaration Procedures. Simplified electronic export procedures. Unique Consignment Reference. A reference allocated by an exporter or their agent to a consignment of goods. 14
