4 3 Executive Summary 3.1 Background The Port of Hastings Development Authority (PoHDA) is a state government entity established on 1 January 2012 to safely manage and operate the Port of Hastings, to promote development of the Port of Hastings and to identify and pursue opportunities for increasing bulk trade. PoHDA took over direct management responsibility of the Port of Hastings on the cessation of the Port Management Agreement with Linx Cargo Care Pty. Ltd. on 1 July The Victorian Regional Channels Authority (VRCA) manages Harbour Control and the Shipping Channels in the Port of Hastings In achieving its vision, mission and objectives, the POHDA commits to the following corporate principles: Integrating safety and sustainability considerations in our planning, management and operations Engaging with the community and stakeholders Ensuring a competitive, economic and financially viable port Complying with relevant legislation and regulation Transparent reporting of our performance Striving to continuously improve. 3.2 Functions of the Port PoHDA The functions of PoHDA under the Transport Integration Act are primarily to: Plan for the development and operation of the port of Hastings Provide land, waters and infrastructure necessary for the development and operation of the Port of Hastings Develop, or enable and control the development by others of, the whole or any part of the Port of Hastings Manage, or enable and control the management by others of, the whole or any part of the Port of Hastings Provide, or enable and control the provision by others of, services for the operation of the Port of Hastings In addition to this, PoHDA will under contract, maintain the navigational aids on behalf of VRCA VRCA As defined in the Transport Integration Act, the VRCA functions are to: Dredge and maintain the Port of Hastings channels Provide and maintain navigation aids associated with the Port of Hastings (function contracted to the Port of Hastings Development Authority) Provide general direction and control of the movement of vessels within the Port of Hastings port waters in accordance with the Marine Safety Act 2010 Provide technical advice and support to the Port of Hastings Development Authority about the management and operation of the Port of Hastings port waters Provide technical advice and support regarding the management and operation of the Port of Hastings Port waters and channels. 5 3.3 Purpose and Scope of Plan The Port Management Act 1995(Vic) (PMA) and supporting Ministerial Guidelines: Port Safety and Environmental Management Plans (2012) require port managers to develop and implement safety and environment management plans (SEMPs) for their ports. The SEMPs are required to take a whole of port, risk based approach to safety and environmental management. All operational activities occurring within a port are required to comply with that port s SEMP. The SEMP for the Port of Hastings was first drafted in 2005 by Patrick Ports Hastings, meeting the requirements of Part 6A of the PMA. This SEMP has evolved over time to reflect changes in port operations and management. The current version of the SEMP (this document), which has been prepared by PoHDA reflects the previous versions, however has been amended to consider the current HSE Management System and business processes of PoHDA. This SEMP is a high level document and is intended to complement PoHDA s and the key port stakeholders HSE Management Systems by bringing a whole of port perspective to the management of safety and environment within the port. The SEMP examines the full range of activities undertaken at the Port of Hastings so that the significant hazards and risks are identified and controlled by the responsible parties. The SEMP will assist PoHDA to respond to the significant hazards and risks in a coordinated, effective and practical way. This SEMP relates to port activities occurring at the Port of Hastings facilities. The gazetted port waters of the Port of Hastings are managed by the VRCA in accordance with its SEMP. This SEMP does not include the BlueScope Steel wharves which are managed under a SEMP developed by BlueScope. Key port activities for PoHDA include: Provision, allocation and management of port facilities Infrastructure maintenance and management Port development Incident management and emergency response Maintenance to navigational aids. 3.4 Port Management Structure and Responsibilities In the Port of Hastings, there are three entities which are port managers, PoHDA and BlueScope who manage landside operations with the Victorian Regional Channels Authority managing the channels, navigational safety and Harbour Control PoHDA is land manager for all State owned port land, which includes responsibility for the maintenance activities associated with the PoHDA s berths. BlueScope manages its land and wharves. VRCA has responsibility for managing the ports channels and anchorage and vessel navigation, including maintenance of navigational aids which has been contracted to PoHDA. The Port of Hastings comprises four separate areas (Steel Industries, Long Island Point, Crib Point and Stony Point) shown in Figure 3.1 Port of Hastings, three of which are covered in this SEMP. PoHDA has statutory responsibilities to Transport Safety Victoria described in Part 2.3 of the Marine Safety Act 2010 in relation to the maintenance and provision of port infrastructure. Parks Victoria manages the waters outside the State Government of Victoria declared port waters and has a SEMP to cover this area. PoHDA is the Coastal Regional Control Agency for Level 1 Maritime Emergencies (non-search and rescue) on behalf of DEDJTR for the waters of Western Port and coastal waters extending three nautical miles from the coastline between Cape Schanck to Wilson Promontory. Any oil pollution to marine waters in the region must be reported to PoHDA who will then verify the spill and report to the EPA, Transport Safety Victoria (TSV) and Australian Maritime Safety Authority (AMSA). Ship safety in port waters during approach and at berth is the responsibility of the VRCA and Harbour Master (employed by VRCA) through statutory responsibilities to Transport Safety Victoria. A full description of the VRCA s and Harbour Masters responsibilities and functions are contained in Part 2.2 and Part 6.4 of the Marine Safety Act 2010 (Vic) as amended. The Harbour Master is also responsible for the Port of Hastings Operating Handbook including Harbour Master s Directions PoHDA maintains and coordinates the Port of Hastings Emergency Plan and as well as the Port of Hastings Security Plan. 6 3.5 Brief Description of Port Location The Port of Hastings is situated in the north arm of Western Port, approximately 70 kilometres southeast of Melbourne. Two large islands, French Island in the middle and Phillip Island to seaward, form the two approaches to the bay Trade The Port of Hastings is a commercial port that serves international shipping operations including the export of crude oil, LPG and steel products and the import of petroleum products. The Port of Hastings also imports and exports general cargo, project cargo, oil and gas project operations and the lay-up/repair of oil rigs/floating platforms. Around 100 vessels, ranging in size up to 100,000 tonnes, enter and leave the Port of Hastings each year. The port s major shipping movements serve the BlueScope manufacturing plant (via the privately owned BlueScope wharves), the Esso-BHP Billiton fractionation plant at Long Island Point and the United Terminals fuel import facility in Hastings. The port is connected to the broader transport network by rail (Stony Point line broad gauge) and via local and regional road networks Port Facilities The Port of Hastings facilities covered by this SEMP includes jetties and land in three precincts within Western Port Long Island Point, Crib Point and Stony Point. The BlueScope wharfs identified in figure 3.1 as Steel Industries are controlled by BlueScope and managed in accordance with BlueScope s SEMP. 7 Figure 3.1 Port of Hastings Major tenants at the port include: Esso Australia United Terminals Inter Island Ferries SERCO Defence VRCA Note: BlueScope wharfs are owned and controlled by BlueScope but are within the designated Port of Hastings boundaries. Users of the port facilities include Cruise Vessels which anchor off Phillip Island from time to time Rigs and heavy lift vessels (on occasion) Vessels servicing the needs of port tenants. 8 Service providers to the Port of Hastings include: Stevedores LW Marine Services Port Phillip Sea Pilots Svitzer Provedores Ship agents and owners Transport companies Vessel surveyors Contractors and Consultants 3.6 Environmental Context Western Port is a Ramsar listed wetland (a convention on wetlands of international importance). It is also a part of the Mornington Peninsula and Western Port Biosphere Reserve and contains three Marine National Parks and five Special Management Areas. It covers an area of approximately 680 square kilometres. There are a wide variety of habitat types in Western Port, ranging from deep channels and seagrass flats, to extensive mangroves and saltmarsh vegetation. Western Port, especially in the northern and western parts experience high levels of turbidity due to significant inputs of sediment from waterways which drain into Western Port, eroding cliffs and banks as well as from strong currents and winds. Western Port is a popular place for recreational boating activities including several yacht clubs and recreational fishing. 3.7 Legal Obligations Operating obligations The Port of Hastings operates within a legislative structure that includes the Westernport (Crib Point Terminal) Act 1963 (Vic), Westernport Development Act (1967) (Vic), Western Port Steelworks Act 1970 (Vic), Transport Integration Act 2010 (Vic), Port Management Act 1995 (Vic) and the Transport Safety Act This legislative structure requires PoHDA to ensure that port infrastructure is maintained and the necessary port services are provided to port customers Safety and environment obligations All port managers have general duties, supported by specific legislative requirements, to prevent or reduce hazards or risks to safety so far as is reasonably practicable as well as to protect the environment from harm. PoHDA has a Health, Safety and Environment (HSE) Management System which is consistent with the requirements of AS/NZS 4801 and ISO The system requirements are reflected in PoHDA s Health, Safety and Environment Management System Manual (HSE MS Manual) and associated procedures and management tools. The system has been developed so that all activities that may have an impact on safety, occupational health or the environment are carried out in a manner that minimises risk and complies with legislative requirements. PoHDA maintains a legal register as part of the HSE Management System which provides an overview of PoHDA s legislative requirements with regards to safety and environmental management. This legal register is reviewed on a regular basis (at least annually) to ensure that PoHDA stays abreast of all of its legal obligations. PoHDA, when notified of incidents from its port stakeholders will follow up incident investigation findings and where appropriate assist in the identification of corrective and preventative actions to prevent recurrence. Key learnings shall be identified and any required improvements reflected in the PoHDA s HSE Management System and SEMP. In addition, all tenants must have a management system in place to effectively manage its safety and environmental risk. Safety and Environment Management Plan POH-HSE-PLN-002 (Rev O) 11

9 3.8 Risk Management Risk Framework The OH&S Act 2004 (Vic) requires that risks be eliminated or reduced, so far as reasonably practicable. PoHDA has a planned and methodical approach to identifying, assessing and controlling HSE risks in the workplace. PoHDA staff responsible for PoHDA activities are required to exercise due diligence to ensure that the PoHDA meets its obligations in relation to HSE. This includes taking reasonable steps to: gain an understanding of the hazards and risks associated with the ports operations; and ensure that the port has appropriate resources, plans and processes to eliminate or reduce to as low as reasonably practicable the risks to health, safety and the environment. PoHDA has undertaken a comprehensive risk review process with key stakeholders to ensure the Port of Hastings risk register reflects all potential safety, health and environmental risks associated with its activities. Identified risks are managed using controls identified in Codes of Practice or Industry Standards or where not available, have been controlled in accordance with the hierarchy of controls to levels as low as reasonably practicable. In addition, PoHDA requires that a Job Safety Environmental Analysis (JSEA, also known as a Safe Work Method Statement) be undertaken for all high risk maintenance activities Whole of Port Risks Each key port stakeholder operates under their own HSE Management System which identifies and addresses operational risks associated with their operations. In preparing the original version of this SEMP, each key port stakeholder was consulted to discuss their respective operational risks that may impact on port operations. Stakeholder operational risks which may impact on port operations have been integrated into PoHDA s Whole of Port SEMP risk register. These risks are discussed at port user meetings quarterly and formally reviewed annually. 3.9 SEMP Objectives and Targets (Whole of Port) Overview The PMA (Section 91CA) sets out the objectives of safety and environmental management planning that the SEMP should address, which are: promoting improvements in safety and environmental outcomes at Victoria s ports promoting and facilitating the development, maintenance and implementation of systems that enable compliance with the various safety and environmental duties that apply to the operation of the port promoting an integrated and systematic approach to risk management in relation to the operation of the port Improve interactions between stakeholders, port users and community Apply sustainable development principles Create opportunities for the continued improvement of safety and environmental performance at the port. PoHDA has developed objectives which are linked to its OHS policy and are aligned to the objectives outlined above. Targets and Key Performance Measures (KPIs) have been established to monitor the effectiveness of this plan in meeting PoHDA s HSE objectives. Performance against these KPI s shall be measured on an ongoing basis and progress reported to the CEO and Board monthly. The targets and KPI s shall be reviewed and updated annually. 11 3.10 Consultation PoHDA s engagement principles are based on inclusivity, transparency, integration and responsiveness with the key objectives of strengthening relationships, building capacity and informing decisions. Specific objectives of the consultative process are to: Identify all relevant stakeholders and interest groups who have, or may have, a legitimate interest in the safety and environmental performance of the port Inform, consult, involve and collaborate with stakeholders as relevant Engage with the SEMP Consultative Committee for the SEMP on a six monthly basis Engage with the Port User Group quarterly Facilitate adequate consultation with stakeholders for any new projects or major changes to existing practices that have safety and environment implications Monitor and evaluate the consultation objectives and planned activities so the approach remains relevant and of value to the implementation of the SEMP.
