3 What is IMPEL TFS Network? The Implementation and Enforcement of Environmental Law (IMPEL) TFS Network is a forum for competent authorities in the EU Member States and other countries (Croatia, Norway, Switzerland and Hong Kong) that enforce the European Waste Shipment Regulation to share information and experience in implementing and enforcing this regulation. Meetings are held regularly to exchange information on waste shipment inspection and enforcement issues. In addition, the Network aims to develop methods and common minimum standards for monitoring and enforcing compliance with waste shipment regulations. The Network has also built up collaboration with other regulators globally, including Interpol, police, customs and the authority of Hong Kong. 3
4 IMPEL TFS Projects In the period two enforcement projects were run under the umbrella of IMPEL TFS network: Seaport (1 and 2) Verification project (1 and 2) Croatia has participated since
5 Why new IMPEL TFS Project? The final Seaport project conference in Liverpool and the Verification Project meeting in Zagreb concluded that both projects had ended too early. Through these projects valuable experience has been gained regarding inspection methods, planning inspections and exchange of staff and information. One of the recommendations was to combine the methods used in both projects into one strategy to be applied in future TFS activities. Based on these findings, all involved enforcement organisations stressed the need to continue joint inspections and enforcement of waste shipments. 5
6 New IMPEL TFS Project In 2006 IMPEL-TFS started a new enforcement project managed and financed by VROM-Inspectorate - The Netherlands and co-financed by IMPEL-TFS also aims to prepare the EU and some non- EU countries for the enforcement of the new WSR (1013/2006). 6
7 New IMPEL TFS Project New project - The Enforcement Actions I and II (EA) combines the objectives and activities of both Seaport and Verification projects: a permanent common and consistent level of enforcement setting up training and exchange programmes for inspection maintain and improve the network of inspectors 7
8 Objectives of EA Project / 1 to contribute to a permanent common and consistent level of enforcement within Europe, to detect illegal waste transports including verification and monitoring, or to verify and monitor waste destination and the treatment at their destination within or outside Europe in order to improve environmentally and humanly sound waste processing, to set up training and exchange programmes for inspectors in order to exchange knowledge and experience, 8
9 Objectives of EA Project / 2 to provide for an easily accessible European enforcement project for all Member States, to detect potentially illegal waste exporters, to maintain and improve the network of front line inspectors, inspection methods, exchange of information and exchange of knowledge, to demonstrate that the Member States continue the joint European enforcement, to improve the collaboration between the different competent authorities and enforcement partners. 9

15 Legal basis rigarding transboundary movement of waste in Croatia National legislation: Waste Act (OG 178/04, 111/06, 60/08) Regulation on supervision of transboundary movement of waste (OG 69/06, 17/07, 39/09 ) Regulation on categories, types and classification of waste with a waste catalogue and list of hazardous waste (OG No. 50/05, 39/09) International legislation: Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal (OG IT 3/94, came into force with respect to the Republic of Croatia on 9 May 2000) Regulation (EC) No 1013/2006 of the European Parliament and of the Council of 14 June 2006 on shipments of waste 15

17 Legal basis according transboundary movement of waste in Croatia Croatia 2007 Progress Report Chapter 27 A Regulation to control transboundary movements of waste, based on the Basel Convention on Hazardous Wastes, has been enacted. Croatia 2008 Progress Report Chapter 27 Full alignment with the acquis in management of waste from extractive industries, hazardous waste and shipments and trans-boundary movement of waste is still required. Preparations in this area are advancing. 17

22 Company inspections After findings on inspections made on road boarder crossing, inspectors have done inspections in companies detected, during transport inspections, which were not in compliance. 22
23 Benefits Environmental inspectors have already been prepared for new national legislation - Regulation on supervision of transboundary movement of waste, 2006, Cooperation between country of dispatch and destination and bilateral cooperation between neighboring countries, Enhanced collaboration with custom and police (each inspector made her/his own network with relevant authorities on their competence areas), Verification on request in any country, participated in EA project (eg. request of NL inspectors about WEEE waste exported from Croatia), Possibility to control waste streams from cradle to grave across almost whole Europe/world. 23
24 Planing It was planned for the year to control all border crossings 6 times/year. Each environmental inspector prepare his/her own detailed plan announced when it is necessary to relevant bodies. 24
