1 COMHAIRLE CHONTAE NA GAILLIMHE WASTE MANAGEMENT ACT 1996 WASTE MANAGEMENT (FACILITY PERMIT AND REGISTRATION) (AMENDMENT) REGULATIONS, 2008 WASTE FACILITY PERMIT Name Address Wheeley Environmental Refuse Services. 2 CEAD DRAMHAÍOLA WFP-G WASTE FACILITY PERMIT WFP-G PART A: ACTIVITIES PERMITTED Permitted Waste Recovery Activities, in accordance with the Fourth Schedule of the Waste Management Acts, Class 2 Recycling or Reclamation of organic materials which are not used as Class 3 Class 4 Class 13 solvents.(including composting and other biological processes) Recycling and reclamation of metals and metal compounds Recycling or Reclamation of other inorganic materials. Storage of waste intended for submission to any activity referred to in a preceding paragraph of this Schedule, other than temporary storage, pending collection, on the premises where such waste is produced. Permitted Waste Recovery Activities, in accordance with the Third Schedule of the Waste Management Acts, Class 11 Blending or mixture prior to submission to any activity referred to in this Class 13 schedule Storage prior to submission to any activity referred to in a preceding paragraph of this Schedule, other than temporary storage, pending collection, on the premises where such waste is produced. Classes of activity subject to waste facility permit application to a Local Authority as per part 1 of the third Schedule of the regulations Class 7 Class10 Recovery of inert waste arising from construction and demolition activity, including concrete,bricks, tiles, or other similar material,at a facility (excluding land improvement or development) where: (a) the annual intake shall not exceed 50,000 tonnes and (b) The maximum quantity of the residual waste consigned from the facility for collection, onward transport and submission to disposal at an authorized facility shall not exceed 15% of the annual intake. The recovery of waste (not mentioned elsewhere in this part of the third schedule),other then hazardous waste or an activity specified in category 5 of annex 1 of Council Directive 96/61/EC, where: (a) the annual intake shall not exceed 50,000 tonnes and (b) The maximum quantity of the residual waste consigned from the facility for, onward transport and submission to disposal at an authorized facility shall not exceed 15% of the annual intake.

3 Only material which conforms to the following European Waste Catalogue code reference under Commission Decision 2001/118/EC shall be accepted and processed at the site: Concrete Bricks Tiles and Ceramics Mixture of concrete, bricks, tiles and ceramics other then that mentioned in Wood Glass Plastic Bituminous mixtures containing other than those mentioned in Copper, brass, bronze Aluminum Lead Zinc Iron and Steel Tin Mixed Metals Cable other then that mentioned in Soil and Stones other then those mentioned in Dredging spoil other then that mentioned in Track ballast other then that mentioned in Insulation materials other then that mentioned in and Gypsum based construction materials other then that mentioned in Mixed construction and demolition waste other then that mentioned in , and Paper & Cardboard Glass Wood Plastic Metals NOTE: GRANTING OF THIS WASTE FACILITY PERMIT, AND ANY CONDITION IMPOSED BY IT, DOES NOT EXEMPT THE HOLDER OF THE WFP FROM COMPLYING WITH THE STATUTORY OBLIGATIONS OF ANY RELEVANT LEGISLATION, INCLUDING WATER POLLUTION, AIR POLLUTION, WASTE, LITTER AND PLANNING LEGISLATION.

4 PART B: CONDITIONS SCOPE OF WFP / SAN ÁIREAMH SA CHEAD 1.1 For the purpose of this permit the facility is the area of land, outlined in red, marked on Drawing No. WE0101F, titled Site Location Plan submitted with this application on the 1 st July For the purpose of conditions of this permit the Waste Facility Permit may be referred to as WFP. 1.3 This Waste Facility Permit is issued under the Waste Management (Facility Permit and Registration) Regulations 2007, to Wheeley Environmental Refuse Services (trading as WERS Waste) in respect of a waste management facility at Weir Road Business Park, Weir Road, Tuam, Co. Galway and will be non-transferable. The WFP holder shall be responsible for the operation of the waste facility in strict accordance with the WFP conditions. 1.4 This Waste Facility Permit shall be valid for five years from the date of issue of this WFP save when Galway County Council at its sole discretion revokes the WFP. Galway County Council may, at any time, review the WFP at its discretion. 1.3 The waste activities shall be confined to the area marked proposed storage/processing area on the site plan drawing number WE0101F submitted with the WFP application received on 1 st July All operations associated with materials recovery and storage shall take place indoors. All materials processed and awaiting transfer shall be stored indoors. No materials are allowed to be stored or processed outside the buildings. 1.4 The WFP holder must obtain written agreement from Galway County Council before: a) making an alteration or reconstruction in respect of the activity that materially changes the range of processes carried out b) making a change in site management and control that has adverse environmental significance. 1.5 This Waste Facility Permit is for the purposes of the Waste Management (Facility Permit and Registration) Regulations 2007, only and no condition imposed in this WFP shall not be construed as negating the permit holders statutory obligations under any other enactment or regulations (e.g. Planning Act) 1.6 In the event of any breach of the conditions of the WFP, the WFP holder shall on receipt of notice from Galway County Council, cease operations on the site within the time specified on the notice and the WFP shall be suspended from the date specified on the notice until such suspension is lifted on rectification of the breach of conditions in the notice. Notice under this condition shall be sent by post to the WFP holder. When the notice has been complied with, the WFP holder shall provide written confirmation to the local authority that the requirements of the notice have been carried out. No waste, which is stipulated in the notice shall be accepted at the facility until written confirmation is received from the Council that the notice is withdrawn. To clarify the scope of this Waste Facility Permit.

5 MANAGEMENT OF THE ACTIVITY / BAINISTIOCHT 2.1 The WFP holder shall acquaint all staff, employees, lessees and agents, including replacement personnel, of the provisions and conditions of this WFP. 2.2 A copy of this WFP shall be held at all times at the facility. 2.3 The Site shall be adequately manned and supervised at all times. It shall be maintained to the satisfaction of Galway County Council and adequate precautions shall be taken to prevent unauthorised access to the site. 2.4 All run-off from waste or recovery material inside the buildings shall be directed to oil interceptor prior to discharge to the the public sewer. 2.5 All yard run-off shall be directed to the oil interceptor prior to discharge to the public sewer. 2.6 All vehicles, skips, trailers etc shall be washed at the wash down area as indicated on the submitted drawings and shall be directed to the oil interceptor prior to discharge to the public sewer. 2.7 The WFP holder is to notify the following to Galway County Council in writing within one month of receipt of WFP: (a) The name of the person on site nominated by them who has responsibility for the implementation of the Waste Regulations and the name of his/her deputy. (b) The name, address and telephone number of the person nominated by them to provide 24 hour call out in the event of an emergency. (c) Confirmation of acceptance of all the conditions attached to the WFP. 2.8 The hours of operation of the facility shall be between the hours of 8.00 am and 6.00 pm, Monday to Saturday. No work or waste acceptance shall be permitted outside these hours. No work shall take place on site on Sundays and public holidays. To provide for the proper management of the activity. RECORD KEEPING AND NOTIFICATION / TAIFID AGUS FÓGRA 3.1 Records shall be kept on site in a site register and shall include the following information: (a) (b) (c) (d) (e) Name of the carrier. Description and origin of the material in each load. The dates and times of all waste deliveries to the site and vehicle registration numbers. The quantity of the materials. Where loads are removed or rejected, details of the material and the place to which they were removed.

6 3.2 The WFP holder shall immediately notify Galway Council by telephone/fax of any incident that occurs as a result of the activity on the site, and which: - (a) (b) (c) has the potential for environmental contamination of surface water or ground water, or poses an environmental threat to air or land, or requires an emergency response by the Council. Full details shall be forwarded in writing on the next working day. The WFP holder shall include as part of the notification: - the date and time of the incident details of the incident and circumstances giving rise to it an evaluation of environmental pollution caused, if any actions taken to minimise the effect on the environment steps taken to avoid reoccurrence any other remedial action taken. The WFP holder shall make a record of any such incident in a register to be maintained on the site. 3.3 The WFP holder shall maintain on the site a register of all complaints received relating to the operation of the activity. Each such record should give details of the following: - time and date of the complaint the name of the complainant details of the nature of the complaint actions taken to deal with the complaint and the results of such actions the response made to each complainant 3.4 The WFP holder shall maintain an on site maintenance register of maintenance carried out on all equipment and machinery at the facility. This register shall include all records of maintenance to the inceptor traps, drains and litter checks. 3.5 The WFP holder shall make all records maintained on the site available for examination to Galway County Council staff at all reasonable times, and shall provide any relevant information when so requested by an authorised officer of Galway County Council. 3.6 The WFP holder shall notify Galway County Council within 7 days of, (a) the imposition of any Court order made under Section 57 or 58 of the Waste Management Act (b) any conviction for an offence under Section 34(5) or 40(7) of the Waste Management Act Where Waste Facility Permits are issued for a period longer than 12 months, the WFP holder shall submit to Galway County Council an Annual Environmental Report (AER) for the preceding calendar year by no later than the 28 th February of each year. For WFPs issued for 12 months or less, the WFP holder shall submit the Environmental Report within one month of waste activities ceasing on the site. The report shall include the information contained in the registers described above and details of any impositions or convictions imposed under the Waste Management Act, together with details of: - (a) the management and staffing structure of the facility

7 (b) (c) (d) (e) (f) quantity, composition and destination of all wastes handled at the facility during the year details of any loads rejected at the facility during the year reportable incidents details of all complaints In addition, the WFP holder shall include in the report, a written summary of compliance with all of the conditions attached to this WFP To provide necessary information to the Local Authority SITE INFRASTRUCTURE / INFRASTRUCTÚR SUIMHE 4.1 The WFP holder shall provide and maintain a substantial facility notice board at the entrance to the facility. The Board shall clearly show: (a) (b) (c) (d) The name and telephone number of the facility. The Waste Facility Permit number and date of grant of the WFP. The normal opening hours of the facility. The name, address and telephone number of the WFP holder. The minimum dimensions of the Board shall be 600mm by 200mm. 4.2 The site, site entrance and access roads shall be maintained to the satisfaction of Galway County Council. Roadways shall be maintained to ensure the safe movement of vehicles within the facility. No traffic queuing shall be allowed on the public road. 4.3 Adequate precautions shall be taken to prevent unauthorised access to the site. To provide for the protection of the environment. WASTE ACCEPTANCE AND HANDLING / GLACADH LE AGUS IÁIMHSEÁIL DRAMHAIOLA 5.1 All recyclable waste leaving the facility shall be sent to a facility for which there is a valid Waste Facility Permit or license under the Waste Management Act All non-recyclable waste leaving the facility shall be disposed of in accordance with the Waste Management Act Materials other than those permitted shall be removed immediately from the site. Such waste shall be disposed of (or recovered) at an alternative facility with an appropriate Waste Facility Permit or waste license. 5.3 The WFP holder shall submit a plan for Fines Management at the facility. 5.4 The WFP holder shall ensure that appropriate indoor storage is provided for the materials on site. 5.5 The WFP holder shall maintain the general area of the site in a clean and tidy state. 5.6 All operations associated with material recovery and storage shall take place indoors. No waste shall be stored outside the buildings.

8 5.7 All trucks shall be unloaded / loaded within the existing buildings. 5.8 The WFP Holder shall ensure that all contractors and vehicles delivering to the site currently hold a valid Waste Collection Permit from Mayo County Council in accordance with the Waste Management (Collection WFP) Regulations, 2001 or has applied and is legally entitled to collect and transport waste material and in the case of hazardous materials, must be accompanied by a C1 form. All movements of hazardous waste and co-mingled green list waste from the facility to locations outside the Rep. of Ireland must be accompanied with the correct TFS documentation. To provide for the acceptance and management of wastes authorised under this Waste Facility Permit. EMISSIONS AND ENVIRONMENTAL IMPACTS / ÉIFEACHT AR AN TIMPEALLACHT 6.1 Air Quality / Aer The WFP holder shall ensure that all operations are carried out in a manner such that air emissions including dust do not cause any significant impairment on amenities outside the permitted site. Dust emissions at any boundary of the site shall not exceed 350 mg/cubic meter/day. Emissions shall be monitored three times a year at stations AA1, AA2 and AA3 as indicated on drawing number WE0101F submitted with the application on the 1 st July The WFP holder shall take adequate precautions to prevent undue noise, odour, dust, grit, litter and other nuisances on the site, which would result in a significant impairment of, or a significant interference with, amenities or the environment beyond the site boundary. 6.3 All vehicles transporting loose waste to and from the premises shall be either totally sealed or covered with a net or tarpaulin in such a manner as to preclude the scatter of materials in transit to and from the site. The WFP holder shall be responsible for the clearance of any material deposited on roadways in transit to the site. Failure to maintain roadways in a satisfactory condition will result in this WFP being revoked and possible prosecution. 6.4 Loose waste which may be lying on the site or access road to the site shall be gathered and disposed of at least once a day or as directed by the Council. 6.5 Dust suppression equipment must be available at all times in the event of excess dust emissions arising from the operations. The WFP holder must comply with all Occupational and Health & Safety Legislation requirements with regard to the employees health and safety requirements. 6.6 The WFP holder shall take adequate steps to minimize noise from the facility and shall have regard to noise sensitive locations. In addition there shall be no clearly audible tonal component or impulsive component in the noise emissions from the site at any noise sensitive locations. Noise emissions at any boundary of the site shall not exceed 55dB (A) during operational hours from Monday to Saturday (inclusive) and 45dB (A) at any other time. Emissions shall be monitored annually at Noise Monitoring Points AN1 and AN2 as indicated on drawing number WE0101F titled Site Monitoring Plan submitted with the application on the 1 st July 2009.

9 6.7 If, in the opinion of the Roads Maintenance Area Engineer, damage is being caused to public roads being used to haul material to the site by the WFP Holder, he shall be empowered to verbally instruct the WFP Holder to cease using these haul roads and use alternative route(s) until the damage has been repaired to the satisfaction of the Council. The WFP Holder shall comply with any such instruction. 6.8 No vehicle queuing or parking of vehicles must occur at the entrance or exit to the facility. If in the opinion of Galway County Council, vehicles are causing a potential hazard to road users in the area or a hazard to users of adjacent facilities, the WFP may be suspended or possibly revoked 6.9 No waste shall be burned on the site The WFP holder shall maintain sufficient and continuous vermin control at the site. To provide for the control of nuisances, emissions and other environmental impacts. ENVIRONMENTAL MONITORING / MONATÓIREACHT TIMPEALLACHTA 7.1 Authorized staff of Galway County Council shall have unrestricted access to the premises at all reasonable times on production of identification, if required, for the purpose of their functions under the Waste Management Act 1996, including such inspections, monitoring and investigations as are deemed necessary by the Council. To ensure compliance with the requirements of the conditions of this WFP CONTINGENCY ARRANGEMENTS / SOCRAITHE TEAGMHAIS 8.1 Adequate fire extinguishers and emergency response equipment shall be maintained on site. 8.2 The WFP holder shall ensure that an Emergency Response Procedure (ERP) is in place, which shall address any emergency situation that may originate on site. This procedure shall include provision for minimizing the effects of any emergency on the environment. The ERP is to be submitted to Galway County Council within six months of the date of issue of this WFP. To provide for an emergency situation at the facility. FINANCIAL PROVISIONS / AIRGEADAIS 9.1 The WFP holder shall pay to Galway County Council an annual contribution of 720. The first payment must be made within 8 weeks of issue of this WFP. The contribution will be used towards the cost of such monitoring of the activity, as the Council considers necessary for the performance of its duties under the Waste Management Act 1996.

10 9.2 In the event of any additional resources (i.e. the need for sampling, further auditing or inspections etc) the WFP holder shall cover these costs. 9.3 In the event of an accident occurring at the site which leads to the emission or release of hazardous materials or of waste which contains any of the properties outlined in Part III of the Second Schedule of the Waste Management Act, 1996 and which has a detrimental effect on the surrounding environment, or which is deemed to be so by authorized officers from Galway County Council, pollution abatement and remediation measures must be taken. Galway County Council may take these measures and their costs reimbursed by the WFP holder. Analysis and monitoring included in these measures if required must continue for not less than 10 years after the final remediation works have been carried out.
