5 Compendium of Regulations and Guidelines European Best Practice Guidelines for Abnormal Road Transport The EU has laws on the maximum weights and dimensions allowed for road freight. Loads that surpass the limits referred to as abnormal loads require special permits from regional or national authorities. Different countries have different rules and procedures for obtaining these permits concerning vehicle escorts, allowed time frames, authorized speeds, etc. That makes things complicated for transport companies. 12 Compendium of Regulations and Guidelines Chapter 1.2 of ADR DEFINITION "Carriage" means the change of place of dangerous goods, including stops made necessary by transport conditions and including any period spent by the dangerous goods in vehicles, tanks and containers made necessary by traffic conditions before, during and after the change of place. This definition also covers the intermediate temporary storage of dangerous goods in order to change the mode or means of transport (trans-shipment). This shall apply provided that transport documents showing the place of dispatch and the place of reception are presented on request and provided that packages and tanks are not opened during intermediate storage, except to be checked by the competent authorities.

13 Compendium of Regulations and Guidelines The Section of ADR Handling and stowage Where appropriate the vehicle or container shall be fitted with devices to facilitate securing and handling of the dangerous goods. Packages containing dangerous substances and unpackaged dangerous articles shall be secured by suitable means capable of restraining the goods (such as fastening straps, sliding slatboards, adjustable brackets) in the vehicle or container in a manner that will prevent any movement during carriage which would change the orientation of the packages or cause them to be damaged. When dangerous goods are carried with other goods (e.g. heavy machinery or crates), all goods shall be securely fixed or packed in the vehicles or containers so as to prevent the release of dangerous goods. Movement of packages may also be prevented by filling any voids by the use of dunnage or by blocking and bracing. Where restraints such as banding or straps are used, these shall not be over-tightened to cause damage or deformation of the package1. The requirements of this paragraph are deemed to be complied with if the cargo is secured in accordance with standard EN : Guidance on the stowage of dangerous goods can be found in the European Best Practice Guidelines on Cargo Securing for Road Transport published by the European Commission. Other guidance is also available from competent authorities and industry bodies.

14 Compendium of Regulations and Guidelines The Section of ADR Handling and stowage Packages shall not be stacked unless designed for that purpose. Where different design types of packages that have been designed for stacking are to be loaded together, consideration shall be given to their compatibility for stacking with each other. Where necessary, stacked packages shall be prevented from damaging the package below by the use of load-bearing devices During loading and unloading, packages containing dangerous goods shall be protected from being damaged. NOTE: Particular attention shall be paid to the handling of packages during their preparation for carriage, the type of vehicle or container on which they are to be carried and to the method of loading or unloading, so that accidental damage is not caused through dragging or mishandling the packages The provisions of also apply to the loading, stowage and unloading of containers, tank-containers, portable tanks and MEGCs on to and from vehicles Members of the vehicle crew may not open a package containing dangerous goods.

During a roadside inspection a vehicle may be subject to an inspection of its cargo securing in accordance with Annex III, in order to ensure that the cargo is secured in such a way that it does not interfere with safe driving, or pose a threat to life, health, property or the environment. Checks may be carried out to verify that during all kinds of operation of the vehicle, including emergency situations or uphill starting manoeuvres: loads can only minimally change their position relative to each other, against walls or surfaces of the vehicle, and loads cannot leave the cargo space or move outside the loading surface. 2. Without prejudice to the requirements applicable to transport of certain categories of goods, such as those covered by the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR) cargo securing and inspection of the securing of cargo may be carried out in accordance with the principles and, where appropriate, the standards laid down in Section I of Annex III. The latest version of the standards laid down in point 5 of Section I of Annex III may be used. 3. The follow-up procedures referred to in Article 14 may also apply in the case of major or dangerous deficiencies related to cargo securing. 4. Member States shall provide that personnel involved in cargo securing checks are to be appropriately trained for that purpose.

Cargo securing shall withstand the following forces resulting from accelerations/decelerations of the vehicle: in driving direction: 0,8 times the weight of the cargo and in lateral direction: 0,5 times the weight of the cargo and against driving direction: 0,5 times the weight of the cargo, and in general must prevent tilting or tipping of cargo. ETC 2 II. Inspection of the Securing of Cargo 1. Classification of deficiencies Deficiencies shall be classified in one of the following deficiency groups: Minor deficiency: a minor deficiency exists when the load has been properly secured but a safety advice might be appropriate. Major deficiency: a major deficiency exists when the load has not been sufficiently secured and a significant shifting or overturning of the load or parts thereof is possible. Dangerous deficiency: a dangerous deficiency exists when traffic safety is directly endangered due to a risk of loss of cargo or parts thereof or a hazard deriving directly from the cargo or an immediate endangering of persons. 2.
