Y N CMV Guidelines for Completion of the DOT Covered Function Checklist OpQual & DER USE ONLY E. Response Y N Non-Covered DOT-Y DOT-N The following guidelines will assist you in completing the DOT Covered Function Checklist. Your response will determine if the job is a safetysensitive DOT regulated position. Personnel Subject to DOT Drug & Alcohol Testing Regulations (49 CFR Part 40) include any individual performing Covered Functions as defined in Part 199 (Section 1), Operator Qualification Covered Tasks as defined in Part 192, Subpart N (Section 2) or Operates a Commercial Motor Vehicle as defined in Part 382 (Section 3) below. 1) Personnel Performing Covered Functions Per Part 199- Drug and Alcohol Testing- Pipeline Hazardous Materials Safety Administration (PHMSA) Covered functions as defined in 49 CFR, that have the following three characteristics: The function is an operations, maintenance, or emergency response function; Is regulated by 49 CFR Part 192, 193, or 195; Is performed on a pipeline or LNG facility Operations functions control the movement or storage of natural gas, LNG, hazardous liquid or carbon dioxide Maintenance functions preserve a pipeline or LNG facility for future use Emergency Response functions are steps taken to identify emergencies, respond to emergencies, protect people, and return a pipeline or facility to normal operations after an emergency. When considering whether an employee is performing an emergency response function, the following criteria should apply: The job classification and position description contain information about covered functions that the employee may perform in an emergency situation. The employee received training in the performance of covered functions in an emergency situation. The employee is involved in, or may potentially be called upon to perform, any of the functions defined in the Company s Emergency Response Plan and associated Procedures required by Emergency Plans or Emergency Procedures. Covered employee or individual is a person who performs a covered function, including persons employed by operators, contractors engaged by operators, and persons employed by such contractors (sub-contractors). Performs a covered function includes actually performing, ready to perform, or immediately available to perform a covered function. 2) Personnel Subject to Operator Qualification Program Per Part 192, Subpart N- Qualification of Pipeline Personnel The Operator Qualification Program applies to all individuals who perform covered tasks, whether they are employed by the Company, a contractor, a sub-contractor, or any other entity performing covered tasks on behalf of the company. Covered tasks are defined as an activity identified by the Company as meeting all of the following criteria: Is performed on a pipeline facility Is operations or maintenance tasks, or new construction Is performed as a requirement of 49 CFR Part 192, and Affects the safe operation or integrity of the pipeline All Operator Qualification tasks are DOT covered functions as noted in the Drug & Alcohol Testing Regulations in Section 1 above. 3) Operators (Drivers) of Commercial Motor Vehicles Per Part 382 Federal Motor Carrier Safety Administration (FMCSA) Commercial motor vehicle is a motor vehicle or combination of motor vehicles used in commerce to transport passengers or property if the vehicle: (1) Has a gross combination weight rating, or gross combination weight, of 11,794 or more kilograms (26,001 or more pounds), whichever is greater, inclusive of a towed unit with a gross vehicle weight rating of more than 4,536 kilograms (10,000 pounds), whichever is greater; or (2) Has a gross vehicle weight rating of 11,794 or more kilograms (26,001 or more pounds); or (3) Is designed to transport 16 or more passengers, including the driver; or (4) Is of any size and is used in the transportation of materials found to be hazardous for the purposes of the Hazardous Materials Transportation Act (49 U.S.C. 5103(b)) and which require the motor vehicle to be placarded under the Hazardous Materials Regulations (49 CFR part 172, subpart F). Driver is any person who operates a commercial motor vehicle. This includes, but is not limited to: Full time, regularly employed drivers; Casual, intermittent or occasional drivers; Leased drivers, and Independent owner-operator contractors.

EMERGENCY RESPONSE FUNCTIONS Associated with pipeline incidents and regulated by 49 CFR Parts 192, 193 or 195 (Refer to Emergency Plans) Yes No Task Supervises or provides work direction that involves selecting and dispatching a first-responder to a natural gas odor call, gas leak, or similar emergency that immediately threatens life and property. Steps in to perform, is ready to perform, is immediately available, or may potentially be called upon to perform a covered function (i.e., for another employee in an emergency situation, and is OpQual trained to perform covered functions ) Takes steps to identify emergencies, protect people, and/or return a pipeline or LNG facility to normal operation Receives, identifies or classifies notices of events that need immediate response by the operator, or notices to fire, police, or other appropriate public officials; communicates this information to appropriate operator personnel for corrective action, including answering calls and making emergency decisions during non-office hours Dispatches personnel for emergency response to make it safe (i.e., takes the call, captures incident information, assesses the problem and dispatches the responder to make the incident safe) May perform an Emergency Function or Task as defined in the Company s Emergency Response Procedures created in compliance with requirements of (Emergency Plans) May perform an Emergency Function or Task as defined in the Company s Emergency Response Procedures created in compliance with requirements of Part 193 ( ) Note: Providing procedural or policy direction only is considered a support function, not an emergency response function; Dispatching and taking notices of events are independent functions for which procedures are required under (a); An employee who merely answers the phone and refers calls to another is not subject to being covered, but would subject the latter employee taking notice of the event (i.e., writing down the information on a permanent record).
