1 CLEVELAND STATE UNIVERSITY SURPLUS PROPERTY BID #463LW 5/30/08 Cleveland State University is soliciting bids for the sale and removal of surplus equipment per attached list. All quotations must be firm. Bids will be awarded by item or as a whole at the discretion of the University. Unit prices govern the award. Check your bid carefully for it cannot be corrected after the bids have been opened. If identical bids are received, the one received first will be selected. The University reserves the right, at its discretion, to remove any equipment from the list. We reserve the right to make an award, which is in the best interest of the University. We also reserve the right to accept or reject any or all bids and to waive any informality in bidding. The purchaser shall furnish all labor, tools, equipment, cartage, etc., as necessary for the removal of the equipment from its respective location. Purchaser is responsible for any damage caused by purchaser in removing the equipment from its location and the University may require proof of a general liability insurance policy or a bond in the form of a current certificate of insurance or proof of the bond. The purchaser shall indemnify and save the University, its agents and employees harmless from and against any and all losses, liabilities, costs, expenses, actions and claims and any reasonable attorney s fees and legal costs resulting from injury to or death of any person arising out of the removal of any surplus items. Equipment shall be removed within two () weeks after notification of award, unless a different time is specified in the bid. If equipment is not removed within this timeframe, the sale will be voided and any money paid to the University will be forfeited. All equipment and material removed under this contract shall be disposed of off the University property. Cleveland State University makes no warranty, expressed or implied, as to the condition, quantity; kind, weight, size and description of any of the property, or its fitness for any use or purpose and assume no liability with respect to any item listed in this inquiry. All goods are sold as is and where is and all sales are final. These items are available for inspection the information on the attached sheet. If you wish to inspect these items in order to place a bid, please contact the person(s) indicated.
