1 STORAGE TARIFF UPDATE (25/JAN/2013 Board of Directors) It includes the use of storage areas no delimited as transit or shunting areas, defined in the goods tax, with the exception of the public domain areas yielding the tax for exclusive occupation of the port public domain. Payment of this tariff shall be based on the occupied area and the usage time. 2 APPLICATION CONDITIONS:. The bonus percentage differentiated for each band is applied to the units included in each one of them, handled during the previous eleven months plus the current one.. It is applied to the units from the same manufacturer, according to the cumulated volume of units from that manufacturer in the last eleven months plus the current one.. In the case of transit units, each unit shall be counted once when it entries into the storage areas.. Units shall be counted by entry order in the storage areas- The mentioned tariffs shall enter into force on 1 January This decision concludes the administrative procedure, according to the article 109 c) of the Law 30/92 of 26 th november, of Legal Regime of Public Administrations and the Common Administrative Procedure [Ley 30/92 de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común], and an appeal may be brought against it. Also, the following amounts for area occupied to the goods that is embarked or disembarked by RO-RO means except automobiles (rolling) are established. In case the user fails to meet the obligation of removing the goods from the storage area when requested, the amounts defined in the goods tax for occupying the transit area shall be invoiced as storage tariff by the Port Authority of Vigo. As an exception, due to port operation reasons and in case of repeated noncompliance by the user, a penalty payment of 20 % of the result of multiplying the storage area by the goods tax corresponding to transit area occupancy by each 24 hours or delay period shall be imposed by the Port. 2

3 If due to port operations, a user asks the occupancy the transit or shunting/manoeuvring area, defined in the goods tax, the tax amount shall be invoiced as storage tariff amount by the Port Authority of Vigo. SETTING THE AREA SUBJECT TO THE TARIFF The rectangular area surrounding the stored goods shall be counted as area of occupancy. SETTING THE BOOKED PERIOD Storage shall be calculated from the booked day until the goods are removed from the area, leaving it free. If the booking is cancelled or changed less than twenty four hours before it begins or if no cancellation is received and the goods do not arrive at the port, the Port Authority has the right to charge the tariff applicable to the goods for the entire day if the area could have been used for other goods. OBLIGATIONS OF THE USER The port director shall decide how, in which order, and at which loading height to store the goods in accordance with current legislation and taking the necessary precautions to ensure the stability of the piles and the load-bearing capacity of the raised areas, etc. In all circumstances and for the purposes of this tariff, the area shall only be considered free when it is found in the same condition and state of cleanliness and preservation as when it was first occupied and can therefore be accessible and useful for other activities. If after having removed the goods or vehicles, this requirement is not met by the user, the Port Authority shall need to clean the aforementioned area itself and shall charge the customer the relevant amount for this service. 3

4 SUPPLY TARIFF This tariff includes the value of the water and electricity provided by the Port Authority to users in the Commercial Docks of the Service Area in the Port of Vigo. If due to other circumstances beyond the Port Authority and being its staff on their positions, the requested operation was not carried out, the user will have to provide for 50% of the costs that should have been paid if the supply were carried out. In the freshwater supplies to vessels, required meters are included in the tariff. o Water supply services to the vessels provided overtime shall be invoiced with an extra surcharge of 10 % for each of the first two extra hours, 25 % in the following and 25 % during public holidays, with the exception of the ones carried out in the Fishing Port. 5 o This tariff does not include the use of welding special plugs or mobile transforming and measuring equipment or any other additional elements when they are necessary. TARIFF FOR VARIOUS SERVICES This tariff shall be charged for the provision of any other commercial service by the Port Authority not listed in the previous tariffs, such as weighing machines, gangways, etc. SPECIFIC REGULATIONS 1. The amounts mentioned below for the tariff shall be paid by the users of the corresponding services. 2. This tariff shall be applied to the number of unities of the service provided in each case. 3. The Port Authority shall not be liable for damages arising from breaks in the service or produced by fortuitous average/breakdowns or breakings that could happen whilst service is being provided. 4. The Port Authority reserves the right to provide service when, due to its characteristics, the good operational progress could be hindered or the security of the facilities would be threatened. Users shall be responsible for damages caused to material. 5. VAT is not included in the amounts of any of the tariffs. TARIFF 1: USE OF WEIGHING MACHINES Payment of this tariff shall be based on the complete weighing (tare and gross). The cost of the means required to place the fenders shall be undertaken by the user. 7
