6 Building Regulations, Approved Document B, Fire Safety. This document details that all inhabited rooms, (Kitchens and Bathrooms are exempt), must have at least one window which has a clear opening size of no less than.33m², and a minimum opening size of 450mm in any direction, for emergency egress from fire. An opening of 450mm X 450mm is only.20m². The minimum width of window to pass this criteria is 586mm. The minimum height depend on the Transom Drop (TD) To establish whether a window passes the criteria, calculate the width and height of the clear opening size with the following formulae, and transfer to the graph below. These calculations are only relevant for our Heritage range of window. Opening Width (X) = Window Width Opening Height (Y) = TD Any result above the blue line will meet the criteria set out in the mentioned Building Regulation.

7 BS 6262: Part4: 1994 BS 6262 part 4: 1994 Safety Glass The publication of BS 6262 Glazing for Building : Part 4 Safety Related to Human Impact mirrors Building Regulations Part N (England & Wales), but extends the critical locations to cover bathing areas and gymnasia, where advice is to use minimum class C safety glass. It also contains further explanation and guidance. Consumer Protection Act 1987 Section 10 of the consumer protection act 1987 provides (amongst other things), that it is an offence to supply goods which fail to comply with the general safety requirement. Goods will fail to comply with the general safety requirement if they are not reasonably safe having regard to all the circumstances including any safety standards. This means that in deciding whether the goods complied with the general safety requirement, the courts can have regard to standards, such as British Standards, and can do so irrespective of whether those standards have been incorporated in safety regulations. Thus, in effect, it is wise to regard BS6262: Part 4 for all practical purposes as a Legal Requirement for any glass sold directly to the general public for use in critical locations. The diagram opposite shows the areas where a minimum class C safety Glass is required.

12 1.0 Quotations: Terms And Conditions of Sale 1.1 All quotations are provisional and are not binding on the company until such time as an order has been accepted in writing. 1.2 The Vendor reserves the right to review quoted prices in the event of any change in costs brought about by changes to material costs, or International exchange rates 2.0 Customers Order: 2.1 A customers order will only be accepted if it is on letter headed paper, or a Masterframe order sheet. 2.2 It is the customers responsibility to check the confirmation sheet against the customers requirement, and to notify the vendor in writing of any anomalies. 2.3 The vendor shall not be held liable for any costs arisen from incorrect specification, unless the goods are incorrect to the customers signed confirmation sheet. 3.0 Payment Terms: 3.1 Payment for goods delivered in the UK will be As Per Agreed Terms. 3.2 Completed manufactures awaiting delivery instructions will be considered as delivered for the purpose of accounting. 3.3 The vendor reserves the right to charge 3% above the base rate, for late payment, returned or stopped cheques. 4.0 Delivery: 4.1 Unless agreed in writing all manufactures will be delivered on the earliest pre-determined date, (determined by location), following completion of the contract. 4.2 Where a deferred delivery has not been agreed prior, but delivery is refused on the original date, delivery must be accepted within 8 weeks from the original delivery date. 4.3 The vendor reserves the right to charge for storage and handling for any period after (3.2) at a cost of 250 per week, orpart thereof for each and any contract stored. 4.4 Any contract being stored will be held at the customers risk. 4.5 Failure to pay on agreed dates, for multiply delivery contracts, will result in the suspension of further manufacture and delivery. 4.6 In the event of a customer account being place on stop, delivery dates will become void, and further manufacture of contracts will cease. 4.7 Deliver dates advised at the time of receipt of a signed order confirmation sheet is a best estimate, 4.8 The vendor will confirm delivery date within two working days of receiving the order. 4.9 Unless agreed and confirmed in writing by a director of the vendor, time is not the essence of any contract. 5.0 Claims: 5.1 All claims concerning perceived shortages, damage in transit, product imperfections, or incorrect specification must be advised to the vendor within three working days of delivery, and in writing within seven working days of receipt of goods. 5.2 The vendors liability will be limited to the option of replacing, repairing, or crediting to the customer the purchase price, or part thereof of the goods sold. 5.3 The return of goods after delivery will not be accepted unless the vendor, or representative have first hade a opportunity to examine the goods. 6.0 Ownership of Goods: 6.1 Products supplied remain the property of the vendor until full payment has been received. 7.0 Handling: 7.1 All supplied goods must be stored in accordance to best practise. Any damage caused to the goods from improper storage or handling will be the responsibility of the customer.

13 8.0 Installation: Terms And Conditions of Sale 8.1 Installation of the goods must be in accordance with recommendation of the vendor. Failure to install and or adjust the products in accordance with these instructions will absolve the vendor of any responsibilities or liabilities with the performance and function of the product. 9.0 Product Maintenance: 9.1 The continued performance / appearance of the goods will be affected by failure to maintain the surface and fittings. Failure of the user to maintain the goods in accordance to the recommended instructions any result in changes to the performance / appearance of the goods, and may affect any guarantee given Product Performance: 10.1 Unless advised by the customer in writing it will be assumed that the installation is within 10 meters of ground level. All sites above this level, or sites of exceptional exposure must be advised to the vendor in writing at the time or order Product Misuse: 11.1 The vendor holds no responsibility to products which have been damaged through misuse either by the customer or the user Imperfections: All materials used in the manufacture of the vendors products shall conform to the material suppliers specification. Material free from all minor imperfections are unobtainable, therefore imperfections recognized by industry standards as acceptable will not be a valid reason for rejection Non Availability of Components: 13.1 If during the life of the guarantee components become unavailable, the company reserves the right to supply alternative components / manufactures to replace products under guarantee Change of Design: 14.1 The company policy is one of continued development to its products, therefore the vendor reserves the right to change product designs without notice. Customers will however be advised of changes made which the vendor considers need to be brought to the customers attention Regulations and Industry Standards: 15.1 It is the customers responsibility to inform the vendor of any industry standard or building regulation the he requires the order to comply with The vendor shall not be held responsible for any loss or damage caused by the goods not conforming to relevant standards, nor under Health and Safety at Work act to the use of the goods by the customer or user, which has not previously been notified in writing and approved by the vendor Risk: 16.1 All risk in the goods will pass to the customer immediately on delivery of the goods Force Majeure: 17.1 The vendor shall not be held liable for any fault with the goods, or any late delivery of the goods due to acts of God, war strike, lockout industrial action, fire, flood, drought, or any other event outside the vendors control Governing Law: 18.1 The above terms and conditions, and their interpretation will be governed by the law of England and the English courts Special Terms & Conditions: 19.1 Unless agreed between a director of the vendor and the customer, and confirmed in writing by both parties the above terms and conditions of sale will solely apply By ordering the goods from the vendor, it is deemed that the customer has accepted the above terms and conditions.

14 Customers Charter What you can expect from masterframe problems with your windows: should you experience 1. The problem will be dealt with promptly and efficiently. 2. You will be kept informed of progress/developments. 3. Your complaint will be acknowledged within three days of receipt, advising available inspection/action dates. 4. Inspection of problem (if required) will be carried out within two weeks of notification. 5 You will be issued with a copy of any inspection reports that will give an indication of time scales and actions that will be taken by Masterframe. 6 Upon completion the customer will sign to confirm that works required by Masterframe are complete. 7 You will receive a letter confirming completion of works, together with a copy of the completion form and a prepaid envelope and form to be returned to Masterframe, enabling 1. complaint to be cleared.
