9 German Packaging Ordinance legal basis is the German Ordinance on the Avoidance and Recovery of Packaging Waste 12 June 1991 the idea was to reduce waste to reuse or recycle 2 April 2008 the 5th amendment to the packaging ordinance effective from 1 January 2009

10 The 5th amendment: News First circulator of sales packaging in Germany is obligated to participate in one or more dual systems Certification of compliance Since manufacturers and distributors are no longer legally obliged to mark the packaging.!

11 Types of packaging Transport Packaging: Packaging that simplifies the transport of goods, that protects goods in transit or must be used for safety reasons and remains with the distributor.

12 Sales Packaging: Packaging that is offered as a single sales unit and remains with the private end consumer. Private end consumers are also households and socalled comparable sources of waste packaging, this includes: Restaurants, Hotels, Canteens, Administration centres, Hospitals, Educational centres, Charity centres, and more

15 Packaging Management as a Delivery Condition German importers often request the exporting company to assume responsibility for all package management requirements

16 Calculation of the package license fee Premise: As the package licensing in Germany is organized by the private sector, there are no standard prices Private Companies prepare individual offers on request Note: The costs of package licensing in Germany are generally above the European average.

17 Key factors for the fee calculation 1. Quantity of packaging material 2. Type of packaging material 3. Proportion of different packaging materials 4. Possibility to apply deduction rates according to German law. in particular: a) sectorial rate (VerpackV 6.2) b) industrial rate (VerpackV 7)

18 Deduction rates Premise 1: Package licensing normally refers to participation in a national dual recycling system Premise 2: Not all packaging is recycled in those systems Conclusion: Exported packaging not recycled in the dual recycling system, such as sectorial or industrially recycled packaging, can be licensed differently and usually at a lower price

19 Possibility of applying deduction rates: Generally the possibility of applying a deduction rate depends on the sector and the distribution network 1st Option: Individual examination of the distribution network to deduct the applicable rates for the individual company 2nd Option: Application of one of the statistics considering the sector and individual distribution

20 1st Option An examination can be valuable depending on the individual situation. Before involving an accountant it is advisable to consider the possible benefit of the examination 2nd Option Concerning the second option, remember that the responsibility for the application of deduction rates still lies with the exporting company. To avoid eventual risks in case of monitoring it is necessary to review the statistical rates.

21 Royalty fee for the Green dot The Green dot is a private trademark in Germany Since 2009 it is no longer compulsory to label products with the Green dot If companies sell products with the Green dot they are obligated to pay a royalty fee to DSD GmbH, which owns the rights of the trademark in Germany

22 Important The package licence fee can vary significantly when comparing offers by different companies and considering different applicable statistics or individual deduction rates

24 Obligation to submit a completeness statement This applies only when exceeding at least one of the following volume thresholds: more than 80 tonnes per year of glass packaging or more than 50 tonnes per year of paper/cardboard packaging or More than 30 tonnes per year of packaging made from aluminium, tin foil, plastics and composites (sum of these four materials)
