3 DB SCHENKERspeed is a product of Schenker Deutschland AG. The German Freight Forwarders' Standard Terms and Conditions (ADSp) shall apply and, where these are not valid for logistics services, the latest version of the General terms and conditions of logistics services providers shall apply. Furthermore, the Terms and Conditions of Use presented below shall be valid and take precedence over our General Terms and Conditions in the areas regulated by them. 1. General scope of service/application The geographical area of validity is the territory of the Federal Republic of Germany National door-to-door service (free to ramp/made available on the premises for removal) Transportation performed in DB Schenker's own general part load network (closed system) Transit time: guaranteed delivery on the following working day (Monday to Friday) o DB SCHENKERspeed on the next working day o DB SCHENKERspeed 12 by no later than 12 noon on the next working day o DB SCHENKERspeed 10 by no later than 10 am on the next working day o DB SCHENKERspeed 8 by no later than 8 am on the next working day The geographical area of validity is determined by the DB SCHENKERspeed routing list valid for the particular Schenker Deutschland AG branch If a consignment is not delivered within the contractual delivery times, despite the above conditions having been observed, due to culpable conduct on the part of the forwarder or of the carrier appointed by the forwarder, the agreed freight charge shall be refunded in full 2. Additional services offered in connection with the product Acceptance of hazardous materials Notification by driver ahead of delivery to recipient Subsequent arrangements for further carriage of consignments Subsequent changes to delivery terms 3. General prerequisites The following general prerequisites must be fulfilled to enable provision of the service offered: Orderly traffic conditions Transit times for islands and enclaves and dutiable goods consignments must be agreed separately Where public holidays are not uniformly observed in different locations, the holiday schedule of the DB Schenker branches involved in the transportation shall apply Secure packaging for transport Printed versions of these Terms and Conditions of Use are not revised or updated 3

4 Registration for collection in the routing area of the responsible DB Schenker branch by 12 noon on the collection day with DB Schenker Customer Service When collection takes place outside of the routing area of the responsible DB Schenker branch, registration by 11 am at the latest on the collection day Collection times must be agreed with the responsible DB Schenker branch Clear identification of the additional services desired on the medium used for transmitting the transport data (shipping order, remote data transmission, registration for collection, etc.) Delivery notes must be attached to the goods and are not transported separately Shipment must be marked for clear identification and labelled with a barcode label Deliveries and collections take place between 7 am and 5 pm (Mon Fri) Hazardous materials (with the exception of individual classes and UN numbers) shall be transported only after the order has been checked and approved by the branches 1 Transportations of waste are possible only after consultation, review and approval by the business process owner 1 4. Delivery terms The following delivery terms are permissible: EXW, CPT, DAT (DDU and DDP) and DAP. 5. Dimensions and weights Volume and minimum weights shall be individually agreed. Dimension and weight restrictions for groupage shipments: Maximum dimensions of a package: 2.40 m x 1.80 m x 2.20 m (W x L x H) Maximum weight per package: 1,500 kg actual weight For transport jobs where a tail lift may be necessary, the following different restrictions shall apply: Maximum dimensions of a package: 2.40 m x 1.20 m x 2.20 m (W x L x H) Maximum weight per package: 1,000 kg actual weight Dimensions and weights in excess of this must be agreed separately. 6. Exclusions Exclusions pursuant to the German Freight Forwarders' Standard Terms and Conditions (ADSp) and the General terms and conditions of logistics services providers Removal goods Temperature-controlled goods Living animals, loose plants, highly perishable goods 1 Orders may be placed only after prior consultation with the responsible DB Schenker branch. 5 Objects, weapons and munitions subject to the German War Weapons Control Act (Kriegswaffenkontrollgesetz) Shipments that have to be unloaded from the side or using a crane Packages weighing more than 30 kg and which cannot be accessed or lifted by industrial trucks Increases in transit time that occur due to circumstances that DB Schenker was unable to prevent, despite exercising the utmost care 7. Prices The prices currently agreed with the relevant branch of DB Schenker shall apply for DB SCHENKERspeed.
