DESCRIPTION - This contract covers the Commonwealth's requirements for mine water treatment chemicals. - Products on this contract must conform to the appropriate PCID specifications, if applicable. -Vendors must adhere to the delivery instructions outlined in the contract at - If vendor cannot make delivery within 5 days of request, the Commonwealth reserves the right to purchase the materials from another source. any additional costs shall be absorbed by the contract vendor. 2 Department of General Services GSPUR-13BRev. 2/20/01 SPECIAL CONTRACT TERMS AND CONDITIONS CONTRACT SCOPE/OVERVIEW: This contract, , will cover the requirements of Department of Environmental Protection (DEP), Bureau of Abandoned Mine Reclamation for mine water treatment chemicals. ORDER OF PRECEDENCE: These Special Contract Terms and Conditions supplement the Standard Contract Terms and Conditions for Statewide Contracts for Supplies. To the extent that these Special Contract Terms and Conditions conflict with the Standard Contract Terms and Conditions for Statewide Contracts for Supplies, these Special Contract Terms and Conditions shall prevail. TERM OF CONTRACT: The Contract shall commence on the Effective Date no earlier than March 1, 2005 and expire on February 28, OPTION TO EXTEND: The Department of General Services reserves the right, upon notice to the Contractor, to extend the Contract or any part of the Contract for up to three (3) months upon the same terms and conditions. This will be utilized to prevent a lapse in Contract coverage and only for the time necessary, up to three (3) months, to enter into a new contract. SPECIFICATIONS FOR LIME: All lime products shall be in accordance with the attached Pennsylvania Commercial Item Description (PCID) Number 1074 Lime, Effective 9/12/01. DELIVERIES: All deliveries must be made within five (5) calendar days after receipt of a Purchase Order from the Commonwealth. Delivery shall be FOB Destination. All costs (to include shipping, handling, and delivery) shall be covered by the awarded unit price. Lime will be delivered as bulk truckload lots except for deliveries to Toby Creek. Trucks shall be equipped to self unload pneumatically to a 4 inch kamlock connection. Purchase orders may be made via call-in, fax, or mail-in. If call-in used, contractor shall provide order reference number to the caller. NOTE: IN THE EVENT THE AWARDED CONTRACTOR CANNOT MAKE A DELIVERY WITHIN THE FIVE (5) CALENDAR NOTICE, THE COMMONWEALTH RESERVES THE RIGHT TO PURCHASE THE REQUIRED MATERIAL FROM ANOTHER SOURCE. THE AWARDED CONTRACTOR WILL BE HELD LIABLE FOR ANY INCREASED COST TO THE COMMONWEALTH. OPTION TO RENEW: The contract may be renewed up to three (4) additional one (1) year terms by mutual agreement between the Commonwealth and the contractor(s). If the contract is renewed, the same terms and conditions shall apply.
