(2) received means all packaging and packaging material (primary, secondary or tertiary) received onto the premises named above in section 4 (including imported packaging material and packaging associated with imported goods). (3) supplied means all packaging, packaging material and packaged goods (primary, secondary and tertiary) supplied at and/or from the premises named above in section 4 Supply in relation to packaging material, packaging and packaged products includes in the course of business, to provide in exchange for any consideration other than money and to give as a prize or otherwise make a gift. 6. Three year implementation plan specifying the steps to be taken to prevent and minimize packaging waste (a) THE RELEVANT FEE The prescribed fee under these Regulations is calculated at 15 per tonne of packaging and packaging material supplied (at or from the premises named above in section 1 or 2 as appropriate) in the twelve month period prior to the date of this application, subject to a minimum of 500 and a maximum of 15,000 per premises as per Article 14(6) & 14(7). REGISTRATION / RE REGISTRATION FEE ENCLOSED: (b) THREE YEAR IMPLEMENTATION PLAN FOR INITIAL APPLICATION FOR SELF COMPLIANCE A 3 year plan must be submitted with this application. This plan should specify the steps to be taken by the applicant in order to comply with the requirements of the European Union () Regulations This plan may relate to the overall activities of the producer, within the Cork City Council area. Please also confirm that a copy of this plan is made available free of charge on request to any person and that a public notice advertising the availability of this plan has been affixed in a conspicuous position at or near each entrance to which members of the public have access. (In compliance with Article 15(1)(b). This notice should read as follows: Waste Management Act 1996 A three-year implementation plan specifying the steps to be taken by (name of producer) for the purpose of recovering packaging waste is available at these premises or, if so requested, will be sent by post, fax or electronic mail. The above notice must remain in place until the preparation of a revised three year implementation plan for re registration as a self complier as required by Article 15(2). (c) FIXING OF OTHER NOTICES Please also confirm that a public notice in compliance with Article 10(1)(a) has been affixed in a conspicuous position, and in such a manner as to be clearly visible to members of the public, at each entrance to each premises to which members of the public have access and at or from which such major producer supplies packaging material, packaging or packaged products. This notice should read as follows: 6

8 Waste Management Act 1996 We are required to accept on these premises, free of charge, for the purpose of recovery, packaging waste arising from products, packaging or packaging material of a type or brand sold or otherwise supplied on these premises. The products or packaging in question need not necessarily have been purchased from (name of producer). (d) NEWSPAPER ADVERTISEMENTS: Please take note under article 10(4) of the aforementioned regulations that self compliers are obliged to advertise take back of packaging waste. Self-compliers must place notices in local newspapers during the months of March and September each year. Self-compliers are required to provide copies of all notices published to Cork City Council within ten days of the date of publication of such notices. Prescribed wording for such notices is provided in Part 5 of the Second Schedule of the regulations. A notice for the purpose of article 10(5) shall state the following. Waste Management Act 1996 (Name of Producer) (Address of Premises) We are required to accept at the above premises, free of charge, for the purposes of recovery, packaging waste of the following categories [insert packaging types]. The products or packaging in question need not necessarily have been purchased from [name of producer] (e) REVISED PLAN OF ACTION FOR RENEWAL OF REGISTRATION A revised three year implementation plan must be submitted with renewal of registration. This revised three year plan shall have regard to experience in the preceding registration period, specifying the steps to be taken to comply with the European Union () Regulations 2007 including steps proposed to be taken to prevent or minimise packaging waste. The format for this revised three year implementation plan shall be similar to the three year implementation as included in point (b). (f) SUBMISSION OF ANNUAL REPORT. Submit an annual report specifying the steps taken by the major producer to comply with the European Union () Regulations 2007 in the preceding registration period. The report shall include a declaration from a competent person having due regard to the records of the major producer, that the competent person is of the opinion that the major producer has complied with the provisions of articles 5,6,7,8,10,11,12,13,14,15,16 and 25 of the European Union () Regulations A competent person may be an auditor or a consultant. A copy of the revised three year plan and annual report shall be made available free of charge on request to any person and that a public notice advertising the availability of this 7

9 plan has been affixed in a conspicuous position at or near each entrance to which members of the public have access. (In compliance with article 15(2)This notice should read as follows: Waste Management Act 1996 The following documentation is available at these premises- (i) An annual report specifying the steps taken by [name of producer] for the purpose of recovering packaging waste in the preceding calendar, and (ii) A three-year implementation plan specifying the steps which (name of producer) proposes to take to recover, prevent and minimise, and if so requested, will be sent by post, fax or electronic mail. The above notice shall replace the original three year plan notice which was erected to upon application for initial registration as a self complier in accordance with Article 15(1) DECLARATION CORK CIYY COUNCIL WILL BE NOTIFIED OF ANY CHANGES TO THE INFORMATION SUPPLIED IN THIS FORM.
