1 Regulations for the Fruity Summer with Virtu contest organized in the Food Plus chain store 1 GENERAL PROVISIONS 1. The Contest Organizer is P4T Sp. z o.o., with its registered office in Lublin, ul. Bursaki 18 lokal 15-16, Lublin, entered into the Register of Businesses in the Lublin-Wschód District Court in Lublin, with its registered office in Świdnik, 6th Commercial Division of the National Court Register under KRS no: , REGON , NIP (tax identification no.) , hereinafter called the Organizer. 2. The contest was commissioned by MASTERMEDIA Cioczek i Wójciak Sp.J. with its registered office in Lublin, ul. Wojciechowska 9B, , entered into the Register of Businesses of the National Court Register kept by the Lublin-Wschód District Court in Lublin in Świdnik, 6th Commercial Division of the National Court Register under KRS no.: NIP (tax identification no.) , REGON , hereinafter called the Ordering Party. 3. The contest is organized in the United Kingdom, Federal Republic of Germany, Belgium and Holland in retail outlets belonging to the Food Plus franchise chain store, whose franchisor is the Ordering Party (hereinafter called the Food Plus Shops). Submissions for the contest span from 13th July 2017 to 31st July The contest is not a random game of chance under the meaning of the Act of 19 November on Gambling (Journal of Laws of 2009 no. 201, item 1540, as amended). 6. Participation in the contest is voluntary and free of charge. 2 TERMS AND CONDITIONS OF PARTICIPATION IN THE CONTEST 1. The following persons cannot participate in the contest: employees of the Organizer and the Ordering Party, persons who are Food Plus Shop franchisors, employees of Food Plus Shops, as well as their families. 2. Meeting the requirements set out in 3 (RULES OF THE CONTEST) is necessary to be able to participate in the contest. 3. The Entrants to the contest may only be adults, having full capacity to perform acts in law, who have read the Regulations and accepted their provisions. The Entrants, by submitting to the contest, declare that they reside in the fiscal jurisdiction of the country mentioned in 1 section 3 of the Regulations and are obliged to independently settle their own taxes if receiving a prize in the contest shall impose such obligations on them.

2 3 RULES OF THE CONTEST 1. The Entrant, in order to take part in the Contest, must make a purchase in one of the Food Plus Shops within the period of the contest which shall be confirmed by a proof of purchase, hereinafter called the Proof of Purchase, and to perform the Contest Task upon the rules described in 3 section 3 of the Regulations. The purchased products need to include at least one of the products mentioned in 3 section 2 of the Regulations. 2. The Contest Task involves Submission to the Contest made via the form contained at with the most creative answer to the Contest Question: In maximum 3 sentences describe your summer memories. You must include 3 words: fruits, summer, and childhood 3. The Organizer reserves that the answer to the Contest Question, hereinafter called the Piece: a) Cannot contain any explicit nor illegal content, as well as abusive language; b) It cannot contain advertising content referring to products other than the Virtu Products; c) It cannot infringe any third party rights, especially: personal rights and copyrights, as well as the right to protect one s image, in line with the provisions of The Contest Task needs to be sent within the period of the contest (from 00:00:00 13th July 2017 to 23:59:59 31st July 2017) by filling in the form contained at

3 5. The total length of the answer cannot exceed 500 characters. 6. The participant should also provide the following data with their answer to the contest question: First and last name; address; The Food Plus Shop s address where they purchased the promotional products (select from the list); The proof of purchase number. 7. Sending the answers before or after the term indicated hereinabove or sending messages noncompliant with the format set out in the preceding section shall mean that the Contest Task has not been fulfilled. 8. An Entrant may submit to the contest any number of times provided that they make a purchase for every submission, in line with 3 section 1 of the Regulations, confirmed by a separate Proof of Purchase. 9. The Entrant who fulfils the Contest Task, gets an confirming that they have been registered in the contest database. 4 INTELLECTUAL PROPERTY RIGHT 1. By taking part in the Contest the Entrant declares that they possess full copyright to the Piece within the meaning of the Act of 4 February 1994 on copyright and related rights (Journal Of Laws of 1994 no. 24, item 83), and that they are entitled to full proprietary copyright to the Piece. 2. The Organizer, in return for the right to participate in the Contest, obtains full proprietary copyright and derivative rights to the awarded Pieces from the Entrant, in all mentioned fields of use, without any limitations concerning territory or quantity, in particular: a) Recording and duplicating the Piece, as well as its compilations - producing with the use of any technique, such as printing, reprography, magnetic record and digital technique; b) Trading with the Piece as well as its compilations or copies on which the Piece was recorded - introducing into trade, lending or lease of the original or its copies; c) Distributing the Piece and its compilations by public performances, exhibitions, projections, reproductions, making it publicly available in such a manner that everyone can have access to it at a place and time selected by them, broadcasting by TV analogue stations, including satellite, multiplex, re-broadcasting, distributing in the press, the Internet, on posters, including large-scale posters, as well as in any other means of communication, promotion, advertising, labelling and manufacturing of products;

4 d) Making any changes and modifications to the Piece, full or partial, as well as making its compilations, full or partial, including remaking, any changes and adaptations of the entire Piece or its particular parts; e) Registering the Piece in the Patent Office, in the form of a trademark, using it for economic and non-economic purposes, as an enterprise identification, trademark or other characteristic symbol of the enterprise, its part, its goods or service; f) Anonymous distribution of the awarded Piece, including deciding on making it publicly available for the first time and supervising the manner of using the Piece; g) The right to make and use the compilations of the awarded Contest Works. h) Using it in any forms of communication, promotion or advertising, especially as advertising or promotional material, as an element of advertising or promotional materials, such as press releases, external advertising, commercials, radio commercials, point of sales literature, distribution on-line, registering as a trademark. 3. The Entrant declares that they are familiar with the purpose set by the Regulations for which the awarded Pieces shall be used. Moreover, they express their consent to such usage of the Contest Works by the Organizer or the Ordering Party. If needed, the Winner, upon the Organizer's request, shall sign respective declarations or agreements confirming that the copyright to the awarded works has been transferred. 4. Due to the fact that the result of participating in the Contest may be a Prize given to the Entrant on principles described in the Regulations, granting licence or transferring rights to the Piece shall not entail any additional remuneration for the Winner. 5 PRIZES 1. Prizes in the Contest are as follows: 20 Bosch blender, PLN 338,25 gross each. 2. The expected total value of awards is PLN 6765 gross. 3. No cash alternative shall be offered. 6 GIVING PRIZES 1. The assessments of the Contest Task shall be made by the Contest Committee. 2. The Prizes shall be given to 20 Entrants who correctly fulfilled the Contest Task and whose answers to the Contest Question shall be deemed by the committee the most creative among all answers submitted, taking into account such factors as: creativity, originality, sense of humour, good taste, uniqueness, etc. 3. Each Entrant can win and get only one prize in the Contest.

The Committee shall convene and give its Prizes after the end of submission period but not later than within 10 days from the end of the submission period, that is by 10th August ANNOUNCING THE WINNERS 1. The Entrants to the Contest who will win the awards shall be notified of that fact within 5 working days from the date the contest commission s meeting (that is by 18th August 2017) via an sent to the address indicated during submission. The contact with the potential winner will be easier if their submission contains the Entrant s telephone number. 2. The full list of winners (containing their first and last names) shall be announced by 31st August 2017 at 8 COLLECTING PRIZES 1. The Entrant, in order to collect their Prize, must send the following to the Organizer's address (P4T Sp. z o.o., ul. Bursaki 18 / 15-16, Lublin): a) Original Proof of Purchase for the Promotional Products; b) Signed declaration, reading as follows: I hereby give consent for my personal data to be processed by P4T Sp. z o.o., ul. Bursaki 18 lokal 15-16, Lublin only for the purposes of conducting the Contest, give the prize and announce the Contest results, in line with the Regulations. I have read and I accepted the terms and conditions of the Fruity Summer with Virtu Contest Regulations and I hereby declare that I am not a person excluded from participating in the Contest, mentioned in 2 point 1. c) The Entrant who has been given the prize is also obliged to send to the Organizer s address the following personal data: First and last name; Address of residence; Correspondence address; Mobile phone number. 2. The above information must be sent within 14 days from the date the Entrant was notified on winning the prize via postal or courier services (date of postmark or date of postal receipt as proof). 3. The prizes shall be directly delivered to the Food Plus Shop where the Winner had made their purchase. The Organizer shall notify the Winners that they can collect the prizes via an sent to the indicated address or a text message sent to the given mobile phone number. The message shall contain a code which, together with a proof of identity containing a photograph, shall constitute the basis for prize collection.

6 4. Sending the prizes shall be made by 15th September 2017 at the latest. 5. If the Winner does not collect their prize within 14 days from the notification date, the Entrant loses their right to the prize and the prize is left at the Ordering Party s disposal. 9 MAKING COMPLAINTS 1. All and any complaints and reservations concerning the Contest may be submitted by the Entrants in writing, via a registered letter sent to the Organizer s address. The complaints shall be accepted during the entire contest period but no later than by 22nd September 2017 (date of receipt by the Organizer as proof). 2. Complaint form should contain the following information: first and last name, the Entrant s correspondence address, phone number, address indicated during their submission and a detailed description and the reason for making the complaint. 3. Complaints shall be processed by a commission appointed by the contest Organizer within 7 working days from the date of their receipt. 4. The Entrant shall be notified on the commission s decision by the Organizer via an sent to the address indicated during submission to the contest within 3 working days from the date the complaint was processed. 10 FINAL PROVISIONS 1. These Regulations are available in the Contest Organizer s registered office and at 2. The contact details shall be processed on demand and only for the purposes of organizing the Contest, selecting the winner, as well as giving, releasing and collecting the prize. Personal data of the Entrants shall be used in line with the conditions set out in the act of 29 August 1007 on personal data protection (unified text: Journal of Laws of 2002, no. 101, item 926). The personal data Administrator is the Contest Organizer. The Entrant can access their personal data and correct it. 3. In matters not governed by the Regulations the provisions of the Civil Code and the act on personal data protection shall apply.
