1 IPFW Mastodon Farmer s Market Vendor Terms and Policies The IPFW campus community recognizes that healthy living education and access to nutritious food can help individuals achieve their personal wellness goals. To that end, the Mastodon Farmer s Market will assist the campus community, as well as the general public, in making healthy choices, emphasize nutrition education, and support local farmers and the local economy by promoting nutrient rich food sources and making fresh, affordable produce and food more available during the summer months. Located on campus, under the Walb Union/Helmke Library Skybridge and the Alumni Plaza, the market will operate Thursdays, from June 23 to September 22, Hours of operation are 11:00 a.m. to 1:00 p.m. The MFM Committee (MFMC) will select the vendors based the information received from this application and an interview. The committee will determine if the vendor meets the goal of providing fresh produce as explained above. A Market Manager will be assigned to oversee market operations. These terms and policies were created for the MFM and are mandatory for all Vendors including their agents and employees. They are subject to change. Vendors are required to read these rules and regulations carefully before signing their applications. The Market Manager: The Market Manager is authorized to assign spaces, enforce all rules and regulations, collect fees, and handle all disputes. Market Information 1. Arrival & Set Up: Vendor set-up may begin 1 1/2 hours before the start of the market, but not before 9:30 a.m. All vendors are to unload supplies and move vehicles out of the Market area to Parking Garage 2, no later than 30 minutes before market. Vendors who have been approved to park a vehicle on the market plaza, in a designated space, must be parked in place no later 45 minutes before the market opens. Movement of vehicles within the Market area during market hours is strictly prohibited. Access to the market is from the Walb Union Circle Drive. This area is busy throughout the day and those arriving later than the 30 minute mark, will not be permitted to unload on site and will need to transport goods from the parking garage. 2. Departure & Tear Down: Vendors will not be permitted to tear down their booth before the close of the market. If a vendor experiences an emergency situation and must leave, early departure must be approved and coordinated with the MFM staff to ensure it is done safely. Page 1 of 7

2 Participants are to place any refuse in designated trash containers upon departure, leaving their space clean and free of litter. 3. Attendance: Vendors must give a 3 day notice to the MFMC if they are unable to attend the market. If a participant encounters an emergency and cannot attend the market, please contact the Market Manager. 4. Market Cancellation: The market will be cancelled in the event of any weather conditions or circumstances that the Market Manager and/or the University determines to be unsafe. 5. Booth Assignments: The market site is partially protected from the elements by the Walb Union/Helmke Library Skybridge. The Market Manager will assign participant 10X10 booth locations based on application receipt dates. Priority will be given to vendors signing up for the entire season. A limited number of spaces will be available for vehicle/trailer placement on the market site. The Market Manager reserves the right to change the assigned booth space of participants, if necessary. Spaces must remain clean and barrier free at all times. Vendors are responsible for providing their own tent, weights and table. Tents must be secured and weighted, to ensure it remains in place and cannot be blown over. Tents must not be larger than the standard size of 10 x Booth Fees: the MFMC sets the booth rental fee. Fees will be paid before setting up at the market. Booth Fees are for a 10 x 10 space, unless other arrangements have been agreed upon. No refunds will be made if the vendor decides to stop attending the market. Fees- Seasonal June-September $100 Weekly- $25 (must pay and sign contract 7 days in advance of market date) 7. Approved Categories: Vendors may only sell products* that fall within one of the following approved categories: A. Home Grown by the Vendor: fresh and unpackaged home-grown vegetables, fruit, nuts, and cut flowers; potted plants and herbs (annuals and perennials); dried flowers. B. Organically Home Grown Farm Fresh by the Vendor: any of the produce or products that have been organically grown Vendor s own farm. Only products which have been organically grown by a Vendor who is an organic farmer may be sold in this category. To sell in this category, a Vendor must be listed as an organic farmer with the appropriate state department in Indiana or the state of his/her residence. *At this time, the MFM is focused on fresh produce only. Items that do not fall into one of the above categories will not be allowed for sale. Page 2 of 7

3 8. Signage: MFM encourages all vendors to display signage identifying their business. A. Produce vendors are required to display signage including the following information: Farm name & location, and the name & price of each item for sale. These signs must be in plain view to the customers. B. Organic Produce and Certified Naturally Grown (CNG) Produce - If any item for sale is labeled organic, the grower must show proof of certification from a USDA licensed certifier. Only USDA certified organic growers may display the USDA organic seal. Products which are certified naturally grown (CNG) may not use the word organic but may display the CNG label. Proof of certification must be supplied to the Manager. Documentation: 1. Each year, Vendor must sign an agreement and pay all required Vendor Fees before the Market season begins. Each Weekly Vendor must sign a Contract and pay all required Vendor Fees at least seven days before the first day the Weekly Vendor plans to sell. 2. Agricultural Vendors must be in compliance with Indiana Department of Health. A copy of your permit and/or certification must be included with your application. 3. Measuring and Permitting: Scales and measuring devices must be legal and accurate. Vendors are responsible for any and all permitting and inspections relating to Allen County Board of Health Rules and Regulations. Fort Wayne - Allen County Department of Health 1 E. When signing and submitting his or her Contract, each Vendor must submit a certificate or certificates of insurance (COI) evidencing adequate insurance to operate such vehicles as are needed to vend at the Market and adequate general liability insurance. This COI must list IPFW as Additionally Insured. IPFW may reject or terminate any contract if IPFW determines in its sole and absolute discretion that a Vendor s coverage is inadequate. 5. Vendors selling products for which sales tax must be collected must provide a Registered Retail Merchant Certificate, which can be obtained from the Indiana Department of Revenue. Page 3 of 7

4 6. Sales Reporting: For current and future marketing purposes, vendors may be asked to submit gross sales by product category for each market. A form will be supplied by MFMC. Sales will be combined by category and no vendor will be identified by name. 7. Each Vendor at the IPFW Mastodon Farmer s Market agrees to fully indemnify and hold IPFW and Purdue's trustees, officers, employees and agents harmless from any and all claims asserting liability, loss, bodily injury, death, or property damage, including settlements, judgments, and reasonable attorney fees and litigation expenses, arising from or related in any way to Vendor s participation in the MFM, regardless of the negligence or other fault of any of the indemnified persons or parties General Information 1. Marketing and Promotion: the MFMC will promote the market through various resources including social media, press release and employee/student communications. 2. Vendors agrees not to use IPFW s logos and licensed trademarks without the expressed written permission of IPFW. 3. Pets/animals: pets/animals (other than service dogs) are not allowed on campus. 4. Smoking: IPFW is a non-smoking campus. All forms of smoking are prohibited. 5. Restrooms and vending: restrooms and vending machines are located in Walb Union and in the Follets Bookstore outlets. 6. Parking: Free parking for the MFM is located in Parking Garage 2, accessed from the Crescent Avenue entrance to campus. Permit parking only in the green lined spaces. Code of Conduct 1. Vendors must comply with all laws and regulations that apply to them. 2. Individuals knowledgeable of the items for sale must be working at each vendor s booth. 3. Vendors must dress appropriately, including shoes and shirts. 4. Fraudulent, dishonest or deceptive merchandising is prohibited. Page 4 of 7

5 5. Solicitation for products, services, or charitable contributions are NOT permitted. 6. Complaints: Vendors are expected to directly address complaints from their customers. The Market Manager may intercede if there are multiple complaints from the public about a vendor. If the MFMC and/or Market Manager receive repeated customer complaints related to a specific vendor, and cannot be resolved. That vendor may be asked to leave the MFM. The Market Manager will mediate any issues that may arise between vendors. 7. Product Quality: All edible goods must be safe for human consumption. The Vendor is solely responsible for any damages resulting from the sale of unsound or unsafe goods. If the Market Master determines that a Vendor is offering any low qualify or unsafe product, the Market Master may require the Vendor (i) to remove the low quality or unsafe merchandise from the Market immediately and/or (ii) to vacate the Market. 8. Resale Items are prohibited - The sale of resale items by Vendors is not allowed. 9. Firearms, alcohol, fireworks, gambling, disorderly conduct, or the use of illegal drugs by vendors, their employees/agents, or market customers is prohibited. Violation of Market Terms and Policies: Notwithstanding any other provision in these policies, MFMC may terminate a Vendor's vending privileges and the Vendor's Contract at any time if IPFW or MFMC determine in its or their reasonable judgment that a Vendor has failed to comply with any provision in these Terms and Policies. No Vending Fees will be refunded. Penalty for Violations: Any violation of the MFM policies as stated above or any violation of the laws of the state of Indiana, Allen County, or The United States of America will result in the following penalties being imposed by the MFMC: 1. First offense: written warning from the Market Manager. 2. Second offense: written warning and $20.00 fine. 3. Third offense: removal from the Market for the rest of the season. Page 5 of 7
