Please remember SCIO is a non-profit, your vendor fees support a small portion of the cost of running the Market. Your participation and promotion of SCIO and its funding efforts, such as fundraising and securing sponsorships will ensure the continued growth and success of the Market. 3 Sheboygan County Interfaith Organization 2019 Summer Farmers Markets Rules and Regulations office: ext. 111 cell: (920) The SCIO Farmers Market makes available fresh native products directly from farmers and to residents. Working to help local farmers and producers remain vibrant, educate the community on healthy eating, and providing a social experience that helps build community and bolster the local economy Dates and Location Sheboygan: Fountain Park June 2nd-October 27 th Wednesdays 8am-2pm Saturdays 8am-2pm Plymouth: June 14th-October 11 th *Tentative Thursdays 9am-1pm Vendor Types: Vendor shall be defined as the producer of goods sold and shall include spouse, siblings, children, parents and employees of the applicant who assist in the cultivation of the same property or assist in the production of items available for sale. Season Vendors are vendors that pay a space fee for the full season. They are assigned a particular space for the entire season. Wednesday only & Saturday only vendors will share a space on the day they are not present. Daily Vendors are vendors that pay for a particular Market day and are assigned a space depending on space availability, product mix, and Market management discretion. Daily vendors are not guaranteed the same space each market, but Market staff will be as consistent as possible. Product Types: Farm Products refers to fresh foods that the farmers plant, grow or care for, and harvest (e.g. fruits, vegetables, nuts, eggs, meats, milk etc.) This process if not processed or is minimally processed. Valued-Added Product refers to products with one or both of the following two characteristics: (1) The vendor makes the foods from raw ingredients and primarily, from ingredients that they plant, grow or care for, and harvest AND/OR (2) they process the foods through baking, cooking, canning, drying, fermenting, preserving, or spinning techniques (e.g., baked goods, cheese, jams, dried fruit, viticulture, pickles, wool yarn, etc.) Ready-to-Eat Food/Prepared food refers to products that agriculture or non-agriculture businesses make from ingredients that they primarily purchase. The food at the market is made for immediate consumption. (sandwiches, brewed coffee, etc) Plants and Flowers refers to bedding, house plants and cut flowers Crafts/Arts refers to products that are made by the vendor themselves. Direct sale and items for resale are not accepted. *A limited number of vendor spaces are available to crafters on Saturdays. Page 1 of 6

4 Vendor applications require vendors to provide a product listing to help the market determine the best placement of vendors. Vendor Spaces: 1. Vendor spaces will be assigned upon receipt of completed application, full payment, and copies of all licenses and/or permits. 2. Spaces are granted for one Market season to bonafide growers or producers of the products sold. Applications received from returning vendors by April 1st, will get priority placement. SCIO retains the right to assign spaces according to the needs of the Market as a whole. a. Vendors are not to move, switch, or change spaces without the approval of the Market Manager. 3. Vendors are required to have a sign with their name and location (city or town). Season vendors must display their seasonal vendor permit. All prices must be displayed with signs. Signs must be prominently displayed each week. a. SCIO will provide each seasonal vendor with a laminated permit denoting vendor name, business name- if applicable, market, and space number b. Each vendor is encouraged to create their own identity at the market through vendor marketing- signage, contact information etc. 4. Vendors who accept Senior Farmers Market Nutrition Program-SFMNP, WIC, Fresh Produce Vouchers, and EBT/SNAP/FoodShare wooden tokens are required to display the appropriate signage. 5. Sheboygan vendor spaces are 10 by 16 and will be clearly marked at the beginning of the market season on the ground. 6. Plymouth vendor spaces are 10 by 25. Vehicles may remain onsite during the Market. 7. If you will not be present on a Market date please notify the SCIO Market Manager via fm@sheboygancountyinterfaith.org or cell phone (920) a. Appropriate lead time in planned absences will allow market staff to keep the Market full and energized. 8. Vendors are responsible for their own setup and take down. Vendors must remain onsite for the duration of the Market. 9. Tents must be properly weighted for safety purposes. 10. Trash, including produce debris and food items, must be swept up and disposed of after each market. Vendors are responsible for cleaning their own area before leaving. Trash must be packed out; public trash containers are for customer use only. Grease and other hazardous materials cannot be poured down the city sewer system. a. In order to prevent damage to the Park or Parking Lot additional mats or other equipment may be required based on the recommendation of the City of Sheboygan or Plymouth partner b. Vendors are not to use public tables as part of their booth area or for food prep Vending Policies: 1. Vendors must complete the application process before being allowed at the Market Page 2 of 6

5 2. Persons selling must be family members, paid employees, or authorized volunteers and shall be in attendance of their space at all times and be knowledgeable about the conditions in which the produce/product was grown/made. 3. The Market is held in all weather conditions. In the rare event the Market would need to be canceled due to severe weather warnings and safety concerns, notification will be made via , Facebook, and on WHBL. No refunds are given in the event of a cancellation; however, paid in full daily vendors may request an alternative day to attend. 4. No items offered for sale may be commercially made or wholesale. All products must be the original work or produce of the vendor. 5. Vendors must own or rent the land on which their vegetables, fruits or products are grown or raised. No Wholesale produce may be sold at the SCIO Farmers Market. 6. Produce vendor gardens must be within a 60 mile radius of the Market, in an area no smaller than 30 by 100 a. Only orchard vendors may sell Michigan Blueberries and Michigan Peaches- with consent from SCIO, and a $50 special allowance fee. b. Products that are not available within 60 miles of the Market may be allowed with written consent from SCIO, and a $50 special allowance fee 7. Market Management reserves the right to conduct on-site inspections of farms, kitchens or other workshops or spaces. 8. No smoking in vendor stalls 9. Non-produce vendors are responsible for collecting, reporting and paying sales tax. 10. Out of respect for other vendors, customers, and neighbors, any music played must be acoustic (no electric instruments, speakers, or DJ equipment, unless approved by SCIO). Acoustic music that can be heard beyond Fountain Park is not allowed. 11. Rude or aggressive behavior toward Market staff, other vendors, or customers by vendors will not be tolerated. 12. The Market is a place of business and a public forum. Polite professional behavior as well as fair and honest business practices are expected. 13. Any form of discrimination based on age, race, sex, sexual orientation, gender identity, religion, national or ethnic origin, political beliefs, veteran status, disability or any other category protected by state or federal law is contrary to the principles and policies of SCIO. Sheboygan Vending: The Market Manager will arrive onsite an hour before the market begins. Vendors are allowed to drive onsite before 7:45am on Wednesdays and Saturdays. Please enter the park using the north and south sidewalks to unload and then exit onto Ontario Ave. Remove your car within 15 mins of arrival in the park. Due to Park regulations there will be no driving or parking on the grass. Vendors must arrive onsite at least 30 mins before the start of the market. A map of vendors spaces and driving instructions can be found at There should be no live animals within Fountain Park, unless in a gated area as a part of a special event. Due to city regulations dogs and other animals are only allowed on the outside perimeter sidewalks of Fountain Park. Page 3 of 6

6 No vehicles will be allowed within Fountain Park during or within 15 minutes of the market start. In order to assure the safety of our customers, a $15 fine will be issued to vendors who are not following this policy. Parking: We encourage you to park at least one block away from the market allowing customers prime parking. o Paid parking is available on a first come first serve basis at Fountain Park Methodist Church, and can be secured at the church office between 9am-noon M-F. o Vendors must park in municipal public lots or utilize street parking o Vendors spaces located along 8 th St. and Erie Ave are NOT guaranteed the corresponding parking space. Vendors should allow customers those prime parking spots. o Parking is public domain and not controlled by SCIO. Plymouth Vending: The Market Manager will arrive onsite an hour before the market begins. Permits will be issued, to ensure vehicles are not able to drive through the market, vendors may be asked to move to enclose the market space. Vendors must arrive onsite at least 30 mins before the start of the market. No vendors will be accepted who would directly compete with other leases of Plymouth partner Licensing, Food Safety and Displays: All vendor product must comply with all applicable federal, state, county and local laws, regulations and permits that govern the products which they sell. The notes and guidelines included in this document are included as a courtesy but do not have precedence over government policy. 1. If products are sold by weights and measures, vendors are responsible for having their scales certified for compliance and obtaining a license through the city; ext 6 or traci.hermann@sheboyganwi.gov. Copies of this license must be submitted with your application. 2. Vendors are responsible for obtaining all licenses or permits required for the sale of the product to the public. Copies of such licenses/permits shall be submitted to SCIO annually. a. This includes; WI Dept. of Agriculture Retail License-Egg Endorsement Form, WI Dept. of Agriculture Official Meat Establishment License, WI Dept. of Agriculture Dairy License, and a WI Temporary Restaurant license for on-site processing. b. Questions regarding state permit can be directed to c. Questions regarding county permits including temporary restaurant license for prepared food or sampling can be directed to Sheboygan Health and Human Services (920) d. Vendors displaying the term organic need to be certified organic. 3. All items must be kept safe from spoilage. 4. All Vendors processing ready to eat food onsite and those providing food samples must display food in a way that prevents contamination. a. Samples are allowed and encouraged. However, sampling must meet County Health Dept. code. Page 4 of 6

7 b. Gloves most be worn by anyone handling food being processed on-site for consumption by customers. c. Each vendor must maintain their own temporary handwashing station if they plan to slice, cut, or prepare food on-site. d. The Health Dept. completes random checks to ensure vendors are in compliance to state regulations. Baked Goods Sales Permitted, under the pickle/cookie law Vendors must not make more than $5,000 in net sales per year and must have liability insurance. Signs and Labels Required: o Sign at the point of sale, stating, These baked goods are homemade and not subject to state inspection. o Product labels must include: Name and address of the person who did the baking, date of baking, Statement- This product was made in a private home, not subject to state licensing or inspection, o Product label must also include: all ingredients in descending order of prominence, including the common name for any ingredient that originates from milk, eggs, fish, shellfish, tree nuts, peanuts, wheat or soybeans. These are ingredients that can cause severe allergic reactions in some people, who must be able to recognize when they are present. o Find additional recommendations at sheboygancountyinterfaith.org/vend-at-themarket.html Payments, Billing and Fees 1. Please see the Vendor Application for a complete breakdown of pricing 2. Daily Vendors who have not pre-paid, must bring their payment to the onsite Market Manager prior to the start of the Market. 3. After the start of the Market season no refunds will be given. If a vendor needs to pull out of the Market prior to the start of the season, a refund will be given minus a $25 administration charge. 4. Returned checks; First Occurrence the vendor will be charged an additional $35 fee and must pay the entire amount in cash. Second occurrence, the fee will increase to $50 and the vendor must pay in cash for the rest of the season. Senior Farmers Market Nutrition Program-SFMNP and WIC Vouchers: All vendors who are interested in accepting SFMNP and WIC vouchers should contact the WIC office at EBT/FoodShare, Gift Certificate and Fresh Produce Voucher: The SCIO Farmers Market works with a variety of partners to encourage individuals of all income levels to utilize the Market. Over $20,000 worth of vouchers are used at the SCIO Farmers Markets each year. This number continues to increase as we gain more partnerships and market use of EBT/SNAP/FoodShare. We highly encourage you to accept SFMNP, WIC, EBT/FoodShare and Fresh Produce Vouchers. Page 5 of 6

8 1. All SCIO Farmers Market vendors are required to accept SCIO Farmers Market Gift Certificates. There are no restrictions on how customers can utilize the Farmers Market Gift Certificates. 2. Vendors who accept vouchers, must accept all vouchers. Vendors will receive a sign to display letting customers know they can use their vouchers at your booth. 3. EBT/FoodShare participants will receive $1 wooden tokens. EBT/FoodShare can only be used for non-prepared food items. 4. Fresh Produce Vouchers are $1 paper vouchers. They will have the SCIO logo and a verification code and can only be used for locally grown fresh fruits, vegetables and herbs EBT/FoodShare, Gift Certificate and Fresh Produce Voucher Reimbursements 1. Voucher Reimbursement forms are available at the onsite Managers info tent. All reimbursements are dispersed by check. 2. Reimbursements are submitted for processing by the Market Manager at the beginning of the week. Checks will be returned to the Market Manager by the following week to be given to the vendor at the next Market. If other accommodations are needed please let the Market Manager know. 3. In order to assist with cost of administering checks we ask that you submit reimbursements monthly or bi-monthly. All summer reimbursements need to be submitted prior to Oct. 31 st and will be mailed out within a week of the close of the Market. Sales Reports To assist with future promotion and fund development of the market SCIO will be collecting anonymous sales reports for each market. At the start of each market a market staff member or volunteer will hand out a sales slip and will collect sales reports from the previous market. Enforcement of Market Polices Violation of any of the Market Rules and Regulations or policies laid out in this or future notices will be handled as follows: 1. First violation will result in a verbal warning, which may be issued by any member of the SCIO staff. 2. Second violation will result in a written warning issued by the SCIO Market Manager. 3. Third violation will result in expulsion from the Market without refund for that day. 4. Fourth violation will result in expulsion without refund for the remainder of the Market season. Violations resulting in a police report or protection order being filed against a vendor may result in said vendor s immediate and permanent expulsion from the Market without refund of vendor fees. Vendors, customers and SCIO partners who believe a vendor is in violation of this agreement should submit a signed written complaint to the Market Manager. If vendors have a concern about any of the SCIO onsite staff please inform the SCIO Executive Director at heidi@sheboygancountyinterfaith.org. 15 Accepting EBT/SNAP Benefits: The Sheboygan County Interfaith Organization (SCIO) Farmers Market uses the EBT/SNAP Benefits and other voucher Programs: What are EBT/SNAP Benefits? Electronic balance transfer (EBT) is nutritional assistance benefit available to low-income individuals and families through SNAP-the Supplemental Nutrition Assistance Program, formerly known as Food Stamps. In Wisconsin SNAP benefits are accessed via a Quest Card. Quest cards work the same as a credit/debit card. As a vendor, there is NO cost to you to accept SNAP benefits. How The Program Works for Customers: Customers can stop at the SCIO Information Tent to swipe their SNAP benefits card for any whole dollar amount and receive tokens in return. How the Program Works for Vendors: Vendors post a laminated sign making customers aware that they can use their benefits at your booth for food products only. Please see list of accepted products below. Customers use the $1 wooden tokens they exchanged at the SCIO Information Tent as cash at your booth. Customers may not receive cash in return for tokens. Please check that the $1 wooden tokens say SCIO Farmers Market. Replacement signs are available for any vendor selling EBT/SNAP eligible products if the signs become damaged. Reimbursement Process: 1. Voucher Reimbursement forms are available at the onsite Managers info tent. All reimbursements are dispersed by check. 2.
