1 Senior Economist Los Angeles, CA Dr. Michael Trousdale is a Senior Economist with Econ One Research, Inc. He applies economic and statistical analysis to liability and damages estimation for litigation matters concerning antitrust, competition, and energy. As an economic expert, Dr. Trousdale has analyzed damages in a wide variety of industries including oil & gas (upstream and midstream), electricity, telecommunications, pharmaceuticals, shipping services, and other commodity products. Before joining Econ One Research, Dr. Trousdale aided the U.S. Food and Drug Administration in crafting federal regulations and analyzing their economic impacts. Such regulations include chain-restaurant menu labeling, calorie labeling on vending machines, Nutrition Facts labeling, preventative controls for human food, produce safety, and sodium reduction in processed foods. Dr. Trousdale is an adjunct professor of economics at the College of the Canyons and the University of Phoenix. His scholarly work in the field of applied economics has recently earned him publications in the National Tax Journal as well as the Public Finance Review. 3 Representative Engagements in Litigation Energy Presently engaged as a consulting expert for a defendant natural gas utilities holding company in matters related to an adverse environmental incident. For a plaintiff class of purchasers of wholesale electricity, performed economic and econometric analysis to establish that the defendant s alleged manipulation of index prices artificially inflated (or deflated) class members payments (receipts), that evidence common to members of the proposed class could be used to show that all or virtually all class members were impacted, and that the aggregate amount of economic damages incurred by the proposed class as a whole could be calculated on a class-wide, formulaic basis using a reliable methodology. For an oil & gas exploration & production company, estimated economic damages in a dispute over a contract breach involving rates for natural gas gathering services. For an Eastern European oil & gas exploration & production company, provided estimates of market value for natural gas in a dispute over a contract breach involving ownership rights to certain volumes of gas. For a midstream energy company, estimated economic damages in a dispute over a contact breach involving cogeneration facilities. For midstream energy company, retained as a consulting expert to assist plaintiff s counsel in preparing economic analysis and trial demonstratives. Antitrust Presently engaged by plaintiff s counsel for a class of direct purchasers of a pharmaceutical product to conduct an economic analysis of the relevant antitrust market. For a class of direct purchasers of hospital health care services, performed economic analysis to establish that a hospital system s contract terms with payers artificially inflated class members payments, that evidence common to members of the proposed class could be used to show that all or virtually all class members were overcharged, and that the aggregate amount of overcharge damages incurred by the proposed class as a whole could be calculated on a class-wide, formulaic basis using a reliable methodology. For a class of direct purchasers of rail freight shipping services, evaluated the plaintiff expert s economic and econometric analysis to establish that an alleged price-fixing conspiracy artificially inflated class members payments, that evidence common to members of the proposed class could be used to show that all or virtually all class members were overcharged, and that the aggregate amount of overcharge damages incurred by the proposed class as a whole could be calculated on a class-wide, formulaic basis using a reliable methodology. For a plaintiff purchaser of air freight shipping services, estimated economic damages stemming from an alleged price-fixing conspiracy. For a plaintiff retail boutique of special occasion prom and homecoming dresses, performed economic analysis of market power with which the defendant competitor allegedly used to foreclose plaintiff s access to suppliers. For an automaker involved in a bid rigging dispute with various part suppliers, developed a theoretical model to analyze optimal auction bidding strategies to estimate overcharges incurred to the automaker from awarding contracts to allegedly collusive bidders. Engaged as a consulting expert for counsel for a manufacturer of coiled steel to determine potential economic damages stemming from alleged monopolization of railroad shipping access. For a class of direct purchasers of polyurethane foam products, performed econometric estimation of overcharges and critically examined opposing experts analysis. For a class of consumers of ridesharing services, estimated potential economic damages stemming from an alleged price fixing conspiracy. For a plaintiff online distributor of dental supply products, estimated economic damages stemming from an alleged conspiracy among certain competitors and product manufacturers to restrain trade. For a counterclaim defendant seller of orthodontic devices, performed an analysis of market power related to allegations of unfair competition. Other Matters Presently engaged as a consulting expert in a matter regarding pharmaceutical-related hospital costs. For a world-wide provider of communications technology, estimated reasonable royalties for a wide range of patents (some standard-essential) across multiple, simultaneous cases involving cellular communication, data transmission security, and certain hardware in mobile handsets, wearables, computers, tablets, and user applications. For a plaintiff class of taxi drivers, performed analysis to establish reliable methodologies to estimate defendant s revenues and plaintiffs aggregate actual damages from alleged false representations. For a defendant marine terminal operator, evaluated the economic validity and reasonableness of opposing (claimant) expert s model of economic damages stemming from alleged false representations.
