1 US Consultant Policies & Procedures (P&P) Frequently Asked Questions (FAQ s) Can I post products for sale on my Facebook page? Yes you can post products for sale on your Facebook page as long as (1) the sales transaction is completed through your JAFRA Personal Website and not through Facebook directly, (2) you follow the other requirements of the Policies & Procedures, and (3) your post reflects the current official sale price (retail price) of the product. What does it mean to complete the sales transaction through my JAFRA Personal Website? When clients would like to buy product online (rather than in person), you should send them the link to your JAFRA Personal Website and tell them to use that link to fill out their payment info, address, etc. Do not complete the sale through Facebook directly, for example by using Facebook messenger to collect the client s address, credit card info, etc. If you need help setting up or using your JAFRA Personal Website, jafracares@jafra.com. Can I post products for sale on Facebook Marketplace? No. (See P&P Section 6.1.1) On Facebook, if someone says they would like to order a product I ve talked about, can I contact them to get their info to complete the order? Yes, you can contact them and then direct them to your JAFRA Personal Website to complete the sales transaction. (See P&P, Section 7.8.2, subsection 4) Can I sell product through mobile apps like Mercari, OfferUp, or LetGo? No, you are not permitted to sell JAFRA products through these apps. The only permitted method of online selling is through your JAFRA Personal Website. (See P&P Section 6.1.1) 1

2 Can I create a post in Facebook, Twitter and other social media sources with a photo of the business kit, including my JAFRA Personal Website and phone number? You may post a photo of the business kit or any other photo of JAFRA product as long as the photo was created by JAFRA for Consultant use, the post represents the most current promotion (not an expired promotion), and as long as your post represents the promotion in the same way as it is represented by JAFRA. You may add your website and phone number to the bottom of the post, and be sure to identify yourself as a JAFRA independent consultant. (See P&P Section 7.1). You are not permitted to take a picture of a business kit or JAFRA product and post it on Facebook, on other social media channels, or otherwise online. If you need a picture of a current business kit or product, please contact JAFRA. Can I use a link to my JAFRA Personal Website in my personal blog? Yes, but be sure to follow Policies & Procedures Section 7.6 Linking Policy and Section 7.7 External JAFRA Websites. Can I promote my JAFRA Personal Website on ebay? No. You cannot use ebay to list or promote JAFRA products. EBay, an online marketplace, is set up to have consumers purchase products directly through its site, so even if you direct clients to your JAFRA Personal Website there is still too much of a similarity with unauthorized online sales. All promotions of JAFRA product must be removed from ebay immediately. Where can I order business tools that comply with the Policies & Procedures? You can order business tools on Consultant Connection or through RedStamp. Where do we get business cards? JAFRA is not offering business cards for sale at this time. You can make business cards yourself, but you are not permitted to use the corporate JAFRA logo on them. Instead, please use the JAFRA Independent Consultant logo and be sure to correctly identify yourself as a JAFRA Independent Consultant. (See P&P Section and Section 7.4). 3 Can I get a print copy of the Policies & Procedures and the Code of Ethics? How do new consultants get that? You can print out a copy of the Policies & Procedures and the Code of Ethics by going to JAFRAbiz> Consultant Connection> Resources > Downloads > Business Literature. Please show your new consultants where to find these documents. Can I sell directly at my parties? Is cash and carry permitted? Yes, you can sell directly at your parties. Cash and carry meaning having product on hand and selling it directly to a client in that moment is permitted as long as you are following the Policies & Procedures. Also, we encourage you not to buy more inventory than you can sell to clients within a reasonable time. Can I use JAFRA banners at events? Yes, only if you have bought or earned them from JAFRA. Is there a place for me to purchase banners, tablecloths, t shirts, etc. from JAFRA? No, JAFRA is not offering that at this time. We are continually taking Consultant feedback and considerations in mind and in the future there may be opportunities for these items. It's hard to get company flyers fast enough to use at some events so in the past I ve made my own - where do you stand on that? The Policies & Procedures, Section 7.3.3, prevents making your own flyers to promote JAFRA, its products, or its opportunity. We understand your concern about not having enough company flyers and will work to provide you the resources you need. Can I make any of my own merchandise or promotional materials to promote my JAFRA business? Yes, you are allowed to make the following items as long as they clearly display the JAFRA Independent Consultant logo (and not the corporate JAFRA logo): Business cards T-shirts, hats, jackets, and other items of clothing Nametags Pens and stationary You are not permitted to make items such as tablecloths, banners, posters, or printed flyers without permission from JAFRA. Please jafracares@jafra.com to ask for permission for your project. 3

4 Please explain what I can and cannot do with the JAFRA logo. You are not permitted to use the corporate JAFRA logo (which is the name JAFRA or the name JAFRA and the slogan Freedom to Be You ) in any materials/content/posts that you create. (See P&P Section ) You may use the JAFRA Independent Consultant logos provided on JAFRAbiz.com for your Consultant activities. (See P&P Section ) Where can I find the JAFRA Independent Consultant logo? You can find it at jafrabiz.com > Consultant Connection > Resources > Training > Web When does the new Policies & Procedures go into effect? Any updated version of the Policies & Procedures goes into effect immediately when it is posted on Consultant Connection. (See P&P Section 1.2.) The updated version is now in effect. Do I have to use the JAFRA order form with clients? Only if you sell product over $25 on an in-person basis, as this order form contains legally required notices for in-person sales, like the three-day cancellation period. (See P&P Section 6.1.9). If you sell product through your JAFRA Personal Website, then the website automatically keeps track of all your sales for you. It s a great way for you to save time and effort! I use recorded phone trees or robo calls to my clients or consultants with reminders. Is that allowed? No, that is not permitted pursuant to Policies & Procedures Section The reason is that there are numerous, complex laws concerning telemarketing and sending prerecorded voice messages, and there are serious fines and penalties for violating those laws. Am I allowed to promote JAFRA at a business, salon, office, etc.? Yes, you are allowed to promote JAFRA at retail locations like businesses, salons, and offices as long as you follow all of the Policies & Procedures. You cannot display the product for sale at those places, but you can display your business cards, brochures, or flyers created by JAFRA. You are permitted to display samples or demonstrate product as long as you do not offer the product for retail sale there. Basically, if a customer would be able to buy the product at a location, as she would at a retail cosmetics store, then you are in violation of the Policies & Procedures. 4

5 Do I have to take JAFRA out of my address? Are new Consultants allowed to use JAFRA in their addresses? We don t want to disrupt your current business, but in the future we will be phasing the use of JAFRA out of Independent Consultant s, so if possible please remove it now. Please tell new consultants they are not permitted to use JAFRA in their addresses. On our voic & signature, can we say our JAFRA title? Yes, you may say your title but you must also say, JAFRA Independent Consultant. For example, Hi, you ve reached Mary, a JAFRA Independent Consultant and JAFRA District Director. (See P&P Section 7.1 and 7.1.1) What is inventory loading? Inventory loading is purchasing product that you are unable or unlikely to be able to sell to clients or use yourself or in your family within a reasonable time period. The Direct Selling Association prohibits its member companies, including JAFRA, from incentivizing or encouraging inventory loading. The reason is to protect independent consultants from losing money by buying more product than they can sell. For example, JAFRA does not want you to purchase product simply for the sake of maintaining or advancing a level in the compensation plan without being able to sell that product to your clients. What can be done about people selling JAFRA product for very cheap prices? As Independent Consultants, you set your own price for selling JAFRA product. However, when promoting product online, Consultants should only post the official current JAFRA sale or retail price. Further, as much of the discount pricing occurs through unauthorized sales online, we are working hard to enforce against these unauthorized online sales. When you say we can t order on behalf of another consultant, what are you referring to? I have consultants that call me at the end of the month so I can help them submit their order online. Some don t have a credit card so they give me money and I make the payment for them. This is not allowed under the Policies & Procedures Section 5.5 and Section 4.8. Instead of doing all this work for the Consultants, teach them how to place orders themselves and help them find a way to pay for the orders themselves. Consultants are not permitted to act on behalf of other Consultants in order to prevent fraud, and also because we want all of our Consultants to be empowered to run their own businesses. 5
