BACKGROUND 1. In March 2000, the secretariat of the Basel Convention has been informed by the director of tariff and trade affairs of the World Customs Organization (WCO) about the Third Harmonized System Review Cycle. 2. Discussion on this review cycle started at the session of the WCO Harmonized System (HS) Review Sub-Committee in September At previous sessions, the HS Review Sub-Committee discussed the scope of the Third Harmonized System Review Cycle and agreed that the next set of amendments should be effective from 1 January Such agreement needs to be approved by the WCO Harmonized System Committee. II. IMPLEMENTATION 3. Reference is made to decision V/10 of the fifth meeting of the Conference of the Parties concerning cooperation with the WCO, in particular regarding the separate identification of hazardous wastes in the Harmonized System. In this regard, the secretariat of the Basel Convention has been invited by WCO to submit proposals with respect to the amendment of the Harmonized System, as part of the third review cycle, as soon as possible. At the sixteenth session of the Technical Working Group in April 2000 Parties were invited to submit preliminary proposals to the secretariat on the separate identification of hazardous wastes and other wastes in the Harmonized System in addition to those already submitted for the next revision of the Harmonized System in 2002 (ref. document UNEP/CHW/C.1/3/Inf.3/Corr.1). The secretariat of the Basel Convention was requested to collect the proposals submitted by Parties and present to the Technical Working Group at its next meeting a consolidated set of proposals that could be submitted to the WCO once finalized by the secretariat. It was further decided that Parties who would submit proposals relating to hazardous wastes and other wastes to the WCO directly to provide the secretariat with copy of such proposals in order to enable the secretariat to keep an up-dated list of proposals submitted to the WCO as part of its Third Harmonized System Review Cycle; although the WCO would prefer that all proposals be channeled through the secretariat. 5. At the seventeenth session in October 2000, the Technical Working Group agreed that the secretariat should appoint a consultant experienced in the BC and the WCO procedure to prepare the background work to assist Parties in presenting submission to the WCO for the separate identification of hazardous waste and other wastes in the Harmonized System for consideration during the next revision of the Harmonized System in Parties and Signatories were also encouraged to provide the secretariat, by the end of February 2001, with proposals on the types of hazardous wastes and other wastes that they would like to be submitted to the WCO. To date no Parties have submitted proposals relating to hazardous wastes and other wastes to the secretariat. The secretariat was also requested to translate the brochure published on this issue in September 2000 into French and other United Nations languages, subject to availability of funds. 6. The appointed consultant began work for the secretariat in February 2001 and completed his task in March The report of the consultant is attached as Annex 1 to this note. Canada s comments on the consultant s report is also attached to this note as Annex The brochure being translated into French and Spanish would be circulated to all interested Parties soon. 8. The secretariat participated in November 2000 and May 2001 in the relevant session of the 26 th and 27 th Sessions of the Harmonized System Committee in order to follow the work of the Committee on the review and addition to the classification of wastes in the Harmonized System. 9. A joint initiative, coordinated by UNEP in Nairobi, is underway between the secretariats of the Basel Convention, the Rotterdam Convention and the Montreal Protocol in order to work together on submission of list of controlled materials and substances to the WCO. A workshop to discuss and exchange experiences in the WCO procedure is being planned in June 2001 for the convention secretariats concerned. 10. The Technical Working Group may wish to: 2 III. PROPOSED ACTION (a) Take note of the progress of the work on the separate identification of hazardous and other wastes in the Harmonized System under the Basel Convention; (b) Welcome the cooperation with other UNEP administered convention secretariats on submission to the WCO for separate identification of wastes and chemicals under the Harmonized System;

3 UNEP/CHW/TWG/18/11 (c) (d) Consider the report prepared by the consultant; Provide further guidance to the secretariat on this issue; (e) Reiterate its invitation to Parties and Signatories to submit proposals to the secretariat on the separate identification of hazardous and other wastes in the Harmonized System by 31 August 2001; (f) Request the secretariat of the Basel Convention to collect proposals submitted by Parties and Signatories and present to the WCO a preliminary set of proposals that could be submitted to the WCO as part of its Third Harmonized System Review Cycle; (g) Also request the secretariat to report to the next meeting of the Technical Working Group on progress. 3

4 Annex 1 CONVENTION WASTES IN RELATION TO THE HARMONISED SYSTEM CODING OF THE WORLD CUSTOMS ORGANISATION This report and tables have been prepared to provide information which takes into account the changes to be introduced in the Third Edition of the Harmonised Commodity Description and Coding System of the World Customs Organisation. The changes which will come into force on 1 January 2002 provide a number of new Harmonised System Codes for certain categories of wastes together with additions made to existing Harmonised System Codes for wastes. Introduction The Second Meeting of the Conference of the Parties to the Basel Convention held in Geneva in 1994 at DECISION II/23 requested the Secretariat to co-operate specifically with the Customs Co-operation Council and other relevant organisations in order to examine the possibility and practicability of including separate headings or sub-headings for hazardous waste in the Harmonised System of the Customs Co-operation Council in order to enhance border control of these wastes In 1994/95 the Secretariat of the Basel Convention, following joint consultation with the World Customs Organisation (WCO), the Environment Directorate of OECD and with the European Commission (EC), submitted a number of proposals to the Nomenclature and Classification Directorate of the World Customs Organisation seeking the separate identification 1

5 of certain categories of Basel Convention listed wastes in the Harmonised System. In parallel, the Environment Directorate of OECD submitted proposals for the separate identification of certain wastes in the OECD List of Wastes. At the same time the EEC had submitted proposals for the specific listing of waste and scrap of certain metals which were already included in the Harmonised System. Negotiations with the WCO Harmonised System Committee and Sub-committee were completed in Recommendations for the inclusion of certain wastes in the Harmonised System nomenclature were approved by the Council of the WCO. Consequently, a number of changes and additional categories of waste will now be included in the next (third) edition of the Harmonised Commodity Description and Coding System which comes into operation with effect from 1 January These changes and additions will make it possible for Parties to the Basel Convention to have regard to and be able to use the new classifications and codes for those wastes which have been given a precise listing in the Harmonised System. At the same time it is recognised that there are differences in the approach between the Harmonised System and the lists in the Basel Convention Annexes. Whereas the Harmonised System seeks to classify individual materials or products this is not always the case in the Basel Convention Lists where wastes are identified principally in relation to them being hazardous to human health and the environment. Nevertheless there are many similarities between the two systems of classification. Indeed, the Annexes VIII and IX in the Basel Convention have their origin in the Harmonised System nomenclature. To assist the Parties to the Convention a series of tables have been constructed. These list all Basel Wastes given in Annexes I, II, VIII and IX of the Convention and where possible ascribes the 2002 Harmonised System Code. In addition, information contained in the Explanatory Notes of the Harmonised System, where relevant, has been included together with the OECD Waste Code. Also included (designated by using italics) are recommendations for new entries in Annex IX which, it is understood, are to be submitted to the next Conference of the Parties by the Technical Working Group. 2

6 It can be seen that it is now possible to ascribe Harmonised System Codes to a significant number of Basel wastes, many of which are now specific entries. However, there remain some wastes for which it is not possible to do so. Two of possibly many reasons for this can be suggested: (1) Waste of a product has not merited entry in the Harmonised System due to a lack of a sufficient volume of trade. (In certain circumstances environmental considerations make it possible to over-ride the volume of trade criterion). (2) The descriptor of a waste listed in the annexes to the Basel Convention are insufficiently precise to allow them to be recognised by the Harmonised System. For example, Y14. Waste chemical substances...; Y15. Wastes of an explosive nature not subject to other legislation; Y34 Acidic solutions; Y35. Basic solutions. Similar examples such as A2030 Waste catalysts also can be found in Annexes VIII and IX. The Future The Fifth Conference of the Parties to the Basel Convention in 1999 at Decision V/10 requested the Secretariat under the guidance of the Technical Working Group, to pursue its cooperation with the World Customs Organisation on matters pertaining to the separate identification of hazardous wastes and other wastes in the Harmonised System and on correlation between the Harmonised System and the Basel Convention. In March 2000 the Basel Convention Secretariat was advised by the World Customs Organisation that the Third Harmonised System Review Cycle would commence in September 2000 with a view to the next set of amendments to the Harmonised System becoming effective from 1 January At the May 2001 meeting of the Harmonised System Committee the Secretariat of the Basel Convention was urged to make submissions for additions or alterations to 3

7 the Harmonised System to be made as soon as possible. The Committee expects the review cycle for the 2007 edition of the Harmonised System to be completed by Spring At the sixteenth session of the Technical Working Group in April 2000, Parties were invited to submit preliminary proposals to the secretariat of the Basel Convention on the separate identification of hazardous wastes and other wastes in the Harmonised System. The Secretariat of the Basel Convention would then assemble the suggestions from Parties into a consolidated set of proposals for consideration by the Technical Working Group before submitting them to the World Customs Organisation. This will further increase the number of Basel wastes provided with separate identification in the Harmonised System and thus satisfy Decision V/26 Work Programme Task III. 1. At the seventeenth session of the Technical Working Group in October 2000, Parties and Signatories to the Basel Convention were encouraged to provide the Secretariat with proposals on hazardous wastes and other wastes they would like to be included in the Harmonised System as soon as possible. At the time of writing this report (May 2001) no suggestions had been forthcoming. Having regard to identification of Basel wastes in the Harmonised System the author of this report makes the following suggestions for consideration by the Technical Working Group: (1) The Harmonised System does not cater for separate identification of the many types of both new and waste batteries and accumulators now being traded on the global market. (2) As discussed at the seventeenth session of the Technical Working Group, waste of animal or vegetable fats and oils, except degras, currently do not appear in the Harmonised System. (3) Currently, B3140 -Waste pneumatic tyres, excluding those destined for Annex IVA operations appears in the Harmonised System as H.S.Code Used pneumatic 4

8 tyres. Under this heading they are considered to be still usable or suitable for retreading. If they are unsuitable for reuse or retreading they are included under Heading No as Waste, parings and scrap of rubber (other than hard rubber) and powders and granules obtained therefrom. Such tyres can be processed to recover their steel bands and the residual tread and wall stripped off and processed to provide powders and granules or crumb of rubber which can be incorporated in road making materials in addition to other uses. Does volume of trade justify proposing the separate identification of tyres which are no longer suitable for reuse or retreading? (4) When preparing a submission for including candidate wastes in the Harmonised System it is always helpful if the phraseology used to describe the wastes where possible reflects that used in the legal text of the Harmonised System. Conclusion While it is now possible to identify individual wastes in the Harmonised System there are still many which can be coded ex only, that is, falling within a particular group or type of products. There are also a number of Basel wastes which defy classification because their description is not sufficiently specific. Proposals for additions or alterations to the Harmonised System can now be made for their inclusion in the 2007 Edition. Candidate wastes for making a submission to the World Customs Organisation are awaited by the Secretariat. 5

(c) Designation of waste on Annex IX does not preclude, in a particular case, characterisation of such a waste as hazardous pursuant to Article I, paragraph I(a) of this Convention if Annex I materials cause it to exhibit an Annex III characteristic.
