1 Raintree Springs Association, Inc. Architectural Control Policy Effective Date: May 7, 2007 Due to aging of the complex and new materials now available on the market, many homeowners are planning to replace existing exterior doors and windows. These replacements are the responsibility of the Homeowner as stated in Article V, Architectural Control, Article VII, Exterior Maintenance as amended, Article VIII, Use Restrictions as amended, Declaration of Covenants, Conditions and Restrictions of Raintree Springs as recorded in Book 2626, pages and amendments recorded in Book 2656 pages in the Records of the Clerk and Recorder, El Paso County, Colorado. In order to maintain uniformity within the complex, it is necessary to impose standards. Homeowners planning to replace exterior doors or windows or to install satellite disc or antenna must submit a Submission for Change Application to the Raintree Springs Board of Directors prior to the installation for approval. Upon notice of Board approval and the initial work has begun, all work shall be completed within thirty (30) days. All work shall be performed to professional standards in accordance with current local building codes and regulations. 1. Architectural Control Committee A. The Raintree Springs Association, Inc. Architectural Review Committee shall be appointed by the elected Board of Directors (Article V, Architectural Control) and shall consist of at least one Board member. B. The responsibility of the Architectural Review Committee is to maintain harmony of external design. (Article V, Architectural Control.) The objective is to keep the overall appearance in accordance with the Bylaws and Covenants of the Raintree Springs Association, Inc. Compliance with the established rules will aid in keeping the complex at its optimal value. C. Homeowners are required to submit plans or requests in writing for any changes to the exterior of any buildings before any work may begin. Submission for Change Application forms may be obtained from the Raintree Springs Association, Inc. Management Company.. The Architectural Review Committee will review requests submitted by homeowners to assure the requests are within accepted parameters set by the Board of Directors (attach a picture of proposed change with application.) The Architectural Review Committee shall make recommendations to the Board of Directors for approval or non-approval. Any change application received by the 30 th of the month will be reviewed and responded to by the 30 th of the following month. 1

Failure to comply with these established rules when making exterior modifications will result in fines and/or legal action and possible removal of unauthorized modification in accordance with the Raintree Springs Association, Inc. Covenant and Rules Enforcement Policy. 2. Exterior Door and Window Replacement Existing doors and windows in place prior to May 7 th, 2007 may remain. However, any future replacements must conform to the established rules as set forth: A. Front Entry Door Replacement of the front entry door is the responsibility of the homeowner. Solid core, paneled or plain doors are acceptable. The door may be wood, steel skin over wood frame or fiberglass composition. No window in the door will be approved, but a peep hole or eye may be installed. The door must be painted to match the existing exterior color scheme in place when the door is installed (the Association is responsible for the paint and painting the door.) Suggested Vendors: Lowes or Home Depot. B. Side Light Adjacent side light (located in B and C units) replacements may be obscured or clear glass. Leaded glass or caming is not acceptable. Interior coverings on side lights for privacy must be of professional quality if visible from the exterior of the building. Suggested Vendors: Lowes or Home Depot. C. Front Storm Door The addition or replacement of front storm door is the responsibility of the homeowner. Aluminum with wood core with windows with insect screens for ventilation or full view type in almond color (which will coordinate with existing and future building color schemes) are acceptable. Vinyl is not recommended for storm doors because of vulnerability to sun damage in some areas of complex. Suggested Vendors: Lowes or Home Depot. D. D Unit Sliding Door: Replacements for sliding glass doors opening to the decks are the responsibility of the homeowner and must match existing door size. Vinyl type door in almond color is acceptable. Suggested Vendors: Lowes or Home Depot. E. Central Passage Door to Garages: 2

3 Replacement of the passage door is the responsibility of the Association. Door must be replaced with a steel door that complies with current local building regulations and must be painted to match existing building color scheme. F. Double Vehicle Garage Door: Door replacement is the shared responsibility of both user unit owners. Replacement garage doors shall be galvanized steel with raised panels (32 panels) in factory white baked-on enamel (windows on the door are not acceptable.) Homeowners are prohibited from painting the door and the door should not require any additional painting for the lifetime of door. This will reduce Association maintenance costs considerably. Several grades of insulation are available. Suggested Vendor: Overhead Garage Doors. G. Windows: Replacement of existing windows is the responsibility of the homeowner. Vinyl windows (no French pane windows will be approved) in almond color are acceptable. Suggested vendors: Lowes, Home Depot or Window World. 3. Deck Replacement (D Units) Replacement of decks is the responsibility of the Association. However, some homeowner restrictions are required in order to control possible damage: A. Decks may not be enclosed with other than original railings. B. Decks may not be used for storage of wood or other items. C. Decks may not be used for clothes drying. D. Planters are allowed on decks; but water leakage must be controlled by homeowners as this may cause rotting of wood surface. E. Outdoor grills are prohibited on decks due to extreme danger of fire and resulting damage to buildings. F. Outdoor carpeting on decks is prohibited. G. Unattended animals are not allowed on decks and are prohibited from urinating and defecating on decks at any time 4. Entryway Safety Railings: Installation of Safety Railings on front entryways is allowed at the homeowner s expense. The purchase and installation of railings must be provided by a professional vendor. Black Wrought Iron railings are acceptable. 5. Exterior Lighting: 3

4 Exterior lighting for safety purposes located on the exterior of buildings around the common areas is the responsibility of the Association. Individual front entryway lighting is the responsibility of the homeowner. Replacement front entry lights must adhere to the following guidelines: A. Original light fixtures when the complex was built are black metal with a globe type fixture in opaque white glass. Replacement globes for this type fixture must be opaque white glass. If the entire unit needs to be replaced, fixture must be black metal with opaque glass enclosure(a variety of contemporary styles are available that would be acceptable). Suggested Vendors: Lowes, Home Depot or Home Lighting B. It is the homeowner s responsibility to change bulbs as necessary. Broken fixtures will not be allowed 6. Building Numbers: Numbers and identifying unit letters for front entryway of each building within the complex shall consist of black metal and must be the appropriate size for visibility and provide continuity within the complex (The Architectural Control Committee in conjunction with the Board of Directors will be responsible for selecting and placing numbers and identifying letters on each building.). 7. Front Entryways: Repair of concrete steps and platform for each unit is the responsibility of the Association. Placement of outdoor carpeting on entryways is not allowed; however, carpeting installed prior to May 7 th, 2007 and still in acceptable condition may remain. Frayed and badly worn carpeting must be removed by homeowner and may not be replaced. 8. Satellite Discs and Antenna: FCC regulations require Homeowner Associations to allow installation of antenna and discs. All homeowners wishing to install these devices are responsible for insuring that the service provider comply with the following installation guidelines: A. Discs or antenna must be installed according to the building map guidelines for placement (see Property Manager.) B. Installation of devices on building roofs is prohibited. Any violations will result in the removal of disc or antenna and any expense incurred with removal and any necessary roof repairs will be charged to the homeowner. C. Should placement on building other than the required location for disc or antenna be necessary to obtain signal, the service provider must state such in writing to the Association Board of Directors for approval prior to installation. 4

5 D. Under no circumstances will the installation of discs or antenna be allowed within the common area of the complex. 9. Exterior Grounds: All exterior grounds maintenance is the responsibility of the Association. Any alterations or replacements to existing landscaping by the Association shall follow the Landscaping Master Plan prepared for the Association by Thomas & Thomas, professional landscape planners. The following guidelines apply specifically to homeowners: A. Homeowners shall not remove or replace any existing landscaping. B. Homeowners are prohibited from placing any furniture, outdoor grills, statuary or decorative objects in the Common Areas or attached to the outside of any building. Outdoor grills may be stored in the homeowner garage space. Grills may not be stored on front entryways or on decks of D units. C. Plant containers are allowed only on the unit entryway or on decks of D units. Planting of any kind in the common areas is prohibited. D. Homeowners with pets residing within complex must comply with the Associations` Pet Control Policy. E. Pets that do not reside within the complex are prohibited in the common areas The above guidelines apply to every homeowner. Homeowners with tenants residing within the complex are responsible for assuring that their tenant is apprised of and follows these guidelines. The enforcement of these regulations is the responsibility of the Raintree Springs Board of Directors.
