10 The New Investments Several pieces of legislation Increased local building codes new homes will be more energy efficient helping state public buildings become more energy efficient through a process called performance contracting, Requires that state buildings and those buildings constructed with state funds meet the Leadership in Energy and Environmental Design Standards set by the United States Green Building Council.

11 The New Investments HB Directs the Colorado Public Utilities Commission (PUC) to require jurisdictional electric utilities and gas local distribution companies to develop and substantially expand energy efficiency programs. Requires investor-owned utilities to provide cost- effect (DSM)energy efficiency programs to their customers.

12 The New Investments HB Raises the baseline for local building codes to the 2003 International Energy Conservation Code. This will ensure buildings in our communities will be more energy efficient and help us reach our goal of 20% efficiency statewide by Sets a statewide energy code only for counties that already have a building code.

13 The New Investments HB GEO has been helping state public buildings become more energy efficient through a process called performance contracting, generally done in concert with Energy Service Companies. This bill earmarks funds to be committed to achieving similar energy efficiency gains throughout our K-12 school system. SB Requires that state buildings and those buildings constructed with state funds meet the Leadership in Energy and Environmental Design Standards set by the United States Green Building Council.

14 The New Investments SB Authorizes state spending on the Collaboratory, a partnership among NREL, Colorado University, Colorado State University, and the Colorado School of Mines. SB The Clean Energy Fund will provide a steady stream of revenue to the Governor s Energy Office (GEO) for the purposes of advancing energy efficiency and renewable energy throughout the state. GEO will be using the fund to target investments in emerging technologies and attract New Energy Economy investment to Colorado.

15 The New Investments HB This comprehensive bill restructures the funds and funding processes for public school capital construction projects. The green building standards and energy efficiency guidelines shall be based on Greening of State Government Executive Order, as well as additional Executive Orders and GEO policy directives. HB Local governments and the Colorado Clean Energy Development Authority (CEDA) may issue bonds to finance capital improvements for energy efficiency retrofits and the installation of renewable energy fixtures for private residences and commercial property.

16 The New Investments HB Allocates $2 Million to the Clean Energy Fund, managed by the Governor s Energy Office, to support investment in new energy technologies. SB Adds low-income housing projects and facilities constructed with severance tax revenue to existing energy efficiency requirements for state-assisted facilities. SB Creates the Colorado Clean Energy Finance Program within GEO to provide loans to home owners for clean energy improvements: any repair of or addition or improvement to residential real property that improves the energy efficiency of the property or replaces all or a portion of the energy from nonrenewable sources with energy from renewable sources.

29 ENERGY STAR RESULTS YTD For Colorado: 2004 = 4.2% of all new homes completions were ENERGY STAR certified, (1,615 of 38,145 homes) = 5.7%, (2,124 of 37,571 homes) 2006 = 7.8% (2,210 of 28,422 homes) 2007 = 8.9% (1,702 of 19,203 homes) 2008 YTD (thru 9/30) = 15.8% (1,505 of 9,530 homes).

32 2009 GEO DRAFT Legislative Agenda Energy Information disclosure act Require that upon contract for sale of a home, the homeowner provide previous year s utility usage information to the new homeowner (this is currently available to the homeowner, but not the prospective buyer). Change hybrid tax credit to a tax credit for AT-PZEV (Advanced Technology, Partially Zero Emitting Vehicles) or 75% of cost of a plug in hybrid conversion. This would restrict tax credit to high efficiency hybrids (not Tahoes, but priuses) and low emission vehicles like Compressed Natural Gas Vehicles while expanding to cover a portion of the costs of a plug-in hybrid conversion which typically double the mileage of a standard hybrid vehicle.

33 2009 GEO DRAFT Legislative Agenda Biodiesel clean up language: Right now, tax exempt entities like agricultural operations, municipalities, etc have to buy their fuel at distribution terminals (before the fuel is put in a truck) to qualify for purchase without paying taxes on the fuel. This clean up would allow a truck to distribute the fuel to the entities and allow them to keep their tax exempt purchasing status when the fuel is blended outside of the terminal. We are working on a funding mechanism through the State Treasurer to finance a solar schools initiative this may need some legislative authority, but currently that is unclear. We are considering an additional measure to significantly increase the size of the solar market over the coming decade. We are considering policy that would require homebuilders to offer solar (PV and SHW) as an option on new homes.
