1 SCDOT & the NPDES Program Presentation Outline Introduction and Overview Permitting Storm Water Management and Planning What is the NPDES Program? National Pollutant Discharge Elimination System Controls water pollution by regulating point source & non-point source discharges into waters of the United States Implemented & regulated by SCDHEC in SC Has three main parts: Industrial Permit Construction Permit MS4 Permit Permitting Three parts to the NPDES Storm Water Permit Program: Industrial Activity Permit MS4 Permit 1

2 and SCDOT Who must obtain a permit? Land disturbing activities greater than or equal to 1 acre anywhere in the state In the eight coastal counties, land disturbing activities ½ acre or more within ½ mile of a receiving waterbody Requirements Operator must prepare & submit a Notice of Intent (NOI) in order to receive permit coverage. A new NOI has been issued by DHEC for use on projects effective September 1, A Storm Water Pollution Prevention Plan (SWPPP) must be prepared & submitted to DHEC prior to DHEC granting coverage under the CGP. Cost of permit coverage is $125 unless DHEC reviews SWPPP then the additional $100/disturbed acre fee applies. All contractors and subcontractors who impact storm water discharges/controls must sign a copy of the Co-Permittee Agreement or Contractor Certification Form. This makes the contractors and subcontractors individually liable for any violations resulting from their work. For any projects that disturb 10 acres or more,,apreconstruction conference must be held to explain the SWPPP to the contractors/subcontractors. 2

3 Inspections HOW OFTEN? At least once every 7 days Only once per month if the entire site is temporarily stabilized WHO? CEPSCI certified inspector & the contractor s certified inspector (this is written into DOT contracts) WHERE? Entire site Weekly inspection meeting SWPPPs WHEN TO PREPARE? Prior to the submission of an NOI WHO PREPARES IT? Either a registered P.E., a registered landscape architect, or a Tier B land surveyor. WHAT IS IN IT? Set of construction plans with appropriate BMPs included (supporting calculations & documents do not have to be included unless requested by DHEC). Contents of the SWPPP The SWPPP must contain a description of: Pollution control measures Temporary & permanent stabilization practices Structural practices Post-construction storm water management measures Measures to prevent the discharge of solid materials Measures to minimize off-site sediment tracking Materials stored on-site and controls to minimize exposure of these materials to storm water Spill prevention and response practices Pollutant sources from other areas 3

4 Coastal Zone Regulations Stormwater Program Refinements apply to DOT projects in the eight Coastal Counties. Coastal Zone Regulations Runoff Storage Requirements: Projects within ½ mile of a receiving water body must store first ½ inch of runoff from entire site or first inch of runoff from the built-upon upon portion of the property, whichever is greater. Projects within 1,000 feet of shellfish beds must retain on site the first 1.5 inches of runoff from the built-upon upon portion of the property. Due to site/space constraints, SCDOT typically uses engineered devices instead of ponds for storm water quality treatment. Coastal Zone Regulations For bridge runoff over saltwater and/or critical areas: Runoff treatment criteria based on projected Average Daily Traffic volume (ADT), the waterbody classification and the presence of nearby shellfish beds. Penalties Civil penalties: $11,000/day/violation up to $137,500 total Criminal penalties: $127,000/day/violation up to $1,000,000 total Possible Imprisonment 4

5 SCDOT MS4 PERMIT SCDOT designated a large MS4 under NPDES Phase 1 Covers storm sewer systems within SCDOT rights-of of-way (ROW) and SCDOT properties within the entire state Phase I application submitted to DHEC in October Status: DOT s MS4 Permit became effective on November 1, Phase I Large & medium MS4s required to develop & implement a Storm Water Management Plan (SWMP). 10 Minimum Control Measures required in DOT s SWMP. 6 SCDOT Permit Requirements Outfall Identification (urbanized areas only!) Discharge Characterization Development of Storm Water Management Program (SWMP) for entire DOT Assessment of Controls Implemented in SWMP (How well are they working?) USGS Study Outfall Identification Locate and identify major outfalls Outfalls that discharge to Waters of the State Non-industrial areas 36-inch pipe or greater Ditches that drain > 50 acres Industrial Areas 12-inch pipe or greater Ditches that drain > 2 acres *This is only for outfalls that physically discharge into Waters of the State! t Discharge Characterization Identify pollutants of concern for SCDOT roads Obtain outfall sampling data collected by other Phase I MS4 permittees Dry Screening Perform sampling during periods when there is no precipitation to determine if there are illicit discharges connected to SCDOT storm drainage systems. 7 Key SWMP Components Practices to reduce discharge of pollutants to the Maximum Extent Practicable (MEP) Public education and outreach Programs to control runoff from: SCDOT owned streets, roads and highways Systems connected to DOT systems through modified encroachment permit process Structural control ol maintenance program Illicit discharge detection & removal program Assessment of SWMP Assess anticipated reduction in pollutant loading from the MS4 as a result of SWMP implementation Direct measurements Indirect measurements (e.g., number of illicit discharges/illegal dumping reported, gallons of used oil recycled, miles of road swept per year, etc) Prepare annual report on effectiveness of SWMP Examples of Storm Water Management & Planning Seven new EP & SC specs have been developed: Inlet Structure Filters Rolled Erosion Control Products (RECPs) Flexible Growth Matrix (FGM) Bonded Fiber Matrix (BFM) Sediment Tubes Stabilized Construction Entrance Silt Fence Examples of Storm Water Management & Planning The Water Quality Protection Field Manual is a handy reference for all SCDOT personnel that deal with Erosion Prevention & Sediment Control.
