2 ARTICLE 1- RECOGNITION The Employer recognizes the union as the sole collective bargaining agency for all employees of the Employer save and except Foreperson, persons above the rank of Foreman and office staff. ARTICLE 2- MANAGEMENT RIGHTS Section 1- The management of the Company's operation, including the right to hire, dismiss, transfer, demote, promote and discipline employees for cause pursuant to the terms of this Agreement, and promotion or appointment to supervisory positions rests solely with the Company. The Company recognizes the desirability of making such promotions and appointments among existing employees. Section 2- Nothing contained herein shall be deemed to qualify, limit or alter in any manner, the Company's sole and complete authority and discretion to establish, regulate, determine or modify at any time, levels of employment, shift hours of work, the extent of hiring and layoff, production schedules, manufacturing methods, the product and parts thereof to be manufactured, where and when work shall be done, marketing of its products, or any other matter related to conduct of its business or manner in which its business is to be managed or carried on, providing its actions are not contrary to the terms of this Agreement. ARTICLE 3- HOURS OF WORK Section 1- Ten (10) hours per day shall constitute a day's work. Forty (40) hours per week shall constitute a week's work, Monday to Thursday inclusive. Working hours may be changed by discretion of the Employer. Section 2 - When an employee reports for work and is sent home and told to return later that day to complete his job, he will be paid two (2) hours extra, as compensation for the shift interruption. Section 3 - Call in - When an employee is instructed to report for work on other than his normal shift, he will be paid a minimum of two (2) hours pay at the applicable rate of pay. ARTICLE 4- SHIFT WORK When other than day shift is worked, a shift bonus of two dollars ($2.00) per hour will be paid. ARTICLE S -RATES OF WAGES Section 1- The following minimum rates of wages will be effective on dates,shown. to be paid weekly every Thursday. In the event of shift work, pay day on afternoon and night shift will be at the conclusion of the Wednesday shift 2

3 Classification October P 1 /2014 Layout Boilermaker $31.21 Fitter/Welder $28.48 Machine Maintenance $25.91 General Welder $25.09 General Machinist $25.09 Welder "B" $22.51 Machine Operator $23.08 Helper "A" $19.27 Helper "B" $17.44 Section 2 - Qualifications - Experience and ability rated by Management for the following positions: Lay-out- Boilermaker papers, or eight (8) years proven experience with the Company. Fitter- Welder- General fit-up and all position welding tickets (6G). Machine Maintenance- Machinist papers, or six (6) years experience with the Company in this area, or three courses at night school. (The Company may give this designation without the previous criteria at their discretion.) General -Welder- All position tickets (6G). General Machinist- Four (4) years shop experience, some night school courses, or experience acceptable to the Company. Welder- "B"- Straight welding- ticket position (2G). Machine Operator and mechanical assembly painter. Helper "A" - Material handling, grinding, straight drilling, testing. Helper "B" -Entry Level Helper, automatically upgraded to Helper "A" after six (6) months. Section 3 - Testing Procedure for upgrading into different classifications. Existing employees will be given the first opportunity to upgrade into a higher classification before any new employee is hired. The employee must display qualifications to be considered.

4 Section 4 - Job Posting Job openings will be posted for one (1) week. The employee will be paid at his cuitent rate of pay for a thirty (30) day trial period. Pay will then increase as skills are upgraded, as agreed between the Union and Management. Section 5 - Christmas Bonus There will be a Christmas bonus paid out based on the following seniority chart: Less than one year: $0 more than one year: $1 00 More than four years: $175 more than eight years: $250 ARTICLE 6 - OVERTIME Section 1 -All overtime will be paid for after ten (1 0) hours have been accumulated in one (I) day. Section 2 - Management agrees to pay overtime after ten (I 0) hours work based on an accumulated forty ( 40) hour work week, or prior approval of absence by Management or proof of sickness via a doctor's note etc. Section 3 - The rates for overtime are as follows: Monday to Friday, time and one-half (1 112) for the first eight (8) hours of overtime, and double time (2x) after eight (8) hours of overtime. Saturday and Sunday and Paid Holidays will be paid at double (2x) time rates. Section 4- In the case of unscheduled or emergency overtime, a hot meal will be provided to the employee if he works more than two (2) hours overtime. Section 5 - When the Company determines that overtime is required, the Company shall give eight (8) hours notice to the employee when possible. ARTICLE 7- PAID HOLIDAYS Christmas Day Boxing Day New Years Day Good Friday Thanksgiving Day Victoria Day Canada Day Civic Holiday Labour Day Floater Family Day Employees must be at work the last day before and the day after a holiday in order to receive payment, unless a doctor's certificate is provided within three (3) days of return to work, or prior approval of Management. 4

5 ARTICLE 8- VACATION PAY Section 1 - All employees with less than three (3) years service shall receive four percent ( 4%) of gross earnings. Section 2 -All employees with over three (3) years service shall receive five percent (5%) of gross earnmgs. Section 3 -All employees with more than four (4) years service shall receive six percent (6%) of gross earnings. Section 4 -All employees with more than eight (8) years of service shall receive seven percent (7%) of gross earnings. Section 5 -All employees with over twelve (12) years of service shall receive eight percent (8%) of gross earnings. Section 6 - Vacation pay shall be computed from July 1st to June 30th of each year. Upon request the vacation pay shall be paid when the employee takes his holidays. Vacation pay shall be paid annually on July 1st unless otherwise requested as stated above. ARTICLE 9- COMPANY PENSION PLAN Section 1- The Company shall contribute to an individual Registered Retirement Savings Plan (R.R.S.P.) at the end of the month the following amounts per employee. Effective October 1st, 2003, fifteen dollars ($15.00) per week. Effective October 1 5 ', 2004, twenty dollars ($20.00) per week. The employee will have the right to match the weekly contribution. Section 2 - Employees hired after October 15th 1990, will be subject to a one (1) year waiting period before joining this plan. ARTICLE 10- UNION SECURITY AND CHECK OFF The Employer will deduct from the first pay period of each month, union dues covering all employees engaged on work coming within the scope of this Agreement, also initiation fees or reinstatements covering new employees and promptly remit same together with a list of names of the employees whose union dues, initiation fees or reinstatements are so deducted, to the Secretary- Treasurer of the Local Union. Union dues shall be forwarded to the Secretary Treasurer of the Local Lodge no later than the fifteenth (15th) of the following month. The Employer shall also deduct one half of one percent (Y2.%)(Shop Dues Assessment) of the gross hourly wage to be deducted weekly and submitted monthly along with the field dues. ARTICLE 11- REPRESENTATION Section 1 -For the purpose of carrying out the provisions of this Agreement the Employer shall deal only with the accredited representative of the Union. The Employer recognizes the right of the Union to appoint, or otherwise select a Shop Steward whose duties will be to assist the Employer and the Union in carrying out the provisions of this Agreement. 5

6 Section 2 - All employees under this Agreement agree to cooperate and assist in every legitimate way the Employer to conduct a successful business bearing in mind that both parties must give service to the public. ARTICLE 12 - SENIORITY Section 1 - Seniority shall be defined as length of continuous service in the Company. New employees shall have no seniority, but upon completion of a probationary period of ninety (90) days, seniority shall then be established and dated back to the time of hiring. Section 2 - Seniority and ability in the classification where an employee is employed shall govern on layoff and recall. Section 3 - Employees who have been absent from work due to layoff or long term disability shall retain their seniority for six (6) months after which the employee will lose all seniority rights. A laid off worker must return to work within seven (7) days notice. Section 4 - An employee shall not suffer loss of seniority because of sickness, accident or authorized leave of absence or union duty. Section 5 - A separate list of seniority dates shall be supplied once a year to the Shop Steward and posted on the bulletin board. If there are no objections after five (5) working days, the list as posted shall stand. A board will be installed in the lunch room. ARTICLE 13- SAFETY AND PROTECTIVE CLOTHING Section I- Safety in the shop shall be governed by the Occupational Health and Safety Act. Section 2- The Employer shall supply gloves and standard safety glasses as required, at no cost to the employee. Replacement on return of damaged articles. Raincoats and boots will be made available by the Company for use as required. Section 3 - Prescription safety glass allowance up to an amount of two hundred ($200.00) per year upon presentation of sales receipts. Safety boot allowance up to the amount of one hundred and fifty dollars ($150.00) per year upon presentation of sales receipt will be reimbursed to the employee. Section 4- The Employer will supply coveralls (and coverall cleaning) at no cost to the employee. Loss or destruction of coveralls will be paid for by the employee. Section 5 -The tool allowance shall be one hundred and thirty-five dollars ($135.00) per year, tools must be approved before purchase to qualify. Section 6 - work. The Employer will provide one ( 1) pair of foam ear plugs per employee per day of 6

7 ARTICLE 14- HEALTH AND WELFARE Section 1- The Employer shall provide and maintain the present Health and Welfare Plan. Section 2 - Benefits cease either on the date of termination of employment or on the day that Long Term Disability begins. Within fifteen (15) days prior to the date that Long Term Disability begins, the option to continue benefits by paying premiums to the Employer will be made available. ARTICLE 15- BEREAVEMENT PAY Section 1- On the death of a Father, Mother, Father-In-Law, Mother-In-Law, Grandparents, Wife, Brother, Sister or child of an employee, the employee so affected, provided he attends the funeral shall be granted three (3) days leave of absence with pay provided they are working days, the days to include the day of the funeral and the two (2) days immediately preceding the day of the funeral. A common law spouse is included in the above list of deceased, if registered as a dependent on the Health and Welfare Plan. Section 2 - The exception to attending the funeral per Section 1 is when the funeral is overseas. If the employee does not attend the funeral because ofthis reason, he shall be granted paid leave of absence per Section 1. ARTICLE 16- PROBATIONARY EMPLOYEES Probationary employees are excluded from paid benefits of Article 7, Article 14 and Article 15 which will become effective starting completion of the ninety (90) day probationary period. ARTICLE 17- GRIEVANCE PROCEDURE First: An employee or group of employees covered by this Agreement having a grievance shall first take the matter up with his Foreman, with or without the assistance of the Shop Steward. Second: Failing to reach a settlement within forty-eight (48) hours, the grievance shall be presented in writing to the Plant Superintendent who will discuss the matter with the employee or group involved and the Shop Steward. Third: Failing to reach a settlement with the Superintendent within forty-eight ( 48) hours, the Employer or Union shall be entitled to have the assistance of an International Representative of the Union if necessary, failing a satisfactory settlement, the grievance may then be referred to arbitration as provided for in Article 18 of this Agreement. ARTICLE 18 - ARBITRATION Should any difference of opinion arise as to the proper interpretation of this Agreement, the case must go to arbitration as is provided for in the Ontario Labour Relation Act. 7

8 ARTICLE 19- LEGISLATIVE EDUCATION ACTION PROGRAM FUND (L.E.A.P.) Effective January 01, 1995 the Employer shall contribute an amount of thirty ($30.00) per month to the Legislative Education Action Program (commonly called L.E.A.P. Fund). The above contribution shall be forwarded monthly to the Secretary-Treasurer of the Local Lodge. ARTICLE 20- DURATION OF AGREEMENT This Agreement is effective October 1 51, 2014 through September 30, 2015 and is to remain in full force and effect for these dates. Should either party to the Agreement desire any changes, written notice must be given by the party desiring the change, stating the desired change or changes, thirty (30) days prior to the anniversary date of the agreement. ARTICLE 21- ENABLING CLAUSE Where a particular Article or Articles of this Collective Agreement is or are found to work a hardship for a particular project, the terms and conditions of this Agreement may be modified by the mutual consent of the Union and the Company when they deem it prudent.
