2 How is waste defined For the purpose of transboundary movement, Article 2, para. 2 defines wastes as follows: «Wastes are substances or objects which are disposed of or are intended to be disposed of or are required to be disposed of by the provisions of national law»

3 How is waste classified Based on 45 categories under Annex I of the Convention and divided into: waste streams (Y1 to Y18) e.g. clinical wastes, waste mineral oil, PCBs, etc. waste having as constituents (Y19 to Y45) e.g. copper compounds, arsenic, cadmium, lead, etc.

4 How is waste classified «Other wastes» Wastes collected from households (Y46) Residues arising from incineration of household wastes (Y47) Hazard Characteristics as on Annex III (H1 to H13) Corresponds to UN hazard classification 1 to 9 on transport of dangerous goods

5 How is a waste classified as hazardous waste Reference to domestic legislation that shall specify the criteria and procedure needed to determine its classification Reference to and use criteria for classification and labelling of dangerous goods Based on hazard classes H10 to H13 (Annex III characteristics)

6 Waste controlled under the Convention «Hazardous wastes» are Wastes that belong to any category contained in Annex I of the Convention (Y1-18 or Y19-45), unless they do not possess any of the characteristics contained in Annex III of The Convention Annexes VIII and IX of the Convention (adopted at COP4 in 1998)

7 Waste controlled under the Convention Article 1.1.b of The Convention Wastes (.) defined as, or considered to be, hazardous wastes by National Legislation of the Party of export, import or transit.

8 Waste controlled under The Convention Definition of «other wastes» (Article 1.2) Waste categories contained in Annex II of this Convention: Y46 Wastes collected from households Y47 Residues arising from incineration of household wastes

9 Waste controlled under The Convention Explanation on Annex VIII: Wastes listed in Annex VIII are characterized as hazardous pursuant to Article 1, paragraph 1(a) The listing of a waste in Annex VIII does not preclude the use of Annex III to demonstrate that the waste is not hazardous Wastes listed destined for D-operations and R- operations are subject to the Ban Amendment (after it comes into force), unless they do not exhibit Annex III characteristics

10 Waste controlled under The Convention Explanation on Annex IX: Wastes listed in Annex IX are not covered under Article 1, paragraph 1(a) unless they exhibit Annex III characteristics Wastes in Annex IX may fall under Article 1, paragraph 1(b) Wastes listed destined for D-operations are subject to the Ban Amendment (after it comes into force), unless they do not exhibit Annex III characteristics

11 Waste controlled under The Convention Explanation on Annex IX (contd): Wastes listed destined for R-operations are not subject to the Ban Amendment (after it comes into force), unless they exhibit Annex III characteristics

12 Wastes controlled under the Convention Wastes excluded from the scope of the Convention Radioactive wastes Wastes derived from normal operation of a ship

13 Environmentally sound management of hazardous wastes Take all practicable steps to ensure that hazardous wastes or other wastes are managed in a manner which will protect human health and the environment against the adverse effects which may result from such wastes (Art. 2) Technical guidelines for the environmentally sound management of wastes subject to this Convention and shall be developed by the Parties (Art. 4.8)
