3 March 26, 2007 Mr. Robert Omalley 19 Talana Lane Bella Vista, Arkansas RE: Omalley Residence Landscaping NPDES Permit Tracking No.: ARR Dear Mr. Omalley: On March 13, 2007, Alison West, District Field Inspector, and I investigated a complaint related to the subject site and performed a storm water permit compliance inspection of this site in accordance with the provisions of the federal Clean Water Act, the Arkansas Water and Air Pollution Control Act, and the regulations promulgated there under. The complainant was concerned that the lack of sediment and erosion controls on your property could allow for transport of sediment into Loch Lomond due to the disturbance of soils from landscaping. Although your property appears to be less than an acre in area, it is part of a larger common plan of development. This means that you are automatically covered by the NPDES Storm Water Discharge Permit (ARR150000) and are required to comply with the terms of the permit as it applies to small construction sites. This inspection revealed the following violations: 1. The Construction Site Notice was not posted in a prominent place for public viewing. This is in violation of Part 1.B.7.e of the permit. 2. No Storm Water Pollution Prevention Plan (SWPPP) was available for review. This is in violation of Part II.B.1.b of the permit. 3. Sediment and erosion controls were not implemented as required by the SWPPP. This is in violation of Part I.C.3 of the permit. The above items require your immediate attention. Please submit a written response to these findings to the NPDES Enforcement Section of this Department when the violations have been corrected. This response should contain documentation describing the course of action taken to correct the items noted.
