1 MEGA WIN SERVICE - TERMS & CONDITIONS 1. THE MEGA WIN SERVICE, PROMOTION & ELIGIBILITY 1.1. The Mega Win Service is a weekly subscription service which allows Hotlink customers who subscribe to the service to download and utilize content such as wallpapers, videos and other content from Mega Win s mobile content media library via the Mega Win Service ( Mega Win Service ) By subscribing to the Mega Win Service, Hotlink Customers are eligible (subject to paragraphs 1.4 and 1.5 below) to participate in a weekly SMS quiz ( Promotion ). The Participants are the Hotlink Customers who meet the eligibility criteria to participate in the Mega Win Service and Promotion as specified in paragraphs 1.2, 1.4 and 1.5) The Mega Win Service commences on 00:00:01 on 13 August 2018 and will continue until 23:59:59 on 30 December 2018 ( Mega Win Service Period ). The Promotion shall run throughout the Mega Win Service Period The Mega Win Service and Promotion are open to Hotlink Customers only who must be: a resident of Malaysia; at least 18 years of age; and the registered owner of the mobile phone number used to subscribe to the Mega Win Service and such person must maintain his/her Hotlink account throughout the Mega Win Service Period. The Hotlink account must not be suspended or inactive for any reason whatsoever during the Mega Win Service Period The following group of persons shall not be eligible to participate in the Promotion: permanent or contract employees of Maxis and their immediate family members (children, parents, brothers and sisters, including spouses); representatives, employees and/or agents of the content provider, advertising and promotion agencies and other service providers for the Mega Win Service and Promotion and their immediate family members (children, parents, brothers and sisters, including spouses); persons who maintain a commercial relationship of agency and/or distribution with Maxis, as well as the companies (including their employees) engaged by Maxis to facilitate or administer the Mega Win Service and/or Promotion; 1.6. In the event any one of the people in paragraph 1.5 participates in the Promotion and turns out to be the winner, the corresponding award will not be granted to such person and it will pass to the corresponding runner-up winner who deems eligibility Subscription to the Mega Win Service and participation in the Promotion constitutes the Participant s full and unconditional agreement to and acceptance of these Mega Win Service Terms & Conditions (including any variations to the same made by Maxis) By subscribing to the Mega Win Service and participating in the Promotion, you agree to be bound by the Mega Win Service Terms & Conditions contained herein. In addition to these Mega Win Service Terms & Conditions, the terms and conditions applicable for the use of the content of the Mega Win Service and participation in the Promotion as set out at shall apply to you. Failure to comply with any applicable terms, conditions, rules, regulations, instructions or methods shall result in you being disqualified from the Promotion All Participants of the previous Mega Win Service will be able to continue their participation in the Promotion during the Mega Win Service Period. 2. PERSONAL INFORMATION/ PERSONAL DATA The personal information/personal data supplied by Participants when subscribing to the Mega Win Service and/or entering into or participating in the Promotion will be collected and used by Maxis in accordance with its privacy policy in the Maxis Group Privacy Statement. Please refer to the Maxis Group Privacy Statement by visiting the website (at for more information as entry in the Mega Win Service is an agreement to be bound by that privacy policy, which shall form an

2 integral part of the Terms and Conditions of the Mega Win Service. The personal information/personal data collected may be used in future by Maxis to provide Participants with further information about similar campaigns and information in relation thereto, which Participants may opt out of by informing Maxis of the Participant s decision to do so. Participants personal information/personal data is subject to the safeguards concerning privacy and security of data as set out in Maxis Group Privacy Statement and the Personal Data Protection Act Participants shall ensure that all personal information/personal data provided to Maxis are accurate and correct at the point of submission and that Maxis is kept informed and updated of any change in their personal information/personal data. 3. MECHANICS OF THE MEGA WIN SERVICE & PROMOTION 3.1. Purpose of the Mega Win Service and the Promotion The purpose of the Mega Win Service is to allow Hotlink Customers to gain access to Mega Win s mobile content media library for a weekly subscription fee of RM5/week (incl 0% GST) For every successful weekly renewal of the Mega Win Service, Hotlink Customers will be awarded with download online credits (RM5 = 5 download online credits; RM1 = 1 download online credit) redeemable for downloads on the dedicated web portal at Hotlink Customers who subscribe to the Mega Win Service will also gain a free entry to participate in the Promotion to be in the running to win a weekly Prize The purpose of the Promotion is to give Hotlink Customers of the Mega Win Service the opportunity to win amazing weekly Prizes at no extra charge Registration for the Mega Win Service and Promotion Hotlink Customers who wish to opt in to the Mega Win Service must send via SMS, YES or YA to Upon successful registration via SMS or USSD, Hotlink Customers will be charged RM5/week for the Mega Win Service and will receive a set of welcome messages followed by the first quiz question of the Promotion By successfully answering all the 30 questions of the Promotion, the Participant is eligible to stand a chance to win one of the three (3) weekly Prizes. The top three (3) winners will be chosen weekly Subscription Charging Once the Hotlink Customer opts in to the Mega Win Service, he/she will be charged a subscription fee of RM5/week (incl 0% GST) for subscription to the Mega Win Service and gain free entry to participate in the Promotion Deduction of the weekly subscription fee is automated and will start at any point after 9:00am daily If a Hotlink Customer has insufficient balance, the Hotlink Customer is still allowed to participate in the Promotion according to the partial charging mechanism Partial Charging If a Hotlink Customer s account balance is less than RM5 but more than RM1, a maximum of RM1 will be deducted and the Hotlink Customer will be allowed to participate in the Promotion and answer the weekly questions. Participants will receive 1 download online credit with the RM1 charge A Participant is allowed to enjoy partial charging only twice throughout the Mega Win Service Period. If the weekly subscription of RM5 failed to be charged on the

3 subsequent week, the Participant will automatically be opted out of the Mega Win Service. The Participant has to opt in again if the Participant wishes to join the Mega Win Service again. Upon auto opt out, the Participant s accumulated quiz points from answering the Promotion s questions (the Promotion points ) for that week will be forfeited Partial charging allows Participants to participate in the Promotion to win the weekly Prizes in case they did not receive the full charge requested (RM5) yet, for two times only throughout the Mega Win Service Period Each SMS sent originating from Malaysia by the Participant to the short code number (for interaction in the Promotion, registration to the Mega Win Service, or any other purpose as per these Mega Win Service Terms & Conditions) will incur no charges. If the Participant sends any SMS to from outside Malaysia, standard roaming charges apply The SMS sent to Participants via the short code number as reply messages or any promotional messages regarding the Mega Win Service and/or Promotion will not incur any charges to the Participant whatsoever The SMS Quiz (Promotion) Mechanism Participants will receive a variation of multiple choice questions in a week (a set of 30 questions) Participants are to answer the questions based on replying with 1 or 2 only to the short code In case Participants send words or any combination of letters without 1 or 2 (for example: Michael or the correct answer is red ) then the SMS shall be considered invalid and they shall receive an SMS asking them to reply with 1 or 2 to input the correct answer. If the Participants send a combination of digits and letters then the first digit shall be taken as the reply but only if it is 1 or 2 (for example: the answer is 1 not 2), otherwise they shall receive an SMS informing them that their input was invalid Participants shall reply with an SMS only once to each question received. In the event that several replies are sent then the first one that reaches the Promotion shall be considered the answer For every correct answer, a Participant will receive a minimum of 10 Promotion points For every wrong answer, a Participant will receive 5 Promotion points The Participant that achieves the highest number of Promotion points in the week will stand a chance to win the weekly Prize The period for a week is defined as 00:00:01 AM on Monday until 23:59:59 PM on Sunday of that week In the event that more than one Participant achieves the 3 rd highest number of Promotion points in a week, the Participant with the shortest duration to achieve this number of Promotion points will be selected as the 3 rd winner for the week The duration recorded is determined from the time the Participant replies to the first question until the time that the Participant replies to the last available question for the week The Promotion points collected from the start of the Promotion (any day of the week) are valid until Sunday 23:59:59 pm of the same week By sending any SMS to short code 29922, Participants signify their complete acceptance and full understanding of the current Mega Win Terms & Conditions and agree: to receive SMS communication on their mobile phones relating to the Mega Win Service and the Promotion; and to receive SMS communication/advertising offers from Maxis.

4 If Participants still have active days at the beginning of the consecutive week then they can send the keyword Go and they will receive the first question of the new week s set and start answering accordingly, but they will not be eligible to win that week s Prize unless they were successfully charged before the end of the week Any other keyword sent (apart from the predefined command keywords) will only be replied to with the invalid keyword reply that states clearly that the keyword sent is not one of the command keywords If the Participant is not eligible to access the Promotion, any keyword sent (apart from the predefined command keywords) will be replied to with the not eligible reply that states that the Participant is not eligible to play due to subscription renewal failure Content Downloads (Mega Win Service) Content made available through the Mega Win Service shall be accessible for view by all Hotlink Customers of the Mega Win Service via the website Hotlink Customers shall earn 5 download online credits for every week that their RM5 subscription is successfully renewed Each download online credit shall be redeemable (may be consumed) by the Hotlink Customer accessing the website to execute content downloads. The Hotlink Customer s download online credit balance shall be deducted for each content downloaded (e.g. one (1) download online credit shall be deducted for each wallpaper download and three (3) download online credits shall be deducted for each video download) Help, Opt Out or any other SMS Options/keywords (SMS sent originating from Malaysia incurs no charge) For clarification on the mechanics of the Mega Win Service, send HELP to To change the language of communication for the Mega Win Service, send BM to change their current language to Bahasa Malaysia and EN to change to English To opt out from the Mega Win Service, send STOP to The Hotlink Customer will then receive an SMS confirmation that his or her MSISDN will be unsubscribed within 24 hours From the point that opt out is completed, the Hotlink Customer will not receive any other promotional SMS from the short code and shall no longer be charged with the Mega Win Service weekly subscription fee unless the Hotlink customer re-subscribes to the Mega Win Service If the Hotlink Customer sends a new Opt In SMS message to 29922, following the opt out, the Hotlink Customer will be subscribed again to the Mega Win Service but will no longer receive any promotional SMS Hotlink Customers shall be also able to send SMS originating from Malaysia to the Short Code without any charge for the following purposes: Being informed of their current Promotion points, by sending the keyword BALANCE Re-acquiring their password for the content portal by sending the keyword PIN If the Hotlink Customer sends any SMS to from outside Malaysia, standard roaming charges apply.

5 4. PRIZES 4.1. Weekly Prizes All Participants that earn any amount of Promotion points during the week corresponding to a weekly Prize are eligible to participate in the Promotion to win the Weekly Prize The 3 Participants with the top 3 highest amount of Promotion points for the week will win an iphone X each In the event that more than one Participant achieves the highest amount of Promotion points in that specific week, the Participant with the shortest duration to reach the highest amount of Promotion points will be declared the winner. The duration referred to is measured from the point the Participant answers the first question to the point the Participant answers the last question to determine the highest points in that week Winning Conditions The eligible Participant can win only one (1) weekly Prize during the Mega Win Service Period A Participant that participated in the Promotion with elements of unfair competition, illegal business practices, consumer rights violation and/or more similar elements shall not be eligible for Prizes and any Prizes won by these Participants shall immediately be forfeited and awarded to the corresponding runners-up Maxis has the right to not allow the participation in the Promotion by individuals who try to influence or have influenced (directly or indirectly) the Promotion points collection procedure by ways which are not specified herein The winner of the Prize (the Winner ) will be notified within 60 working days after the weekly Promotion, in which he/she participated, ends. All Participants must keep their mobile phones switched on and their Hotlink accounts active during the weekly Promotion in which they participated and 60 days after. Maxis shall not be responsible or liable if the Winner cannot be contacted for any reason whatsoever following efforts by Maxis to contact the Winner via phone. If Maxis is unable to reach the Winner for a period of 5 (five) consecutive working days, Maxis reserves the right to disqualify the Winner and to select the next Participant as winner of the Prize The Prizes provided cannot be substituted with other rewards Maxis reserves the right to change the Prizes without notice Prize Delivery All Winners will be called by a representative of Maxis (i.e. 123 which is Hotlink s care line) Winners shall not be notified by way of SMS Winners shall share with the representative of Maxis their personal info, i.e. full name, a valid Malaysian Identification Card (NRIC) number that is registered to the Hotlink account owner/participant of the mobile number used to subscribe to the Mega Win Service and to participate in the Promotion and a Malaysian address to receive the Prize The Prizes will be delivered to the Winners by a courier service Winners will receive their Prize within 30 days after the collection of their personal info from Maxis representative.

6 5. GENERAL TERMS AND CONDITIONS 5.1. Maxis reserves the right to disqualify any registrations, subscriptions or redemptions (as the case may be) that are not eligible or due to any reasons whatsoever as Maxis may in its absolute discretion deem fit Maxis decision on all matters relating to the Mega Win Service and/or Promotion will be final and binding Maxis, its agencies, affiliates, sponsors and representatives shall not be liable to any Hotlink Customer/Participant or any other party for any loss or damage of whatsoever nature suffered by any Hotlink Customer/Participant or any other third party as a result of or in connection with the participation or non-participation in the Mega Win Service, Promotion or as a result of any act or omission on the part of Maxis The laws of Malaysia shall in all respects govern the Mega Win Service and Promotion. However, it shall be your sole responsibility and obligation to ensure that you comply with and do not contravene with any laws to which you may be personally subject to By participating in the Mega Win Service and Promotion, Hotlink Customer/Participants shall be deemed to have unconditionally accepted all the Mega Win Service Terms & Conditions and the Hotlink Customer/Participants further: (i) agree to co-operate and comply with all reasonable requests of Maxis in connection with the Mega Win Service and/or Promotion; and (ii) agree to disclose personal details to Maxis for the purpose of organizing, facilitating, administering, promoting and conducting the Mega Win Service and/or Promotion, including for the purposes under paragraph Maxis reserves the right, in its sole discretion, to disqualify any Participant that is found or suspected of tampering with the Mega Win Service, the Promotion and/or its process or the operation of the Mega Win Service or Promotion. Maxis reserves the right to disqualify any Participant and/or to forfeit any Prize and/or reward from a Participant it believes has undertaken fraudulent practice and/or activities or other activities that may be harmful to Maxis, to other Hotlink Customers/ Participants, to the Mega Win Service and/or Promotion or to the Mega Win Service/ Promotion submission process. Fraudulent activities are deemed to include but are not limited to any act of deceit and/or deception and/or cheating Maxis reserves the absolute right at any time without assigning any reasons, to add, alter, modify, change or vary the Mega Win Service Terms & Conditions contained herein, wholly or in part at its absolute discretion. Hotlink Customers/Participants who subscribed/participated in the Mega Win Service and/or Promotion are deemed to have accessed the Mega Win Service website at and to have knowledge of and to have agreed to any changes or variations to these Mega Win Service Terms & Conditions. The Hotlink Customers/Participants agree that their continued subscription/participation in the Mega Win Service/Promotion will constitute their acceptance of these Mega Win Service Terms & Conditions (as varied or changed) Hotlink Customers/Participants are advised to constantly review the Mega Win Service Terms & Conditions uploaded on the Mega Win Service website ( Maxis reserves the absolute right at any time without assigning any reasons thereto to cancel, terminate, postpone or suspend indefinitely the Mega Win Service and/or Promotion Maxis, its agencies, affiliates, sponsors and representatives shall not be liable for any default due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, drought, storm or any event beyond the reasonable control of Maxis.

A failure by Maxis to enforce any of these Mega Win Service Terms & Conditions in any instance(s) will not give rise to any claim by the Hotlink Customer/Participant and/or any person Maxis reserves the right to alter, amend, suspend and/or discontinue the Mega Win Service, the Mega Win Service Period, the Promotion and any of the Mega Win Service Terms & Conditions of the Mega Win Service and or Promotion without any prior notice Maxis reserves the right to revise and amend these Mega Win Service Terms & Conditions to reflect changes in the market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities or for any other reason in our sole discretion which we may decide The Hotlink Customer/Participant shall assume full liability in the case of any mishap, injury, damage, claim or accidents arising from their participation in the Mega Win Service, the Promotion and/or redemption of the Prizes, wherein Maxis shall not be responsible and/or liable to the Hotlink Customer/Participant for any mishap, injury, damage, claim or accidents arising from their participation in the Mega Win Service, the Promotion and/or redemption, acceptance of the Prizes In no event shall Maxis, its related and affiliated corporations, sponsors, agencies and representatives be liable to any Hotlink Customer/Participant or to anyone else for any loss or injury or any direct, indirect, special, exemplary, consequential damages, or any damages whatsoever, whether in contract, negligence or in tort, arising out of or in connection with the Mega Win Service, the Promotion or the Hotlink Customer s/participant s participation in the Mega Win Service/Promotion including (without limitation) any cancellation, suspension, postponement or termination of the Mega Win Service and/or the Promotion Maxis is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of, user or member communications, or any problems or technical malfunction of our telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of or players on account of technical problems or traffic congestion on the Internet.
