1 January 14, 2009 Bob Tobey, Chairman Runyan SID #211 # 5 Teakwood Drive Sherwood, AR AFIN: NPDES Permit No.: AR Dear Mr. Tobey: On January 13, 2009, Inspector Jill Glenn and I performed a reconnaissance inspection of one of the pump stations in the Oak Shadows subdivision in accordance with the provisions of the Federal Clean Water Act, the Arkansas Water and Air Pollution Control Act, and the regulations promulgated thereunder. This inspection was performed in response to a complaint. The complaint alleged that the pump station has overflowed and raw sewage was on the ground. The complaint was found to be valid and the inspection revealed the following violation of the Arkansas Water and Air Pollution Control Act: A.C.A (b)(1)(e) Discharging sewage to the waters of the state without a permit. You will need to remove any residual sewage from the pump station area. The above item requires your immediate attention. Raw sewage was noted on the ground surrounding the pump station and near the creek running behind the pump station. There was a backhoe on site and a hole had been dug next to the pump station. A sanitary sewer overflow was reported to the department on January 7, I spoke to superintendent Bob Evans who informed me the problem was in the process of being remedied. Your letter appears to adequately address the discrepancies identified during the visit. The Department assumes the corrective actions taken will be maintained to ensure consistent compliance with the requirements of the permit. Acceptance of this response by the Department does not preclude any future enforcement action deemed necessary at this site or any other site. The Department will keep the inspection and response on file. If future violations occur that require enforcement action, the Department will consider the inspection and response as required by the Pollution Control and Ecology Commission Regulation No. 7, Civil Penalties. This regulation requires the Department to consider the past history of your company and how expeditiously the violations were addressed in determining any civil penalty that may be necessary for any future violations.
