2 NON BINDING TRANSLATION Page 2 / 6 Article 1 Part constitution, amendments and changes The present part forms integral part of the Contract which is part of the appendices of Sections A B C D1 and D2 of the Contract since applicable to the title of the Contract. All the Contract stipulations apply mutatis mutandis to the present part. In accordance with article 2 of the Contract, the Shipper commits himself becoming acquainted with any evolution or update of this posterior part at the date of signature of the Contract, notified by GRTgaz. 1.1 Amendments following legislative and regulatory changes of the legal framework The stipulations of article 2.1 Section A of the Contract apply mutatis mutandis in the case of new legislative or regulatory provisions from any competent authority that may apply directly or indirectly to this part or a decision of the Energy Regulatory Commission under the article L of the energy Code or a final decision of the CoRDIS under the articles L to 24 of the energy Code, would come into effect after the Contract signature. 1.2 Other changes The stipulations of article 2.2 Section A of the Contract apply mutatis mutandis in the case of GRTgaz should amend the Contract for reasons other than those referred to in sub-clause 1.1 above. Article 2 Introduction This document sets out: The conditions of capacity availability on GRTgaz's main transmission system for each contractual point with interruptible capacity, for the North-South link, and for the Nord Atlantique and Sud Atlantique storage facilities. The conditions of capacity availability at the Fos and Montoir LNG Terminal Interface Points. The terms used in this document are in accordance with the definitions presented in the Appendix A1 of the transmission contract. Article 3 REMINDER CONCERNING THE FIRM CAPACITIES 3.1 Definition In accordance with the general conditions of the transmission contract, a firm capacity is a capacity whose availability is contractually guaranteed by GRTgaz under normal operating conditions, in particular outside the periods of engineering works and outside the case of "force majeure". 3.2 Case of the PITS In the particular case of Transport-Storage Interface Points (PITS), firm capacity exists solely for the following periods (see Transmission contract, Section B): Firm entry capacity is calculated for the period from November 1 to March 31; Firm exit capacity is calculated for the period from May 1 to September 3. In other words, the availability of firm capacities at the PITS varies over the year. The capacities are guaranteed each day in normal operating conditions of the transmission system. GRTgaz makes its best efforts, acting as a prudent and reasonable operator, in order to accept nominations at PITS higher than the guaranteed level of firm capacities. 3 NON BINDING TRANSLATION Page 3 / 6 Article 4 REMINDER CONCERNING THE INTERUPTIBLE CAPACITIES 4.1 Definition In accordance with the general terms and conditions of the transmission contract, an interruptible capacity is a capacity whose use is not guaranteed by GRTgaz. 4.2 Conditions of availability The availability of the interruptible capacities depends of several factors: 1. The consumption level related to temperature, seasonality and considered month; 2. The network configuration, especially related to scheduling choice of all shippers on a given point; 3. The maintenance works. Each interruptible capacity can be divided into a "climate-related" part and a "scheduled" part, respectively associated to the consumption or temperature parameter and to the scheduling parameter of all shippers. This document sets out the relations between the capacity on the considered contractual point and these 2 parameters, excluding periods of maintenance works and under normal operating conditions,. 4.3 Description of information forms The main features of the contractual points listed below are provided in the attached summary appendix. 4 NON BINDING TRANSLATION Page 4 / "Conditions of interruptible capacity availability" section This section provides indicative formulas concerning the availability in relation with the temperature or consummation parameter (for the "climate-related" part) and the scheduling parameter for all shippers (for "the scheduled" part). The formulas are applied in accordance with the following rules: The available interruptible parts "climate-related" and "scheduled" can be aggregated ; The interruptible capacities are always under the maximum interruptible capacity specified in the table. The climatic part The available capacities may be related to consumption. Therefore, consumption forecasts on GRTgaz grid, in H-Gas or L-gas, in South and North balancing zone are used to determine climatic parts. Total resulting scheduling The total resulting scheduling on a given contractual point is equal to the difference between: The sum of "entry" scheduling for all shippers on this point ; The sum of "exit" scheduling on the same point. A shipper can assess the available interruptible capacity on a given point or a link using a hypothesis of a total resulting scheduling on another point "History" section This section allows comparing the historical achievements of allocations (quantities allocated) over the period January 1- December 31 for monthly profiles of the available capacities. 4.4 CASE OF THE NORTH-TO-SOUTH LINK CAPACITY The firm capacity on the North-to-South link is 27 from April 1 to October 31, 29 from November 1 to March 31. The interruptible capacity on the North-to-South link includes two components: A "climate-related" part up to 3 maximum. His terms of availability are defined in the Appendix 1. A scheduled part up to 15 maximum. o For the period from April 1 to October 31th, these availability conditions are defined in the Appendix 16. o For the period from November 1 to March 31, these availability conditions are defined in the Appendix CASE OF THE PITS NORD ATLANTIQUE AND SUD ATLANTIQUE CAPACITIES The capacities marketed on PITS Nord Atlantique and Sud Atlantique are available in accordance with the following conditions: The provisions specified in paragraph 3.2 regarding the capacity seasonality at PITS; The total availability of firm entry capacities at PITS Nord Atlantique and Sud Atlantique higher or equal to the total nominal daily capacities and conditional daily withdrawal capacities 1 are guaranteed only at the extremely low temperature corresponding to a maximum period of three successive days as statistically occurs once in fifty years; GRTgaz guarantees a minimum availability of the exit firm and interruptible capacities from the North zone to PITS Nord Atlantique and entry capacities into the South zone at PITS Sud Atlantique, in relation to the temperature and the total resulting scheduling on the concerned PITS; 1 Nominal daily capacity and conditional daily withdrawal capacity as defined by STORENGY. 5 NON BINDING TRANSLATION Page 5 / 6 GRTgaz as a prudent and reasonable operator makes its better efforts, to accept nominations at PITS Nord Atlantique and Sud Atlantique higher than the firm capacities and released in relation to the temperature or to the consumption and total resulting scheduling on the concerned PITS In summer PITS Nord Atlantique The firm guaranteed exit capacities from Northern zone to PITS Nord Atlantique depend on the level of the total consumption of gas H and B on the GRTgaz network for the considered day (consoh+b_d_forecast), in the limit of 17 and according to the formula: Firm guaranteed capacity D >= MAX ( ; -,19 * consoh+b_d_forecast ) The interruptible exit capacities from Northern zone to PITS Nord Atlantique are released by the LNG Montoir terminal emissions and depend on interruptible capacities released on the link between North and South balancing zones. The interruptible exit capacity from the Northern zone to PITS Nord Atlantique may be adjusted each day up to 185. The rule regarding the capacities released of the zone towards PITS Nord Atlantique is specified in Appendix 16. PITS Sud Atlantique The exit scheduled capacities from Southern zone to PITS Sud Atlantique are released in case of under-utilization of the South to North link, up to In winter PITS Nord Atlantique The firm guaranteed capacities at PITS Nord Atlantique to the entry into Northern zone depend on the level of the total consumption in North zone of gas H and B on the GRTgaz network for the considered day (consonordh+b_d_forecast), in the limit of 43 and in accordance with the formula: Firm guaranteed capacity D >=MAX(,33 * consonordh+b_d_forecast - 32 ; ) In case of under-utilization of the interruptible part of link capacity between the South and North balancing zones, a transfer of capacity to the entry on the Northern zone from PITS Nord Atlantique thanks to the nominations at 2 p.m on day D-1 may take place in the limit of 43 and according to the formula: Firm guaranteed capacity D <=MAX(,22 * consonordh+b_d_forecast -4 ; ) The interruptible capacities at PITS Nord Atlantique at the entry point at the Northern zone are released in the limit of 5 in case of LNG Montoir terminal emission lower to 15. The availability terms of firm and interruptible capacities are defined in Appendix 13. PITS Sud Atlantique The firm guaranteed capacities at the entry point of the Southern zone from PITS Sud Atlantique depend on the level of the total consumption in South zone on the GRTgaz network for the considered day (consosud_d_forecast), in the limit of and according to the formula: Firm guaranteed capacity D >= MAX(,52 * consosud_d_forecast ; ) In case of under-utilization of the interruptible part of link capacity between the North and South balancing zones, a transfer of capacity to the entry of the South zone from PITS Sud Atlantique thanks to the nominations at 2 p.m on a D-1 may take place in the limit of and according to the formula : Firm guaranteed capacity D <= MAX(,3 * consosud_d_forecast + 4 ; ) The availability terms of these capacities are defined in Appendix 17. 6 NON BINDING TRANSLATION Page 6 / 6 The scheduled capacities of PITS Sud Atlantique are released at the entry point of the Southern zone according to the nominated quantities delivery on the PIR Midi point. The availability terms are defined in the Appendix 14. Article 5 CAPACITIES AT THE LNG TERMINAL INTERFACE POINTS 5.1 PITTM Montoir The available entry capacity at the Montoir Transmission - LNG Terminal Point depends on the local level consumptions as described in the form provided in Appendix 19. On the basis of these relations and taking into account the delivery history over the last two years as all as climatic data, it is also possible to conduct a statistical analysis to determine the minimum capacity available each day at a given level of probability. The curve provided in Appendix 2 thus represents the minimum capacity available each day using a 5% and 9% probability scenario. The probability level is determined using the consummation parameter. 5.2 PITTM Fos The entry capacity at the Transmission-LNG Terminal Interface Point depends on the following system parameters: Rhône pipeline transit capacity. This one depends on the performance of the pipeline's constituent infrastructures. Currently, it is equal to 15. The consumption level in the South-East area. This one depends on the temperature and operation of certain major industrial customers (for example the Combined-Cycle Gas power plants). We consider that this parameter may vary from 6 (August minimum with one or two CCG in works) to 29 (consumer risk 2%, may occurs once in fifty years). Deliveries to Cruzy via the Midi pipeline. These deliveries depend on shipper's nominations at PIR Midi point. This parameter has a low impact, as a minimum 15 transit capacity at Cruzy is guaranteed (excluding maintenance works periods). Two thirds of Midi nominations (up to 45 of nominated capacity) thus contribute to the Fos capacity. The level of injection and /or withdrawal into/from the Manosque storage facility. This level depends on shipper's nominations at PITS Saline. This parameter thus varies from -15 (withdrawal) to +2 (injection). For a given day, the following relation is established: Capacity at FOS <= + CONSUMPTION + PITS SUD EST + 2/3* MIDI For the period from November 1 to March 31, the firm entry capacity at the Fos Transmission-LNG Terminal Interface Point under the normal operating conditions of the transmission network is 41. For this period, the normal operating conditions are defined as follow: minimum consumption of 8 over the period, minimum nomination of 45 at PIR Midi. For the period from April 1 to October 31, the firm entry capacity at the Fos Transmission-LNG Terminal Interface Point under the normal operating conditions of the transmission network is 41. For this period, the normal operating conditions are defined as follow: minimum consumption of 6 over the period, injection of 2 into PITS Sud Est, nomination of 45 at PIR Midi. The curve provided in Appendix 22 presents the minimum entry capacity available each day using a 5% and a 9% probability scenario. The probability level is calculated on the basis of all consumption parameters taken together, including deliveries to Cruzy and Manosque (and not on the basis of each parameter separately).
