3 ANNEX BB SCRD STAFF MEMO DATE: October 16, 2013 TO: Planning and Development Committee, October 17, 2013 FROM: RE: Teresa Fortin, Planner Notification of BC Timber Sales Block A79517 BACKGROUND BC Timber Sales (BCTS) has advertised that they are seeking bids on cut block A See attached maps. Block A79517 comprises of several sections: DK042, DK0043, DK0044 and DKOO44B lie in the Dakota Community Watershed, and DK045 is near the headwaters of Roberts Creek. At the September 2013 Planning and Development Committee meeting, a staff report noted that Norm Kemp, BCTS Planning Forester, had notified the Regional District that BCTS was deferring the sale of this block while they are determining the presence of unique ecological/cultural attributes in DK045. It appears that BCTS has removed DK045 from the sale. DISCUSSION The SCRD had reviewed this block in 2012 and made the following resolution: 1 80/1 2 Recommendation No. 8 BC Timber Sales March 2012 Update THAT the staff report titled BC Timber Sales March 2012 update dated April 5, 2012 be received; AND THAT the Regional District inform BCTS that it does not support logging within the Dakota Community Watershed, including Block A79517 that lies within this watershed; AND THAT the Regional District does not support logging of old growth trees on Mt. Elphinstone; AND FURTHER THAT staff invite BCTS to talk to the Board about harvesting in old growth forests and within a community watershed. This resolution was recently sent again to BCTS in a letter addressed to Mr. Don Hudson, BCTS Timber Sales Manager on August 7, CONCLUSION It appears that BCTS has modified the sale of block A to exclude section DK045 that was in the Roberts Creek headwaters. 15 SCRD STAFF REPORT DATE: October 17, 2013 TO: Planning and Development Committee, October 17, 2013 FROM: Teresa Fortin, Planner RE: Application File by Horst for Private Moorage located at Highway 101, Halfmoon Bay. RECOMMENDATION The Planning and Development Committee recommend that the Regional District: 1) Request a surveyed plan of the infrastructure in the proposed licence area; 2) Request a report by a professional fisheries biologist to address consequences of removing the concrete boat launch; 3) Refer this information back to the Halfmoon Bay APC for comment; 4) Notify the Province of the Regional District recommendation. BACKGROUND The Regional District has received an application from the Ministry of Forests, Lands and Natural Resource Operations regarding a private moorage application by Mr. Horst fronting DL 1485 in Halfmoon Bay. Please review the application (Attachment A) for more information. DISCUSSION The private moorage and boat ramp/launch have both already been built and this is an application to legalize the foreshore development. According to our orthophotos, the boat launch and dock appear to have been constructed since September There are retaining walls and stairs that have been built to access the moorage facility. Zoning The upland parcel is zoned Rural Two (RU2) and is large enough to permit three dwellings and an auxiliary dwelling. It appears that the applicant does comply in this regard. The applicant also operates a Bed and Breakfast which is permitted under the zoning as long as it complies with part 502 (11) of Bylaw 310. In 2012, the applicant applied to the Regional District for a variance permit to address several structural setbacks and building issues on the property. The initial variance was denied but the applicant has recently entered into a compliance agreement with the Regional District and is working with the Building Department to address the outstanding information required of the variance application by November 30,2013.

16 File by Horst for Private Moorage Planning and Development Committee October 17,2013 Page 2 of 2 The foreshore in Halfmoon Bay is zoned Water One (WI - see Attachment B). The Wi zone permits one residential mooring facility for pleasure craft, which is auxiliary to the residential use. Mooring facilities in the Wi zone shall have a combined area, independent of any pedestrian access, not exceeding 65 m2. It appears that the existing moorage facility complies in this regard. The Wi also zone permits a public boat ramp, so long as it is operated and maintained directly or indirectly by local, provincial, or federal government which is customarily located on public land. This application for the boat ramp/launch appears to be on private land and for private use, which the zoning does not permit. The applicant has three options to address the non compliance: 1) remove that section of the ramp below the high water mark 2) apply to rezone the area of the ramp Access to Foreshore The proposed licence area appears to cross the foreshore fronting a Ministry of Transportation and Infrustructure (MOTI) right of way and the neighbouring lots to the west and south. The Province may require MOTI and the neighbours permission. Although the right of way is not being used, the SCRD considers it a public asset and would not support blocking access to it. DeveloQment Permit Area Development Permit Area #15 Stream Riparian Assessment Areas runs through the property (see map in Attachment A). Any development within 30m of the watercourse requires a Development Permit, which includes a riparian assessment report completed by a Qualified Environmental Professional. No building is permitted within i5m of the watercourse without a variance permit. The Regional District will require a building permit and/or a development variance permit for the stairs and retaining walls constructed to access the moorage facility Advisory Planning Commission The Halfmoon Bay APC reviewed this application at their September 2013 meeting and recommended that the applicant: - submit a set of surveyed drawings - consider alternatives for anchoring the dock that makes it more amenable for neighbour and the public, thus removing obstacles for navigation and encroachment on neighbouring foreshore and public right-of-way. - remove the boat launch CONCLUSION Staff recommend that the Regional District: I) Request a surveyed plan of the infrastructure in the proposed licence area; 2) Request a report by a professional fisheries biologist to address consequences of removing the concrete boat launch; 3) Refer it back to the Halfmoon Bay APC for comment; 4) Notify the Province of the Regional District recommendation.
