ALL PROJECTS MUST BE APPROVED BY THE ARCITECURAL REVIEW COMMITTEE THE HOA BOARD HAS ESTABLISHED THE FOLLOWING PROCEDURES AND GUIDELINES FOR THE ARC. THEY DO NOT COVER ALL SITUATIONS. PLEASE SUBMIT ANY QUESTIONS, CONCERNS, OR THE NEED FOR A PRELIMINARY REVIEW OF A PROJECT TO DEVELOPMENT SERVICES OVERVIEW: This document provides a framework for the makeup of the Lexington Hills Homeowners Association Architectural Review Committee ( ARC ) as well as adopts a fee schedule for the review and administration of requests that come before the ARC and the guidelines for the ARC members to use in carrying out the services and responsibilities of the Lexington Hills Board OBJECTIVE: The objective of the ARC is to maintain aesthetics, the quality of living, and property values of the subdivision. The ARC may periodically change the guidelines to meet this goal. It is important to keep the subdivision updated and modern. The ARC and the HOA Board have authority, in their sole discretion, to change these guidelines. No portion of these guidelines will supersede Lexington Hills CC&R s or the building codes of the City of Eagle or State of Idaho APPROVAL: Homeowners are required to submit project plans in writing prior to the start of any project for the consideration, review, and approval of the ARC, per CC&Rs The guidelines listed hereafter have been and may be modified from time to time to reflect changes in materials, building practices or the desire of the ARC and the HOA Board. Therefore, any prior approval of a project or material shall not be construed as an automatic approval of a similar, subsequent project for the same or another property Architectural Review Committee Procedures approved by HOA Board (11/30/18) Page 3

4 NOISE PERTAINING TO HEAVY CONSTRUCTION/DEMOLITION: The operation of any tools or equipment used in construction, drilling, repair, alteration, or demolition work that creates a noise disturbance across a residential real property line is limited to Monday through Saturday between the hours of 8:00 a.m. and 10:00 p.m. Heavy construction and demolition work is prohibited on Sundays and Holidays COMMITTEE MEMBERS: The ARC consists of the following representatives: At least one member of the Lexington Hills Homeowners Association Board of Directors, (the HOA Board). At least four current Lexington Hills homeowners. A construction or design specialist to serve on as needed basis. A representative of the Lexington Hills Homeowners Association s management company. A representative must be in compliance with CC&R s, Bylaws, and ARC Guidelines. It is recommended that the ARC choose a chairman and vice-chairman to oversee the meetings of the ARC. At least three committee members must be present at each meeting to establish a quorum. The ARC shall adopt the rules and regulations on how the ARC should work, how often it will meet, and how homeowners should submit plans for approval. The HOA Board must approve the ARC procedures and guidelines. ARC SUBMISSION & REVIEW FEES: Homeowners shall request approval of their planned project(s) prior to the starting of the project and resubmit if the approved plans are changed. Any subsequent changes, amendments, or additions to previously approved plans must also be submitted for review and approval. All exterior changes and/or additions to lawns, fences, and other improvements on a lot must be approved by the ARC, per CC&Rs ARC approval forms must be completed including a detailed description of the requested project upon submission. See PENALTIES FOR NON-COMPLIANCE WITH ARC PRE-APPROVAL PROCEDURES below for additional information. Based on the description of the project, a homeowner may be charged for the review, approval, and monitoring of changes and/or additions to homes or lots as required by the Lexington Hills CC&R s. The fees to be charged are as follows: All Exterior changes/additions - $ with $ refunded to the homeowner upon completion and subject to inspection/review of the completed work compared to the approved request. 5 Storage sheds/lean-to-sheds/playhouses - $ with $75.00 refunded to the homeowner upon completion and subject to inspection/review of the completed work compared to the approved request. Fences - $ with $75.00 refunded to the homeowner upon completion and subject to inspection/review of the completed work compared to the approved request. All Other Requests Including but not limited to paint color, any landscape changes, patio covers, hot tubs, playground equipment, patio extensions, pools, roofing, shutters, accents, garage doors, satellite dishes, flag poles, dog runs, and retaining walls shall not require a fee. All plans shall be submitted for approval to the ARC in care of Development Services at 9601 W. State Street, #203, Boise, ID 83714, danielle@dev-services.com, or call for more information. Since the ARC is made up of volunteer homeowners, please ensure that all items are submitted at once and allow the ARC adequate time to review requests. Due to the demand, and the number of individuals on the ARC, it is impossible to have each item reviewed on an expedited basis. Although the CC&R s allow the ARC 30 days to review and respond to a submittal, the ARC attempts to review and respond to submittals in 15 days. ARC Forms must be filled out by homeowners or their designated representative. Forms filled out by contractors, renters, real estate agents, or other parties will not be reviewed. Of the fees collected, the Management Company shall be paid on an hourly rate of $75 for time associated with ARC meetings, any correspondence, and/or monitoring of the approved project. In addition, if the services of a construction or design specialist are required, the ARC, after receiving pre-approval from the HOA Board, should contract with a knowledgeable and competent individual to provide such services. DRIVE THROUGH: Once a month the ARC drives or walks the Lexington Hills subdivision to inspect and insure compliance with the ARC guidelines. PENALTIES FOR NON-COMPLIANCE WITH ARC PRE-APPROVAL PROCEDURES: Failure by a homeowner to complete and submit the required ARC approval form and obtain ARC approval prior to starting a project covered by the ARC Guidelines may result in a penalty fee charged to the homeowner, the amount of the fee to be determined by the HOA Board. Pursuant to the CC&Rs, further action may also be taken by the HOA Board as may be necessary to remedy any resulting violations of the CC&R s and the ARC Guidelines. Failure by a homeowner to complete a project in accordance with the approved ARC approval form, shall require the homeowner to correct the project to the originally approved form or the homeowner must resubmit a new ARC approval form and pay a resubmission fee as recommended by the ARC and approved by the HOA Board. PERMITS CITY OF EAGLE (Building codes) or STATE of IDAHO (Electrical codes): Nothing in these guidelines shall preclude the requirements of the building codes of the City of Eagle or the State of Idaho. All necessary requirements, permits, and compliance to the building and electrical codes shall be the sole responsibility of the homeowner. 6 If the City of Eagle requires a building permit for the proposed work, a copy of the permit shall be provided to the ARC prior to the commencement of the work THE FOLLOWING MUST BE APPROVED BY THE ARC PRIOR TO INSTALLATION: CASE-BY-CASE BASIS The approval of all requests for an addition, change or other improvements to a structure or landscaping will be based on the compatibility and of harmony surrounding homes, the environment, and the lack of gaudiness of offensive visual or acoustical interference within the environment of the Lexington Hills subdivision as determined by the ARC, per CC&Rs DOG RUN A dog run may be made out of chain link, however the chain link may not be visible from the street. If the dog run is not located behind an approved screening fence, it must be screened by tall shrubs. FENCES There are no requirements to install a boundary fence around property in Lexington Hills. However, if the homeowner chooses to install a fence, they must submit a request to the ARC and abide by following regulations. Section 7.7 of the CC&R s for Lexington Hills shall be the basis of guidelines for fences within Lexington Hills. This section is included below: No fence, hedge, or boundary wall situated anywhere upon any lot shall have a height greater than six (6) feet, or such other lesser height as the Architectural Control Committee may specify, above the finished graded surface of the ground upon which such fence, hedge, or wall is situated. No fence shall be constructed of any material other than wood nor finished in other than natural finish, except as may be specifically approved by the Architectural Control Committee... No fence shall be constructed so as to extend toward the front of the lot past the front plane of the dwelling structure constructed thereon, or closer than ten (10) feet to any side lot line adjacent to a dedicated street on a corner lot. No fence, wall, hedge, or shrub planting with an elevation above three (3) feet shall be permitted in front of the building set back requirement without special written consent of the Architectural Control Committee. No fence, wall, hedge, or shrub planting which obstructs sight lines at an elevation between four (4) and eight (8) feet above the roadway shall be placed or permitted to remain on any corner lot within the triangular area formed by the street property lines and a line connecting them at points twenty-five (25) feet from the intersection of the street lines or, in the case of a rounded property corner, from the intersection of the street property lines within ten (10) feet from the intersection of a street property line with edge of a driveway. No tree shall be permitted to remain within such distances of such intersections unless the foliage line is maintained at sufficient height to prevent obstruction of sight lines. 7 Further definitions of fence guidelines are: Three (3) styles of wooden fences are allowed within Lexington Hills at certain locations are specified below: Good Neighbor 1x4 or 1x6 cedar dog-eared cedar. Closed Picture Frame 1x4 or 1x6. Open Picture Frame cedar with 2x2 bars with or without a puppy panel See attachments for a graphic representation and specifications. Wrought iron fences with or without a puppy panel are allowed within Lexington Hills at certain locations specified below. Vinyl The vinyl closed picture frame 1x6 Sound Barrier Fence was required by the City of Eagle along the boundary of Lexington Hills and State Highway 55 and will not be permitted in any other location. COMMON AREA BOUNDARY: May be either Open Frame Wood or Wrought Iron WOOD- OPEN PICTURE FRAME 2X2 WOOD fence with or without a puppy panel as per attachment. Vertical bar openings MUST NOT EXCEED 3-1/2. MUST be finished in a natural finish, except as approved in writing by the ARC. Six (6) feet height upon ground finish grade or such other lesser height as the ARC may specify in writing. WROUGHT IRON: MUST be vertical bar style with or without ornamental tips on bars as per attachment and with or without a puppy panel as per attachment. May be powdered coated aluminum or powdered coated/painted steel. Panel widths generally are 4, 5, 6, but may vary to fit boundaries. May be black or brown in color to blend well with the landscape as determined by the ARC. Six (6) feet height upon finish grade or lesser height as the ARC may specify in writing. Vertical bar openings MUST NOT EXCEED 3-1/2. Privacy slats are NOT allowed. BETWEEN NEIGHBORS SIDE OR BACK BOUNDARY: May be either Wood or Wrought Iron. WOOD- May be GOOD NEIGHBOR, CLOSED PICTURE, or OPEN PICTURE FRAME with or without a puppy panel (as per attachments). Fences adjoining existing fences require the agreement of all adjoining neighbors EXCEPT PHASE 9. Phase 9 requires Open Picture Frame with or without a puppy panel or wrought iron (see below) with or without a puppy panel on side boundaries. 8 If adjacent homeowners are sharing in the installation, ALL names MUST appear on the ARC request form. WROUGHT IRON- MUST be vertical bar style with or without ornamental tips on bars as per attachment and with or without a puppy panel as per attachment. May be powdered coated aluminum or powdered coated/painted steel. Panel widths generally are 4, 5, 6, but may vary to fit boundaries. May be black or brown in color to blend well with the landscape as determined by the ARC. Six (6) feet height upon finish grade or lesser height as the ARC may specify in writing. Vertical bar openings MUST NOT EXCEED 3-1/2. Privacy slats are NOT allowed. If adjacent homeowners are sharing in the installation, ALL names MUST appear on the ARC request form. STREET FACING: May be either WOOD or Wrought Iron. WOOD- May be GOOD NEIGHBOR, CLOSED PICTURE, or OPEN PICTURE FRAME with or without a puppy panel (as per attachments). If Good Neighbor fence, street side section at front of house or side of house on corner lots must be good side with slats facing out. WROUGHT IRON- MUST be vertical bar style with or without ornamental tips on bars as attachment and with or without a puppy panel as per attachment. May be powdered coated aluminum or powdered coated/painted steel. Panel widths generally are 4, 5, 6, but may vary to fit boundaries. May be black or brown in color to blend well with the landscape as determined by the ARC. Six (6) feet height upon finish grade or lesser height as the ARC may specify in writing. Vertical bar openings MUST NOT EXCEED 3-1/2. Privacy slats are not allowed. FLAGPOLES Permanent Permanent flagpoles are not allowed in the Lexington Hills subdivision. FLAGPOLE Temporary or Removable Temporary or removable flagpoles are allowed in the Lexington Hills Subdivision. When selecting a US Flag and temporary flagpole, the following specification must be followed: Flagpole telescoping or removable. 9 Material aluminum. Color aluminum, white, bronze. Height does not exceed the ridge line (highest point of the roof) of the home. Base size maximum 2 ½ inches. Halyard external halyard (nylon ropes) not allowed. US FLAG SIZE 3 FOOT BY 5 FOOT. Quantity one per household. FLYING THE US FLAG The US Flag may be displayed on a removable pole that is held in place by a bracket placed upon the front of a dwelling. The US Flag must be clean and in good condition, and comply with flag etiquette. A flag should be flown from sunrise to sunset. However, a flag may be displayed 24 hours if properly illuminated during the hours of darkness. Flags should not be displayed on inclement weather days, except when an allweather flag is displayed (all weather nylon or non-absorbent material). When picking a location for a pole, consideration for neighbors should be given. Means of the flag attachment must be such as to prevent noise in windy conditions. GARAGE DOORS Garage doors may be raised metal panel, wood, or fiberglass and may have windows in the top panel. Slab (one piece) garage doors are not allowed. GARAGE - Detached Detached garages with or without a breezeway maybe allowed provided they are built of the same materials and decor as the house and have the same roof pitch as the house. LANDSCAPING Any Changes *Reviewed on a case-by-case basis. Please submit as detailed a plan as possible, noting any changes to existing landscape along with any additions or modifications. Must meet minimum landscape requirements as specified by lot size. Requirements available from Development Services. MAILBOXES Each lot shall have a uniform mailbox and support structure that is maintained by the Owner. Each mailbox must be black rural, measuring 7 ½ w x 10 ½ h x 20 ½ d, attached to a wooden rot resistant post measuring 3 1/2 x 3 ½ x 42 high, that is cemented into the sidewalk. 10 PAINT COLOR *All paint requests are reviewed on a case-by-case basis. Paint chips must be attached to ARC request form. Bold or stand out colors will not be allowed. Downspouts must be painted to blend with the house body color. Gutters must be painted the same as the trim color. When changing from original color, a 2-foot square of body color, 2-foot square of garage door color, and 3-foot length of trim must be painted on house in close proximity before submitting an ARC Form. Recommended colors reflect nature and are in harmony with surrounding homes brown tones, gray/grey tones, beige, or cream. Bold or accent colors may be considered for accents such as front door color. Approval at the discretion of the ARC. PATIO COVERS/PATIO EXTENSIONS Metal roof material is not allowed. Shingle roofed patio covers must match house shingles exactly. Alumawood type patio covers and pergolas must submit sample of material. *Reviewed on a case-by-case basis. PLAYHOUSES - See storage sheds. PLAYGROUND EQUIPMENT The ARC will evaluate setbacks from neighbors so the swings do not hit the fence and children are not looking into neighbor s yard, etc. Any covers must be part of the submittal for approval. RETAINING WALLS *Reviewed on a case-by-case basis. Special consideration will be given to impact/water runoff onto neighboring properties. ROOFING REPLACEMENT Reviewed on a case-by-case basis, with consideration given to the suitability of the proposed material and if it is in harmony with the surroundings and the neighboring properties. The approval or application of any style or type of roofing material shall not be deemed as a waiver of any right to withhold approval of any subsequent application for a roofing project. A product sample board and a full-sized sample of the roofing material must be submitted to the ARC for review. LOTS CLASSIFIED AS A or B Roofing materials may consist of wood shakes, tile, cement, slate or presidential style shingles with a minimum weight of 340 pounds per square. Colors similar to Black, Weathered Wood, Charcoal or Driftwood may be considered for approval. Architectural Review Committee Procedures approved by HOA Board (11/30/18) Page 10

11 LOTS CLASSIFIED AS C, D, E, or F Roofing materials may consist of wood shakes, tile, cement, slate, presidential or architectural style dimensional/laminated shingles with minimum weight of 240 pounds per square. Colors similar to Black, Weathered Wood, Charcoal or Driftwood may be considered for approval. SATELLITE DISHES Homeowners must work with satellite dish suppliers to place dishes in such a manner as not to be intrusive and be consistent with good reception while keeping in mind the aesthetics of the home and neighborhood. Satellite dishes no longer in use must be removed. BASKETBALL BACKBOARDS Basketball backboards or posts shall not be installed without prior approval of the ARC as to materials and positioning. Backboards shall be freestanding, constructed of Plexiglas or acrylic material and shall be supported by removable metal posts, painted white to blend with the color of the house and anchored in concrete. Backboards must be perpendicular to and adjacent to the driveway, or to the side of the house, or shall be located in the backyard, so as not to constitute a nuisance or visual obstruction to adjacent homeowners. STORAGE SHEDS/PLAYHOUSES All sheds and playhouses must maintain the aesthetics and architectural design of the property. Any free-standing storage structure or play house that may be walked into will be considered a shed. Shed exterior and roof must be the same color as the house. Exceptions by the ARC may be made for sheds installed at houses with tile or shake roofs. These roofs must be black or charcoal in color. Roll up doors must be the same color as the shed walls. All sheds must be located at least 5 feet from each property line in order to screen the shed from neighbor s view and for shed and landscape maintenance. ARC may waive this requirement upon inspecting the location of a shed at the request of the homeowner. Visibility to street and common area will be considered. *Will be reviewed on a case-by-case basis. LEAN TO SHED *Reviewed on a case-by-case basis. A lean to shed is a structure that can be walked into and has a common wall with the house. To be considered for approval, a lean to shed must be located behind an approved solid fence or hidden from view by trees or shrubs. 12 Pumps should be located so as to not cause a noise nuisance for neighbors. Side and back set back minimum 5 feet requirement as of June Permits from the City of Eagle and State of Idaho are required. Above ground swimming pools are not allowed. TENNIS COURTS Tennis courts will be considered on a case-by-case basis. The ARC is particularly concerned about the tennis court s lighting and fences. Tennis courts must be setback from property lines so as to not cause a nuisance to neighboring property owners. ROOF SOLAR PANELS *Reviewed on a case-by-case basis. Considerations will include, but not limited to, visibility from street and neighbors view. Additional requirements detailed in the Lexington Hills Solar Panel Policy. HOME BACKUP GENERATORS *Reviewed on a case-by-case basis. Considerations will include, but not limited to, visibility and noise level WINDOW FANS/WINDOW AIR CONDITIONERS *Reviewed on a case-by-case basis.
