B-2 GENERAL BUSINESS DISTRICT : PERMITTED USES: : SPECIAL USES: : PROHIBITED USES: : AREA AND SITE RESTRICTIONS: : PARKING REQUIREMENTS: : PERMITTED USES: Permitted uses of land or buildings, as hereinafter listed, are authorized, subject to all specified conditions. Unless otherwise specifically set forth, wherever a permitted use is named as a major category, it shall include only those itemized uses specifically listed under the said major category. Unless specifically authorized elsewhere in this chapter, no building or zoning lot located in this B-2 general business district shall be developed for any use other than a use permitted hereinafter, and no buildings or structures shall be erected, altered, enlarged or occupied, except for a use permitted hereinafter. The following uses are permitted in the B-2 general business district: A. Retail Uses: (1) Antique shops. (2) Appliance shops. (3) Retail art galleries. (4) Bookstores. (5) Candy and ice cream stores. (6) China and glassware stores. (7) Craft and hobby shops. (8) Drugstores. (9) Florist shops. (10) Food stores, including groceries, meat markets, bakeries and delicatessens. (11) Furrier shops. (12) Furniture stores. (13) Gift shops. (14) Clothing and apparel stores. (15) Hardware stores. (16) Jewelry stores. (17) Liquor stores, if otherwise permitted by village ordinances. (18) Music stores. (19) Notions shops. 1/6

2 (20) Paint and decorating shops. (21) Pet and pet supply stores. (22) Photography and camera shops. (23) Restaurants, as defined in section of this chapter. (24) Stationery and card shops. (25) Shoe stores. (26) Toy stores. (27) Video sales and rental stores. (28) Department stores. (29) Variety stores. (30) Auto and home supply stores, but not including service bays. (31) Sporting good stores. (32) Luggage and leather goods stores. (33) Tobacco stores and stands. (34) News dealers and newsstands. B. Service Uses: (1) Security and commodity brokers, dealers, exchanges and services. (2) Insurance carriers, agents, brokers, and services. (3) Real estate offices. (4) Holding and other investment offices. (5) Veterinary services for animal specialties. (6) Grooming services for pets. (7) Laundry, cleaning, and garment services, but not including dry cleaning plants or industrial launderers. (8) Photographic and portrait studios. (9) Beauty shops. (10) Barbershops. (11) Shoe repair shops and shoeshine parlors. (12) Tax preparation services. (13) Advertising services. (14) Mailing, reproduction, commercial art and photography, and stenographic services. (15) Offices for services to dwellings and other buildings, but not including any outside storage of construction materials, vehicles or equipment. 2/6

3 (16) Employment agencies. (17) Temporary help services. (18) Computer programming, data processing and other computer related services. (19) Electrical repair shops, but not including refrigeration and air conditioning service and repair shops. (20) Watch, clock, and jewelry repair. (21) Reupholstery and furniture repair. (22) Offices and clinics for doctors of medicine, dentists, osteopaths, chiropractors, optometrists, podiatrists and other health practitioners. (23) Kidney dialysis centers. (24) Legal services. (25) Engineering, architectural, and surveying services. (26) Accounting, auditing, and bookkeeping services. (27) Management and public relations services. (28) Miscellaneous business and professional office uses not listed herein. (29) Offices of local and suburban transit and interurban highway passenger transportation companies, but not including terminals, stations, vehicle yards or garages. (30) Travel agencies. (31) Tour operators. (32) Airline, bus and railroad ticket offices, but not including bus parking. (33) Offices of communications and utility companies. C. Miscellaneous Uses: (1) Apartment units (provided they are located above the first floor; are not on the same floor level as a nonresidential use, unless fire separation required by the village building and fire protection codes is provided; and have at least 1,500 square feet of zoning lot area for each unit). (2) Accessory uses, incidental to, and on the same zoning lot as, the principal use. (3) Public and governmental land and buildings. (Ord ) : SPECIAL USES: Special uses, as hereinafter listed, may be allowed subject to the issuance of special use permits in accordance with the provisions of this chapter. Unless otherwise specifically set forth, wherever a special use is named as a major category, it shall be deemed to include only those itemized uses specifically listed under the said major category. The following special uses may be allowed in the B-2 general business district in the event the village authorizes a special use permit, after appropriate hearing by the zoning board of appeals/plan commission and authorization by the village board pursuant to the provisions of article 15 of this chapter: 3/6

4 A. Retail Uses: (1) Carryout restaurants, as defined in section of this chapter. (2) Gasoline filling stations. (3) Nursery, lawn and garden sales establishments. B. Service Uses: (1) Auto, boat, motorcycle and RV repair and service establishments. (2) Auto wash stations. (3) Financial institutions. (4) Hotels/motels. (5) Automatic teller machines, when not attached to the principal structure on the lot. (6) Miscellaneous personal services, but not including coin operated service machine operation, comfort station operation, dating services, escort services, locker rental, massage parlors, restroom operation, steam baths, tattoo parlors, Turkish baths, or wedding chapels. (7) Medical and miscellaneous equipment rental and leasing. (8) Passenger car rental and leasing. (9) Automobile parking, but not parking of towed vehicles. (10) Motion picture theaters, except drive-in establishments. (11) Dance studios, schools, and halls. (12) Physical fitness facilities. (13) Medical and dental laboratories, when not accessory to a medical or dental office or clinic. (14) Meeting places for business associations. (15) Meeting places for professional membership organizations. (16) Meeting places for labor organizations. (17) Meeting places for civic, social and fraternal associations. (18) Meeting places for political organizations. (19) Local and suburban passenger transportation terminals and stations, but not including vehicle yards or garages. C. Miscellaneous Uses: (1) Planned unit developments. (2) Drive-through or drive-in facilities accessory to any permitted or special use in the B-2 general business district. (Ord ) 4/6

5 : PROHIBITED USES: All uses not listed as permitted or special uses in the B-2 general business district shall be prohibited in the B-2 general business district, including, but not limited to, the following prohibited uses: A. Amusement parks. B. Auction house. C. Automobile/truck towing and storage services. D. Game rooms. E. Livery, taxi and/or bus service agencies. F. Membership sport or recreation clubs. G. Nursery or daycare facilities. H. Plumbing, heating, sheet metal, roofing, siding, electrical, air conditioning and general contractors. I. Stone, masonry or other stonework contractors or establishments. J. Truck, automobile, power equipment rental or leasing agencies. K. Warehousing. L. Welding and fabricating shops. (Ord ) : AREA AND SITE RESTRICTIONS: A. Lot Coverage/Intensity Of Use Of Lot: The structures erected on a zoning lot subject to this article shall not occupy more than eighty percent (80%) of the zoning lot area. 5/6

6 B. Yard Requirements: (1) No front yard shall be required, but no accessory structure shall be nearer to the street line than any principal structure. (2) An accessory structure on a through zoning lot shall comply with the front yard requirements for the streets to the front and rear of the principal structure. (3) No side yards shall be required, except that if any side yard is provided for any structure, it shall not be less than five feet (5') in width. (4) No rear yard shall be required. C. Height Restrictions: No structure shall exceed forty feet (40') in height. (Ord ) : PARKING REQUIREMENTS: Off street parking shall be provided in accordance with section of this chapter. (Ord ) 6/6
