1 December 18, 2012 Honorable Marilyn Edwards County Judge, Washington County 2615 Brink Drive Fayetteville, AR RE: Municipal Separate Storm Sewer System (MS4) Inspection AFIN: , NPDES Permit No.: ARR Dear Judge Edwards: On November 7 and 8, 2012, members from ADEQ s Water Division Permits Branch and Inspection Branch performed a Municipal Separate Storm Sewer System (MS4) Audit on Washington County. This Audit was performed in accordance with the provisions of the Federal Clean Water Act, the Arkansas Water and Air Pollution Control Act, and the regulations promulgated thereunder. Overall, the County appeared to have implemented an effective program to identify and eliminate discharges to the MS4. Robyn Reed, Environmental Affairs & Recycling Director, had an excellent general awareness of the stormwater program. This inspection revealed the following: Section Illicit Discharge Detection and Elimination The Department noted areas for improvement with regard to the County s illicit discharge detection and elimination program. This includes: 1. A map of the stormwater conveyance system has not yet been completed as required by Section of the general permit. 2. The County does address illicit discharges when discovered; however, the County has not implemented a systematic approach for detecting illicit discharges at all outfalls during dry weather screenings. During the inspection, Mrs. Reed stated that the Road Department looks for illicit discharges when conducting maintenance activities in the area; however, the County has not implemented a systematic approach for detecting illicit discharges at all outfalls during dry weather screenings.

2 Page 2 Although the Washington County Road Department is not included in the Washington County MS4 jurisdiction, an operation and maintenance program that includes a training component with the ultimate goal of preventing or reducing pollutant runoff from municipal operations should be developed and implemented. Best Management Practices had not been implemented to prevent the discharge of sediment and other pollutants from various areas of the Washington County Road Department equipment yard. The following items were noted: 1. Small hydrocarbon spills were observed on the ground. All hydrocarbon spills must be cleaned up immediately. 2. Best Management Practices had not been implemented to prevent the discharge of sediment and other pollutants from various areas. 3. Floatable and blowable litter was observed on the grounds. 4. A written procedure for opening the valve in the containment structure with used oil, etc. should be developed and implemented. 5. Concrete was not disposed of in a designated concrete washout area. 6. The waste bins were not covered at the time of the inspection. The above items require your immediate attention. Please submit a written response to these findings to the Water Division Inspection Branch of this Department. This response should be mailed to the address at the bottom of the first page of the letter or ed to Water-Inspectionreport@adeq.state.ar.us. This response should contain documentation describing the course of action taken to correct each item noted. This audit was conducted in November of 2012 at which time Robyn Reed was the director of the Washington County Environmental Affairs and Recycling Department. A letter was sent in January requesting that Washington County follow up on some areas that needed improvement. As of the beginning of January, I, Sophia Stephenson, became the Director of the Environmental Affairs Department. I was not involved with the stormwater program before becoming Director. I am attempting to address each issue to the best of my ability and knowledge. Illicit Discharge Detection and Elimination ADEQ noted areas of the County s illicit discharge detection and elimination program that need improvement mapping outfalls and detection of illicit discharges. The MS4 areas under the jurisdiction of Washington County have changed with the most recent census data. The stormwater conveyance system and outfalls have not yet been mapped. I am working on gathering information about these new MS4 areas in order to begin mapping the conveyance system. Once the system has been mapped, we will develop a schedule for monitoring outfalls during dry weather screenings. I anticipate a completion date for mapping outfalls and developing a plan to be May 30, I would like to be in communication with ADEQ about this timeframe and modify as necessary. The hydrocarbon spills have been cleaned up. Katie Teague, University of Arkansas Extension Agent, conducts training with the road department employees each December. She addressed the importance of cleaning spills at the most recent training. 2. A silt fence has been erected to control the runoff of any sediment. This area has also been seeded. Silt fence will remain in place until vegetation cover has been established. 3. Litter was picked up from the yard and more trash cans were placed outside. The Road Department cleaned and organized the entire yard area. The waste bins noted that were not covered are two large containers, one for the collection of scrap metal the other for bagged trash or bulky items. The dumpster that collects bagged trash and bulky items has a solid bottom to collect any water. This 40 yard dumpster is taken to Boston Mountain Solid Waste District transfer station. The transfer station has a leachate collection system in place. No water that touches trash from this 40 yard dumpster is released onto the ground. The metal trailer that we currently have does not hold water. I have contacted the company who services our metal trailer, RIMCO. The next time the metal trailer is full (one to two months), it will be replaced with a roll off container which will hold liquids. RIMCO collects all liquids from roll off containers and processes it. In the future no water that touches the scrap metal will touch the ground. The road department does not currently have a SWPPP. I will work with Shawn Shrum to develop a plan for the road department equipment yard. 19 Washington County Road Department Policy for Handling and Disposing of Containment Area Rain Water Washington County has established certain guidelines for handling rainwater that collects in the containment areas for our holding tanks. The containment areas have locks placed on the drain and only certain personnel have access to keys for the locks. Those personnel have been trained on this policy. The majority of the excess water will evaporate off. During times of heavy rain and when evaporation is not enough, rainwater will be removed by an approved company and properly disposed of. The response indicated it will take approximately 3 months to complete a storm sewer system map. This is an acceptable time line for the Department. To facilitate tracking your progress toward resolving this issue, please submit to the Department a final report depicting a complete stormwater system map as required by Part 3, Section of the general permit. In addition, the response must, also, include a systematic approach for detecting illicit discharges at all outfalls during dry weather screenings. Road Department Equipment Yard and Surrounding Buildings Six issues were found in the Road Department s equipment yard. All issues have been addressed and remediated as stated in the February letter from Washington County. Certification for No Exposure Exclusion has been filled out and should be received by ADEQ by June 5 th. The No Exposure Exclusion pertains to the Household Hazardous Waste Drop-off Facility. The road department does not currently have a SWPPP. Shawn Shrum, Assistant Road Superintendent, and I will work together to develop a plan for the road department equipment yard. Notification in Personnel Change A letter was sent to ADEQ in April notifying the department that Sophia Stephenson is now the Director of the Environmental Affairs Department and the contact for the MS4 stormwater program. As a result of this change, we have until July 31, 2014 to complete mapping the storm sewer system. I am in the process of negotiating with an engineering firm to map the storm sewer system for the County s MS4 area. I plan on having a timeline for the completion of this work soon.
