6 ACE Mandatory Dates CBP has established three important dates that guide the trade community s transition into ACE. Mandatory Date Explanation Electronic imp/exp manifests, for all modes of transport, must be filed in ACE Import Manifest: Impact is for Air Export Manifest: Cannot mandate filing in ACE until regulations are published Current processes for export manifest will continue to be supported, but as of 5/1/15, all ELECTRONIC manifests must be filed in ACE All electronic entries and entry summaries must be filed in ACE Includes Partner Government Agency (PGA) requirements at time of entry or entry summary Paper filings allowed today, e.g., non-abi, will continue to be supported All remaining electronic portions of cargo process must be done in ACE Protest, Liquidation, etc.

18 Line Level Party Reporting Sold to party Name and address of last known entity to whom goods are sold or agreed to be sold reported as an IRS, SS# or CBP assigned format! If goods are to be imported otherwise than in pursuance of a purchase, the name and address of the owner of the goods must be provided! Mandatory for entry types 01 and 03.! For type 03, AD/CVD entry types, the first unaffiliated purchaser to whom merchandise under investigation or administrative review by the Department of Commerce is sold, or agreed to be sold, for exportation to the US. 18

19 Line Level Party Reporting The US party or other entity (individual or firm) identified as the first delivered-to party scheduled to physically receive the merchandise after its release from CBP custody! Reported as an IRS, SS#, or CBP assigned format.! Reporting is optional Delivered to Party 19

20 Line Level Party Reporting The party or other entity (individual or firm) identified as the last named foreign party identified on the transaction invoice / purchase order that has a substantial financial interest in the goods and who causes the goods to be shipped by any mode of transport.! This is not the transportation shipping party (freight forwarder, consolidator, or NVOCC)! For consigned shipments, household effects, lease transaction and similar contractual arrangements, the name of the supplier may be provided! The supplier could be a trading company, selling agent, owner (e.g. personal effects), or similar party! Mandatory for 03 entry types Foreign Exporter Party 20

22 What s Different? Census Warnings ACE sends census warning message back to filer indicating type of census parameter violated 1. Review and correct the entry summary input data and resubmit the entry summary transaction to ACE 2. Provide the appropriate override code and submit the census warning override transaction to ACE 3. The override codes allow the filer to electronically resolve the Census warning independently of CBP 4. Eliminates paper Census Override form submission to CBP 22

Document imaging system (DIS) DIS allows trade partners to submit document images and associated descriptive meta data to CBP and PGAs in an automated manner using EDI communication (Unsolicited Messages) 26

28 CBP vs. Trade Control! Entry Summary Control status is an essential component of the ACE Entry Summary process ACE accepts the ABI transmission, Entry summary is in Trade control status Trade users may make revisions to the ACE entry summary while the entry summary is in Trade control via the Add or Replace function Once preliminary daily statement is generated, the entry summary control status is updated to CBP control and CBP starts to track Entry Summary version numbers! Trade Control Status: Before entry appears on preliminary statement After manual rejection by CBP (UC4)! Customs Control Status: After Entry appears on a preliminary statement After an action identifier has been issued! Filer can always query the entry summary via ACE and the query results will tell you the current status. 28

29 Entry Summary Versions Entry summary does not have a version until entry is in CBP Control (appearing on a statement). ACE adds a version number to the transaction to identify the initial data submission and all subsequent modifications made to the record by the trade community and CBP! Version number assigned to an ACE entry summary Changes made to the ACE Entry Summary by the trade community are reflected in the number to the left of the decimal point (e.g., v. 1.00, 2.00, 3.00) in the record Changes made to the ACE Entry Summary by CBP are reflected in the number to the right of the decimal point (e.g., v. 1.01, 1.02, 1.03) in the record! Version number can be determined: 1. Submit an ABI ACE Entry Summary Query 2. ACE Portal Entry Summary reports - Modify and include the version number data object to the ACE ESM 7008 Entry Summary Line Detail or the ESM-7068 Entry Summary Report 29

31 Post Summary Correction (PSC) Overview! May be submitted for ACE entry summaries, types 01 and 03 only! Provides the ability for the trade to submit corrections to ACE entry summaries electronically! Replaces the existing post entry amendment (PEA) for ACE entry summaries! Uniform process for submission of corrections! Nationwide visibility of corrections by CBP! No limit to the number of PSCs that may be filed within the permitted time period as long as all filing conditions are met! The PSC filer may or may not be the same filer as the original entry filer PSC User Guide: 31

32 Post Summary Correction Overview! Fully replaces the existing ACE entry summary as a new version! Processed through all existing validations, including census warnings! May be subject to CBP team review Not all PSCs will be reviewed for agreement, but those which impact revenue will be reviewed May request documents in order to determine validity of amendment 32

33 Post Summary Correction Restrictions Importers who file their own PEAs will not have capability to file ACE PSC unless they have ABI software! Elimination of Quarterly PEA! Not permitted on an entry summary under CBP review! Not permitted on informal (type 11) entries! If flagged for reconciliation, the entry cannot have been reconciled on a type 09 entry! FTA claims may not be made via PSC if the FTA is subject to filing a 1520 (d) claim. See CSMS # and Guidance: Post-importation Claims for Preferential Tariff Treatment (Aug 11, 2014) 33

34 Post Summary Correction Basic Rules PSC must be transmitted within 270 days of date of entry! The entry must have a scheduled liquidation date that is more than 20 days in the future If the entry summary is within 20 days of liquidation, the filer must wait until liquidation and file a protest if appropriate and allowed (Tip - see CSMS # and Guidance: Post-importation Claims for Preferential Tariff Treatment (Aug 11, 2014)! A filer may not submit a PSC for an entry paid on a periodic monthly statement until CBP has received payment for that statement May be up to 45 days following the entry date 34

35 Post Summary Corrections Reason Codes and Document Requests! Filers are required to transmit one or more reason codes for the change At the header and/or line level and a description of the change Up to five reason codes at the header and/or line level may be identified on a single PSC Additional changes may be detailed in the description field also! Additional documentation on a PSC review The PSC transmission may result in an immediate ABI-generated request for electronic invoice or document package to be submitted to CBP, filer will receive an Action ID number Within 30 days, CBP personnel are supposed to issue a request for documents via ACE status notification message, but experience indicates they usually use or phone If over 30 days, CBP must request the documentation via a CBPF 28 35

36 Post Summary Corrections Refunds and Payments! Accelerated liquidation request When the PSC results in a change in duties, taxes, or fees, the filer has the option of requesting CBP to use the two-week liquidation cycle CBP will prioritize the PSCs flagged for accelerated liquidation Not allowed on AD/CVD entry summaries! PSCs with no accelerated liquidation If the importer does not want an immediate bill or refund, ACE will accept the requested changes and the version number of the entry summary will change Except for PSCs under CBP review, CBP will process the refund or bill at the end of the 314 day cycle! Revenue adjustments will liquidate with refund or bill issued to IOR! Filers may present a check for PSCs resulting in a duty increase at the time the change is made! CBP is currently not able to accept supplemental duty payments via ACH 36

37 Post Summary Corrections Refunds and Payments! Requests for refunds less than $20 CBP generally does not process refunds or bills under $20 The importer may request a refund for less than $20 via PSC functionality using the accelerated liquidation request indicator When the PSC is received, CBP will perform a review, if required, and CBP will liquidate the entry using the two-week liquidation cycle! If CBP disagrees with the PSC change, the CBP user shall reject the PSC back to the filer A PSC which has been rejected back to the filer may only be retransmitted as a PSC A rejected PSC must be retransmitted to CBP within two business days If the filer does not retransmit the entry summary within two business days, CBP will change the entry summary to the previously accepted version and liquidate the entry in the two-week cycle 37

43 ACE Cargo Release What s Different?! Commercial entity reporting Buyer Seller Manufacturer not MID, transmit name and address! Time frame transmission prior to departure is the goal! Bill Status Messages Match, Departed, Arrival, Split! Paperless environment NO 3461 Challenge in dealing with non automated partners! Document Imaging System used to support the paperless environment Currently supported through an transmission of requested documents 43

44 ACE Cargo Split Shipments! Split Shipment Cargo tendered to the carrier as a single shipment, under a single bill of lading for carriage on a single conveyance, and subsequently split by the carrier for transport on multiple conveyances! No need to FAX/ CBP to post each part of the split. The current manual process is very labor intensive for Trade and CBP. Significant change and improvement to the process! Split Indicator decision time: 1. Hold All Release Entry when all cargo qualifies for release (all parts arrive) Filer will not see a release until all parts have arrived. Release for each part will post automatically Cargo Release Notification will show SPIT SHIPMENT RELEASE PENDING until all parts arrive 2. Immediate Delivery Procedures Request Special Permit to release cargo incrementally Release for each part that has arrived will post automatically 10 days for all parts to arrive. More than 10 days from release date or arrival (whatever is latest), must do a new entry for the balance. 44

48 Border Interagency Executive Council (BIEC)! Streamlining the Export/Import Process for America s Businesses! Executive Order has two main requirements: 1. Completion and government-wide utilization of the International Trade Data System (ITDS) by December 31, 2016 and 2. Upon full implementation, ITDS, through the Automated Commercial Environment (ACE), will allow businesses to submit the data required by U.S. Customs and Border Protection and its Partner Government Agencies (PGAs) to import or export cargo through a "single window" concept 48

49 PGA Integration! CBP is prioritizing onboarding of those PGAs with release decision authority to ensure they are integrated with Cargo Release by the time it becomes mandatory! 52 Frozen Importer Records! Importer/principal records may be frozen per 19 CFR A frozen importer/ principal record may be changed only if an authorized individual makes the request. If an importer record is frozen, changes (e.g. name, address, or legal designation) to that account can only be transmitted by the Revenue Division Bond Team (RDBT). CBP Form 5106, signed by an authorized signer, to cbp.bondquestions@dhs.gov.! The purpose of freezing an importer record is to restrict who can make changes to the importer record. In order to freeze an importer record, the following information must be provided to RDBT:! To unfreeze an importer record, submit a withdrawal letter on company letterhead to RDBT at cbp.bondquestions@dhs.gov. Policies and Procedures - CBP Form
