Nos: (307-17; MSR07-17; SR07-17) Pursuant to Government Code Section , you are hereby notified that a Notice of Intent to circulate a petition for the incorporation of Rancho Santa Fe has been submitted to the San Diego Local Agency Formation Commission (LAFCO). The petitioners have authorization to begin gathering petition signatures to initiate the incorporation process on the issuance date of this memorandum. State Law provides the petitioners (Citizens to Protect the Ranch), six months from the date on which the first signature is affixed to the petition to submit the incorporation petition for filing with the Executive Officer. A sufficient petition must be signed by not less than 25 percent of the registered voters residing in the area to be incorporated, or 25 percent of the number of landowners who also own not less than 25 percent of the assessed value of land within the incorporation boundary. If a sufficient number of signatures are affixed to the petition and certified by the Executive Officer, then a comprehensive analysis will be conducted covering fiscal and service issues. After the requisite analysis is completed, a public hearing will be scheduled to determine whether the question of incorporation should be placed on the ballot. 2 PETITION FOR PROCEEDINGS PURSUANT TO THE CORTESE-KNOX- HERTZBERG LOCAL GOVERNMENT REORGANIZATION ACT OF 2000 PART I: NOTICE OF INTENT TO CIRCULATE PETITION Notice is hereby given to circulate a petition proposing to establish an incorporated Town of Rancho Santa Fe ("RSF"). The reason is to shift governance from the County to a new Town Council so that residents will have the local control necessary to improve municipal services and protect the community's unique rural environment. A non-profit 501(C)4 civic organization has been formed, called the Citizens to Protect the Ranch (CPR), for the purpose of educating the electorate, circulating a petition and placing incorporation on the CPR members believe there are three primary reasons to incorporate RSF: (1) increased public safety through establishment of a Town Police Department and local 91 1 Dispatch Center; (2) improved road maintenance and traffic management decisions as a result of increased funding and Town circulation planning; (3) local control over decisions regarding land use, development and open space preservation in and around the village of RSF. Other benefits include: access to grants for public works improvements, increased regional influence through SANDAG representation, capturing tax revenues for local prioritization, making government administration more accessible to the people, and enhancing property values. Rancho Santa Fe was created as a planned, un-gated dequestrian community in the 1920s. In 1928, residents formed the Rancho Santa Fe Association (RSFA) and collectively agreed to the "Protective Covenant" that governs all development and architectural decisions within its boundaries today. Over time, the RSFA became a quasi-town government, with its own planning department, recreational facilities, and private security force. In the last 25 years, the surrounding open spaces have filled in with higher density, gated developments. With no by-pass roads to re-route comuters around the village, traffic has become an increasing headache. The community also lacks needed neighborhood parks, tot lots and playing fields. In , the RSFA Board commissioned a series of four studies (available at on diffmnt facets of incorporation at a total cost of $85,000.The studies concluded that a Town of RSF would yield many benefits, but under LAFCO guidelines its boundaries would inevitably extend beyond the Covenant. The RSFA Board therefore decided in April, 2006 to curtail additional spending and leave it up to its members to form a citizens group and pursue incorporation. CPR was formed in this aftermath by people who had conducted the RSFA studies. CPR's proposed Town boundary includes the Covenant and eight surrounding neighborhoods that have similar densities, utilize the RSF village center and support its community organizations. The Town would have about 6500 residents and 4400 registered voters. The CPR services plan for RSF establishes a local Police Department but leaves fire, water, sewers, emergency medical, public transportation and schools being provided by independent districts. An Initial Fiscal Analysis prepared by outside consultants shows that, if voters concurrently approve a Utility Users Tax of 5.5% to fund the new Police Department, the Town can operate with a balanced budget while

3 improving public safety, increasing road maintenance expenditures and gaining local control of municipal services, tax revenues and land use decisions. Richard H. Ott, Executive Officer Disclosure Provisions Effective in 2007: PART 11: DISCLOSURE REQUIREMENTS Expenditures for political purposes related to a change of organization or reorganization proposal which has been submitted to the Commission in 2007, and contributions in support of, or in opposition to such measures, shall be disclosed and reported to the same extent subject to the same requirements as provided for local initiative measures to be presented to the electorate (Government Code Section ). This Notice is being submitted on November 28,2007. Disclosure Provisions Effective in 2008: Pursuant to Government Code Section , any person or combination of persons who, for political purposes, directly or indirectly contributes $1000 or more, or expend $1000 or more in support of, or in opposition to a proposal for a change of organization or reorganization that will be submitted to the Commission, shall disclose and report to the Commission to the same extent and subject to the same requirements of the Political Reform Act (Title 9 [commencing with Section ) as provided for local initiative measures. If the proposal is approved by LAFCO and submitted to the voters, any person or combination of persons who directly or indirectly contributes $1 000 or more, or expends $1 000 or in support of, or in opposition to, a change of organization or reorganizations, must comply with the disclosure requirements of the Political Reform Act of 1974, (Government Code section et seq. Applicable reports must be submitted to the Secretary of State and the appropriate city or county clerk. Copies of the reports should also be filed with the Executive Officer of San Diego LAFCO.

4 PART 111: PETITION FOR CHANGE OF ORGANIZATION OR REORGANIZATION This proposal is made pursuant to Part 3, Division 3, Title 5 of the California Government Code, Section et seq. of the Cortese-Knox-Hertzberg Local Government Reorganization Act of a) Proposed Jurisdictional Changes: The specific changes of organization proposed are: Incorporation of the Town of Rancho Santa Fe ("Town") and detachment from County Service Area No. 83 (San Dieguito Local Parks). It is proposed that the town remain within County Service Area No. 17 (San Dieguito Paramedic Service.) b) Proposed Incorporation Boundaries: The incorporation boundaries are shown in the attached map and described in a separate legal description that is by reference incorporated herein. The Town will include the following areas: Rancho Santa Fe Covenant, South Pointe Farms, Stonebridge, Horseman's Valley, Rancho Serena, San Dieguito Regional Park, Sun Valley, Hacienda Santa Fe, Rancho del Rio, and the Summit at RSF. The Town boundaries will be delineated approximately as follows: Northwest: City of Encinitas. Northeust: South Pointe Farms and RSF Covenant boundary, following sections of El Camino del Norte, and then slanting southeast to intersect the northern boundary of The Summit. East: Eastern boundary of The Summit, then following Del Dios Highway to the east boundary of Rancho del Rio, following that south to the San Dieguito River. Southeast= Follows the San Dieguito River southwestward, then jogs west at El Apajo extension to Via de la Valle, following generally that highway to the northern boundary of the City of San Diego. South: San Diego, following that boundary westward until it meets the City of Solana Beach. West= Solana Beach northward to the City of Encinitas. c) Terms and Conditions: The proposed action will be subject to voter approval of a Utility Users Tax of 5.5% on monthly utility bills (e.g., electric, gas, water, telephone) of residential and commercial customers. d) Reasons for incorporation: The main reasons for pursuing local control can be summarized as follows: 1) To preserve our community's rural character by giving residents greater control over planning, land use and traffic management decisions. 2) To improve overall police protection, law enforcement response times, and traffic regulation and enforcement by establishing a Town Police Department. 3) To improve the condition of roads by setting priorities locally, reducing overhead and making additional maintenance W i g available to the community. 4) To gain access to public funding for village improvements, parks, utility undergrounding and open space purchases. 5) To gain greater regional influence through municipal government status and a seat on the San Diego Association of Governments (SANDAG). 6) To capture for local use and control revenues generated by Rancho Santa Fe that are now distributed County-wide. 7) To make government more accessible and responsive by shifting responsibility from San Diego County to a Town Council made up of local residents elected by their neighborn. 8) To preserve and enhance property values by safeguarding our community's historic heritage and distinctive character. e) Proceedings: It is requested that proceedings for this proposal be taken in accordance with Section et seq. of the Government Code. 4 Sphere of Influence: This proposed change of organization includes a new sphere of influence that is coterminous with the Town of Rancho Santa Fe and is consistent with the spheres of influence of all affected agencies, except for County Service Area No. 83. The Local Agency Formation Commission is responsible for making all necessary sphere determinations. g) Territory: The territory included in the proposal is inhabited. h) Town Name and Organization: The proposed name of the new town is: Town of Rancho Santa Fe. It is to be a General Law city with a five person Town Council elected at large, a Mayor elected h m the T~wn Council by its members, and an appointed Town Manager, Town Clerk and Town Treasurer. i) Petition Signers: Signers of this petition have signed as registered voters.
